Authorizing development in New Hanover County at ad to the AIWW and Middle Sound, at
8036 Bald Eagle Lane, in Wilmington , as requested in the permittee's application dated 5/6/20,
including attached workplan drawings(4) dated 5/5/20.
This permit, issued on July 15, 2020 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
,f these terms may be subject to fines, imprisonment or civil action; or may cause the permit to De nun ana voia.
Dockine Facilitv
1) This permit authorizes only the docks, piers, platforms, boatlifts, and other structures and uses
located in or over the water that are expressly and specifically set forth in the permit application. No
other structure, whether floating or stationary, shall become a permanent part of this docking facility
without permit modification. No non -water dependent uses of structures shall be conducted on, in or
over Public Trust waters without permit modification.
2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the
U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum,
permanent reflectors shall be attached to the structure in order to make it more visible during hours of
darkness or inclement weather.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2023
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) Any portion of the permitted access pier and docking facilities built above Coastal Wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as
measured from the bottom of the decking.
4) The authorized structures and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the existing pier. headline.
5) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
7) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
8) This permit authorizes a maximum of 4 formalized boat slips.
9) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's area of riparian access.
10) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and
shall be permeable to air and water. Screen or wire on the sides along with benches are permitted.
Lattice is specifically excluded from being used under this authorization.
11) The roof of the gazebo shall not be designed for second story use.
USACE Conditions
12) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
14) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.

15) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit
197800056 and Programmatic General Permit No. 198000291 (Action ID SAW-2007-01199).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2007-0252V2.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water.
NOTE: An application processing fee of $250 was received by DCM for this project.

Shoreline length= 255 LF x 8 SF/LF = 2000 SF (maximum allowable)
Proposed fixed access pier: (158' x 6') = Not counted for access credit
Proposed floating dock: (36' x 6') = Not counted due to alignment for access credit
Proposed floating finger piers: 2 @ (9' x 5') = 90SF
Proposed fixed platform: (16.5' x 24') — access credit on uncovered portion (8' x6') = 348 SF
Total = 438 SF
The application states that the docking facilities would provide docking space for up to four (4)
vessels at this location in water depths of -4.0' to -5' @ NLW. It appears that the project is
CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6), including the the eight -
square foot rule and the pier width rule. The proposed structure would extend past the /4 width, but
not past the neighboring pier head line or the 1/3 width, and would be between two longer structures
that are within 200 feet from the property. The proposed structure would be located mostly over open
water and would not encroach into either adjacent riparian corridor setback area.

Description of project area and activity: The proposal is to construct a new private 4-slin docking facility. It will consist of a 158
feet by 6 feet access pier, a 24 feet by 16.5 feet fixed T-head platform a 36 feet by 6 feet Boating dock and two (2) 9 feet by 5
feet Boating finger docks This dock will cover 1,207 square feet of open water and 330 square feet of coastal wetlands adjacent
to the AIWW.

This project appears to be consistent with the New Hanover County Comprehensive
Land Use Plan Update
The applicant proposes to construct a private docking facility that would accommodate
four (4) boat slips adjacent to the AIWW in New Hanover County. The property is
located at 8036 Bald Eagle Lane.
Areas of Environmental Concern (AEC's) impacted by the proposal are EW, ES, ORW
and PTA. Waters at the project site are classified as SB and are not open to the
harvesting of shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the New Hanover County
Comprehensive CAMA Land Use Plan and offer the following comments.
The general area of the project is classified as Developed and Conservation.
In general, Wilmington -New Hanover County allows development in Developed and
Conservation classified AECs, which is consistent with the State's minimum use
standards. The New Hanover County Comprehensive Land Use Plan contains some
policies, which exceed the State's minimum use standards. However, none of these
policies appear to be applicable to this project.
Provided all local, state and federal requirements can be met, this project appears to
be consistent with the New Hanover County Comprehensive Land Use Plan.

