This permit, issued on January 23, 2020 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation )f these terms may be subject to fines, imprisonment or crvti action, Ur May �aun .... y........ .- -- --- Dockine Facility Expansion 1) This permit authorizes only the docks, piers, tie pilings, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility expansion without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) The authorized structures and associated activity shall not cause an unacceptable interference with navigation, and shall not exceed the established Wrightsville Beach pier head line. (See attached sheets for Additional Conditions) This permit action may be appealed by the permntee or omen qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Permit No. 9-20 Page 2 of 3 ADDITIONAL CONDITIONS 3) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 4) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 6) This permit authorizes a maximum of 4 formalized boat slips. 7) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's areas of riparian access to the northeast. 8) Should Lot to the southeast be sold prior to the initiation of construction of the docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving the 15 foot riparian corridor setback and submit it to the Division of Coastal Management prior to initiating construction of the docking facility. 9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 10) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. USACE Conditions 11) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at http,//www.fws.pov/nc-es/mammal/manatee euidelines.ndf. General 12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 13) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. LTI2 Properties LLC. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, . approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2019-02264) issued 1/14/20. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2019-1600. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the mean high water level. You should also be aware that another qualified party may submit an objection to the issuance of this permit within twenty (20) days. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance requires additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. From time to time, Department personnel will visit the project site. To facilitate this review, we request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance. Lumina Avenue. State Permit No. 9-20 is due to expire on December 31, 2023. The action proposed in your submittal consists of changes to the dimensions of floating docks F4 and F5 and the removal of F6. The permitted dimensions of F4 are 4' by 34' and the proposed new dimensions would be 6' by 35'. The permitted dimensions of F5 are 4' by 40' and the proposed new dimensions would be 6' by 31.67'. The outer mooring piles on the west side would remain in the originally permitted position (see enclosed drawing dated 6/4/2021). Upon review of the information provided, the Division of Coastal Management has determined that the proposed action continues to be consistent with existing State rules and regulations and is in keeping with the original purpose and intent of the permit. I hereby submit this Letter of Refinement authorizing the modification of State Permit #9-20, as described in your request dated May 28, 2021 and drawing dated June 4, 2021. By copy of this letter we are notifying the US Army Corps of Engineers and the Division of Water Resources of our action. Please note this refinement does not alleviate the need to obtain any other local, state or federal permits. If it is a minor mod. we need notifications from the adjacent property owners alerting them to the changes proposed, a check for $100, and a written request for the modification with the drawings. An email request with the drawings you already sent would suffice for that piece. I'll take a closer look either tomorrow or Tuesday and let you know if I think you need to go the major mod. route. The access ramp would connect the northernmost floating dock (F3) (oriented parallel with the access pier/platform) measuring approximately 42' in length by 6' in width creating boat slip #4. Extending south on the landward side of this floating dock approximately 6' feet from the gazebo would be a proposed floating dock (F4)) measuring measuring approximately 34 feet in length by 4 feet in width creating a spine. At the southern end of the floating dock connected perpendicularly would be a proposed floating dock (F5) measuring approximately 40' in length by 4' in width creating boat slip 41. Four tie pilings are proposed approximately 23' to the south from this floating dock (F5). Extending perpendicular to the shoreline approximately in the center of the floating dock spine (F4) would be a proposed floating dock (F6) measuring approximately 26' in length by 4' in width. This middle floating dock would create two slips which would be occupied by two boatlifts. The water depths in the area of the proposed docking facility range from approximately -5' to -1 Vat mean low water level (MLW). Shaded impacts to Shell Island Sound are approximately 1,476 square feet. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. Lumina Ave. in Shell Island Sound also known locally as the Lollipop, adjacent to Middle Sound and the Atlantic Intracoastal Waterway (AIWW). The site is located within the Town of Wrightsville Beach, in New Hanover County. To locate the property, travel east on Eastwood Road (N.C. HWY 74) from Military Cut -Off Road for approximately 1 mile towards Wrightsville Beach. From the drawbridge, continue heading east on Causeway Drive (N.C. HWY 74) approximately 1 mile and proceed to cross the bridge over Banks Channel. Veer left at the light onto N. Lumina and continue to travel north approximately 1.2 miles until you reach the property of interest, which will be on your left. The applicant currently maintains a single-family residence on the project site. The property is adjacent to residential properties with existing single family structures and private docking facilities. Highground vegetation consists of ornamental landscaping. The lot is approximately 29,000 square feet in size and has an average elevation of approximately 5.70' above normal high water (NHW). The project site has approximately 95 linear feet of shoreline frontage stabilized by an existing bulkhead, which meets NHW. There is a patch of Coastal Wetlands consisting primarily of Smooth Cordgrass (Spartina alterniflore), which measures approximately 20' in width and is located at the south of the Riparian Corridor. The applicant currently maintains an existing 3-slip docking facility within Shell Island Sound (see Sheet 1 of 3). An access pier, measuring approximately 50' in length by 6' in width extends in a westerly direction from the existing bulkhead. The pier terminates onto a T-Head covered platform, measuring approximately 19' in length by 19' in width. An access ramp leads from the covered platform onto a floating dock, measuring approximately 20' in length by 10' in width, which runs in the same alignment as the access pier. Adjacent to this floating dock to the north is an existing boat lift measuring approximately 13' in length by 13' in width. Adjacent to this floating dock to the south are two floating docks measuring approximately 17' in length by 11' in width and 15' in length by 9' in width. The existing docking facility meets the Town of Wrightsville Beach's New Pierhead Line which was approved on August 22, 2018 according to the applicant. The Town of Wrightsville Beach Land Use Plan classifies adjacent waters and high ground area of the project site as Conservation. There are no known archaeological sites located in the project vicinity. The waters in the project area are classified SA/ORW by the Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. 10. PROPOSED PROJECT The applicant proposes to reconfigure the existing 3-slip private docking facility by adding floating docks and two boatlifts for a total of 4-slips. Extending from the waterward end of the covered platform would be a proposed fixed access pier/platform (F1) measuring approximately 4' in length by 6' in width (see Sheet 2 of 3). A proposed access ramp (F2) measuring approximately 16' in length by 3' in width would connect to the access pier/platform to the proposed floating docks. The access ramp would connect the northernmost floating dock (F3) (oriented parallel with the access pier/platform) measuring approximately 42' in length by 6' in width creating boat slip #4. ANTICIPATED IMPACTS The proposed expansion of the existing docking facility would incorporate an additional 400 ft' of Estuarine Waters and Public Trust Areas AECs. The proposed 400 ft2 addition of shading impacts to these AECs would meet the 8 square feet per linear foot of shoreline rule (see Sheet 2 of 3), The proposed expansion would encroach into the southern 15' Riparian Corridor Setback, which has been waived by the adjacent riparian property owners the Perkins. The proposed expansion would not encroach into neither the northern 15' Riparian Corridor Setback nor the Town of Wrightsville Beach's Pierhead Line. The proposed expansion would extend approximately 85' into the waterbody, which measures approximately 850' wide from the edges of Coastal Wetlands bordering the waterbody.
