This permit, issued on November 30, 2021 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
Athese terms may be subject to Imes, imprisonment or civil action; or may cause the permit to be null ano vote.
Docking Facility
1) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
mooring. Any sewage discharged at the mooring shall be considered a violation of this permit for
which the permittee is responsible. This prohibition shall be applied and enforced throughout the
entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) Any portion of the permitted access pier and docking facilities built over wetlands shall not exceed six
feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured
from the bottom of the decking.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes a maximum of 3 formalized boat slips.
6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
7) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
8) The permittee is advised that submerged aquatic vegetation (SAV) habitat exists in close proximity to
the authorized project. All available precautions shall be utilized to ensure that damage to SAV habitat
does not result from the construction and/or operation of the authorized facilities. Should dredging of
these areas be proposed in the future, the permittee is further advised that the Rules of the Coastal
Resources Commission prohibit new dredging within SAV beds.
Sedimentation and Erosion Control
9) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
10) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
General
11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
12) All construction debris associated with the removal or construction of the permitted docking facility
shall be contained within the authorized project area and disposed of in an approved upland location.
13) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.

NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit
197800056 (Action ID SAW-2021-01044).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2020-08901 v2.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808. prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high-water level. .

The following are my comments and recommendations regarding the aforementioned
proposal. The proposal is for a three slip docking facility with boatlifts, pier, platform and
finger piers.
The site is currently a total of 5.5 (241,322.4so total acres that is located along Bogue
Sound and the ICW. This property had a previous CAMA major permit 194-06 for upland
development and a 10-slip docking facility however it has long since expired. There is a
single- family home currently being constructed on the high ground as well as all pertinent
utilities. All of this work is outside of the 75' CAMA AEC. SAV were observed to a distance
of approximately 150' to 200' from NHW depending on location. The substrate is a
predominately sandy bottom with some loamy sand bottom. Water depths within the slip
areas are at least -2' nlw. The development conforms to the guidelines set forth under 15A
NCAC 07H .0208. Assuming that state and federal agencies concur with the proposal, the
District recommends the project be authorized as proposed, contingent upon the following
conditions:
• All work shall remain within the areas shown on plats dated received 8/30/2021.
All slip areas shall be in a minimum water depth of -2' nlw over any SAV
habitat.
• No more than three slips total are authorized.
• No filling of wetlands is authorized and no other high ground development is
authorized.

Consistency Determination: The request is consistent with/not in conflict with the Town of Morehead
City Land Use Plan certified by the CRC on September 28, 2007.
Overview: The Green Channel Marker, LLC project is located at 4021 Arendell Street within Morehead
City, Carteret County. The Green Channel Marker, LLC property is 5 .5 acres (241,322.4sf) in its entirety,
20' above nhw and is along Bogue Sound. There is a house with amenities currently being constructed on
the high ground which is outside of the 75 ' CAMA AEC. The upland vegetation mainly consists of lawn
grasses and trees. The applicant is proposing the construction of a three slip docking facility with pier,
platform, finger piers, wet slip, and two slips with boatlifts (three total).
AEC's involved include: Estuarine Waters (EW), Public Trust Areas (PTA), and Estuarine Shorelines (ES).
This section of Bogue Sound has a classification of HQW/SA Waters. The site is not a Primary Nursery
Area, and is open to taking of shellfish. There is a 10' x 60' fringe of coastal wetlands along the east side
of the property and consists mostly of Spartina alterniflora. The bottom substrate is sand and SA V were
observed within the proposed docking facility location. The width of the water body within this location
is approximately 5,260 feet per Google Earth. The east edge of the property is approximately 886' from
the setback of the AIW W with the western edge located a distance of 928' from the AIWW setback.
Anticipated impacts resulting from this project are expected to: The proposed development would shade
and incorporate 360ft' of shallow bottom habitat, shade 1,377 sf of SAV and incorporate a total of 1,771
of SAV habitat. Because all proposed development is located within the existing pier head lengths as well
landward 730' of USA COE channel setbacks, there should be no navigation issues. The increase in
suspended sediment and turbidity levels from the piling placement would be temporary, occur while the
piling placement is taking place and should be minimal given the bottom composition.

Basis for Determination: The project site is in the Town of Morehead City and is subject to the 2007 Town
of Morehead City Core Land Use Plan Update. The Future Land Use Map (FLUM) designates the site as
"Low Density Residential" and "Conservation/Open Space" (due to the sites location in Estuarine Waters,
Estuarine Shorelines and Public Trust Area AECs).
The following LUP policies may be applicable to this request:
4.2.6 Areas of Environmental Concern
Policy 1, pg. 94: The Town of Morehead City supports state and federal law regarding land use and
development in AECs.
Policy 2, pg. 94: Morehead City considers coastal wetland areas to be valuable passive recreation areas.
These areas should be protected in their natural state. Only uses which are permitted by 15A NCAC 7H
will be allowed.