9. PROJECT DESCRIPTION:
The project site is located at 8036 Bald Eagle Lane, adjacent to the Atlantic Intracoastal
Waterway (AIWW) and Middle Sound, in New Hanover County. To locate the property from
Market Street (NC Highway17), turn right onto Porter's Neck Road and travel east
approximately one mile. At the round -about, continue straight for 1.4 miles, and then turn right
onto Bald Eagle Lane and travel approximately 0.45 miles until you reach the property of
interest on the left.
The project site is approximately 0.55 acres and is vegetated primarily with domestic grasses
and ornamentals. The property is 1 00'feet wide near the water, but the shore line along the
AIWW is approximately 255 LF at Normal High Water due to the meandering nature of the
NHW line on the property (See sheet 2 of 4). The property slopes down from high ground to a
30' wide band of high marsh, which wraps around an irregularly shaped bulkhead that extends
with the high ground to the southeast, in a waterward direction. This area transitions to low
marsh consisting primarily of Salt Marsh Cordgrass (Spartina Alterniflora) that is approximately
40' wide.
There is an existing single-family residence, detached garage, bulkhead, and retaining wall
currently on the property. The existing bulkhead was authorized under CAMA General Permit
#46102D, and the retaining wall along the northern property line was authorized via CAMA
Minor Permit #06-61. The applicant was issued CAMA Major Permit #58-07 on May 31st, 2007
for the construction of a private docking facility to accommodate four slips, but the facility was
not constructed, and the permit expired December 31, 2010 (See Appendix B).
The Wilmington -New Hanover County 2006 Land Use Plan classifies adjacent waters and high
ground portion of the property as Conservation. The waters of the AIWW and Middle Sound
are classified SA-ORW by the Division of Resources. They are NOT designated as a Primary
Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are OPEN to the
harvest of shellfish.
10. PROPOSED PROJECT:
The applicant proposes to construct a new private docking facility to accommodate 4 boat slips
adjacent to the AIWW. According to the application, the proposed docking facility would
consist of a fixed access pier (158' x 6'), originating from the northern side of the property,
extending 30' to the south, towards the center of the property, and then extending 115' in a
southeasterly (waterward) direction. At the end of the fixed pier, the applicant proposes a "t-
head" fixed platform (16.5' x 24'), partially covered with a roof (8.5' x 24'). The applicant
proposes to construct two (2) boatlifts, each measuring 12.5' x 12.5% on the northern and
southern sides of the fixed platform. From the waterward edge of the fixed platform, the
applicant proposes a ramp extending to a floating dock (36' x 6'), oriented perpendicular to the
shoreline. Two floating finger piers (9' x 5') would extend from the landward end of the floating
dock, each oriented parallel to the shoreline, with one extending to the north and one
extending to the south. According to the applicant, the proposed private docking facility would
accommodate 4 boat slips in water depths ranging from -4.0' to -5.0' @ NLW (Se

11. ANTICIPATED IMPACTS:
The proposed docking facility would extend 140 ft. into a waterbody measuring approximately
490 ft. across. This exceeds the''/<width distance (-123') but meets the adjacent pier headline
and would be in between longer structures that are within 200' from the property. The
waterward edge of the proposed features would be constructed 10' landward of the federal
navigation channel setback of the AIWW. The proposed structures would incorporate 30 SF of
high ground, shade 330 SF of coastal wetlands, and incorporate 1207 SF of public trust area
and estuarine waters. As proposed, the facility would not encroach into either adjacent 15 ft.
riparian corridor setback. The proposed docking facility would be located approximately 60 ft.
from the docking facility to the north, and 45 ft. from the docking facility to the south. The
proposed facility would provide dockage for a total of four (4) vessels in water depths ranging
from -4.0' to -5.0' @ NLW. Minor increases in turbidity should be expected during project
construction.

