Permit Class 'NEW Permit Number 11-20 STATE OF NORTH CAROLINA Department of Environmental Quality and O� Coastal Resources Commission �a V e r m for X Major Development in an Area of Environmental Concern pursuant to NCGS I I3A-118 X Excavation and/or filling pursuant to NCGS 113-229 Issued to Mark Jenner, 816 Majestic Ct., Chesapeake VA 23330 Authorizing development in Pasquotank County at adj. to Little River. at 507 Dances Bay Rd.. in Elizabeth City , as requested in the permittee's application dated 9/19/19 (MI'm 1, MP-4) and 8/27/19 (MP-2), including attached_workplan drawings (2), Sheets 1 and 2 of 2 dated 9/17/19. This permit, issued on January 23, 2020 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation it uresc tcrms may oe suolect to nnes, imprisonment or civil action; or may cause the permit to be null and void. Shoreline Stabilization — Bulkhead and Wetland Fill 1) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 2) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 3) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. (See attached sheets for Additional Conditions) i ms permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Davis, Director Division of Coastal Management This permit and its conditions are hereby accepted. of Permittee Mark Jenner Permit No. 11-20 Page 2 of 3 ADDITIONAL CONDITIONS 4) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 5) The bulkhead shall be constructed prior to any backfilling activities. 6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 7) The fill material shall be clean and free of any pollutants except in trace quantities. 8) No backfill material is. to be placed within 30 feet of the normal water line, except that which will be used to backfill the area behind the permitted bulkhead. Sedimentation and Erosion Control 9) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. Docking Facility 10) This permit authorizes only the docks, piers, tie pilings and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 11) No portion of the docking facility shall be constructed more than 220 feet waterward of the waterward edge of the existing bulkhead. 12) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 13) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible. during hours of darkness or inclement weather. 14) This permit authorizes a maximum of 2 formalized boat slips. 15) The authorized covered gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches are permitted. Lattice is specifically excluded from being used under this authorization. Mark Jenner Permit No. 11-20 Page 3 of 3 ADDITIONAL CONDITIONS 16) The roof of the covered gazebo shall not be designed for second story use. 17) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General 18) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 19) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having if transferred to a third parry. 20) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2019-02301) issued 1/23/20. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 19-1397. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. The property is located at 507 Dances Bay Road, Elizabeth City, Pasquotank County adjacent to the Little River. The development proposal involves the Public Trust Area (PTA), Estuarine Shorelines (ES), Public Trust Shorelines (PTS), and Estuarine Waters (EW) Areas of Environmental Concern. I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project and my findings are as follows: 15A NCAC 07H .0208 USE STANDARDS (a) addresses General Use Standards, and subparagraph (1) requires that uses which are not water dependent shall not be permitted in coastal wetlands, estuarine waters, and public trust areas. Restaurants, residences, apartments, motels, hotels, trailer parks, private roads, factories, and parking lots are examples of uses that are not water dependent. Uses that are water dependent include: utility crossings, wind energy facilities, docks, wharves, boat ramps, dredging, bridges and bridge approaches, revetments, bulkheads, culverts, groins, navigational aids, mooring pilings, navigational channels, access channels and drainage ditches. Consistent: The development will have minimum adverse effects on life cycles or estuarine resources. (a)(2)(G) requires that the development shall not jeopardize the use of the waters for navigation or for other public trust rights in public trust areas including estuarine waters. (b) Specific Use Standards --- ----- (b)(6) Addresses Piers and Docking Facilities. ----- = -- (b)(6)(A) requires that piers shall not exceed six feet in width. Piers greater than six feet in width shall be permitted only if the greater width is necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. - Consistent: The proposed pier is 6 foot in width. (b)(6)(B) requires that the total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the total. Projects requiring dimensions greater than those stated in this Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Size restrictions shall not apply to marinas. Consistent: The proposed covered platform will provide 400 square feet of shaded area. The shoreline along the project area is 193 feet which allows for the maximum 1,544 square feet of shaded area and the shaded impacts will only be 400 square feet (b)(6)(F) requires that piers and docking facilities shall be single story. They may be roofed but shall not be designed to allow second story use. Consistent: The proposed pier and covered platform will be single story. (b)(6)(G) requires that pier and docking facility lengths shall be limited by: (i) not extending beyond the established pier or docking facility length along the same shoreline for similar use; (This restriction does not apply to piers 100 feet or less in length unless necessary to avoid unreasonable interference with navigation or other uses of the waters by the public); Consistent: The proposed pier will be 200 feet which is shorter than the existing pier line length of 220 feet. (ii) not extending into the channel portion of the water body, and Consistent: The proposed pier will not extend into the channel portion of the waterbody. (iii) not extending more than one-fourth the width of a natural water body, or human -made canal or basin. The