(5) All structures shall comply with the NC Building Code, including the Coastal and Flood Plain Construction Standards
of the N. C. Building Code, and the Local Flood Damage Prevention Ordinance as required by the National Flood
Insurance Program. If any provisions of the building code or a flood damage prevention ordinance are inconsistent
with any of the following AEC standards, the more restrictive provision shall control.
(6) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Disturbed areas shall be vegetated and stabilized (planted and
mulched) within 14 days of construction completion.
(7) The amount of impervious surface/coverage on this property shall not exceed 25% within 575 feet of the Normal
High Water line.
(8) With exception of the deck, boardwalk and landscaping (including rip -rap), and unless specifically allowed in 15A
NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing, all development/construction shall be located a
distance of 30 feet landward of Normal High Water.
(9) The permittee is required to contact the Local Permit Officer (910) 796-7221, shortly before he plans to begin
construction to arrange a setback measurement that will be effective for sixty (60) days barring a major shoreline
change. Construction must begin within sixty (60) days of the determination or the measurement is void and must
be redone.
(10) Pursuant to 15A NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise
disposed of to a third -party.
(11) All conditions of the original permit issued on July 22, 2013, shall be adhered to, unless otherwise approved by the
N.C. Division of Coastal Management.
(12) The placement of all rip -rap material shall be located landward of the normal high water line.

Permit Number
as authorized by the State of North Carolina, Department of Environment,
and Natural Resources and the Coastal Resources Commission for development
in an area of environment concern pursuant to Section 113A-118 of the
General Statutes,. "Coastal Area Management"
Issued to Frank Francin authorizing development in both the Estuarine Shoreline (ORW) Area of Environmental
Concern (AEC) at 15 Osprey Drive, in North Topsail Beach, Onslow County as requested in the permittee's modification
request, dated December 2, 2013 and received by DCM on December 2, 2013. This permit, modified on March 3, 2014,
is subject to compliance with the application and site drawing (where consistent with the permit), all applicable
regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a
fine, imprisonment or civil action, or may cause the permit to be null and void.
This permit modification authorizes: The installation of rip -rap material along the shoreline.
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s) dated received by the Division of Coastal Management on December 2, 2013.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at (910) 766-7221 for a final inspection at
completion of work.

This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days of the issuing date. From the date of an appeal, any ,
work conducted under this permit must cease until the appeal is resolved. This 3-M
permit must be on the project site and accessible to the permit officer when the
project is inspected for compliance. Any maintenance work or project Jason Dail

Thanks agoi,n for your potiencewith tl?is permit. ! "lave Uttached the originally
approved sketch with 'Y' marking the location for the additional rip -rap. 1 do not
have an exact amount of rip -rap to be installed, only that it will be placed as
needed to ensure minimum erosion... and it will be located along the perimeter
marked by the pink flags installed this past summer. 1 have left those original
markers intact so that 1 do not enter the wetlands...
Also, please find the proof of mailings for both adjacent property owners.
Please let me know the permit modification request is in process...
