This permit, issued on November 29, 2021 is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Docking Facility
1) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether Floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) The waterward edge of the authorized docking facility shall be staked by the permittee prior to the
start of the dock construction and the permittee shall contact the appropriate DCM Field
Representative for an inspection to verify the authorized dock length and distance from NHW. The
stake shall remain in place for the duration of the construction project.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be' accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees.that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) Any portion of the permitted access pier and docking facilities built over wetlands shall not exceed six
feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured
from the bottom of the decking.
4) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
mooring. Any sewage discharged at the mooring shall be considered a violation of this permit for which
the permittee is responsible. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
5) To reduce direct impacts to oyster resources, the permittee shall relocate all oysters falling within the
footprint of pilings to an area immediately adjacent to the project area.
6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
7) This permit authorizes a maximum of one (1) formalized boat slip.
8) In order to satisfy concerns of the resource agencies, physical stops shall be placed on the boat lift at a
minimum height of 18" above the bottom substrate to prevent the boat lift from disturbing the bottom
substrate. The physical stops shall remain in place for the life of the permitted docking facility.
9) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's area of riparian access.
10) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct
view and shall be permeable to air and water. Screen or wire on the sides along with benches are
permitted. Lattice is specifically excluded from being used under this authorization.
l 1) The roof of the covered platform shall not be designed for second story use.
12) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
13) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
14) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or
excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat
propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.

ADDITIONAL CONDITIONS
Sedimentation and Erosion Control
15) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
16) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
USACE Conditions
17) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

General
18) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
19) All construction debris associated with the removal or construction of the permitted docking facility
shall be contained within the authorized project area and disposed of in an approved upland location.
20) In order to ensure compliance with the conditions of this Permit, the permittee and his contractor shall
schedule a pre -construction conference with the Division of Coastal Management prior to the initiation
of any mobilization activities.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2021-02006).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2007-1367 v10.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the mean high-water level.
NOTE: An application processing fee of $250 was received by DCM for this project.

The following are my comments and recommendations regarding the aforementioned proposal. The
proposal is for the construction of a pier, ]-head platform and boatlift. The water depths within this area
are an average of-2.1' nlw.
The proposed development is consistent with 15A NCAC 7H.0208. The Morehead City District office
recommends the project be authorized as proposed on plats dated received 4/29/2021 contingent upon
all applicable general conditions and the following standard conditions:
The pier and platform should not exceed a maximum distance of 409' waterward of NHW
and should not exceed a maximum of 75' from the oyster bed/coastal wetland due to the
edge of channel as well as a 300' wide water body width (measured from edge of coastal
wetlands/oyster rock to coastal wetlands).
Recommend a stop system on the proposed boatlift due to the shallow water depth of -2'
nlw within a PNA and the silty substrate.
All development shall be a minimum of 15' from riparian access lines.

Consistency Determination: The request is consistent with/not in conflict with the Town of Morehead
City Land Use Plan certified by the CRC on September 28, 2007.
Overview: The project is located adjacent to Dill Creek at 1302 Barnacle Lane in the Mariners Point
subdivision in Morehead City, Carteret County. Lot 45 is .520 acres (22,667 sf) in its entirety and is an
average of 5' above NHW. The total length of the shoreline is 174'. The applicant is proposing a 6' x 427'
pier, a 15' x 22' L- head platform and an 8' x 8' boatlift. The lot is not developed at this time and no upland
development is proposed.
Areas of Environmental Concern (AEC) in the project area include Estuarine Waters (EW), Coastal
Wetlands (CW) and Public Trust Areas (PTA). This section of Dill Creek is classified as SA/HQW, is a Primary
Nursery Area, and is closed to shellfishing. There is a 174' x 370' fringe of Coastal Wetlands present along
the shore adjacent to Dill Creek. This fringe contains Smooth Coordgrass (Spartina alternitlora), Salt Grass
(Distichlis spicato) and Salt Meadow Grass (Spartina patens). Within the waters of Dill Creek expanses of
oyster beds are present. The water depths in Dill Creek are shallow (-2'nlw) and according to the applicant,
reach-3' NL W within the channel portion and an average of-2' at NLW at the waterward end of the
proposed structure. Extensive field work confirms the soundings as well as the channel edge along the
property located approximately 83' from the edge of marsh/ oyster rock. The substrate in this area is thick
organic mud.
Anticipated impacts: The proposed pier would shade and incorporate 240 ft2 of coastal wetlands above
NHW, as well as shade and incorporate 1962 ft2 of coastal wetlands and oyster beds. A total 690 ft2 of
open water of would be shaded and 754 ftZ incorporated by the pier, platform and boatlift. Oyster beds
containing healthy (productive) populations existing along the shoreline would be disturbed during the
construction process. There would also be temporary turbidity during piling placement.

