This permit, issued on November 17, 2021 is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Docking Facility Expansion
I) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this docking facility expansion
Without permit modification. No non -water dependent uses of structures shall be conducted on, in or
over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
mooring. Any sewage discharged at the mooring shall be considered a violation of this permit for
which the permittee is responsible. This prohibition shall be applied and enforced throughout the
entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
4) This permit authorizes 2 additional formalized boat slips for a maximum of 4 formalized boat slips at
this docking facility.
5) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's area of riparian access.
6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
7) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
Sedimentation and Erosion Control
8) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
9) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
General
10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
11) All construction debris associated with the removal or construction of the permitted docking facility
shall be contained within the authorized project area and disposed of in an approved upland location.
12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action 1D SAW-2021-01779).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2021-1252.

boatlift located on his property off SR 1746 at 1781 Bayview Rd. adjacent to the Pamlico River near the Town of
Bath in Beaufort County, North Carolina.
This office has reviewed the proposed project with regard to rules found in Subchapter 7H concerning
development in AEC's with the Estuarine System, including 15A NCAC 07H.0209 Coastal Shorelines, and .0207
and .0208 Public Trust Area, and have found the project to be consistent.

Reference the application of Kenny K. Fisher for a Department of the Army permit to
construct a 12x15 boat lift and a 5x12 PWC lift adjacent to an existing pier, on property located
at 1781 Bayview Road, adjacent to the Pamlico River, near the Town of Bath, in Beaufort
County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
3. Except as authorized by this permit or any USACE approved modification to this
-AOW%&,
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
4. The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for reason other than safety.
5. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

Consistency Determination: The request is consistent with/not in conflict the Beaufort County Joint Land
Use Plan 2006 Update certified by the CRC on January 13, 2010.
Overview: Project is located at 1781 Bayview Rd. adjacent to the Pamlico River near the Town of Bath in
Beaufort County, North Carolina. Currently the project site is developed with a single family dwelling
including a maintained upland grass yard, bulkhead, 2 groins, pierwith platform,1 boatlift and 1 PWC lift.
The site is±0.11 acres in size and faces the Pamlico River on the southern side of the property. The project
site has ±50 linear feet of shoreline along the Pamlico River with an approximate elevation of 4' above
NWL. The length of the shoreline along the river is bordered by an existing bulkhead with upland grasses
between the bulkhead and the existing single-family dwelling.
AECs involved include: Public Trust Shoreline, Public Trust Area, Estuarine Waters, and Estuarine Shoreline.
The project is located within in Tar -Pamlico River Basin and is subject to the Tar -Pamlico Buffer Rule. The
Pamlico River is classified as SB; NSW, and is not a Primary Nursery Area, and is closed to shellfishing.
The applicant proposes the installation of a 12' by 12' boatlift on the west side of the pier, and one 5' x
12' PWC lift on an already installed pole along the east side of the pier. The applicant has fulfilled their
obligation to the Division of Water Resources (DWR) forthe 401 pre -filing certification by signing up online
on July 4, 2021 and waiting 30 days before submitting their application. The boatlift and PWC lift will be
located in Estuarine Waters and the Public Trust Area AEC.
Anticipated impacts The addition of the boatlift will result in short-term localized turbidity from the
installation of the 4 poles required the additional boatlift.

Basis for Determination:
The project is subject to the Beaufort County Joint Land Use Plan 2006 Update. The counties Future Land
Use Map (FLUM) classifies the site as Agricultural — Forestry — Rural Housing (land), Conservation I (Public
Trust and Estuarine Waters AEC, water protected by Tar -Pam Buffer), and Conservation II (100-year flood
plain).
The following LUP policies use enforceable language and are applicable to this request:

2.1.3 Only development and land/water use activities that are consistent with the use standards for
coastal wetlands, estuarine waters, and public trust areas (15A NCAC 07H .0208) are allowed in this
classification. Permitted extractive uses in the Aurora area will continue.
2.2 Conservation II
2.2.2 Only development that is consistent with the use standards for the estuarine shoreline AEC and the
public trust shoreline AEC (15A NCAC 07H.0209(d)) is allowed.

Dear Mr. Fisher:
You have our approval for the impacts listed below for the purpose described in your application received by the Division
of Water Resources (Division) on August 17, 2021. These impacts are covered by the attached Water Quality General
Certification Number 4175 and the conditions listed below. This certification is associated with the use of Regional General
Permit Number 291 once it is issued to you by the U.S. Army Corps of Engineers. Please note that you should get any other
federal, state or local permits before proceeding with your project, including those required by (but not limited to) CAMA
Major, Sediment and Erosion Control, Non -Discharge, and Water Supply Watershed regulations.

