as authorized by the State of North Carolina, Department of Environment,
and Natural Resources and the Coastal Resources Commission for development
in an area of environment concern pursuant to Section 113A-118 of the
General Statutes, "Coastal Area Management"
Issued to Frank Francinauthorizing development in both the Estuarine Shoreline (ORW) Area of Environmental
Concern (AEC) at 15 Osprey Drive, in North Topsail Beach, Onslow County as requested in the permittee's application
package, dated July 1, 2013 and received by DCM on July 1, 2013. This permit, issued on July 22, 2013, is subject to
compliance with the application and site drawing (where consistent with the permit), all applicable regulations and
special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment
or civil action, or may cause the permit to be null and void.
This permit authorizes: Construction of a deck and boardwalk and installation of landscaping.
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s) dated received by the Division of Coastal Management on July 16, 2013.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at (910) 766-7221 for a final inspection at
completion of work.
(Additional Permit Conditions on Page 2)
This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days of the issuing date. From the date of an appeal, any
work conducted under this permit must cease until the appeal is resolved. This
permit must be on the project site and accessible to the permit officer when the
project is inspected for compliance. Any maintenance work or project
modification not covered under this permit, require further written permit
approval. All work must cease when this permit expires on:

(5) All structures shall comply with the NC Building Code, including the Coastal and Flood Plain Construction Standards
of the N. C. Building Code, and the Local Flood Damage Prevention Ordinance as required by the National Flood
Insurance Program. If any provisions of the building code or a flood damage prevention ordinance are inconsistent
with any of the following AEC standards, the more restrictive provision shall control.
(6) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Disturbed areas shall be vegetated and stabilized (planted and
mulched) within 14 days of construction completion.
(7) The amount of impervious surface/coverage on this property shall not exceed 25% within 575 feet of the Normal
High Water line.
(8) With exception of the deck, boardwalk and landscaping, and unless specifically allowed in 15A NCAC 07H.
0209(d)(10), and shown on the permitted plan drawing, all development/construction shall be located a distance of
30 feet landward of Normal High Water.
(9) The permittee is required to contact the Local Permit Officer (910) 796-7221, shortly before he plans to begin
construction to arrange a setback measurement that will be effective for sixty (60) days barring a major shoreline
change. Construction must begin within sixty (60) days of the determination or the measurement is void and must
be redone.
(10) Pursuant to 15A NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise
disposed of to a third -party.

Hey Jason...... hope all is well by you. I finally figured out the scanner on my end and have attached the revised
landscape plan for your review. I made a few minor changes to assure overall accuracy, but most importantly/
have re -measured just about everything per your request. The open deck is less than the 200 square foot limit
(item F) and the walkways will give me the necessary access to all areas. 1 do not see any DENR limitation to
square footage for walkways (item D), so 1 believe that my drawing is in full compliance. The fire -pit is also
beyond the 30 foot mark.
After meeting with Tara last week, I will also follow through with our discussions to replace the silt fence with
an erosion -control landscape border sometime after the sandmulch has stabilized.
Above all else, please keep in mind that the unexpected expense 1 am incurring is due to the significantly
negative environmental impact on this area, which was caused by both natural and man-made erosion from
my neighbor's lot. 1 was not really aware of the actual amount of continual erosion of both sand and soil from
my back yard until 1 had lost the majority of trees and beach front. 1 did not realize that the soil and sand from
my backyard was continually eroding into the oyster beds of Alligator Bay because my access to the backyard
was blocked. When 1 was able to actually see the damage, 1 began the process of stabilizing my backyard by
restoring the lost sand and soil, and now with a significant investment into a seawall, rip -rap, landscaping and
other erosion controls, 1 will be able to protect and enjoy the natural environment of the waterway as well as
eliminate future deterioration of my property.
1 would expect that you will continue to assist me in following DENR protocol, while also accepting my genuine
intentions to protect both the natural environment as well as my property and therein allow me to proceed
immediately with this project. Please let me know if 1 can provide any further information......