The Division of Land Resources approved the Sedimentation and Erosion control plan (CARTE-2006-440)
on 6/19/06 with the DWQ Stormwater permit #SW8060625 issued on 7/12/06 for the existing s/d. No
written concurrence is required by NCDWR per GC 4175. Based on the determination of the water body
widths by the Division and the District, the structure should not cause a hindrance to navigation due to
the location of the existing oyster beds. The oyster beds/coastal wetland area terminates approximately
360' waterward of NHW. The channel edge is located approximately 83' from the edge of the oyster beds.
Basis for Determination: The project site is in the Town of Morehead City and is subject to the 2007 Town
of Morehead City Core Land Use Plan Update. The Future Land Use Map (FLUM) designates the site as
"Low Density Residential" and "Conservation/Open Space' (due to the sites location in Coastal Wetlands,
Estuarine Waters and Public Trust Area AECs).
The following LUP policies may be applicable to this request:
4.2.6 Areas of Environmental Concern
Policy 1, pg. 94: The Town of Morehead City supports state and federal law regarding land use and
development in AECs.
Policy 2, pg. 94: Morehead City considers coastal wetland areas to be valuable passive recreation areas.
These areas should be protected in their natural state. Only uses which are permitted by 15A NCAC 7H
will be allowed.
Policy 5, pg. 94: Morehead City supports the use standards for estuarine and public trust areas as
specified in 15A NCAC.0207.

A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has
reviewed the permit application for proposed actions that may impact fish and/or fish habitats.
The proposed work is located at 1302 Barnacle Lane, Morehead City, within Carteret County.
The applicant is proposing to install a 6' by 427' pier, a 15' by 22' L-head platform, and an 8' by
8' boatlift. No upland development is proposed. Water depths are approximately -2' normal low
water (NLW). This area is designated as a Primary Nursery Area (PNA) and the waters are
classified as SA/HQW and is closed to the taking of shellfish. There are also oyster beds present
within the project footprint.
Areas designated as PNA are critical in the life history cycle of the species that utilize these areas
as nursery habitat. Many of the species found in these areas have specific habitat requirements
(i.e. temperature, salinity, and water velocity) for the susceptible stages of development, and
waters designated as PNA meet those specific requirements. In addition to meeting the
environmental requirements, these areas also often provide significant refuge habitat and
foraging resources for species. Therefore, it is critical that these habitats be protected from
impacts that may occur as a result of coastal development.
Taking into consideration the PNA designation and the presence of oyster beds, DMF would
oppose to the project unless the following recommendations are incorporated into the permit.
First, the boat lift should incorporate stops at 18 inches to prevent the vessel from resting on the
bottom and to limit vessel use during low tides when bottom disturbance could occur. Also, the
platform should include design elements (i.e. railings) that prevent the structure from being used
for the docking of vessels. The issuance of the permit should also be conditioned on no
additional slips being added in the future. In order to protect the existing oyster resources, care
should be taken no to smother oysters with equipment or sediment. Where impacts would be
unavoidable (i.e. piling placement), oysters should be moved by hand to an area adjacent to the
project. Lastly, the pilings should be the maximum distance apart to minimize wetlands and
oyster resource impacts.

North Carolina.
Biologists with the North Carolina Wildlife Resources.Commission (NCWRC) reviewed the permit
application with regard to impacts on fish and wildlife resources. The project site:is located at 1302
Barnacle Lane within the Mariners Point SD in Morehead City, NC adjacent to Dill Creek. Our comments
are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through
113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.).
The applicant proposes to construct a 427' pier over coastal wetlands and open water, a 15' 22' L-
platform, and an 8' by 8' boatlift A circulation of the projected is a requirement of the subdivision's
Permit No. 167-07 for additional slip installation. The piers platform would extend 75' into the 300'
water body, terminating 8' landward the channel. The water depth within the slip is approximately -2'
NLW. Oysters are within the, area, located along the marsh. The substrate is thick organic mud. Dill Creek
at this location is classified SA HQW by the Environmental Management Commission and is designated a
primary nursery area (PNA) by the NC Division of Marine Fisheries.
The NCWRC is very familiar with the site and the Mariner's Point subdivision. The allowance of the
multi -slip facility was to minimize impacts from individual lots developing water access and
compromising environmental resources. The waters of Dill Creek are designated aPNA. PNAs are
defined as those areas inhabited by the embryonic, larval or juvenile life stages of marine or estuarine fish
or crustacean species due to favorable physical, chemical or biological factors. As a designated PNA, the
creek provides an impoiiant rearing'area for this variety of estuarine fishes and invertebrates that need
relatively undisturbed habitats. Erosion of the marsh, sediment disturbance, turbidity, and contamination
collectively will degrade vital habitat and forage for wildlife in Dill Creek. Resources within the creek
and various marsh plants along the shore provide food and cover for a variety of wildlife such as blue

