Authorizing development in Perauimans County at adj. to Albemarle Sound. at Lot 26-E within
Long Beach Estates S/D, near Hertford , as requested in the permittee's application dated 2/13/20, including
attached workplan drawings (4), Pages 1,4 of 4 dated 1 /21 /20, Page 2 of 4 dated 1/9/20 and Page 3 of 4 dated 1/24/20.
This permit, issued on April 17, 2020 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Shoreline Stabilization - Bulkhead
1) The bulkhead shall be constructed in accordance with the alignment depicted on the attached
workplan drawings.
2) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the
approved bulkhead alignment.
3) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a
representative of the Division of Coastal Management within a maximum of 30 days prior to the start
of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse
weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM
within a maximum of 30 days prior to the new expected start of construction.

This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered

your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
4) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles,
or other suitable materials approved by Division personnel.
5) The bulkhead shall be constructed prior to any backfilling activities.
6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
7) The fill material shall be clean and free of any pollutants except in trace quantities.
8) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
9) No backfill material is to be placed within 30 feet of the normal water level, except that which will be
used to backfill the area behind the permitted bulkhead.
10) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead.
Boat Ramp
11) Unless specifically altered herein, this permit authorizes one concrete boat ramp, as indicated on the
attached workplan drawings.
12) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or
poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact
waters of the State or waters that will enter waters of the State.
13) Excavation and ground disturbing activities, associated with the placement of the boat ramp, above and
below the normal water line shall be limited to that absolutely necessary to establish adequate ramp
slope and provide a ramp no greater in size than specified in the attached permit application and
workplan drawings.
Groins
14) The alignment of the authorized groins shall be verified by a representative of the Division of Coastal
Management within a maximum of 30 days prior to the start of construction. Failure to initiate
construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the
alignment to be re -staked by DCM within a maximum of 30 days prior to the new expected start of
construction.
15) The groins, as depicted on the attached workplans, shall not extend more than 20 feet waterward of the
normal water level at the time of construction.
16) The permitted groins shall be constructed of treated wood, plastic lumber, metal or vinyl sheet piles or
other suitable materials approved by Department personnel.

Pier
17) This permit authorizes only the pier and uses located in or over the water that are expressly and
specifically set forth in the permit application. No other structure, whether floating or stationary, shall
become a permanent part of this marina/docking facility without permit modification. No non -water
dependent uses of structures shall be conducted on, in or over Public Trust waters without permit
modification.
18) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
19) This permit does not authorize any formalized boat slips.
20) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
Upland Development
21) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities
associated with the development of the above referenced property, including the gravel drive, rip rap and
drainage pipe repair, all as expressly and specifically set forth in the attached permit application and
workplan drawings.
Sedimentation and Erosion Control
22) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
23) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
24) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of
grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities.
General
25) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
26) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.

27) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2020-00430).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 20-0337.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 264-3901 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

Recommendations
The applicant proposes to replace an existing remnant bulkhead with 271 linear feet of
new bulkhead containing two 10 foot returns out an average of 4.75 feet out from Normal
Water Level, replace the existing 10 foot by 20 foot boat ramp and two 20 foot groins,
construct a new 119 foot by 12 foot gravel drive, repairing and existing drain pipe and
construct a 20 foot by 6 foot pier. The property is located at off Long Beach Drive, Hertford,
Perquimans County adjacent to the Perquimans River.
The development proposal involves the Public Trust Area (PTA), Estuarine Shorelines
(ES), Public Trust Shorelines (PTS), and Estuarine Waters (EW) Areas of Environmental
Concern.
I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to
this project and my findings are as follows:
15A NCAC 07H .0208 USE STANDARDS
(a) addresses General Use Standards, and subparagraph (1) requires that uses which are
not water dependent shall not be permitted in coastal wetlands, estuarine waters, and
public trust areas. Restaurants, residences, apartments, motels, hotels, trailer parks,
private roads, factories, and parking lots are examples of uses that are not water
dependent. Uses that are water dependent include: utility crossings, wind energy facilities,
docks, wharves, boat ramps, dredging, bridges and bridge approaches, revetments,

