Permit Class NEW STATE OF NORTH'CAROLINA Department of Environmental Quality and Coastal Resources Commission Permit for X Major Development in an Area of Environmental Concern pursuant to NCGS I I3A-118 X Excavation and/or filling pursuant to NCGS 113-229 Permit Number 97-20 Issued to John Michals & Hannah Greenlick-Nhchals, 1600 South Eads St., Apt. 1135W, Arlington, VA 22202 Authorizing development in Currituck County at man-made canal leading to Knotts Island Bay, at 2147 Drake Rd., in Corolla , as requested in the permittee's application dated 8/11/19 (MP-1) and 4/8/20 (MP-2,4), incl att workplan drawings (3), Survey dtd "Rec DCM-EC 3/19/20" and Cl & C2 of 2 dtd "Rec DCM-EC 5/14/20". This permit, issued on September 30, 2020 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation )t tnese terms may be subject to tines, imprisonment or civil action; or may cause the permit to oe null ana void. Excavation 1) No excavation shall take place outside of the area indicated on the workplan drawings. 2) Excavation shall not exceed -4.5 feet below the normal water level. In no case shall the depth of excavation exceed the depth of connecting waters. 3) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 4) No excavated or fill material shall be placed at any time in any vegetated wetlands/marsh or surrounding waters outside of the alignment of the fill area indicated on the workplan drawings. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee John Michals & Hannah Greenlick-Michals Permit No. 97-20 r Page 2 of 4 ADDITIONAL CONDITIONS 5) All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the National Response Center at (800) 424-8802 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. Spoil Disposal 6) No spoil material shall be placed within 10 feet of the Currituck County side lot setbacks. 7) Spoil from the authorized dredge footprint shall be dewatered before use as backfill. All remaining backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 8) No spoil material shall be placed within 30 feet of the normal water line, except that which will be used to backfill the area behind the permitted bulkhead, once properly dried. 9) All excavated materials shall be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 10) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. Maintenance Clause 11) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any maintenance excavation work authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for spoil disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the spoil disposal site shall be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. D. The date of map revision and the permittee's signature shown anew on the original plan. Shoreline Stabilization - Bulkhead 12) . The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 13) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. John Michals & Hannah Greenlick-Michals Permit No. 97-20 Page 3 of 4 14) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. 15) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 16) The bulkhead shall be constructed prior to any backfilling activities. 17) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 18) This permit does not authorize any excavation waterward of the approved alignment. 19) The fill material shall be clean and free of any pollutants except in trace quantities. 20) Unless altered herein, all backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 21) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead. Docking Facility 22) This permit authorizes only the docks, piers, tie pilings, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 23) . No portion of the authorized docking facility shall extend more than one quarter of the width of the water body. Measurements to determine width of the water body shall be made from the normal water line or the waterward edge of any coastal wetland vegetation which borders the water body, whichever is more restrictive. 24) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 25) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. .John Michals & Hannah Greenlick-Michals Permit No. 97-20 Page 4 of 4 ADDITIONAL CONDITIONS 26) This permit authorizes a maximum of 2 formalized boat slips. 27) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 28) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. USACE Conditions 29) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at htto://www.fws.gov/nc-es/mammal/manatee euidelines.odf. General 30) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 31) All debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and removed to an appropriate upland location 32) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2020-00951). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2019-0711. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. I have been in contact with them as recently as 8/11/20. The DCM permit application is used as the application for both the federal review (USACE) and the DWR certification process. These agencies are separate authorizations and have their own review process and requirements. Coastal Resources Commission rules require the proposal meets all local, state and federal rules or laws, of which the CAMA process is used to satisfy this. Therefore, without their approval I cannot move forward with a final CAMA decision. Until a final decision is made you are not authorized to perform any development activities requested in the major permit application currently under review. With almost all agencies working from home due to the global pandemic the normal workflow has been interrupted and things are less efficient. With 15 agencies reviewing a CAMA permit application the process has been slower across the board for all, with all projects being extended. With that being said, once all comments are in I am confident that a final decision will be made shortly thereafter. Subparagraph (1) (B) States, "All dredged material shall be confined landward of regularly and irregularly flooded coastal wetlands and stabilized to prevent entry of sediments into the adjacent . water bodies or coastal wetlands;" Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (1) (C) States, "Dredged material from maintenance of channels and canals through irregularly flooded wetlands shall be placed on non -wetland areas, remnant spoil piles, or disposed of by a method having no significant, long-term wetland impacts. Under no circumstances shall dredged material be placed on regularly flooded wetlands. New dredged material disposal areas shall not be located in the buffer area as outlined in 1 SA NCAC 07H .0209(d)(10);". Subparagraph (1) (D) States, "Widths of excavated canals and channels shall be the minimum required to meet the applicant's needs but not impair water circulation;" Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (1) (H) States, "Maintenance excavation in canals, channels and boat basins within primary nursery areas and areas of submerged aquatic vegetation as defined by the MFC shall be avoided. However, when essential to maintain a traditional and established use, maintenance excavation may be approved if the applicant meets all of the following criteria: (i) The applicant demonstrates and documents that a water -dependent need exists for the excavation; Consistent: The proposed development is consistent with the intent of this rule. (ii) There exists a previously permitted channel that was constructed or maintained under permits issued by the State or Federal government. If a natural channel was in use, or if a human -made channel was constructed before permitting was necessary, there shall be evidence that the channel was continuously used for a specific purpose; Consistent: The proposed development is consistent with the intent of this rule. (iii) Excavated material can be removed and placed in a disposal area in accordance with Part (b)(1)(B) of this Rule without impacting adjacent nursery areas and submerged aquatic vegetation as defined by the MFC; Consistent: The proposed development is consistent with the intent of this rule. (iv) The original depth and width of a human -made or natural channel shall not be increased to allow a new or expanded use of the channel" Consistent: The proposed development is consistent with the intent of this rule. The proposed dredge footprint is within the originally platted canal area. Paraeraoh (6) Piers and Dockine Facilities Subparagraph (6) (A) states, "Piers shall not exceed six feet in width. Subparagraph (6) (B) states, "The total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the total. Projects requiring dimensions greater than those stated in this Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Size restrictions shall not apply to marinas;" Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6) (C) states, "Piers and docking facilities over coastal wetlands shall be no wider than six feet and shall be elevated at least three feet above any coastal wetland substrate as measured from the bottom of the decking;" Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6) (F) states "Piers and docking facilities shall be single story. They may be roofed but shall not be designed to allow second story use" Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6) (G) states "Pier and docking facility length shall be limited by: (i) not extending beyond the established pier or docking facility length along the same shoreline for similar use; (This restriction does not apply to piers 100 feet or less in length unless necessary to avoid unreasonable interference with navigation or other uses of the waters by the public); Consistent: The proposed development is consistent with the intent of this rule. (ii) not extending into the channel portion of the water body; Consistent: The proposed development is consistent with the intent of this rule. (iii) not extending more than one-fourth the width of a natural water body, or humanmade canal or basin. Measurements to determine widths of the water body, canals or basins shall be made from the waterward edge of any coastal wetland vegetation that borders the water body. The one- fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier - head line. The one-fourth length limitation shall not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6) (1) states "Piers and docking facilities shall not interfere with the access to any riparian property and shall have a minimum