SUBJECT: CAMA Dredge/Fill Permit Application for Green Channel Marker, LLC,
Carteret County, North Carolina.
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit
application with regard to impacts on fish and wildlife resources. The project site is located at 4021
Arendell Street adjacent Bogue Sound and the AIW W in Morehead City, NC. Our comments are
provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through
113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, the Endangered
Species Act of 1973, as amended (16 U.S.C. 1531 ct scq.), the Fish and Wildlife Coordination Act (48
Stat. 401, as amended; 16 U.S.C. 661 et seq.), the Magnuson -Stevens Fishery Conservation and
Management Act (FCMA), as amended (16 U.S.C. 1801 et seq.), and the Migratory Bird Treaty Act (16
U.S.C. 703-712 et seq.).
The applicant proposes to construct a three -slip docking facility with a 6' by 190' pier that intersects a 10'
by 30' T-head platform 200' from NWL.,Slips one and two am located along the northwest side of the

along the northeast side of the platform and have a 3' by 23' finger pier. Water depths within the slips
range between -2' to -2.5' NWL.'Submerged aquatic vegetation (SAV) was noted in the vicinity.The
structure as proposed would be sited 730' landward the USACE AIW W setback. The Bogue Sound at this
location is classified SA HQW by the Environmental Management Commission and is open to shellfish
harvesting.
The NCWRC has reviewed the permit application and is familiar with the project area. Our agency
reviewed and commented (Tripp 17 November 2005) on a permitted but never constructed project off this
shoreline. The facility under the 2005 application review was for a 10-slip docking structure, sited in

water depths of -3' NWL. Due to the presence of SAV, the NCWRC requests the slips be extended
waterward to depths that would allow vessel use with minimal SAV and sediment disturbance. The
preferred depth would be -3' NWL. This extension should not cause navigation concerns due to the
distance from the AIW W setback, the distance from riparian landowners, and the location of the
previously permitted docking facility.

A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has
reviewed the permit application for proposed actions that may impact fish and/or fish habitats.
The proposed work is located at 4021 Arendell Street within Carteret County, North Carolina.
The applicant is proposing to construct a three -slip docking facility with a pier, platform, finger
piers, wet slip, and two boatlift slips. The proposed pier would be 6' by 190' and would extend
into Bogue Sound, terminating at a 10' by 30' T-head platform. The two boatlift slips would be
located along the northwest (landward) side of the proposed platform. The third slip would be
located along the northeast side of the proposed platform. Water depths range from -2' to -2.5'
depending on location. Submerged aquatic vegetation (SAV) was observed growing within the
proposed location.
SAV is an important habitat that provides a wide array of functions. This habitat type provides
nursery, forage, and refuge for numerous commercially, recreationally, and ecologically
important fmfish and shellfish species. Additionally, SAV provides natural water quality
enhancement through nutrient removal, and the presence of SAV is often seen as a bioindicator
of high water quality. Furthermore, SAV provides benefits to coastal communities by naturally
stabilizing shorelines. Taking the above into consideration, it is important that this critical
habitat type be protected from impacts that may result from development projects.
DMF would be opposed to the project unless the design of the structure is adjusted so that the
proposed boat slips are in water depths that are 3' or greater. This would minimize the potential
for impacts to occur to SAV through the use of the structure, including prop scar and damage
through the use of the boat lifts.
Although not a requirement for approval, DMF would also recommend that the design include
elements that would prevent the terminal end of the platform and the waterward sides of the
finger piers from being used as slips, and that the permit be conditioned on these sections not
being proposed as slips in the future.

Hi Greg,
So I think you guys were leaning towards a mod to the Port permit moratorium condition w/ a 1-time event. However
DCM wants to condition the state permit is fine. But I do anticipate the Port to request the condition be permanently
modified to match the USACE dredging window -since that is essentially what they were asking for to begin with. Based
on my coordination with Pace, NMFS was currently alright with only allowing the modified window during the 2022
dredging season, and not long-term. If it makes more sense to allow a 1-time event during the 2022 season, outside of
the current window, maybe that's how we should write it.

