Permit Class NEW STATE OF'NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission V erm t for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 Excavation and/or filling pursuant to NCGS 113-229 Permit Number 86-20 Issued to John Kilian,162 Greensboro St., Supply, NC 28462 Authorizing development in Brunswick County at adj. to the a man-made canal system and AIW W, at 162 Greensboro St., in Holden Beach , as requested in the permittee's application dated 5/27/20, including attached workplan drawings (2), Pages 2-3 of 3 dated 6/2/20. This permit, issued on August 13, 2020 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation if these terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) This permit authorizes only the docks, boatlifts, piers, platforms, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. - All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee John Kilian Permit No. 86-20 Page 2 of 3 ADDITIONAL CONDITIONS 3) The authorized structures and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the established pier headline of adjacent structures. 4) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 5) This permit authorizes a maximum of 3 formalized boat slips. 6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner to the east area of riparian access. 7) Should the property to the west of the applicant be sold prior to the initiation of construction of the docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving the minimum setback, and authorizing the construction of a portion of the docking facility within the property owner's riparian setback, and submit this authorization to the Division of Coastal Management prior to initiating construction of the docking facility. 8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 9) The authorized structures and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. General 10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 11) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 13) All debris associated with this development shall be contained within the authorized project area and removed to an appropriate upland refuse disposal site. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 197800056 (Action ID SAW-2020-01035). Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2020-0786. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water. NOTE: An application processing fee of $250 was received by DCM for this project. PROJECT DESCRIPTION The proposed project is located at 162 Greensboro Street, on the feeder canal directly across from the north end of Charlotte Street, on the west end of Holden Beach, Brunswick County. The property can be reached by traveling NC HWY 17 south towards Holden Beach. At the Supply intersection, turn left onto NC 211 S. Travel .3 miles down NC 211 S and turn right onto Stone Chimney Road SW. Drive down Stone Chimney Road for 5.5 miles and continue onto Old Ferry Connection SW for 1.1 miles. Turn right onto Sabbath Home Road SW and then take the next left onto NC 130 E towards Holden Beach. Travel over the Holden Beach bridge and take a right onto Ocean Blvd W. Continue for 1.8 miles and take a right onto Greensboro Street. Drive .8 miles and the project location will be located on the right hand side. Existing structures on the project site include a single family residence and a private two (2) slip docking facility located on the south side of the property. The existing docking facility includes a 7' wide x 20' long fixed platform, an 8' wide x 16' long floating dock, and a 12.5' wide x 12.5' long boatlift. The project site is approximately .12 acres and is vegetated primarily with domestic grasses and ornamental landscaping. The high ground portion is elevated approximately 5' above the normal high water (NHW) level, and the shoreline 50 linear feet) is stabilized by bulkhead. There are no Coastal Wetlands within the riparian corridor of the applicant's property. The applicant's property sits on a feeder canal, directly across from the north end of Charlotte Street. Residential properties border the project site to the east and west, Greensboro Street borders the north, and the feeder canal borders the south side of the property. The width of the feeder canal measures approximately 92' feet at the proposed project site. The waters of the canal system are classified SA by the Division of Water Quality and ARE NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. Based on visual observations made by DCM staff during the June 2020 site visit, there appears to be NO Submerged Aquatic Vegetation (SAV) in the surrounding waters. Water depths at the waterward end of the proposed boatlift is approximately -3.P relative to MLW. PROPOSED PROJECT The applicant proposes to install a second boatlift and increase the dimensions of the existing fixed platform and floating dock, increasing the total slip count from two (2) to three (3) in the Holden Beach canal system. The applicant proposes to build a new boatlift on the western side of the property in the east -west feeder canal. The existing 7' wide x 20' long fixed platform would be extended out an additional 4 ft. towards the canal. The new 11' wide x 20' long fixed platform and would not encroach into the eastern riparian setback. The existing floating docking would also be increased from 8' wide x 16' long to 8' wide x 20' long and would not encroach into the eastern riparian setback. ANTICIPATED IMPACTS The proposed docking facility would incorporate approximately 536.25 sq. ft. of Estuarine Waters and Public Trust Area. The docking facility would remain consistent with similar pier length requirements (established pier -head line). The proposed docking facility would not encroach into the 15-foot riparian corridor setback of the eastern property owner and a waiver has been obtained for the western riparian corridor setback. Minor increases in turbidity should be expected during piling installation.
