This permit, issued on January 2, 2020 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. JaUJUL.L LV LULVJ, .... auvauaavaau VL vl.............. ......_1 _.-.-..- Maintenance Excavation 1) In order to protect juvenile shrimp and finfish populations, no excavation or filling shall be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with appropriate resource agencies. 2) No excavation shall take place outside of the area indicated on the workplan drawings. 3) Excavation shall not exceed -2.5 feet below the mean low water level. In no case shall the depth of excavation exceed the depth of connecting waters. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Ronald and Cyndi McNeil Permit No. 4-20 Page 2 of 3 ADDITIONAL CONDITIONS 4) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 5) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. Spoil Disposal 6) No spoil material shall be placed within 30 feet of the mean high water line. 7) All excavated materials shall be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 8) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. Maintenance Clause 9) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any maintenance excavation work authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for spoil disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the spoil disposal site shall be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. D. The date of map revision and the permittee's signature shown anew on the original plan. General 10) If the crossing of wetlands with mechanized construction equipment is necessary, temporary construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed immediately upon completion of construction. 11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 12) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 13) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action iD SAW-1997-04267). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2019-1119. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the mean high water level. Should concerns be expressed over potential impacts from any of the resource agencies, the project could then be found to be inconsistent with NCAC 07H .0208(a)(2), which requires that the location, design and need be consistent with the management objective of the Estuarine System AEC and the project be sited and designed so as to avoid significant adverse impacts upon the productivity and biological integrity of spawning and nursery areas. It is the opinion of this office that this proposal would be CONSISTENT with the use standards set forth in 711 .0205 (d) "Highest priority of use shall be allocated to the conservation of estuarine waters and their vital components. Second priority of estuarine waters use shall be riven to those types of development activities that require water access and use which cannot function elsewhere such as simple access channels • structures to prevent erosion • navigation channels: boat docks marinas piers wharfs and mooring pilings". The proposed excavation of the area within the existing channel to Hewlett's Creek appears to be CONSISTENT withl5 NCAC 07H.0208 (b)(1). It is the opinion of this office that the area for the proposed excavation is located within a channel that has been historically used for docking and navigational purposes. This office has no objection to the proposed work, provided it is consistent with all state and federal permitting requirements. Any permit issued should include standard conditions for maintenance dredging. Shell bottom is an extremely productive self -building three-dimensional habitat that can be impacted long term through dredging and filling, pollution and other contaminants. This vital estuarine habitat is very limited in North Carolina, and restoration and conservation of shellfish habitat is at the forefront. Increased sedimentation raises concern for shellfish and shellfish habitat by either the direct burial of oyster beds or reductions in filtration efficiency, respiration rates, and/or reproduction and settlement. Larval oysters require a clean hard bottom for attachment and sedimentation as little as 1 or 2 mm may inhibit settlement. The resuspension of sediment can create an increase in turbidity that larvae, juveniles, and especially filter feeding species, can be acutely susceptible. An increase in suspended sediments can result in clogged gill surfaces and mortality, and can cover oysters, SAV, and other sessile fauna and flora. Elevated water temperatures reduce dissolved oxygen (DO) concentrations, making the potential for a DO crash from increased turbidity a major concern, even if sediment booms are utilized. Due to the concerns raised above, DMF is recommending a moratorium on in -water work, to include dredging, from 1 April to 30 September to reduce the negative effects on critical fish life history activities, to include spawning migrations and nursery functions. PROJECT DESCRIPTION: The project site is a 5.8 acre residential tract at 102 Magnolia Drive off Masonboro Sound Road, adjacent to Masonboro Sound at the mouth of Hewlett's Creek. To locate the property from Oleander Drive (NC Highway17), turn onto Greenville Loop