9. Narrative Description:
The Green Channel Marker, LLC project is located at 4021 Arendell Street
within Morehead City, Carteret County. The site is found by following 70 East
(Arendell St.) towards Carteret Community College and within the 4000 block of Arendell
Street (within the Hampton Inn vicinity). The site will be located directly adjacent to and
east of the Hampton Inn and is enclosed by a chain link fence system.
The Green Channel Marker, LLC property is 5.5 acres (241,322.4sf) in its entirety, 20'
above nhw and is along Bogue Sound. The upland vegetation mainly consists of lawn
grasses and trees. There is a 10' x 60' fringe of coastal wetlands along the east side of the
property and consists mostly of Spartina alterniflora. There is a house with amenities
currently being constructed on the high ground which is outside of the 75' CAMA AEC.
Written approval was not required by NCDWR. No additional high ground disturbance is
proposed.
The Division of Water Resources classifies this area as HQW/SA Waters. This area of
Bogue Sound is not designated as a Primary Nursery Area and is open to the taking of
shellfish. The Morehead City Land Use Plan classifies this area as Low Density
Residential with Conservation within the AECs. Water depths within this project location
are-2'nlw/mlw to —2.5' nlw/mlw (field verified), depending on location. The bottom
substrate is sand and SAV were observed within the proposed docking facility location.
The width of the waterbody within this location is approximately 5,260 feet per Google
Earth. The east edge of the property is approximately 886' from the setback of the AIWW
with the western edge located a distance of 928' from the AIWW setback. This property
had a previous CAMA major permit 194-06 for upland development and a 10-slip docking
facility however it has long since expired.
10) Proposed Development:
The applicant is proposing the construction of a three slip docking facility with pier,
platform, finger piers, wet slip, and two slips with boatlifts (three total).
The applicants are proposing to construct a 6' wide x 190' pier that would extend from
NHW into Bogue Sound and would intersect a 10' x 30' t-head platform for a maximum
length of 200' from NHW. Slips one and two would be located along the northwest
(landward) side of the proposed platform. There would be two 3' x 38' finger piers, one
15' x 15' boatlift within slip # 2 and a 13' x 13' boatlift within slip # 1.. Slip # 3 (wet slip)
would be located along the north east side of the proposed platform and would have a 3' x
23' finger pier. Water depths within the slip areas are -2' to -2.5' depending on location.
All work would be a distance of approximately 200' from the western riparian access line,
30.5' from the eastern riparian access line and 730' landward of the AIWW setback. The
typical boat size would be 25' and of center console design.

11. Anticipated Impacts:
The proposed development would shade and incorporate 360111 of shallow bottom habitat,
shade 1,377 sf of SAV and incorporate a total of 1,771 of SAV habitat. Because all
proposed development is located within the existing pier head lengths as well landward
730' of USACOE channel setbacks, there should be no navigation issues. The increase in
suspended sediment and turbidity levels from the piling placement would be temporary,
occur while the piling placement is taking place and should be minimal given the bottom
composition.

Mr. Pate is seeking to install a dock extending 200' from the NHW line. The dock will be for private recreational use and is
an ammenity to his residence that is currently under construction on the property. Earl Weeks of Intracoastal Marine is the
contractor for the project and will conduct the construction of the dock. This permit will also include extension of the
perimeter fencing on both the East and West property border to the NHW line. The Dock is to have 3 finger piers and two
boat lifts.
c. Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type
of equipment and where it is to be stored.
Piles will be driven by a vibratory excavator attachment on a small barge that will be moored in front of the site.

Development encompassed under this permit will be construction of the dock facility to serve the residence that is currently
under construction. There will also be a bridge spanning the ditch on the property. Permitting and ACOE signoff on the
bridge has already been obtained.

Scope of Project:
Mr. Pate is currently constructing a home at 4021 Arendell Street in Morehead
City, NC. This permit will encompass a 200' private dock to serve the residence. The
dock surfacing will be open slatted IPE decking, 6' in width, with a platform at the extent
of the pier. There will be two boat lifts with finger piers extending from the western side
of the pier, and a single finger pier extending to the east. No sitework is proposed within
the AEC, but two sets of stairs on either side of the pier within the "beach" area are
proposed. A request for express review state stormwater has been submitted and a
meeting is expected for early August. This project will be low density, and the site plan
has been reviewed and accepted by both the ACOE and NCDWR. The project
proponent hereby certifies that all information contained herein is true, accurate, and
complete to the best of my knowledge and belief. The project proponent hereby
requests that the certifying authority review and take action on this CWA 401 certification
request within the applicable reasonable period of time

approval for development of your property located on Bogue Sound at 4021 Arendell Street in
Morehead City,. Carteret County. The application was received as complete on 8/30/2021, and .
appears to be adequate for processing at this time. The projected deadline for making a decision is
11/13/21. An additional 75-day review period is provided by law when such time is necessary to
complete the review. Ifyou have not been notified of a final action bythe initial deadline stated above,
you should consider the review period extended. Under those circumstances, this letter will serve as
your notice of an extended review. However, an additional letter will be provided on or about the
75th day.
If this agency does not render a permit decision within 70 days from 3/30/2021, you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the
status of your project. Such a meeting will be held within five working days from the receipt of your
written request and shall include the property owner, developer, and project designer/consultant
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing' postcard which must be posted at
the property of your proposed development You should post this notice at a conspicuous point along
your property where it can be observed from a public road. Some examples would be: Nailing the
notice card to a telephone pole or tree along the road right-of-way fronting your property, or at a
point along the road right-of-way where a private road would lead one into your property. Failure
to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by

I spoke with Holley and given no dredging is required or proposed, it doesn't impact shellfish resources or SAV, and is
less than 10 slips, it is her recommendation that written approval is not required there for prefiling is not applicable.
