This permit, issued on February 14, 2020 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Shoreline Stabilization - Bulkhead 1) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 2) No open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 3) No vegetated wetlands shall be excavated or filled, even temporarily. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Lilly Permit No. 21-20 Page 2 of 4 ADDITIONAL CONDITIONS 4) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within a maximum of 30 days prior to the new expected start of construction. 5) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel 6) The bulkhead shall be constructed prior to any backfilling activities. 7) The bulkhead, shall be structurally tight so as to prevent seepage of backfill materials through the structure. 8) The fill material shall be clean and free of any pollutants except in trace quantities. 9) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 10) No backfill material is to be placed within 30 feet of the normal high-water level, except that which will be used to backfill the area behind the permitted bulkhead. 11) All fill material to be placed below normal high-water level shall be confined behind the permitted bulkhead. Sedimentation and Erosion Control 12) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately follqwing completion of backfrlling activities. Dockine Facility Expansion 13) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility expansion without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 14) No portion of the docking facility shall be constructed waterward of the established Wrightsville Beach pier head line. 15) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be consider iof this permit for which the permittee is responsible. This prohibition shall be applied ce throughout the entire existence of the permitted structure. MAR 2 3 2020 Damon C. Lilly Permit No. 21-20 Page 3 of 4 ADDITIONAL CONDITIONS 16) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 17) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 18) This permit authorizes a maximum of 4 formalized boat slips. 19) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's areas of riparian access. 20) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches are permitted. Lattice is specifically excluded from being used under this authorization. 21) The roof of the gazebo shall not be designed for second story use. 22) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. USACE Conditions 23) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at h=://www.fws.gov/nc-es/mammal/manatee guidelines.ndf. General 24) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 25) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 26) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of ProgruicVgieral Permit 198000291 (Action ID SAW-2019-02264) issued 2/13/20. MAR 2 3 2020 DChlti44HU UTY Damon C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2019-1602. NOTE: Future development of the permittee's property may require a modification of this permit. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high-water level. Salisbury St., Wrightsville Beach, New Hanover County, North Carolina. Coordinates in decimal degrees are: N 34.216242 W - 77.792419. A new approximately 76 linear foot bulkhead will be constructed a maximum of four (4) feet waterward of an existing bulkhead. The reconfigured and expanded dock will include a gazebo, a ramp, two floating docks and a boatlift and will accommodate four (4) boat slips. Impacts from the new bulkhead will include fill of 228 square feet of fill in open water and from the dock will include 584 square feet of shading in navigable waters. Your proposal has been reviewed and found to be consistent with the provisions and objectives of the CAMA-Corps Programmatic Permit process (copy attached) for construction activities that receive authorization from the State of North Carolina. Therefore, you may commence construction activity in strict accordance with applicable State authorization, attached Federal special conditions, and the approved plan. Failure to comply with the State authorization or conditions of the Federal permit could result in civil and/or administrative penalties. If any change in your work is required because of unforeseen or altered conditions or for any other reason, plans revised to show the change must be sent promptly to this office and the North Carolina Division of Coastal Management prior to performing any such change or alteration. Such action is necessary as revised plans must be reviewed and the authorization modified. Your Department of the Army permit will expire on December 31, 2021. Special Conditions 1. For further information, the permittee should contact the U.S. Coast Guard Marine Safety Office at (910) 772-2191. 3. All work authorized by this permit must be performed in strict compliance with the submitted plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. 4. Approval of the structure is based on determinations that there would be no obstruction to navigation. The structure may be damaged by wave wash from passing vessels. Issuance of this permit should not be construed, as relieving the permittee of taking proper steps to insure the structure and moored boats will not be damaged by wave wash. 5. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the N.C. Division of Water Resources at (919) 733-5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. 6. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 7. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 8. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. -3- 9. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion of the work will, without expense to the United States and in such time and manner as the Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre -project condition. 