heron (Ardea herodias), sora rail (Porzana carolina), and pintail (Anas acuta). Extensive beds of oysters
are also present along the shoreline and would be vulnerable to continuous boating activity.
To minimize the impacts this facility may have, we request a construction moratorium from April 1—
September 30 due to the designation of the water body, the SA H WQ water classification, the presence of
oysters, and the importance of coastal marsh during the peak period of biological productivity. This
moratorium should be observed for any portion of the structure that is constructed over coastal wetlands,
oyster habitat, and open water.

The Division of Water Resources (DWR) has received a copy of your CAMA Major permit application
request dated received by this office on October 13, 2021.
The waters of the Dill Creek are classified as SA;HQW by the Division of Water Resources (DWR) and
have been determined to be a Primary Nursery Area (PNA) by the Division of Marine Fisheries (DMF).
Please understand that the waters around your project area have been identified as a PNA and should
requests for dredging within the proposed project area arise in the future, they will be denied. Please
be aware that new dredging within a PNA is not permitted under 15A NCAC 02B .0220. This activity
results in degradation of water quality standards and is therefore considered a water quality violation.
Any turbidity standard violations of waters going into these creeks are also considered Water Quality
Violations. [15A NCAC 02B .0220].
The Permittee shall comply with any moratoriums per the NC Division of Marine Fisheries and the
NC Wildlife Resources Commission. Dredging moratoriums shall be observed as required by the NC
Division of Marine Fisheries, NC Wildlife Resources, US Fish and Wildlife and National Marine
Fisheries. If such activities should take place during periods of high biological activity (e.g. shorebird,
or sea turtle nesting), biological monitoring may be required at the request of other state and federal

In accordance with the attached General Certification #4175 (GC 4175), the impacts described in your

While we are generally ok with the project, the presence of oysters and the area being a PNA gives
us some concern. We would like to see the project amended to reduce impacts to the
estuarine bottom. As noted in NCDMF's letter, the desired impact minimization could be achieved
by incorporating stops at 18 inches to prevent the floating dock from resting on the bottom and to
limit vessel ingress and egress during low tides when bottom disturbance is more likely. The oyster
patches should be avoided during construction. Oysters that cannot be avoided could be relocated
by hand to a safe, nearby location. Lastly, we believe it would be helpful to the homeowner if the
permit noted resource agencies are unlikely to support adding additional boat slips or dredging. If
additional discussion is needed, please let us know.

EFH:
This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson -
Stevens Fishery Conservation and Management Act. The Corps' initial determination is that the
proposed project may affect, but not likely adversely affect EFH or associated fisheries managed
by the South Atlantic or Mid Atlantic Fishery Management Councils or the National Marine
Fisheries Service. The waters within the project area ARE designated as PNA by the NC Division of
Marine Fisheries, are classified as SA; High Quality Waters by the NC Division of Water Resources,
and are Closed to harvesting shell fish. Average water depths along the proposed platform and
slip area are -2.0' at Normal Low Water (NLW). According to the BioReport, healthy/productive
oyster populations would be disturbed during construction.
ESA:
The Corps has reviewed the project area, examined all information provided by the applicant and
consulted the latest North Carolina Natural Heritage Database. Based on available information,
the Corps has determined that the project may affect, but is not likely to adversely affect the West
Indian Manatee. The use of Manatee Guidelines may be required as a permit condition. The
project would have No Effect on any other federally listed species.
NHPA 106:
Pursuant to Section 106 of the National Historic Preservation Act (NHPA) of 1966, Appendix C of
33 CFR Part 325, and the 2005 Revised Interim Guidance for Implementing Appendix C, the
District Engineer consulted district files and records and the latest published version of the
National Register of Historic Places and initially determines that no historic properties, nor
properties eligible for inclusion in the National Register, are present within the Corps' permit area:
therefore, there will be no historic properties affected.