Road and travel west approximately 3.0 miles. Turn left onto Pine Grove Road and travel south approximately 1.2 miles until you reach Masonboro Sound Road, which will be on your left. Turn left onto Masonboro Sound Road and travel approximately 1.0 mile east until you reach Magnolia Drive, which will be located on the left. Turn left onto Magnolia Drive and the property of interest will be the immediate driveway on the right. The applicant currently maintains a single-family residence on the property, which has elevations ranging from 5' to 25' above normal high water (NHW). This area is one of older homes occupying large tracts of land along Masonboro Sound. The property is vegetated with lawn grasses and ornamental landscape vegetation.'rhe adjacent tract to the south is undeveloped and vegetated with oaks, pines, yaupon and wax myrtle. There is a fringe of Smooth Cordgrass (Spartina alterniflora) averaging 25' in width along the channel. The upper edges of the channel are lined with Black Needlerush (June us rcemerianus), Salt Meadow Cordgrass (Sp_attinapatens) Sea Oxeye orrichia frutescens , and Sea Lavender Limonium earolinianum). The channel bottom is very silty, probably due to the stagnant nature of the channel terminus. The applicant currently maintains a private docking facility within the channel, which was authorized under CAMA General Permit No. 36908 on 12/01/2003. The docking facility includes an access pier, uncovered 'T head" platform and a floating dock, which runs parallel to the channel. The application states that the existing channel appears to have been artificially created, extending across several properties, including the applicant's, which ties into Hewletfs Creek to the north. This channel is parallel to the AIW W, and appears to be originally excavated in the 1950's. The application states that the dimensions of the original channel as originally constructed were approximately 535' in length by 35' in width. The channel terminates at the south end of the applicant's property and continues along the adjacent riparian properly owners to the north (Paisley and Woodbury). This sandy material within the channel has apparently been associated with runoff from the existing ditches along the highground portions of the properties, which border the channel. The previous property owner (D. Batten) obtained State Permit No. 34-97 on 3/24/1997 for maintenance excavation of the channel, with dimensions of approximately 215' in length by 14' in width to a final project depth of-2.0' @ MLW (US Army Corps of Engineers (USACE) Action ID No. 199704267). These authorized dimensions were within the limits of what appears to have been the historical channel that was created. The application states that this was accomplished through a dragline dredge methodology, and the excavated material was placed onto the highground portion of the properties along the channel. A Major Modification issued on 02/15/13 expanded the authorized channel to 535' in length, 18' in width, and-2.5'@NLW. State Permit No. 34-97 also authorized the stabilization of the ditch on the applicant's property through the means of three (3) check dams to address the shoaling within the channel. State Permit No. 34-97 was transferred to the applicant on 11/13/1997. A Major Modification was issued to the applicant on 02/15/2013 for maintenance excavation and expansion of the previously authorized access channel. Condition No. 1 of the permit required that rip rap be placed at the confluence of the drainage ditch and the canal, which was completed. Permit No. 34.97 expired on 12/31/16. The Wilmington/New Hanover County Land Use Plan 2006 Update classifies the area within the scope of the project as Conservation. They ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. The Division of Water Resources has classified the waters as SA- ORW; however, the ORW designation stops at the mouth of Hewlett's Creek. The applicant wishes to excavate the channel within the shoaled area, measuring approximately 535' in length by 18' in width to a final project depth of -2.5' @ NLW, which would tie into connecting water depth towards Hewlett's Creek to the north (See Sheets 2 and 3 of 4). The proposed excavation would run along the location of existing docking facilities of three contiguous property owners (102, 106, and 110 Magnolia Drive). The material would he excavated mechanically by bucket -to -barge method, which would result in the removal of approximately 447 cubic yards (cy) of material. The excavated material would then be placed on the high ground at the applicant's property at 102 Magnolia Drive as depicted in Sheet 2 of 4. The spoil disposal area would be approximately 124' by 102' (-12,600 W) and would be located outside the 30' coastal shoreline buffer from NHW. Should concerns be expressed over potential impacts from any of the resource agencies, the project could then be found to be inconsistent with NCAC 07H .0208(ax2), which requires that the location, design and need be consistent with the management objective of the Estuarine System AEC and the project be sited and designed so as to avoid significant adverse impacts upon the productivity and biological