bulkheads, culverts, groins, navigational aids, mooring pilings, navigational channels,
access channels and drainage ditches.
Consistent: The applicant proposes to construct a bulkhead, boat ramp, groins and a
pier. This sub -paragraph lists these structures as water dependent.
(a)(2)(A) requires that the location, design, and need for development, as well as the
construction activities involved shall be consistent with the management objective of the
Estuarine and Ocean System AEC (Rule .0203 of this subchapter) and shall be sited and
designed to avoid significant adverse impacts upon the productivity and biologic integrity
of coastal wetlands, shellfish beds, submerged aquatic vegetation as defined by the Marine
Fisheries Commission, and spawning and nursery areas.
Consistent: The development is designed to not interfere with Shellfish beds or
submerged aquatic vegetation.
(a)(2)(B) requires that the development shall comply with state and federal water and air
quality
Consistent: This development will not violate water and air quality.
(a)(2)(C) requires that the development shall not cause irreversible damage to
documented archaeological or historic resources as identified by the N.C. Department of
Cultural resources.
Consistent: There are no known archaeological or historic resources on the
property.
(a)(2)(D) requires that the development shall not increase siltation.
Consistent: It does not appear that this development will measurably increase
siltation.
(a)(2)(E) requires that the development shall not create stagnant water bodies.
Consistent: It does not appear that the development will create stagnant water
bodies.
(a)(2)(F) requires that the development shall be timed to avoid significant adverse impacts
on life cycles of estuarine and ocean resources.
Consistent: The development will have minimum adverse effects on life cycles or
estuarine resources.

(a)(2)(G) requires that the development shall not jeopardize the use of the waters for
navigation or for other public trust rights in public trust areas including estuarine waters.
Consistent: The development proposal minimal effects on navigation.
(b) Specific Use Standards
(b)(6) Addresses Piers and Docking Facilities.
(b)(6)(A) requires that piers shall not exceed six feet in width. Piers greater than six feet in
width shall be permitted only if the greater width is necessary for safe use, to improve
public access, or to support a water dependent use that cannot otherwise occur.
Consistent: The proposed pier is 6 foot in width.
(b)(6)(B) requires that the total square footage of shaded impact for docks and mooring
facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline
with a maximum of 2,000 square feet. In calculating the shaded impact, uncovered open
water slips shall not be counted in the total. Projects requiring dimensions greater than
those stated in this Rule shall be permitted only if the greater dimensions are necessary for
safe use, to improve public access, or to support a water dependent use that cannot
otherwise occur. Size restrictions shall not apply to marinas.
Consistent: The proposed pier does not include any platform area.
(b)(6)(F) requires that piers and docking facilities shall be single story. They may be
roofed but shall not be designed to allow second story use.
Consistent: The proposed pier will not be covered.
(b)(6)(G) requires that pier and docking facility lengths shall be limited by:
(i) not extending beyond the established pier or docking facility length along the same
shoreline for similar use; (This restriction does not apply to piers 100 feet or less in length
unless necessary to avoid unreasonable interference with navigation or other uses of the
waters by the public);
Consistent: The proposed pier will be 20 feet which is less than the 100 foot length.
(ii) not extending into the channel portion of the water body; and
Consistent: The proposed pier will not extend into the channel portion of the
waterbody.
(iii) not extending more than one-fourth the width of a natural water body, or human -made
canal or basin. Measurements to determine widths of the water body, canals or basins shall
be made from the waterward edge of any coastal wetland vegetation that borders the