setback of 15 feet between any part of the pier or docking facility and the adjacent property owner's areas of riparian access. The line of division of areas of riparian access shall be established by drawing a line along the channel or deep water in front of the properties, then drawing a line perpendicular to the line of the channel so that it intersects with the shore at the point the upland property line meets the water's edge. The minimum setback provided in the rule may be waived by the written agreement of the adjacent riparian owner(s) or when two adjoining riparian owners are co -applicants. If the adjacent property is sold before construction of the pier or docking facility commences, the applicant shall obtain a written agreement with the new owner waiving the minimum setback and submit it to the permitting agency prior to initiating any development of the pier. Application of this Rule may be aided by reference to the approved diagram in 15A NCAC 07H .1205(t) illustrating the rule as applied to various shoreline configurations. Copies of the diagram may be obtained from the Division of Coastal Management. When shoreline configuration is such that a perpendicular alignment cannot be achieved, the pier shall be aligned to meet the intent of this Rule to the maximum extent practicable as determined by the Director of the Division of Coastal Management." Consistent: The proposed development is consistent with the intent of this rule. Paragraph (7) Bulkheads Subparagraph (7) (A) states, "Bulkhead alignment, for the purpose of shoreline stabilization, shall approximate the location of normal high water or normal water level." Inconsistent: The proposed bulkhead averages 6.5' waterward of NWL with a maximum distance of 25' waterward of NWL. See Subparagraph (7) (D) below. Subparagraph (7) (B) states, "Bulkheads shall be constructed landward of coastal wetlands in order to avoid significant adverse impacts to the resources" Consistent: The proposed bulkhead will result in the filling of 540ft' of an insignificant coastal wetland fringe comprised entirely of Scirpus species; however, this fringe is so sparse that it does not provide habitat for fish or other animals and does not appear to trap nutrients and sediments. Subparagraph (7) (D) states, "Bulkheads shall be permitted below normal high water or normal water level only when the following standards are met: (i) the property to be bulkheaded has an identifiable erosion problem, whether it results from natural causes or adjacent bulkheads, or it has unusual geographic or geologic features, e.g. steep grade bank, which will cause the applicant unreasonable hardship under the other provisions of this Rule; ' Consistent: The proposed development is consistent with the intent of this rule. (ii) the bulkhead alignment extends no further below normal high water or normal water level than necessary to allow recovery of the area eroded in the year prior to the date of application, to align with adjacent bulkheads, or to mitigate the unreasonable hardship resulting from the unusual geographic or geologic features; Consistent: The proposed development is consistent with the intent of this rule. (iii) the bulkhead alignment will not adversely impact public trust rights or the property of adjacent riparian owners; Consistent: The proposed development is consistent with the intent of this rule. (iv) the need for a bulkhead below normal high water or normal water level is documented by the Division of Coastal Management; Consistent: The proposed development is consistent with the intent of this rule. (v) the property to be bulkheaded is in a nonoceanfront area." Consistent: The proposed development is consistent with the intent of this rule. 1 SA NCAC 07H.0209 Use Standards Paragraph (d) (1) states "All development projects, proposals, and designs shall preserve natural barriers to erosion, including peat marshland, resistant clay shorelines, and cypress -gum protective fringe areas adjacent to vulnerable shorelines." Impervious surfaces shall not exceed 30 percent of the AEC area of the lot, unless the applicant can demonstrate, through innovative design, that the protection provided by the design would be equal to or exceed the protection by the 30 percent limitation. Redevelopment of areas exceeding the 30 percent impervious surface limitation shall be permitted if impervious areas are not increased and the applicant designs the project to comply with the rule to the maximum extent feasible." Consistent: The proposed development is consistent with the intent of this rule. Paragraph (d) (3) states "All development projects, proposals, and designs shall comply with the following mandatory standards of the North Carolina Sedimentation Pollution Control Act of 19'73: (A) All development projects, proposals, and designs shall provide for a buffer zone along the margin of the estuarine water that is sufficient to confine visible siltation within 25 percent of the buffer zone nearest the land disturbing development. Consistent: The proposed development is consistent with the intent of this rule. (B) No development project proposal or design shall propose an angle for graded slopes or fill that is greater than an angle