This permit, issued on December 9, 2013, is subject to compliance with the application and survey drawing dated November 21, 2013, and received by DCM on November 22, 2013 (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject the permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes: Construction of a single family residence with associated parking, driveway, amenities and utilities. (1) All proposed development and associated construction must be done in accordance with the permitted survey drawing dated prepared on November 21, 2013, and received by DCM on November 22, 2013 (2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations, applicable local ordinances and FEMA Flood Regulations. (3) Any change or changes in the plans for development, construction, and/or land use activities will require re-evaluation and modification of this permit. (4) A copy of this permit shall be posted or available on site throughout the construction process. Contact this office at (910) 766-7221 for a final inspection at completion of work. From the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval. This permit may not be transferred to another party without the written approval of the Division of Coastal Name: Lane and Becky Schiffman Minor Permit # NTB13-32 Date: December 9, 2013 Page 2 of 3 (5) With exception of the proposed structural access walkway -and decking, ALL other structure(s) must be set back a minimum of 75 feet from the First Line of Stable Natural Vegetation (FLSNV), as determined by the DCM. With exception of the access walkway and structurally detached ocean side decking, no eaves, cantilevers, pilings, etc. may encroach within 75' from the FLSNV. (6) The permittee is required to contact the Local Permit Officer (910) 796-7221, shortly before he plans to begin construction to arrange a setback measurement that will be effective for sixty (60) days barring a major shoreline change. Construction must begin within sixty (60) days of the determination or the measurement is void and must be redone. (7) Any structure(s) constructed within the Ocean Hazard area shall comply with the NC Building Code, including the Coastal and Flood Plain Construction Standards of the N. C. Building Code, and the Local Flood Damage Prevention Ordinance as required by the National Flood Insurance Program. If any provisions of the building code or a flood damage prevention ordinance are inconsistent with any of the following AEC standards, the more restrictive provision shall control. (8) Any decking located within 75 feet from the FLSNV shall not exceed a combined footprint of 500 sq. ft. and shall be structurally independent (detached) of the residential or primary structure. The deck(s) may be cosmetically attached, but shall remain free standing as a single unit. (9) All buildings must be elevated on pilings with a diameter of at least 8 inches in diameter if round, or 8 inches to a side if square; and the first floor level of the sills and joists must meet the 100-year flood level elevation. (10) All pilings shall have a tip penetration greater than eight feet below the lowest ground elevation under the structure. (11) The total floor area of the permitted dwelling shall not exceed 2,013 square feet, as indicated in the permit application. (12) Dune disturbances will be allowed only to the extent necessary for development and if the dune's protective value is not weakened or reduced. Disturbed dune areas will be immediately stabilized. (13) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Disturbed areas shall be vegetatatively stabilized (planted and mulched) within 14 days of construction completion. (14) Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently threatened by changes in shoreline configuration. The structure(s) shall be relocated or dismantled within two years of the time when it becomes imminently threatened, and in any case upon its collapse or subsidence. However, if natural shoreline recovery or beach renourishment takes place within two years of the time the structure becomes imminently threatened, so that the structure is no longer imminently threatened, then it need not be relocated or dismantled at that time. This condition shall not affect the permit holder's right to seek authorization of temporary protective measures allowed under CRC rules. Riggs and Associates Inc.) submitted a packet of information concerning the above referenced CAMA Minor Permit application package that was initially submitted by Orin O'quin on September 11, 2013. As you are aware, an email was generated and submitted to Mr. O'quin on September 11, 2013, advising Mr. O'quin that the subject minor permit application package was insufficient and additional information was needed in order to process. As a follow up, and in an effort to fulfill our request for additional information, you hand delivered a packet of information to our office on November 12, 2013. The packet you submitted included a set of house plans (prepared by Reece Engineering), a full size copy of the proposed site plan, a small scale version of site plan and an elevation certificate of the property. As I have cited below, as stated in a previous email, the submitted site plans (as referenced above) did not indicate the date of the determination of the First Line of Stable Natural Vegetation (FLSNV), nor did it indicate who made the determination or when it was done. As a