water body. The one-fourth length limitation does not apply in areas where the U.S. Army
Corps of Engineers, or a local government in consultation with the Corps of Engineers, has
established an official pier head line. The one-fourth length limitation shall not apply when
the proposed pier is located between longer piers or docking facilities within 200 feet of
the applicant's property. However, the proposed pier or docking facility shall not be longer
than the pier head line established by the adjacent piers or docking facilities, nor longer
than one-third the width of the water body.
Consistent: The proposed pier will extend 20 feet which is less than the Y/4 width of
the waterway which is 2,283.5 feet.
(b)(6)(I) requires that piers and docking facilities shall not interfere with the access to any
riparian property and shall have a minimum setback of 15 feet between any part of the pier
or docking facility and the adjacent property owner's areas of riparian access. The line of
division of areas of riparian access shall be established by drawing a line along the channel
or deep water in front of the properties, then drawing a line perpendicular to the line of the
channel so that it intersects with the shore at the point the upland property line meets the
water's edge.
Consistent: The proposed pier will remain outside of the 15 foot setback.
(b)(7) Addresses Bulkheads.
(b)(7)(A) requires that bulkhead alignment, for the purpose of shoreline stabilization, shall
approximate the location of normal high water or normal water level.
Possible Inconsistency: The proposed bulkhead is to be placed an average of 4.75
feet below Normal Water Level.
(b)(7)(B) requires that bulkheads shall be constructed landward of coastal wetlands in
order to avoid significant adverse impacts to the resources.
Consistent: The propose bulkhead will not impact any coastal wetland areas.
(b)(7)(C) requires that bulkhead backfill material shall be obtained from an upland source
approved by the Division of Coastal Management pursuant to this Section, or if the
bulkhead is a part of a permitted project involving excavation from a non upland source,
the material so obtained may be contained behind the bulkhead.
Consistent: The applicant has indicated that the fill will be obtained from an upland
commercial location with some existing from a neighboring lot in Long Beach
Estates.
(b)(7)(D) requires that bulkheads shall be permitted below normal high water or normal
water level only when the following standards are met:

(i) the property to be bulkheaded has an identifiable erosion problem, whether it results
from natural causes or adjacent bulkheads, or it has unusual geographic or geologic
features, e.g. steep grade bank, which will cause the applicant unreasonable hardship under
the other provisions of this Rule.
Consistent: The property shows identifiable erosion problems.
(ii) the bulkhead alignment extends no further below normal high water or normal water
level than necessary to allow recovery of the area eroded in the year prior to the date of
application, to align with adjacent bulkheads, or to mitigate the unreasonable hardship
resulting from the unusual geographic or geologic features.
Possible Inconsistency: The erosion on the property looks to have been occurring
since early 2000.
(iii) the bulkhead alignment will not adversely impact public trust rights or the property of
adjacent riparian owners
Consistent: The proposed bulkhead alignment will not adversely affect public trust
rights or adjacent riparian property owners.
(iv) the need for a bulkhead below normal high water or normal water level is documented
by the Division of Coastal Management; and
Consistent: The need for a bulkhead below NWL to maintain a straight alignment is
documented by the Division of Coastal Management.
(v) the property to be bulkheaded is in a non -oceanfront area.
Consistent: The proposed bulkhead is in a non -oceanfront area.
(b)(7)(E) requires that where possible, sloping rip rap, gabions, or vegetation shall be used
rather than bulkheads.
Possible Inconstancy: The proposed development of a bulkhead is to be placed in
front of where there is currently riprap placed for shoreline protection but does
appear to have erosion where the riprap has not properly been maintained
therefore with proper riprap maintenance it may protect the property.
(b)(9) Addresses Groins.
(b)(9)(A) requires that groins shall not extend more than 25 feet waterward of the normal
high water or normal water level unless a longer structure is justified by site specific
conditions and by an individual who meets any North Carolina occupational licensing