Frank,
I am including below a list of exceptions to our 30' Coastal Shoreline Buffer. If you plan to develop the area in excess of
what is identified below, you will need to seek approval through our variance process.
Essentially, the "arbor" is not a permissible structure if it's located within 30' of the normal high water level. Same
applies to all of the decking/walkways you have shown on the revised plan dated amended 7/10/13. Your arguments for
allowance of the arbor have been heard numerous times with our Commission, with a mixed response. Unfortunately, I
cannot tell you how the Commission will vote on your request, should you chose to proceed down that path. In short,
there are four criteria which have to be met in order for the Commission to consider your plea. They are as you read
below, per 15A NCAC 07J .0701 VARIANCE PETITIONS:
(8) an explanation of why the petitioner believes that the Commission should make the following findings, all of which
are necessary for a variance to be granted:
(A) that unnecessary hardships would result from strict application of the development rules, standards, or orders issued
by the Commission;
(8) that such hardships result from conditions peculiar to the petitioner's property such as the location, size, or
topography of the property,
(C) that such hardships did not result from actions taken by the petitioner; and
(D) that the requested variance is consistent with the spirit, purpose and intent of the Commission's rules, standards or
orders; will secure the public safety and welfare, and will preserve substantial justice.
The walkways, in addition to the open, uncovered deck, shall not exceed a footprint greater than 200 square feet.
However, if you need a boardwalk to access the proposed deck, you may have a walk no more than 6' in width.
Additionally, the fire pit will need to be relocated so that it is outside of the 30' Coastal Shoreline Buffer (as measured
from NHW).
Lastly, I will need dimensions for everything you propose. This includes and walkway leading to the proposed deck.
Here are the Rules pertaining to the 30' Coastal Shoreline buffer per 15A NCAC 07H .0209 COASTAL SHORELINES.
(d)(10) Within the Coastal Shorelines category (estuarine and public trust shoreline AECs), new development shall be
located a distance of 30 feet landward of the normal water level or normal high water level, with the exception of the
following:
(A) Water -dependent uses as described in Rule 07H .0208(a)(1) of this Section;
(8) Pile -supported signs (in accordance with local regulations);
(C) Post- or pile -supported fences,
(D) Elevated, slatted, wooden boardwalks exclusively for pedestrian use and six feet in width or less. The boardwalk may
be greater than six feet in width if it is to serve a public use or need, 17
(E) Crab Shedders, if uncovered with elevated trays and no associated impervious surfaces except those necessary to
protect the pump;
(F) Decks/Observation Decks limited to slatted, wooden, elevated and unroofed decks that shall not singularly or
collectively exceed 200 square feet,
(G) Grading, excavation and landscaping with no wetland fill except when required by a permitted shoreline stabilization
project. Projects shall not increase stormwater runoff to
adjacent estuarine and public trust waters,
(H) Development over existing impervious surfaces, provided that the existing impervious surface is not increased and the
applicant designs the project to comply with the intent of the rules to
the maximum extent feasible;

Hope you survived the 4th of July weekend..... mast people f know were happy to return to work
after getting 4-days off.
Please let me know how to go about getting on appeal started for the pergola over my bock
yard deck. I was told that I am incorrect in calving it a pergola. And also that I should have no
resistance by LAMA to this type of open -slatted arbor since it is consistent with the type of
pervious construction for my location.
Also, I wanted to add another walkway onto the property to allow better access to the 12 x 16-
foot deck while also providing additional support for the seawall.....con I amend the permit
request in process, or start a new request? Do f need to supply a revised sketch to you only, or
also to my neighbors ?

Thanks again for your patience with this permit. I was able to correct everything
that Tara had noted. She visited the property July 9, 2013 and released the stop -
work -order.
I needed to add another walkway onto the property to allow better access to the
12 x 16 foot deck, while also providing improved support for the seawall.....
I also included an open -slatted arbor over the approx 200 square foot deck to be
consistent with the type of pervious construction for my waterfront location. I was
able to locate Rule 15A NCAC..07H .0208 (b) 6 (d,ef).... which would allow me to
construct a boat house up to 400 square feet and have it closed -roofed.
Since the open -slats are over the deck, 1 expect this arbor should not be rejected.
Please let me know if that makes sense...
Please amend the permit request in process.... a revised sketch is attached, with
the additions high -lighted.

CAMA MINOR PERMIT NOTICE
Pursuant to NCGS 113A-119(b), the North Carolina Division of Coastal Management, an
agency authorized to issue CAMA permits in areas of environmental concern, hereby gives NOTICE
that the following applied for CAMA permits on July 1, 2013 in North Topsail Beach, adjacent to
Stump Sound, Onslow County. John & Lois Sutton, proposed to construct an addition and deck onto
the existing dwelling at 7703 8th Ave., and Frank Francin proposed to landscape and construct
walkways at 15 Osprey Dr., adjacent to Alligator Bay. On July 2, 2013 the Town of Carolina Beach
proposed to construct a Hatteras ramp at the entrance to Freeman Park, and to perform beach raking
adjacent to the Atlantic Ocean at Freeman Park and between Harper & Hamlet Avenues, in Carolina
Beach, New Hanover County. These 3 applications may be inspected at the address below. Public
comments received by July 19, 2013 will be considered. Later comments will be accepted and
considered up to the time of permit decision. Project modifications may occur based on further
review and comments. Notice of the permit decision in this matter will be provided upon written
request.