result, I sent you an email on November 13, 2013, and stated the following: "Good morning Charles. I received your packet of information dated November 11, 2013, as a follow up to my previous email sent to Orin O'quin requesting additional information on the subject project. Based on the information you provided, it appears the proposed uncovered decking will exceed the 500 sq. ft. allowable limit within the 75'small structure setback. Although the structure is identified as a 'free standing" deck, it must be less than 500 sq. ft. total. As shown, the decking measures 11.5' x 55' (southern deck) and 11.5' x 30' (wrap around portion located on the eastern side of the house) giving a total of 977sq. ft. of decking within and adjacent to the 75'setback. Because the proposed decking is partially located within the setback, the entire structure (deck) counts towards the maximum allowable limit. In other words, any proposed decking that is located outside of the setback, but is structurally attached to decking that is located within the setback will count towards the 500 sq. ft. allowable limit. In order to get this portion of the project approved, the overall size of the decking (combined) will need to be reduced to 500 sq. ft. or less. Additionally, the site plan you submitted shows a "CAMA First Line of Stable Natural Vegetation (to be reviewed)'; however, we (you, myself and Debra Wilson) have already reviewed the First Line of Stable Natural Vegetation and determined the appropriate location (field verified on 10131113). Please show the location of the staked alignment (actual First Line of Stable Natural Vegetation stakes) and provide this information on the site plan. Historically, you have provided this information on your plans." In an attempt to fulfill our request, James Riggs forwarded me a copy of the revised site plan showing the location of a "CAMA First Line of Stable Natural Vegetation JAD 10131113" on November 13, 2013, and showed "triangular" features that I assume denote the location of each of the wooden stakes that indicate the alignment of the FLSNV per the Division of Coastal Management. Additionally, the site plan had been revised to address the other issues related to the size of the proposed ocean side deck which was located within the 75' small structure setback. On November 14, 2013, 1 conducted a follow-up site visit to the subject property and discovered that the alignment shown on the plans you submitted is not the alignment that we agreed to during our on -site meeting held on October 31, 2013. Specifically, the location of the FLSNV along the northern/northeastern side of Lot number 9, bordering lot number 4, that Debra Wilson, you and myself agreed to, has been recorded in a manner that is inconsistent with our on - site determination. In addition to determining the discrepancy with the FLSNV alignment, I also observed (which you can refer to in the attached photo that I took today) several transplanted species of vegetation in the area oceanward of the approved FLSNV. Please note that these transplants do not substitute for natural vegetation, nor shall they be considered when determining the FLSNV. As a result of today's findings, I have placed another wooden stake in the ground, at the location of the FLSNV that we all (Debra Wilson, you and myself) agreed to on October 31, 2013. This wooden stake has been field verified by a Division of Coastal Management representative and has markings which read "FLSNV, 11114113 JAD". At this time, in order to complete the CAMA Minor Permit application package, this stake should be recorded and depicted on an approved site plan. I am attaching a copy of a photo that I took today which shows the alignment that you determined to be the First Line of Stable Natural Vegetation (white pvc with orange ribbon) and the Division of Coastal Management's determination of the FLSNV (wooden stake with pink "CAMA" ribbon which reads "FLSNV, 11/14/13, JAW). The profile view should show the FLSNV, the corresponding setback, the dunes (toe and crest), decks, platforms and/or any other proposed structures. 3. Please provide a certificate of elevation for the proposed property/project. 4. If possible, please provide a set of the subject house plans and/or blueprints. One copy will suffice. Accordingly, I am requesting that you submit the following additional information to this office: On the submitted "Preliminary Plot Plan for: Lane and Becky Schiffman", prepared by Weston Lyall and dated August 4, 2013, a "60' CAMA setback" is shown on the plans. Please note that the "CAMA setback" for this particular area of North Topsail Beach is 75 feet, as measured from the First Line of Stable Natural Vegetation (FLSNV), not 60 feet as shown. Additionally, the FLSNV makes a sharp turn along the eastern side of this property and the setback line will need to follow that contour. Please revise the site plan and re -configure the proposed structures to ensure they do not encroach into the 75' setback. Please provide a cross section or side view profile of the proposed development. The profile view should show the FLSNV, the corresponding setback, the dunes (toe and crest), decks, platforms and/or any other proposed structures. Please provide a certificate of elevation for the proposed property/project. If possible, please provide a set of the subject house plans and/or blueprints. One copy will suffice.