requirements for the type of structure being proposed and approved during the application
process;
Consistent: The proposed groins will be 20 feet which is less than the 25 foot
limitation.
(b)(9)(B) requires that groins shall be set back a minimum of 15 feet from the adjoining
riparian lines. The setback for rock groins shall be measured from the toe of the structure.
This setback may be waived by written agreement of the adjacent riparian owner(s) or
when two adjoining riparian owners are co -applicants. Should the adjacent property be
sold before construction of the groin commences, the applicant shall obtain a written
agreement with the new owner waiving the minimum setback and submit it to the
permitting agency prior to initiating any development of the groin;
Consistent: The proposed groins will be more than 15 foot from the riparian
property lines.
(b)(9)(C) requires that groins shall pose no threat to navigation
Consistent: The proposed groins will pose a threat to navigation.
(b)(9)(D) requires that the height of groins shall not exceed one foot above normal high
water or normal water level;
Consistent: The proposed groins will not exceed one foot above normal water level.
(b) (9) (E) requires that no more than two structures shall be allowed per 100 feet of
shoreline unless the applicant provides evidence that more structures are needed for
shoreline stabilization
Consistent: There are only two proposed groins and the shoreline length is 300 feet.
(b)(9)(F) requires that "L" and "T" sections shall not be allowed at the end of groins
Consistent: The proposed groins will not contain any "L" or "T" ends.
07H .0209 Coastal Shorelines
(d) Use Standards. Acceptable uses shall be those consistent with the management objectives in
Paragraph (c) of this Rule. These uses shall be limited to those types of development activities
that will not be detrimental to the public trust rights and the biological and physical functions of
the estuarine and ocean system. Every effort shall be made by the permit applicant to avoid,
mitigate or reduce adverse impacts of development to estuarine and coastal systems through the
planning and design of the development project. In every instance, the particular location, use,
and design characteristics shall comply with the general use and specific use standards for

coastal shorelines, and where applicable, the general use and specific use standards for coastal
wetlands, estuarine waters, and public trust areas described in Rule .0208 of this Section.
Consistent: The development proposal meets the intent of this rule.
(d)(1) requires that all development projects, proposals, and designs shall preserve and not
weaken or eliminate natural barriers to erosion including peat marshland, resistant clay
shorelines, and cypress gum protective fringe areas adjacent to vulnerable shorelines.
Consistent: The proposed development does not weaken or eliminate any natural barriers
to erosion.
(d)(4) requires that the development shall not have a significant adverse impact on estuarine and
ocean resources. Significant adverse impacts include development that would directly or
indirectly impair water quality standards, increase shoreline erosion, alter coastal wetlands or
Submerged Aquatic Vegetation (SAV), deposit spoils waterward of normal water level or normal
high water, or cause degradation of shellfish beds.
Consistent: The proposed development meets the intent of this rule.
(d)(5) requires that the development shall not interfere with existing public rights of access to, or
use of, navigable waters or public resources.
Consistent: The proposed development meets the intent of this rule.
(8) requires that established common-law and statutory public rights of access to the public trust
lands and waters in estuarine areas shall not be eliminated or restricted. Development shall not
encroach upon public accessways nor shall it limit the intended use of the accessways.
Consistent: The proposed development meets the intent of this rule.
(10) requires that within the Coastal Shorelines category (estuarine and public trust shoreline
AECs), new development shall be located a distance of 30 feet landward of the normal water
level or normal high water level, with the exception of the following:
(10)(A) Water -dependent uses as described in Rule 07H .0208(a)(1) of this Section;
Consistent: The proposed development of a boat ramp and its associated driveway is listed
in 07H.0208(a)(1) as water dependent.
Based on my review of the applicable subsections of the North Carolina Administrative
Code, the permit application, and plans, I recommend a Major Permit be issued to Long
Beach Estates Property Owner Association with standard permit conditions.

SUBJECT: Major Permit Request by the Long Beach Estates Property Owners Association
(POA) to construct 271 linear feet of bulkhead with two (2) 10 foot long return walls,
and a 6 foot wide by 20 foot long pier, and replace a 10 foot wide by 20 foot long
boat ramp and two (2) 20 foot long groins on the Perquimans River, and install a
12 foot wide by 119 foot long gravel drive; on Lot #26E in the Long Beach Estates
subdivision, in New Hope, Perquimans County.
DATE: March 19, 2020
Consistency Determination: The request is consistent with/not in conflict with the
Perquimans County / Town of Hertford / Town of Winfall Land
Use Plan (LUP) certified by the CRC on February 10, 2016, as
amended through March 5, 2018.
Overview: The project site consists of a .61 acre lot with 283 linear feet of shoreline along the
Perquimans River. Water depths range from 2.5 feet to 2 feet along the shoreline to 3.5 feet at a
distance of 20 feet from the shoreline. Property elevation is approximately 3.36 feet above Normal
Water Level (NWL) along the shoreline. Vegetation on the lot consists of domestic grasses, trees,
and a bush. The shoreline is located in the AE Floodzone, with the remainder of the property
being outside of a Floodzone.
Existing site improvements consist of two (2) metal swing sets. Existing shoreline improvements
consist of a remnant wooden bulkhead, a dilapidated 10 foot wide by 20 foot long boat ramp with
a connecting drain pipe, two (2) 20 foot long groins and some mooring pilings.
Construction of 271 linear feet of bulkhead with two (2) 10 foot long return walls, and a 6 foot wide
by 20 foot long pier, replacement of the 10 foot wide by 20 foot long boat ramp and two (2) 20
foot long groins,°and installation of a 12 foot wide by 119 foot long gravel drive are proposed. The
bulkhead will be installed an average distance of 4.75 feet below NWL and a maximum of 10 feet.
Approximately 58 square feet of riprap will be installed around the drain pipe alongside the boat
ramp: The gravel driveway will run from the end of the boat ramp to the roadway.