3. During construction of the proposed project fueling, lubrication and general equipment maintenance should
not take place within 50 feet of a waterbody or wetlands to prevent contamination by fuel and oils. [15A NCAC
02H .0506 (b)(3) and (c)(3) and 15A NCAC 02B .0200 (3)(0]
4. The permittee shall report to the Washington Regional Office any noncompliance with this certification, any
violation of stream or wetland standards [15A NCAC 02B .0200] including but not limited to sediment
impacts, and any violation of state regulated riparian buffer rules [15A NCAC 02B .0200). Information shall be
provided orally within 24 hours (or the next business day if a weekend or holiday) from the time the applicant
became aware of the circumstances. A Written submission shall also be provided within 5 business days of
the time the applicant becomes aware of the circumstances. The written submission shall contain a
description of the noncompliance, and its causes; the period of noncompliance, including exact dates and
times, if the noncompliance has not been corrected, the anticipated time compliance is expected to continue;

and steps taken or planned to reduce, eliminate, and prevent reoccurrence of the noncompliance. The
Division may waive the written submission requirement on a case -by -case basis.

Watercraft Lift (PWC) on an existing pole as well as the instillation of an additional 4 pole boatlift on his
existing pier located on his property off SR 1746 at 1781 Bayview Rd. adjacent to the Pamlico River near
the Town of Bath in Beaufort County, North Carolina.
Currently the project site is developed with a single family dwelling including a maintained upland
grass yard, bulkhead, 2 groins, pier with platform, I boatlift and 1 PWC lift. The site is t0.I I acres in size
and faces the Pamlico River on the southern side of the property. The project site has 150 linear feet of
shoreline along the Pamlico River with an approximate elevation of 4' above NWL. The length of the
shoreline along the river is bordered by an existing bulkhead with upland grasses between the bulkhead and
the existing single-family dwelling.
Both the upstream (west) and downstream (east) properties have developed home sites and have
installed shoreline stabilization in the form of groins and vertical bulkheads. The upstream property has a
pier with platform and 1 boatlift and the downstream property has a pier, platform, and two boatlifts.
This area of the Pamlico River is classified as SB NSW by the Environmental Management
Commission at the project site. The Pamlico River is classified as coastal fishing waters at this site and the
site is not located in a primary nursery area. The property is subject to the Tar -Pamlico Riparian Buffer rules
enforced by the N.C. Division of Water Resources.

The property owner, Kenny Fisher, would like to add a single pole pwc lift to an existing
wooden pole, as well as a 10,000 lb boat lift.
The proposed pwc lift will be installed on the East side of the pier and is an elevator lift design
with a vertical aluminum I-beam mounted to the pole, and the end of the I-beam sunken into the
sand. The cradle travels up and down on the I-beam.
The proposed boat lift will be installed on the West side of the pier and is an open design, with
no roof covering, and will need to have four poles installed.
The proposed locations, are labeled, and can be seen on the attached top view drawing of the
existing pier.
Property owners on both sides of the subject have signed attached owners statements.
There should be very little environmental impact, as the only construction will be the
installation of four poles to support the boat lift.

OF APPLICATION FOR
CAMA MAJOR DEVELOPMENT PERMIT
The Department of Environment and Natural Resources hereby gives public notice as
required by N.C.G.S. I I3A-119(b) that an application for a development permit in an Area of
Environmental Concern as designated under the Coastal Area Management Act (CAMA) was
received on 12 August 2021. According to the said application submitted by Kenny Fisher
proposes to construct one 12' x 12' boatlift and one 5' x 12' P.W.0 lift next to their existing pier
on the Pamlico River.
A copy of the entire application may be examined or copied at the office of Kelly Spivey,
District Manager, Washington Regional Office, 943 Washington Square Mall, Washington, NC,
during normal business hours. Public comments received by September 07, 2021 will be
considered. Later comments will be accepted and considered up to the time of permit decision.
Project modifications may occur based on further review and comments. Notice of the permit
decision in this matter will be provided upon written request.

The NC Division of Coastal Management hereby acknowledges receipt of your application
for State approval for development of property located 1781 Bayview Road Bath in Beaufort
County, North Carolina. It was received on August 12, 2021, and appears to be adequate for
processing at this time. The projected deadline for making a decision is 26 October 2021. An
additional 75-day review period is provided by law when such time is necessary to complete
the review. If you have not been notified of a final action by the initial deadline stated above,
you should consider the review period extended. Under those circumstances, this letter will
serve as your notice of an extended review. However, an additional letter will be provided
on or about the 75th day. Ashley Grandy Field Representative for the Division of Coastal
Management is responsible for processing your permit and he can be reached at 252-948-
3854 or via email at ashley grandyCfancdenr.eov if you have any questions.
If this agency does not render a permit decision within 70 days from 12 August 2021, you
may request a meeting with the Director of the Division of Coastal Management and permit
staff to discuss the status of your project. Such a meeting will be held within five working
elays-from-the receipt -of -your —written -request -and- shall --include-the-.property- owner, --_-
developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development. You should post this notice
at a conspicuous point along your property where it can be observed from a public road.
Some examples would be: Nailing the notice card to a telephone pole or tree along the road
right-of-way frontingyour property, or at a point along the road right-of-way where a private
road would lead one into your property. Failure to post this notice could result in an
incomplete application.