integrity of spawning and nursery areas. PROJECT DESCRIPTION: The project site is a 5.8 acre residential tract at 102 Magnolia Drive off Masonboro Sound Road, adjacent to Masonboro Sound at the mouth of Hewletes Creek. To locate the property from Oleander Drive (NC Highwayl7), turn onto Greenville Loop Road and travel west approximately 3.0 miles. Turn left onto Pine Grove Road and travel south approximately 1.2 miles until you reach Masonboro Sound Road, which will be on your left. Turn left onto Masonboro Sound Road and travel approximately 1.0 mile east until you reach Magnolia Drive, which will be located on the left. Turn left onto Magnolia Drive and the property of interest will be the immediate driveway on the right. The applicant currently maintains a single-family residence on the property, which has elevations ranging from 5' to 25' above normal high water (NHW). This area is one of older homes occupying large tracts of land along Masonboro Sound. The property is vegetated with lawn grasses and ornamental landscape vegetation. The adjacent tract to the south is undeveloped and vegetated with oaks, pines, yaupon and wax myrtle. There is a fringe of Smooth Cordgrass (S ahemiflora) averaging 25' in width along the channel. The upper edges of the channel are lined with Black Needlerush Juncus roemerianus), Salt Meadow Cordgrass (Spartinapatens) Sea Oxeye omchia fiutescens). and Sea Lavender imonium carolinianum). The channel bottom is very silty, probably due to the stagnant nature ofthe channel terminus. The applicant currently maintains a private docking facility within the channel, which was authorized under CAMA General Permit No. 36908 on 12/01/2003. The docking facility includes an access pier, uncovered 'Thead" platform and a floating dock, which runs parallel to the channel. The application states that the existing channel appears to have been artificially created, extending across several properties, including the applicant's, which ties into Hewletes Creek to the north. This channel is parallel to the AIW W, and appears to be originally excavated in the 1950's. The application states that the dimensions of the original channel as originally constructed were approximately 535' in length by 35' in width. The channel terminates at the south end of the applicant's property and continues along the adjacent riparian property owners to the north (Paisley and Woodbury). This sandy material within the channel has apparently been associated with runoff from the existing ditches along the highground portions of the properties, which border the channel. The previous property owner (D. Batten) obtained State Permit No. 34-97 on 3/24/1997 for maintenance excavation of the channel, with dimensions of approximately 215' in length by 14' in width to a final project depth of -2.0' @ MLW (US Army Corps of Engineers (USACE) Action ID No. 199704267). These authorized dimensions were within the limits of what appears to have been the historical channel that was created. The application states that this was accomplished through a dragline dredge methodology, and the excavated material was placed onto the highground portion of the properties along the channel. A Major Modification issued on 02/15/13 expanded the authorized channel to 535' in length, 18' in width, and-2.5'@NLW. State Permit No. 34-97 also authorized the stabilization of the ditch on the applicant's property through the means of three (3) check dams to address the shoaling within the channel. State Permit No. 34-97 was transferred to the applicant on 11/13/1997. A Major Modification was issued to the applicant on 02/15/2013 for maintenance excavation and expansion of the previously authorized access channel. Condition No. 1 of the permit required that rip rap be placed at the confluence of the drainage ditch and the canal, which was completed. Permit No. 34-97 expired on 12/31/16. The Wilmington/New Hanover County Land Use Plan 2006 Update classifies the area within the scope of the project as Conservation. They ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. The Division of Water Resources has classified the waters as SA- ORW; however, the ORW designation stops at the mouth of Hewlett's Creek. The applicant wishes to excavate the channel within the shoaled area, measuring approximately 535' in length by 1 S' in width to a final project depth of -2.5' @ NLW, which would tie into connecting water depth towards Hewlett's Creek to the north (See Sheets 2 and 3 of 4). The proposed excavation would run along the location of existing docking facilities of three contiguous property owners (102, 106, and 110 Magnolia Drive). The material would be excavated mechanically by bucket -to -barge method, which would result in the removal of approximately 447 cubic yards (cy) of material. The excavated material would then be placed on the high ground at the applicant's property at 102 Magnolia Drive as depicted in Sheet 2 of 4. The spoil disposal area would be approximately 124' by 102' (-12,600 ft) and would be located outside the 30' coastal shoreline buffer from NHW. The application states that mats would be used for any machinery crossing coastal wetlands that may be required. 10.