The waters of the Perquimans River in this area are classified as Class SB waters and Coastal
Waters and are closed to shellfish taking. The applicant has stated that they found no submerged
aquatic vegetation (SAVs) within the project area and that there are no historic sites associated
with the property.
Anticipated Impacts resulting from this project are expected to include: the filling of 1,400 sq. ft.
of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC), .35 acre of
Estuarine Shoreline AEC and 588 sq. ft. of High Ground outside of an AEC, and; the shading of
120 sq. ft. of Public Trust Area/Estuadne Waters AEC.
Basis for Determination:
The property is designated as "Residential' on the Perquimans County Future Land Use Map
(FLUM). "Designated conservation/open space areas" are also included within the project area.
As indicated on Page IX-34 "(t)he precise location of protected/regulated areas that have a
conservation or open space connotation such as coastal wetlands, estuarine waters, estuarine
shoreline, pubic trust areas, and Section 404 wetlands must generally be determined by field
investigation on a case by case basis. These areas, scattered throughout the County and
generally found along creeks and rivers, are not individually identified on the future land use map."

burdened with surface waters as a result of such developments."

"Because of water quality concerns, only limited construction will be allowed
within a landward buffer (provided in accordance with locally adopted best
management practices) of the mean high water mark on subdivision lots which
adjoin the Little River, Perquimans River, Yeopim River, the Albemarle Sound,
or their impounded waters and tributaries. The landward buffer shall not
contain any buildings or related structure, such as decks, paved patios, or
utility sheds. The primary use of the area is the growth of natural vegetation
such as a grassed lawn. The only structure permissible within the waterfront
set -back area is an elevated pier of wood construction constructed to provide
access to the water. On -site septic systems and nitrification lines are also
prohibited from the required setback area. The locations of buildings or
related structures, such as decks, paved patios, or utility sheds in. new
developments shall be subject to the more or less stringent provisions of any
applicable State law."

Administrative Code (15 NCAC 7H) for development within the estuarine
system. Generally, only those uses which are water -dependent will be
permitted in coastal wetlands, estuarine waters, and public trust areas.
Examples of permitted water -dependent uses included utility easements,
docks, boat ramps, bulkheads, dredging, bridges and bridge approaches,
revetments, culverts, groins, navigational aids, mooring pilings, navigational
channels, simple access channels, and drainage ditches."

River, and Albemarle Sound. Perquimans County and its towns support
continued management of these shorelines and their attendant wetlands and
shores to protect and preserve the natural resources of the water and
shoreline, relying primarily on the Division of Coastal Management's
permitting and enforcement program of the State's Coastal Area Management
Act (CAMA), the Dredge and Fill Law, and the Federal Coastal Zone
Management Act of 1972 in designated areas of Areas of Environmental
Concern (AEC) Perquimans County and its towns will review, comment,
advocate, or oppose any regulations or programs that may affect the
regulation of river and sound waters and/or shorelines. In their respective
zoning ordinances, Perquimans County and its towns will consider and may
include specific guidance relative to: net developable area calculations should
not include natural hazard areas or areas of environmental concern wherein
development should not occur; that a variety of residential zoning districts
should be considered with varying density and intensity standards and
development requirements; that cluster development should be promoted in
various residential zoning districts; that buffering of various land uses such as
commercial and industrial uses should be included when proposed in or near
residential areas or adjacent thereto; and, that any such approval must be
consistent with LAC #30, page IX-22"