that can be retained by vegetative cover or other erosion -control devices or structures. Consistent: The proposed development is consistent with the intent of this rule. (C) All development projects, proposals, and designs that involve uncovering more than one acre of land shall plant a ground cover sufficient to restrain erosion within 30 working days of completion of the grading; unless the project involves clearing land for the purpose of forming a reservoir later to be inundated." Consistent: The proposed development is consistent with the intent of this rule. Paragraph (d) (4) states "Development shall not have a significant adverse impact on estuarine and ocean resources. Significant adverse impacts include development that would directly or indirectly impair water quality increase shoreline erosion, alter coastal wetlands or Submerged Aquatic Vegetation (SAV), deposit spoils waterward of normal water level or normal high water, or cause degradation of shellfish beds." Consistent: The proposed development is consistent with the intent of this rule. Paragraph (d) (8) states "Established common-law and statutory public rights of access to the public trust lands and waters in estuarine areas shall not be eliminated or restricted. Development shall not encroach upon public accessways nor shall it limit the use of the accessways." Consistent: The proposed development is consistent with the intent of this rule. DATE: June 8, 2020 Consistency Determination: The request is consistent with/not in conflict with the Currituck County 2006 Core Land Use Plan (LUP) certified by the CRC on May 18, 2007 as amended through July 2, 2019. Overview: The vacant .33 acre lot has approximately 223 linear feet of shoreline along a manmade canal that connects to Knotts Island Bay. Water depths within the project area range from -.5 feet to -4.5 feet and average -2.6 feet below Normal Water Level (NWL). Approximately 540 sq. ft. of Coastal Wetland fringe is located along 180 linear feet of unimproved shoreline. The site is vegetated with trees and mowed grasses. The property is located primarily outside of a Floodione, however all properties in this area are within the Coastal Barrier Resource System (CBRS) zone where federal expenditures and financial assistance that encourage development, such as federal flood insurance, are restricted. Existing shoreline improvements consist of approximately 12 linear feet of bulkhead connecting to 35 linear feet of return wall. The bulkhead/return wall is an encroachment associated with shoreline improvements on the abutting property to the northwest. The bulkhead/return wall has resulted in severe shoreline erosion on the subject property. Dredging of a 35 foot by 180 foot area of the manmade canal to a connective depth of -4.5 feet below NWL, installation of 180 linear feet of bulkhead, construction of a 4 foot wide by 12 foot long pier with a 4 foot wide by 24 foot long terminus platform, and placement of two (2) tie pilings are proposed. Dredge spoils will be kept on site at least 30 feet from NWL. Once dried, they will be used as backfill for the bulkhead. The bulkhead will continue in a straight alignment and connect to the bulkhead on the adjacent property to the south, averaging 6.5 feet waterward of NWL. The pier and terminus platform will be arranged in an "L" configuration. The two (2) tie pilings will be placed between the bulkhead and terminus platform to designate two (2) wet slips. The waters of the manmade canal connecting to Knotts Island Bay are classified as SC (fish propagation) and Joint Waters, and are closed to shellfish taking. Submerged Aquatic Vegetation (SAV) was not observed growing within the project area. A review of potential historic, geological .or archaeological resources was not provided. _ l . + Anticipated impacts resulting from this project are expected to include: the excavation of .14 acre of Public Trust Area/Estuarine Waters/Coastal Wetlands Areas of Environmental Concern (AEC); the filling of .12 acre of High Ground within the Estuarine Shoreline AEC and 1,170 sq. ft. of Public Trust Area/Estuarine Waters AEC; the disturbance of .12 acre of High Ground within the Estuarine Shoreline AEC, and; the shading of 144 sq. ft. of Public Trust Area/Estuarine Waters AEC. Basis for Determination: The project area is located within the "Carova Sub -Area" and is designated as "Limited Service Areas (Areas Preferred for Low Density Development)" on the Currituck County Future Land Use Map (FLUM); with Areas of Environmental Concern (AECs) designated as "Conservation Areas" as indicated on Page 11-1. As indicated on Page 11-1, the purpose of the Conservation designation is to provide for the long- term management and protection of significant, limited, or irreplaceable areas. Proper management is needed to conserve the natural, cultural, recreational, scenic or biologically productive values of these areas. The designation is applied to areas that should not be developed at all (preserved), or if developed, done so in a very limited manner characterized by careful planning and cautious attention to the conservation of environmental features. Land Use Plan policies address the use of vegetated buffers to reduce