10. Violations of these conditions or violations of Section 404 of the Clean Water Actor Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation. Fixed platform = 20' x 20' = 400 ft Main spine floating dock = 42' x 6' = 252 I(not calculated due to alignment) Shore parallel floating dock= 23' x 8' = 184 112 Total - 584 ftt It is the staffs recommendation that the new bulkhead waterward of an existing bulkhead is potentially CONSISTENT with the Rules of 15 NCAC 7H.0208 (b) (7) (D)(ii) Use Standards for Bulkheads and Shore Stabilization Measures. The bulkhead averages 3' waterward ofNHW, with a maximum of 5' waterward of NHW. The application states the purpose of this new alignment is to "allow the new wall to be squared up to the property". The construction of the additional floating dock at the existing docking facility would provide docking for two (2) additional vessels for a total of four (4) vessels at this location. It appears that the project is CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6), including the '/, width rule, the eight square foot rule and the pier width rule. The proposed structures would be located almost entirely over open water. If the project is determined to be consistent with NCAC 07H .0208(b) (7) (Dxii) use standards for bulkheads and if there are no objections from any of the resource agencies and it is found consistent with all other state and federal requirements, it is recommended that any permit issued should include standard conditions for docking facilities and bulkheads. From the northeast corner of the platform a ramp would lead onto a floating dock measuring 42' in length by 6' in width and would be oriented perpendicular to the shoreline. At the terminus of the float would be another floating dock section measuring approximately 23' in length by Win width oriented parallel to the shoreline and creating an "L" configuration. Along the main spine of the float and within the "L" would be one 16' by 16' boatlift. The facility would be designed to accommodate four (4) vessels in water depths of approximately -4.0 at normal low water (NLW). Impacts include 228 square feet of fill to place the bulkhead and 584 square feet of shading for the dock expansion, in open waters of Sunset Lagoon. Salisbury Street; adjacent to Sunset Lagoon, in the Town of Wrightsville Beach, New Hanover County. To locate the property from the Wilmington Regional Office (WiRO) travel cast on Eastwood Road approximately 3 miles towards Wrightsville Beach. From the AI W W drawbridge, continue to travel east on West Salisbury Street (US HWY 74) for approximately two miles. The property of interest will be located on the left. The property is approximately 0.13 acres with an elevation reported by the applicant of approximately 4'above normal high water (NHW). There is approximately 76' of shoreline frontage along Sunset Lagoon, which is currently stabilized by an old bulkhead. The NHW boundary comes up to the existing bulkhead. There is an area of Coastal Wetlands approximately 2' to 4' waterward of the bulkhead, extending approximately 20' into Sunset Lagoon. There is an existing single family residence on the property with associated decking. Upland vegetation consists of maintained lawn grass. The applicant currently maintains a private docking facility in Sunset Lagoon. An existing fixed pier, measuring approximately 55' in length by 6' in width extends perpendicular to the shoreline into Sunset Lagoon. From the terminus of the pier is a ramp leading to a float measuring approximately 6' in width by 24' in length which is also oriented perpendicular to shore. The existing docking facility currently accommodates up to two (2) vessels in water depths of approximately -4.0' at NLW. It appears through aerial photography review that the existing docking facility was built sometime in the early 1990s. General permit 45940 was issued in 2006 to Martha Reiser (former owner) for replacement of the bulkhead. General permit 63800 was also issued to Ms. Reiser in 2019 for replacement of the floating dock. The Wrightsville Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed. The waters of Sunset Lagoon are classified as SB#, by the NC Division of Water Resources. These waters are NOT designated as Primary Nursery Area (PNA), by the NC Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: 9. The applicant proposes to install a bulkhead waterward of an existing bulkhead, and reconfigure and expand a private docking facility within Sunset Lagoon for a total of four boat slips. A new approximately 76 lincar foot bulkhead (including return walls) would be constructed waterward of the existing bulkhead. The new bulkhead would be located an average of 3' waterward of NHW and a maximum of 4' waterward of NHW and would be landward of all Coastal Wetlands. The area behind the bulkhead would be filled with approximately 38 cubic yards of clean sand fill with the associated tie -back anchor system. A fixed pier measuring 20' in length by 6' in width would extend perpendicular to the shoreline and lead to a new 20' by 20' fixed covered platform. From the northeast corner of the platform a ramp would lead onto a floating dock measuring approximately 42' in length by 6' in width and would be oriented perpendicular to the shoreline. At the terminus of the float would be another floating dock section measuring approximately 23' in length by 8' in width oriented parallel to the shoreline and creating a `L' configuration (see page 2 of 3). Along the main spine of the float, and within the'L' would be one 16' by 16' boat lift. The facility would be designed to accommodate four (4) vessels in water depths of approximately A.0' at normal low water (NLW). 10.