Reference the application of Longbeach Estates for a Department of the Army permit to
construct a replacement bulkhead, boat ramp, and groins, and construct a new dock and access
road to the Longbeach Estates Community Recreation Area, located at Lot 26-E Longbeach
Drive, adjacent to the Perquimans River, near Hertford, in Perquimans County, North Carolina,.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USAGE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
3. Except as specified in the plans attached to this permit, no excavation, fill or mechanized
land -clearing activities shall take place at any time in the construction or maintenance of this
project, in such a manner as to impair normal flows and circulation patterns within waters or

wetlands or to reduce the reach of waters or wetlands. PO P SECTION MHD
. 4. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the.permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
trace.quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
6. The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for reason other than safety.
7. If the permittee discovers any previously unknown historic or archeological remains
while accomplishing the authorized work, he will immediately notify the Wilmington District
Engineer who will initiate the required coordination procedures.
8. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally, the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4).
9. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
10. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

On March 3, 2020, the Washington Regional Office of the Division of Energy, Mineral, and
Land Resources received a copy of your CAMA Major application for a project located at off Long
Beach Drive near Hertford, NC. This project involves the replacement of an existing bulkhead and
boat ramp. Staff review of the plans and specifications has determined that the project, as
proposed, consists of activities that will not pose surface water quality threats from stormwater
runoff. The Director has determined that projects that are reviewed and approved by the Division
as not posing water quality threats from stormwater runoff should not be subject to the stormwater
management permitting requirements of 15A NCAC 2H.1000. For this reason, we are informing
you by way of this letter that the current project will not require a State Stormwater management
permit.
The stormwater rules require the Division to permit the common plan of development,
therefore, any future development on the property, regardless of whether a SEC plan or CAMA
Major permit is also required, will require a Stormwater Management Permit application and
permit issuance from the Division of Energy, Mineral, and Land Resources prior to any
construction. Any construction on the subject site, prior to receipt of the required permit, will
constitute a violation of 15A NCAC 21-1.1000 and may result in appropriate enforcement actions by
this Office.

PROJECT SUMMARY:
The applicant proposes to construct a replacement bulkhead, replace the existing boat ramp
and groins, construct a new dock and add a gravel driveway to the community recreation area
adjacent to the Perquimans River.
Project Setting
The property proposed for development is located between lots 145 and 150 Long Beach
Drive in Perquimans County and consists of approximately 0.61 acres adjacent to the
Perquimans River. The property consists of a remnant wooden bulkhead, dilapidated boat
ramp and groins, two metal swing sets and some mooring pilings. The properties to the north
and south are both residential lots.
Vegetation on the site includes, but is not limited to, indigenous yard grasses, a magnolia tree,
loblolly pines, and groundsel bush. Soil Types include Roanoke Silt Loam (Ro). The property
has an elevation of approximately 3.36 feet above normal water level (NWL) along the
shoreline.
The shoreline is +/- 283 feet in length and has been hardened by riprap and a remnant
bulkhead. The property also contains an existing 10 foot by 20 foot boat ramp, two 20 foot
groins, and two metal swing sets within the 30 foot buffer. The water classification for this area
is Primary Recreational, Salt Water (SB) and are coastal waters that are closed to shellfishing.
The water depths range from 2 feet 6 inches to 2 feet along the bulkhead and boat ramp area.
Development Proposal
The applicant proposes to replace the existing remnant bulkhead with a new 271 foot bulkhead
that contains two 10 foot returns with an average distance of 4.75 feet below normal water level
with a maximum of 10 feet. The old 10 foot by 20 foot boat ramp and two 20 foot groins
will be removed and replaced with new ones of the same dimensions within the existing
footprint. The applicant also proposes to construct a new 12 foot by 119 foot gravel drive
running from the end of the boat ramp to the roadway. The applicant will also be repairing an
existing drain pipe by placing about 58 square foot of riprap around the pipe to control erosion
problems. A new 20 foot by 6 foot pier will be installed level with the proposed groins on the
north side of the boat ramp. The water depth at the terminus of the pier is three and a half
feet.
Anticipated Impacts
The proposed development will result in the shading of 120 square feet and the filling of 1,400
square feet of Estuarine Waters and Public Trust Areas of Environmental Concern. The
proposed development will also result in the filling of 15,084 square feet of Estuarine Shoreline
Area of Environmental Concern. Temporary turbidity will possibly occur during construction.