Christopher Bailey, for State approval for development of the subject property located at 8036 Bald Eagle
Lane, adjacent to adjacent to the Banks Channel and Atlantic Intracoastal Water Way, in New Hanover
County. It was received as complete on May 19, 2020 and appears to be adequate for processing at this
time. The projected deadline for making a decision is August 2, 2020. An additional 75-day review period
is provided by law when such time is necessary to complete the review. If you have not been notified of a
final action by the initial deadline stated above, you should consider the review period extended. Under
those circumstances, this letter will serve as your notice of an extended review. However, an additional
letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from May 19, 2020, you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of
your project. Such a meeting will be held within five working days from the receipt of your written
request and shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road
right-of-way where a private road would lead one into your property. Failure to post this notice could
result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in writing

3.1 Section 6. a. Project Narrative
3.1.1 Project Location and Existing Conditions
The project is adjacent to the Intracoastal Waterway and Middle Sound at 8036 Bald Eagle Lane in Porters Neck,
New Hanover County. There is a single-family residence currently located on the property. There is an existing
bulkhead located on the property constructed under LAMA General Permit number 46102. There is a retaining
wall along the northern property boundary that was constructed under CAMA Minor Permit number 06-61
through New Hanover County. There are no piers or docking facilities currently located on the property. CAMA
Major permit number 58-07 was issued on May 31, 2007 that included the construction of a pier and associated
docking facilities, but construction was never implemented. LMG staff flagged Normal High Water and Coastal
Wetlands in March 2020. Normal High Water and Coastal Wetland lines were verified by DCM staff on April 1,
2020. An upland survey was conducted by Johnny Williams surveying on April 1, 2020. A hydrographic survey
of the project area was conducted by ESP Associates P.A. on March 16, 2020. See Appendix B for details. Waters
in the project area are classified as SA ORW and are open to shellfishing. The area is not a primary nursery area.
3.1.2 Proposed Action
The applicant proposes the construction of a private pier that would terminate in a partially covered "T-head"
platform with a floating dock, finger piers, and boatlifts into the Atlantic Intracoastal Waterway. The proposed
design is consistent with previously issued permit number 58-07. The proposed fixed pier measures
approximately 149' in length by 6' wide, with a proposed height at least 3' above coastal marsh. The proposed
fixed pier leads to a 16.5' x 24' platform with an 8.5' x 24' roofline. There are two 12.5' x 12.5' boat lifts proposed
for each side of the fixed platform. A proposed 16' x 3' access ramp leads to a 6' x 36' floating dock with (2) 5'
x 9' floating finger piers. The facility is designed for 4 slips. See Appendix A for details.

This permit, issued on May 31. 2007 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
Docking Facility
1) Unless specifically altered herein, this permit authorizes only the docks, piers, and other structures
and uses located in or over the water that are expressly and specifically set forth in the attached
permit application and workplan drawings. No other structure, whether floating or stationary, shall
become a permanent part of this docking facility without permit modification. • No non -water
dependent uses of structures shall be conducted on, in or over public trust waters without permit
modification.
2) The pier and associated structures shall have a minimum setback distance of 15 feet between any
parts of the structure and the adjacent property owner's riparian access corridor, which is determined
by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that
intersects with the shore at the point where the upland property line meets the water's edge.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.

ADDITIONAL CONDITIONS
3) The authorized structure shall not extend more than 'A of the width of the waterbody, as measured from
the waterward edge of the marsh on both sides of the AIWW immediately in front of the project site.
4) In order to ensure compliance with Conditions No. 2 and 3 of this permit, an as -built survey showing the
location and dimensions of the constructed structure. the distance to the neighboring riparian corridors,
and the distance across the waterbody shall be performed, and copies of the survey shall be provided to
the Division of Coastal Management, within 60 days of completion of construction.
5) All portions of the access pier located over Coastal Wetlands shall not exceed a width of 6 ft. and shall
be elevated a minimum of 3 feet above the marsh substrate as measured from the bottom of the decking.
6) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct
view and must be permeable to air and water. Screen or wire on the sides along with benches and knee
walls are permitted. Lattice is specifically excluded from being used under this authorization.
7) The roof of the covered platform shall not be designed for second story use.
8) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
9) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
10) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
1 l) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum. permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or

removal, relocation, or other alteration of the structure or work authorized by this permit. or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause

due notice from the Corps of Engineers. to remove, relocate or alter the structural work or obstructions