one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier head line. The one-fourth length limitation shall not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. However, the proposed pier or docking facility shall not be longer than the pier head line established by the adjacent piers or docking facilities, nor longer than one-third the width of the water body. Consistent: The proposed pier will extend 200 feet which is less than the'/4 width of the waterway which is 1,256 feet. (b)(6)(1) requires that piers and docking facilities shall not interfere with the access to any riparian property and shall have a minimum setback of 15 feet between any part of the pier or docking facility and the adjacent property owner's areas of riparian access. The line of division of areas of riparian access shall be established by drawing a line along the channel or deep water in front of the properties, then drawing a line perpendicular to the line of the channel so that it intersects with the shore at the point the upland property line meets the water's edge. Consistent: The proposed pier will remain outside of the 15 foot setback. (b)(7) Addresses Bulkheads. (b)(7)(A) requires that bulkhead alignment, for the purpose of shoreline stabilization, shall approximate the location of normal high water or normal water level. Possible Inconsistency: The proposed bulkhead is to be placed an average of 6 foot below Normal Water Level. (b)(7)(B) requires that bulkheads shall be constructed landward of coastal wetlands in order to avoid significant adverse impacts to the resources. Consistent: The propose bulkhead will not impact any coastal wetland areas but will impact noncoastal wetlands. (b)(7)(C) requires that bulkhead backfill material shall be obtained from an upland source approved by the Division of Coastal Management pursuant to this Section, or if the bulkhead is a part of a permitted project involving excavation from a non upland source, the material so obtained may be contained behind the bulkhead. Consistent: The applicant has indicated that the fill will contain clean sand from an upland location. Consistent: The property shows identifiable erosion problems. (ii) the bulkhead alignment extends no further below normal high water or normal water level than necessary to allow recovery of the area eroded in the year prior to the date of application, to align with adjacent bulkheads, or to mitigate the unreasonable hardship resulting from the unusual geographic or geologic features. Possible Inconsistency: The area that cuts in on the property has had minor erosion but has been in this alignment since the late 90's. (iii) the bulkhead alignment will not adversely impact public trust rights or the property of adjacent riparian owners Possible Inconsistency: The proposed bulkhead may result in increased erosion on the adjacent riparian property owner's property to the west, which is riprapped but not bulkheaded. (iv) the need for a bulkhead below normal high water or normal water level is documented by the Division of Coastal Management; and Consistent: The need for a bulkhead below NWL to maintain a straight alignment is documented by the Division of Coastal Management. (v) the property to be bulkheaded is in a non -oceanfront area. Consistent: The proposed bulkhead is in a non -oceanfront area. (b)(7)(E) requires that where possible, sloping rip rap, gabions, or vegetation shall be used rather than bulkheads. Possible Inconstancy: The proposed development of a bulkhead is to be placed in front of where there is currently a riprap revetment that is mostly below NWL but does appear to have some erosion behind a failed section of riprap therefore maintaining the current riprap revetment may protect the property. DATE: October 21, 2019 Consistency Determination: The request is consistent with/not in conflict with the Pasquotank County/Elizabeth City 2004 Advanced Core Land Use Plan (LUP) certified by the CRC on February 9, 2012. Overview: The .84 acre subject property is a vacant residential lot with 193 linear feet of shoreline along the Little River. Water depths range from 1.66 feet at the shoreline to 3.14 feet a distance of approximately 220 feet from the shoreline. Section 404 Wetlands are located along a portion of the shoreline. The property has an elevation of approximately 3 feet above Normal Water Level (NWL) at the shoreline. The lot is primarily vegetated with yard grasses. The property is located within a Floodzone. Existing site improvements consist of a septic system and drainfield. A single family house has been authorized for construction on the property under CAMA Minor Permit 8282019. Existing shoreline improvements consist of narrow riprap revetment along the entire shoreline and a 34 foot section of remnant bulkhead on the westernmost portion of shoreline. Section 404 Wetlands run along 105 feet of the revetment at NWL with the remainder just below NWL. Installation of 194 linear feet of bulkhead and a 6 foot wide by 200 foot long pier with a 20 foot by 20 foot terminus covered platform and four (4) tie pilings is proposed. The bulkhead will be installed an average of 6 feet from NWL and a maximum distance of 31 feet and will include a 25 foot long wing wall along the eastern property line. Backfill and grading will extend approximately 50 feet landward of the bulkhead. Backfill material will consist of clean sand from an offsite location. The pier and tile pilings will create two (2) formalized boat slips. Submerged Aquatic Vegetation (SAV) was not found within the project area. A review of archaeological or historical sites within or adjacent to the project area was not provided. Anticipated Impacts resulting from this project are expected to include: the filling of 1,382 sq. ft. of Section 404 Wetlands within the Estuarine Shoreline Area of Environmental Concern (AEC), 1,508 sq. ft. of Public Trust Area/Estuarine Waters AEC and .12 acre of High Ground within the Estuarine Shoreline AEC, and; the shading of 1,600 sq. ft. of Public Trust Area/Estuarine Waters AEC. Basis for Determination: The project site is shown as "Low Density Residential' on the Pasquotank County Future Land Use Plan Map (FLUPM). All work authorized by this permit must be performed in strict compliance with the attached plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal, relocation, or alteration. Except as authorized by this pennit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 6. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work for reason other than safety. 7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the work authorized by this permit and again upon completion of the work authorized by this permit. 8. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. Proiect Settin The property proposed for development is located at 507 Dances Bay Road in Elizabeth City and consists of 0.84 acres adjacent to the Little River. The property is a vacant lot with a few trees, some 404 wetlands along the shoreline and a wetland toe revetment where minor permit number 8282019 has been issued to construct a single family residence. The property to the west is a residential property and the property to the east is an undeveloped private lot. Vegetation on the site includes, but is not limited to, indigenous yard grasses, Phragmites (Phrgmites australis), and other noncoastal wetland species. Soil Types include Dragston Fine Sandy Loam (DrA). The property has an elevation of approximately 3 feet above Normal Water Level (NWL) along the shoreline. The shoreline is +/-193 feet in length and has been hardened with a narrow riprap revetment. Approximately 105 feet of this revetment is adjoined by USACE 404-wetlands at NWL with the rest just below NWL along the shoreline. A 34 feet section of remnant bulkhead is located on the west side of the property. The water classification for this site is Aquatic Life, Secondary Recreation, Saltwater (SC). The water depths range from 1.66 feet near the riprap to 3.14 feet at the terminus of the proposed pier. Submerged Aquatic Vegetation (SAV) was not found in the project area. Development Pr000sal The applicant proposes to construct 194 feet of new bulkhead out an average of 6 feet from NWL and a maximum distance of 31 feet. The backfill and grading will extend approximately 50 feet landward of the new bulkhead and will fill a +/- 1,382 square foot area of USACE 404-wetlands. The backfill will be brought in from an offsite location consisting of clean sand. In the middle of the property the applicant proposed to construct a 200 foot by 6 foot pierwith a 20 foot by 20 foot "T" end covered platform. On both the east and the west side of the pier, landward of the platform the applicant proposes to place two pilings to create two formalized boat slips. The water depth at the terminus of the proposed pier will be approximately 3 feet. The proposed pier meets the quarter width requirement. No portion of the proposed pier will fall within the 15 foot setback for either of the adjacent riparian properties. Submitted by: Cynthia Rountree Date: October 4, 2019 RECEIVED OCT 0 9 2019 DCM-MHD CITY CAMA Major Narrative 507 Dances Bay Road, Pasquotank County, NC Existing Conditions The Project Site is a 0.84 acre parcel owned by Mr. Mark Jenner and located at 507 Dances Bay Road in Pasquotank County, NC. The site is waterfront, located on the Little River and is upstream from the Albemarle Sound. Until 2019, this was a largely undeveloped residential lot, with the only existing improvements consisting of a shed and shoreline riprap (combination of granite, concrete and bricks). The owner has applied for and received a CAMA Minor Permit on 8/28/2019 (#8282019) for a single- family residential structure. The shed has been demolished and the home is under construction. There is a portion of the shoreline that contains a small amount of Section 404 non -coastal wetlands, dominated by Phragmites spp., that were created by erosion and naturalization over time. This area was delineated by Brian Rubino from Quible and verified by Josh Pelletier from US Army Corps on 8/21/2019. There is also a highly eroded area on the east side of the lot that does not contain wetlands, but is now surface water due to a greater amount of erosion than the 404 wetland area. In this area, the rip rap (former shoreline edge) is in the water and is washed out behind it. A significant amount of this eroded out area occurred in the last calendar year, and all of it occurred between 2012 and present. The Site has an adjacent property to the east that is an undeveloped parcel and an adjacent property to the west that has a single-family residence and bulkheading. Mr. Jenner would like to tie a new bulkhead into the adjacent bulkhead to the west and run a straight line to the eastern lot line (169 ft), where a wingwall would run up the lot line (25 ft). This would result in the backf ill of 1,508 SF below NWL and fill impacts to 1,382 SF of 404 wetlands. This bulkhead follow of is landward of the existing rip rap. The waters to be filled have recently been eroded and the filled bottom consists of broken pieces of debris and unvegetated bottom In addition to the proposed bulkhead and shoreline reclamation, Mr. Jenner proposes to construct a 200 LF by 6-foot pier extending from the center of the proposed bulkhead into the Little River, with a 20-foot by 20-foot roofed platform on the end. This would include two boat slips with 4 tie pilings each. All proposed work is shown on the attached Plan. The end of the platform is landward of the existing pierhead alignment of the nearest pier systems (shown on plan). SAV Survev On Monday August 5th, a qualified environmental scientist along with a surveyor from Quible performed an SAV survey of the Project Area. At least eight transacts were walked from the shoreline out past the waterward limits of the proposed platform. Brian Rubino snorkeled this area to review bottom conditions and to take shallow cores to look for rhizomes (visibility less than 2 ft), and walked the transacts with a steel rake to further sample the bottom. The substrate of the nearshore area was predominately a silty sand with stumps and root systems exposed. There was no rooted SAV or associated rhizomes found within the proposed fill area or anywhere in surface waters adjacent to the Site. Additionally, no ripped up SAV was found in wrack along this shoreline. This is not mapped as a potential SAV area and there has been no evidence suggesting SAV has grown in this area in the recent past.