Long Beach Park Is located between 145 and 150 Long Beach Drive in Long Beach Estates, at the
end of a short access drive named Park Point on the original plat (plat enclosed with application
packet). Long Beach Estates is a residential subdivision located long the Albemarle Sound, in New
Hope Township, Perquimans County. The property is more specifically described as being Lot
ff26-E and has no formal address.
H_istory and Existinit Conditions:
In 1977 Longbeach Land Company deeded the park to a Property Owners association (POA).
Improvements to the property at that time included a boat ramp with 20' wooden groins (on
either side of the ramp), two swing sets and a wooden bulkhead.
Long Beach is located at the mouth of the Perquimans River with 283' of shoreline fronting on
the Albemarle Sound. The width of the waterbody measured at the mouth of the Perquimans
River to Harvey's Point is 1.73 miles and across the Albemarle Sound to Tyrell County is 9.36
miles.
Elevation of the property ranges from 2' above normal water level (NWL) on the north side, 4'-
9" in the center and 3'-4" on the south side of the property for an average elevation of "3.36'.
Vegetation on the property includes, but is not limited to, a variety of grasses, a magnolia tree,
loblolly pines, and groundsel bush.
The adjacent water bottom is a fine sand cluttered with riprap debris. No submerged aquatic
vegetation was found within the proposed work area. While late fall and early winter is not a
favorable time for submerged aquatic growth, no vegetation has been found within the project
area over that past several summers according to the applicant(s) except for green algae on the
bulkhead and boat ramp. The proposed in -water work will be undertaken within an existing
riprap debris field and an existing boat ramp, except for a small pier. The proposed 20' x 6' pier
will not be used for mooring vessels and meets the CAMA General Permit dimensional limitations.
The property is located within the Coastal Waters of the State, are designated as Estuarine
Waters, and are classified as "SB" primary recreation/saltwater. There are no known historical
sites associated with the property.
Proposed Development:
The Long Beach POA would like to make the following improvements to the property for the
community:
1) Replace the failing (and remnant) bulkhead along ^271' of shoreline with two 10'return
walls if needed. The adjacent riparian property owner to the north, Dennis Williams, has
obtained a CAMA General Permit to replace his bulkhead. If agreeable with Mr. Williams,

the park bulkhead will tie into his. The riparian owner to the south (David Watson) is also
planning to replace his bulkhead and has requested that they be constructed at the same
time to form a continuous wall.
2) Replace an existing boat ramp that is "'10' wide (varies by a few inches from place to place)
x 20' (extending from NWL). The ramp will be constructed at a width of 10'-2" within the
existing footprint. The slab will actually be slightly smaller than the original ramp, which
widens at the end to -11'. The 20' x 10'-2" (203.33sf) reinforced slab will be constructed
by one of two methods:
a. Poured on high ground and slide into place between 1" x 6" guides between the
groins, or,
b. poured in place landward of a temporary vinyl cofferdam.
The ramp replacement falls within the dimensional requirements for CAMA General
Permit. The method of construction Is dependent on cost.
3) Replace the remnant wooden groins (on either side of the boat ramp) with vinyl walls at
a height of - 2' above NWL and 20' waterward of the proposed bulkhead alignment.
4) Construct a 12' gravel access drive to the boat ramp ('"119' x 12').
5) Repair existing drainpipe adjacent to the boat ramp by placing riprap around the pipe to
stop ongoing erosion problems. Estimated area is 56sf total as shown on the enclosed site
plan.
6) Construct a new 20' x 6' pier level with the proposed groin on the north side using the
groin pilings as support on the south side of the dock.
7) Relocate swing sets as needed to construct the replacement bulkhead.
8) Backfill brought onto the property prematurely (stockpiled >40' from normal water level
with a silt barrier around the base), along with commercially obtained sand will be used
as backfiil and to grade and dress the bank to an -3'-6" elevation above NWL at the
bulkhead. Metal and tires will be removed prior to the placement of backfiil.
The proposed bulkhead alignment, while greater than a 2' average from NWL, is a reduction in
the original waterward alignment on the south side and will be within an existing riprap debris
field. The plan Is to pull back the debris behind the proposed bulkhead, clean up the water bottom
and encapsulate the riprap behind the proposed bulkhead.
Proposed Impacts:
The following Impacts will result from the proposed development:
1) 1,159sf of shallow bottom will be filled in association with the proposed bulkhead
alignment.
2) 203.33sf of shallow water bottom fill will be placed within the footprint of a pre-existing
boat ramp.
3) 15,084sf of high ground disturbance from bulkhead backfill, anchors, gravel ramp access,
and associated grading of stockpiled dirt. It is anticipated that grading will occur within
the entire 75' AEC and within the gravel ramp access alignment.