Specifically, the applicant proposes to construct a new, single -slip docking facility. According to

The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report. We recommend that the following conditions be
included in the modification to the State authorization:
1. In order to further protect the endangered West Indian Manatee, Trichechus manatus,
the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and
strictly adhere to all requirements therein. The guidelines can be found at

2. Stops at 18 inches are recommended in order to prevent the floating dock from resting
on the bottom, and to limit bottom disturbance associated with vessel ingress/egress during low
tides.

5. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities.

Office at (910) 772-2191.
6. All work authorized by this permit must be performed in strict compliance with the
submitted plans, which are a part of this permit. Any modification to these plans must be
approved by the US Army Corps of Engineers (USACE) prior to implementation.
7. Except as specified in the plans attached to this permit, no excavation, fill or
mechanized land -clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
8. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
9. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Resources at (919) 733-
5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and
Hazardous Substances Control Act will be followed.
10. Unless otherwise authorized by this permit, all fill material placed in waters or
wetlands shall be generated from an upland source and will be clean and free of any pollutants
except in trace quantities. Metal products, organic materials (including debris from land
clearing activities), or unsightly debris will not be used.
11. If the permittee discovers any previously unknown historic or archeological remains
while accomplishing the authorized work, he will immediately notify the Wilmington District
Engineer who will initiate the required coordination procedures.
12. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.

13. The permittee shall employ all sedimentation and erosion control measures necessary
to prevent an increase in sedimentation or turbidity within waters and wetlands outside the
permit area. This shall include, but is not limited to, the immediate installation of silt fencing or
similar appropriate devices around all areas subject to soil disturbance or the movement of
earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project
must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of
1973 (North Carolina General Statutes Chapter I I3A Article 4).
14. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
15. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will, without expense to the United States and in such
time and manner as the Secretary of the Army or his authorized representative may direct,
restore the water or wetland to its pre -project condition.
16. Violations of these conditions or violations of Section 404 of the Clean Water Actor
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

8. PROJECT SUMMARY: The project is for a pier, platform and boatlift for lot 45 of
the Mariners Point s/d. As a requirement of the original major permit for the s/d each lot
would be required to apply for a major permit if individual docks were requested.

9. Narrative Description:
The lot 45 project is located at 1302 Barnacle Lane off Oglesby Rd which is part of the
existing Mariners Point subdivision. Mariners Point was permitted through major permit #
167-07 for infrastructure, 149 lots and a docking facility. Oglesby Rd. is found by turning right
off ofN. 20`h St. in Morehead City in the area locally known as Crab Point. Dill Creek borders
this site to the east and north.
Lot 45 is .520 acres (22,667) in its entirety and is an average of 5' above NHW. The total
length of the shoreline is 174'. There is a 174' x 370' fringe of Coastal Wetlands presentalong
the shore adjacent to Dill Creek. This fringe contains Smooth Coordgrass S artina
altgrniflora), Salt Grass (Distichlis spicata) and Salt Meadow Grass (Spartina patens). Within
the waters of Dill Creek expanses of oyster beds are present. The water depths in Dill Creek
are shallow (-2'nlw) and according to the applicant, reach-3' NLW within the channel portion
and an average of-2' at NLW at the waterward end of the proposed structure. Extensive field
work confirms the soundings as well as the channel edge along the property located
approximately 83' from the edge of marsh/ oyster rock. The substrate in this area is thick
organic mud. The lot is not developed at this time.
This section of Dill Creek is a PrimaryNursery Area as designated by the Division of Marine
Fisheries and the Division of Water Quality classifies it as SA/HQW waters. The area in
which the proposed project would take place is closed to the taking of shellfish. Morehead
City's Land Use Plan dated 2007 classifies this area as Low Density Residential and
Conservation within the AECs.
10. Project Description:
The applicant is proposing a 6' x 427' pier, a 15' x 22' L- head platform and an 8' x 8'
boatlift. No upland development is proposed.
The pier would extend from high ground and. cross over coastal wetlands landward of NHW
for approximately 40', coastal wetlands and oyster beds below NHW for approximately
327"and open water for 60' with a total length of 427' (area over the coastal wetlands/oyster
beds and open water'). It would then intersect a 15' x 22' 1-head platform. There is one slip
proposed with an 8' x 8' boatlift along the north side of the proposed platform. The maximum
boat length would be 21' and of open runabout design. The water depths along the platform
and within the slip is -2.0' nlw. The most water ward portion of the structure would be located
8' landward of the edge of the existing channel (incorrect on the plat).
The Division has determined through previous permit activity, that the configuration of marsh
and oyster beds along the shoreline of this property establishes the point from which to
measure the water body for the immediate area, creating a width of 300'. In consideration of
this, the impedance into the water body by the structure consequently extends approximately
75' into the 300' body of water and would be 8' landward of the channel edge. The pier and
platform would be located approximately 20' from the north riparian access line and 30' from
the south riparian access line. Riparian access lines where determined on the original major