pollutants and protect water quality. The project areas contain shoreline along an existing man-made canal. Bulkhead will help protect water quality -by reducing soil erosion and sedimentation. Definitions of key words are provided on page 9-2. These words include "Encourage: to favor or foster", "Should: Ought to, if no valid reason not to", and "Support: to shore up, may imply financial support". The proposed project is located at 2147 Drake Road, Corolla, within Currituck County. The applicant is proposing to dredge a 180' by 35' section of man-made canal to a depth of -4.5' normal water level (NWL); dredged materials will be kept at the project site at least 30' from NWL. Once dredging is completed, the applicant proposes to construct at 180' bulkhead in a straight alignment, connecting to the bulkheads of the adjacent properties. The proposed bulkhead will be an average of 6.5' from NWL, with a maximum distance of 25' from NWL. The bulkhead will be backfilled using the dredged materials. Lastly, the applicant proposes to construct an L-shaped 4' by 12' pier with a 4' by 24' platform with two wet slips. Bulkheads can have tremendous negative effects on coastal wetlands and their ecological functions. Bulkheads are intended to hold the shoreline in place and prevent erosion. However, this function of bulkheads alters the natural movement of sediment (including new sediment) in and out of sites. Furthermore, bulkheads restrict and prevent waterward wetlands from migrating landward in response to sea level rise. In order to adequately assess potential impacts that could result from the proposed project, the DMF requests that a more specific breakdown of the losses to coastal wetlands be provided. DMF also requests additional information regarding the reasoning for the location of the proposed bulkhead structure. Specifically, the reasoning for the location of the tie-in to the adjacent property at the north, rather than having it tie into the return wall (which would minimize impacts to wetlands and waters). MAY 2 8 2020 DCM-MHD CITY RECEIVED John & Hannah Michals Field Investigation Report Page 2 Proiect Settin The site of the proposed development is located at 2147 Drake Road, within the Carova Beach s/d of Corolla, Currituck County, adjacent to a man-made canal leading to Knotts Island Bay which connects to the Currituck Sound. The project location is a vacant lot, 14,374 sf in size, and has approximately 180' of unhardened shoreline. The elevation of the property is approximately +3 feet above NWL. According to the USDA's Natural Resources Conservation Services' Web Soil Survey, the soil on the property is made up of Newhan fine sand. A fringe coastal wetland consisting of Bulrush (Scirpus spp.) was observed growing along the entire shoreline. Other vegetation on the property consisted of trees and grasses that are mowed periodically. The adjacent riparian property to the northwest is a similarly vegetated vacant lot with a bulkheaded shoreline. The bulkhead on this property continues 12' onto the applicant's property before turning 900 to the south for approximately 20' then 450 to the west for approximately 15' completing the return wall. This bulkhead return wall has severely eroded the applicant's shoreline. The adjacent riparian property to the south is another similar vegetated lot with a bulkheaded shoreline, a pier, and platform. The man-made canal, which connects to Knotts Island Bay, is classified as Joint waters by the agreement with the Marine Fisheries Commission and Wildlife Resources Commission. The Division of Environmental Management's water quality classification for this waterbody is SC and it is closed to shellfish taking. Water depths within the project site range from 0.5' to 4.5' below normal water level (NWL) and average -2.6'. The bottom substrate within the project area is made up of muddy sand. Submerged aquatic vegetation, as defined by the Division of Marine Fisheries, was not observed growing within the project area. Development Proposal The applicant proposes to mechanically dredge a 180' x 35' section of a man-made canal to a connecting depth of -4.5'. All of the spoils will be kept on the project site and will be located 30' from NWL. Once the dredging is complete the applicant proposes to construct 180' of wooden bulkhead. In order to connect to the bulkhead located on the adjacent property to the north, the proposed bulkhead must extend a maximum distance of 25' waterward of NWL. The proposed bulkhead will continue in a straight alignment connecting to the bulkhead on the adjacent property to the south over a distance of 180' averaging 6.5' waterward measured from normal water level. The bulkhead will be backfilled using the spoils from the dredging once it has dried. Lastly, centered on the lot, the applicant proposes to construct an L shaped 4' x 12' pier with a 4' x 24' platform extending to the south. On the west side of the platform, between the platform and the bulkhead, the applicant proposes 2 designated wet slips. The wet slips will be designated by placing 2 tie piles in this area. The docking facilities location will not encroach within the 15' setback area and will not violate the Y< waterbody width requirement.