AEC and 588sf landward of the 75' AEC).
5) 280sf impervious cover form a concrete ramp apron. The apron will be placed within the
existing apron footprint.
6) 56sf of riprap fill around an existing drainpipe.
7) 120sf of open water shading from the pier.
8) Significant reduction in shallow water bottom debris along the park waterfront.
9) While temporary turbidity is anticipated during construction, the use of a vibratory
hammer and backhoe to install the vinyl sheathing and pilings will help reduce turbidity.
Purpose and Need:
Since being dedicated to the PDA, little to no maintenance has been undertaken on the now
failing bulkhead, ramp and groins. Over the years, as the bulkhead has deteriorated various
owners have deposited ceramic tile, metal, tires, brick and concrete debris along the landward
side of the bulkhead as voids have formed from storms. The entire water bottom between the
remnant bulkhead and the erosion escarpments on the property has riprap debris that has
washed beyond the original alignment. The current Long Beach PDA formed, or "re-formed",
within the last year to take needed action to renovate and protect the community recreation site.
Dumping along the shoreline has made it dangerous for swimming and erosion now threatens
adjacent properties. There is no attempt to gain land or expand the purpose and intent of the
park property. Enclosed photos of the park clearly demonstrate the need to take action to restore
the property.

The NC Department of Environmental Quality hereby gives public notice as
required by NCGS 113A-119(b) that application fora development permit in an AEC as
designated under the CAMA was received on 02/17/20. The Long Beach Estates POA ,
proposes to construct a replacement bulkhead, replace the existing boat ramp and groins,
construct a dock and add a gravel driveway to the community recreation area at Lot 26-
E off Long Beach Drive adjacent to the Perquimans River in Perquimans County.
A copy of the entire application may be reviewed at the office of the Division of
Coastal Management, located at 401 S Griffin St, Ste 300, Elizabeth City, NC, 252-264-
3901 during normal business hours. Comments mailed to Braxton Davis, Director, DCM,
400 Commerce Avenue, Morehead City, NC 28557, prior to 03/31/20, will be considered
in making the permit decision. Later comments will be considered up to the time of permit
decision. Project modification may occur based on review & comment by the public, state

Dear Mr. Wright:
The NC Division of Coastal Management hereby acknowledges receipt of your application
for State approval to replace a bulkhead, boat ramp, groins and construct a dock, add a gravel
driveway to the community recreation area located at Lot 26-E off Long Beach Drive in
Perquimans County.
It was received complete on February 17, 2020 and appears to be adequate for processing at this
time. The projected deadline for making a decision is May 2, 2020. An additional 75-day review
period is provided by law when such time is necessary to complete the review. If you have not
been notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an extended
review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from February 17, 2020, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to
discuss the status of your project. Such a meeting will be held within five working days from the
receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted
at the property of your proposed development. You should post this notice at a conspicuous point
along your property where it can be observed from a public road. Some examples would be:
