This letter is in response to correspondence dated February 19, 2020 from Doug Dorman of Atlantic
Environmental Consultants, LLC, in which it was requested that Major Permit #17-20 be modified to
eliminate the bend in the bulkhead, and move one groin to the north property line.
To clarify, the removal of the bend in the bulkhead would straighten the bulkhead
alignment and move the southern wall east/landward of the original alignment.
The proposed new location of the northern -most groin requires a signed waiver from the
riparian property owner of Parcel 014438000 at 0 CC Gray Road in Avon. Dare County tax
records note the current tax owners as The Heirs of Farrow L. Scarborough. The riparian
waiver form submitted was signed by Luther Hooper. Before the new location of the groin
can be approved, the Division requires documentation that verifies Mr. Hooper is a
Scarborough heir.
Coastal Management Representative Yvonne Carver has received email correspondence, as well as
a phone call, confirming that it would be in your best Interest to move forward with the refinement
for the bulkhead alignment so that your bulkhead contractor can start construction the first of
March. Mr. Dorman further stated that he will look further into the matter of the deed/records to
confirm Mr. Hooper is an heir and has the authority to sign the riparian waiver for the groin
project.
To confirm, Major Permit #17-20 was issued to Charles and Allyson Mitchell on February 5, 2020 for
development at 40175 CC Gray Road and the contiguous lot in Avon, Dare County. The
development authorized by this permit included shoreline stabilization (bulkhead

Your modification request as described and/or depicted in your submittal dated February 19, 2020,
along with drawings 2 of 4 and 3 of 4 revised 2/13/20, is hereby authorized —for the modification
to the bulkhead alignment only— as a refinement to CAMA Major permit #17-20. All existing
conditions remain in effect, including the expiration date of December 31, 2023. This letter is
provided to you as a record of the authorization, and should be included with the Permit file.
Please note that you may need to obtain a building permit from Dare County.
