USACE Conditions 4) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at bllps://www.fws.gov/raleigh/pdfs/ManateeGuidelines20l7.pdf General 5) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 6) All debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and removed to an appropriate upland location. 7) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. The proposed project is located in Queens Creek, adjacent to the Kingsbridge II subdivision near the community of Herbert, Onslow County, North Carolina. The applicant is proposing to install two "No Wake' buoy markers along Queens Creek, as this area is a designated "No Wake Zone" by applicable regulations. The buoys would be anchored to the bottom by concrete block. The proposed project is located within a Primary Nursery Area (PNA), as described by 15A NCAC 03R.0103(12)(h). Areas designated as PNA are estuarine waters where post -larval development occurs. Species within this area are early post -larval to juvenile, and utilize PNAs'for their food, protection, and favorable environmental conditions during vulnerable periods of their life history. NARRATIVE DESCRIPTION: The Kingsbridge II HOA project is located in Queens Creek adjacent to their subdivision near the community of Hubert. There are no SAVs or oyster rocks in this area and the bottom substrate consists of fine sand with some silt. This area is classified as SA and is closed to the harvesting of shellfish. It is not a Primary Nursery Area. This waterbody is classified as conservation in the Onslow Co.LUP. 10. PROJECT DESCRIPTION: The applicant is proposing to install two "No Wake" markers along Queens Creek. These buoys are labeled as Buoy No. 1 & 2 on the associated drawings. This area is formally designated as a "No Wake Zone" by 15A NCAC 1 OF .0320.' The No Wake Buoys would be of Standard NCWRC size and markings. They would be anchored to the bottom by concrete block. 11. ANTICIPATED IMPACTS: Approximately 8ftz of deep bottom benthic habitat would be disturbed during placement of the concrete anchors for the No Wake Buoys. First, we would like to start off that we would like our community to be considered for a No Wake Zone but not in accordance to the current survey shared with us for the buoy placements. The reasons we object to the current proposed placement are as follows: 1. First and foremost, the survey is inaccurate. For instance, where our dock is drawn is on the corner of our property on the left side and stretches onto the neighboring property at 248 E. Ivybridge Dr. This is inaccurate. Furthermore, the depth of the waterway depicted is inaccurate as well as the width. In the areas where buoy 2 is proposed to be placed is much narrower and shallower. As you directed over our phone call in 10/5/20, we will send this information to the licensing board. 2. The no wake zone letter we received discussed it being for the Kingsbridge 2 community. In its current placement by the survey shared, the no wake zone only extends to a small portion of the community on Queens Creek and does not account for our fellow neighbors upstream; many which have docks. Additionally, there are homes being built as we speak on the water. 3. Upstream, the creek is much wider; we wonder why the buoy would not be placed there? It would seem more fitting to place it before the wide turn further up the creek. 4. In its current placement, it is center of our yard and does not include our dock. We fear that our dock along with the marsh that protects our home that has an abundance of wildlife (e.g. crab) are'going to experience significant damage when the boaters/jet ski/etc. slow down and/or take off. As of now, many motorists come at high speeds to avoid the shallow spots. 5. Buoy 2 is also a fisherman's favorite spot year-round. We fear what will happen to the inhabitants of the water in this area. On a side note, we wanted to inform you that the phone number provider for you by Parker & Associates for the HOA is inaccurate.
