1) Unless specifically altered herein, this permit authorizes the installation of two (2) no wake buoys, all
as expressly and specifically set forth in the attached permit application and workplan drawings.
2) The navigational aids shall conform with any and all appropriate regulations governing such
structures, including but not limited to marking and lighting requirements of the N.C. Wildlife
Resources Commission and/or the U.S. Coast Guard.

4) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

5) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
6) All debris associated with the removal or construction of the permitted development shall be contained
within the authorized project area and removed to an appropriate upland location.
7) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Nationwide Permit 1
(Action ID SAW-2020-01812).

A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has
reviewed the CAMA Permit application for proposed actions that impact fish and fish
habitats. The proposed project is located in Queens Creek, adjacent to the Kingsbridge II
subdivision near the community of Herbert, Onslow County, North Carolina. The applicant
is proposing to install two "No Wake' buoy markers along Queens Creek, as this area is a
designated "No Wake Zone" by applicable regulations. The buoys would be anchored to the
bottom by concrete block.
The proposed project is located within a Primary Nursery Area (PNA), as described by 15A
NCAC 03R.0103(12)(h). Areas designated as PNA are estuarine waters where post -larval
development occurs. Species within this area are early post -larval to juvenile, and utilize
PNAs'for their food, protection, and favorable environmental conditions during vulnerable
periods of their life history. Therefore, DMF would recommend that the proposed work be
restricted to occur outside of the 1 April — 30 September moratorium period.

Comprehensive Land Use Plan Update.
The applicant is proposing to install two no wake zone buoys in Queens Creek that has
been authorized by the NCWRC in Onslow County.
Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PTA.
Waters at the project site are classified as SA and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Onslow County Comprehensive
Land Use Plan and offer the following comments.
The general area of the project is classified as Conservation.
In general, Onslow County allows development in Conservation classified AECs which is
consistent with the State's minimum use standards. The Onslow County Land Use Plan
contains some policies, which exceed the State's minimum use standards. However,
none of these more restrictive policies appear to be applicable to this project.
This project appears to be consistent with the Onslow County Land Use Plan
Update.

9. NARRATIVE DESCRIPTION: The Kingsbridge II HOA project is located in Queens
Creek adjacent to their subdivision near the community of Hubert. There are no SAVs or
oyster rocks in this area and the bottom substrate consists of fine sand with some silt. This
area is classified as SA and is closed to the harvesting of shellfish. It is not a Primary
Nursery Area. This waterbody is classified as conservation in the Onslow Co.LUP.
10. PROJECT DESCRIPTION: The applicant is proposing to install two "No
Wake" markers along Queens Creek. These buoys are labeled as Buoy No. 1 & 2 on the
associated drawings. This area is formally designated as a "No Wake Zone" by 15A NCAC
1 OF .0320.' The No Wake Buoys would be of Standard NCWRC size and markings. They
would be anchored to the bottom by concrete block.
11. ANTICIPATED IMPACTS: Approximately 8ftz of deep bottom benthic habitat would
be disturbed during placement of the concrete anchors for the No Wake Buoys. The
placement of the buoys and associated anchors should,pose no environmental impact. No
impacts to SAVs or wetlands would occur as a result of this project.

Kingsbridge II HOA Association, adjacent to Queens Creek, in Onslow, County. The proposed
project consisted of two no wake buoys within Queens Creek. The proposed project has been
determined to comply with the Rules of the Coastal Resources Commission and as such, a permit
has been issued to authorize the development. I have enclosed a copy of the permit for
reference.
If you wish to contest our decision to issue this permit, you may file a request for a Third Party
Appeal. The Chairman of the Coastal Resources Commission will consider each case and
determine whether to grant your request to file for a Contested Case Hearing. The hearing
request must be filed with the Director, Division of Coastal Management, in writing and must be
received within twenty (20) days of the disputed permit decision.

We hope we are finding you well. We are writing you to object to the current "No Wake Zone" permit
proposal for multiple reasons; please see below.
First, we would like to start off that we would like our community to be considered for a No Wake
Zone but not in accordance to the current survey shared with us for the buoy placements. The reasons
we object to the current proposed placement are as follows:
1. First and foremost, the survey is inaccurate. For instance, where our dock is drawn is on
the corner of our property on the left side and stretches onto the neighboring property at 248
E. Ivybridge Dr. This is inaccurate. Furthermore, the depth of the waterway depicted is
inaccurate as well as the width. In the areas where buoy 2 is proposed to be placed is much
narrower and shallower. As you directed over our phone call in 10/5/20, we will send this
information to the licensing board.
2. The no wake zone letter we received discussed it being for the Kingsbridge 2
community. In its current placement by the survey shared, the no wake zone only extends to a
small portion of the community on Queens Creek and does not account for our fellow
neighbors upstream; many which have docks. Additionally, there are homes being built as we
speak on the water.
3. Upstream, the creek is much wider; we wonder why the buoy would not be placed there?
It would seem more fitting to place it before the wide turn further up the creek.
4. In its current placement, it is center of our yard and does not include our dock. We fear
that our dock along with the marsh that protects our home that has an abundance of wildlife

(e.g. crab) are'going to experience significant damage when the boaters/jet ski/etc. slow down
and/or take off. As of now, many motorists come at high speeds to avoid the shallow spots.
5. Buoy 2 is also a fisherman's favorite spot year-round. We fear what will happen to the
inhabitants of the water in this area.
On a side note, we wanted to inform you that the phone number provider for you by Parker &
Associates for the HOA is inaccurate.

for a Coastal Area Management Act Major Permit to undertake development activities to install
two no wake zone buoys within Queens Creek, in Onslow County.

the standard review time be extended. An additional 75 days is provided by G.S. I I3A-122(c)
which would make February 26, 2021 the new deadline for reaching a decision on your request.

NOTICE OF FILING OF APPLICATION FOR CAMA
The Department of Environment and Natural Resources hereby gives public notice as required
by NCGS 113A-119(b) that an application for a development permit in an Area of Environmental
Concern as designated under the CAMA was received on 9/29/20. According to the application;
Kingsbridge II HOA applied to place two no wake zone buoys in Queens Creek. A copy of the
entire application may be examined or copied at the office of Ryan Davenport, NC Division of
Coastal Management, located at 400 Commerce Avenue, Morehead City, NC, [phone]
during normal business hours. Comments mailed to Braxton C. Davis, Director, Division of
Coastal Management, 400 Commerce Avenue, Morehead City, N.C. 28557, prior to 11/7/20 will
be considered in making the permit decision. Later comments will be accepted and considered
up to the time of permit decision. Project modification may occur based on review and
comment.by the public and state and federal agencies. Notice of the permit decision in this
matter will be provided upon written request.

The NC Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development in Queens Creek. The complete package was received on 9/29/20/20. The
projected deadline for making a decision is 12/13/20. An additional 75-day review period is provided by
law when such time is necessary to complete the review. If you have not been notified of a final action by
the initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional letter
will be provided on or about the 75th day.