permit submittal for the subdivision as well as through field visits and aerial photography and
are drawn relative to the channel location. All water depths and the outermost limit of the
oyster rock, channel location and water body width have been field verified by DCM staff on
numerous occasions throughout the years.
II. Anticipated Impacts:
The proposed pier as would shade and incorporate 240ft2 of coastal wetlands above NHW,
as well as shade and incorporate 1962 ftz of coastal wetlands and oyster beds. A total 690
ftZ of open water of would be shaded and 754 ftz incorporated by the pier, platform and
boatlift. Oyster beds containing healthy (productive) populations existing along the
shoreline would be disturbed during the construction process. There would also be
temporary turbidity during piling placement. The Division of Land Resources approved the
Sedimentation and Erosion control plan (CARTE-2006-440) on 6/19/06 with the DWQ
Stormwater permit #S W8060625 issued on 7/12/06 for the existing s/d. No written
concurrence is required by NCD WR per GC 4175. Based on the determination of the water
body widths by the Division and the District, the structure should not cause a hindrance to
navigation due to the location of the existing oyster beds. The oyster beds/coastal wetland
area terminates approximately 360' waterward of NHW. The channel edge is located
approximately 83' from the edge of the oyster beds.

Hey Heather,
It looks like the edge of channel line on the plan is actually the edge of what we thought would be the
edge of navigable waters.
The edge of channel is out much further and I will have to do a revision on this plan.
The numbers in the water are elevations of sea floor and we used the tides and currents charts from
the Duke marine lab to establish water depths using the NAVD '88 datum which is what we used to
establish the sea floor elevations.
I think I will have to redo the one quarter line as well since the channel edge was defined incorrectly?
I will revise this copy and send back to you here in a bit. Does everything else look ok?

I'm trying to develop a plan for a potential dock permit on Clarke Merrell's lot.
There is a point of riparian setback intersection with lot #45 and I wanted to see how CAMA views this
area to the south of the intersection of setback.
I have advised them that they would need a setback waiver from Mr. Osbourne Hester and they want to
approach him on this subject but I wanted to see if you could review and comment on the plan.
The two items I've mentioned above as well as any other barriers you may see with the conceptual plan
eventually being submitted as a CAMA major permit that we would need to address.

Project narrative for 1302 Barnacle Lane, Morehead City, NC 28557
Construct a 435 foot long dock with a L shaped dock head 15 by 22 feet.
A Boat lift will be installed. Dock construction will have 8" to 10"
diameter piles driven in with a vibratory head on an excavator. Piles will
be driven every 8 feet and dock will be 6 feet wide. 2x8 cross
members, 2x8 girders 2x6 deck joist and 2x6 deck boards. Dock will be
for personal use.

The NC Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development of your property located on Dills Creek in Carteret County. The site is at
1302 Barnacle Lane in Morehead City, Carteret County. The application was received as complete on
7/9/2021, and appears to be adequate for processing at this time. The projected deadline for making
a decision is 9/22/2021. An additional 75-day review period is provided by law when such time is
necessary to complete the review. If you have not been notified of a final action by the initial deadline
stated above, you should consider the review period extended. Under those circumstances, this letter
will serve as your notice of an extended review. However, an additional letter will be provided on or
about the 75th day.
If this agency does not render a permit decision within 70 days from 7/9/2021, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your
project. Such a meeting will be held within five working days from the receipt of your written request
and shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at
the property of your proposed development. You should post this notice at a conspicuous point along
your property where it can be observed from a public road. Some examples would be: Nailing the
notice card to a telephone pole or tree along the road right-of-way fronting your property, or at a
point along the road right-of-way where a private road would lead one into your property. Failure
to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by
the appropriate State or Federal agency. Please contact me if you have any questions and notify me
in writing if you wish to receive a copy of my field report and/or comments from reviewing agencies.
