This permit, issued on May 6, 2013, is subject to compliance with the application and site drawing dated received April 15, 2013 (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject the permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes: Construction of "Hatteras Ramps" at the beach access sites. (1) All proposed development and associated construction must be done in accordance with the permitted work plat drawings(s) dated received on April 15, 2013. (2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations, applicable local ordinances and FEMA Flood Regulations. (3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. (4) A copy of this permit shall be posted or available on site. Contact this office at (910) 766-7221 for a final inspection at completion of work. (Additional Permit Conditions on Page 2) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. This permit may not be transferred to Name: Town of North Topsail Beach Minor Permit # NTB13-11 Date: May 6, 2013 Page 2 (5) The permittee is required to contact the Local Permit Officer (910) 796-7221, shortly before he plans to begin construction to arrange a setback measurement that will be effective for sixty (60) days barring a major shoreline change. Construction must begin within sixty (60) days of the determination or the measurement is void and must be redone. (6) Any structure constructed within the Ocean Hazard area shall comply with the NC Building Code, including the Coastal and Flood Plain Construction Standards of the N. C. Building Code, and the Local Flood Damage Prevention Ordinance as required by the National Flood Insurance Program. If any provisions of the building code or a flood damage prevention ordinance are inconsistent with any of the following AEC standards, the more restrictive provision shall control. (7) Dune disturbances will be allowed only to the extent necessary for development and if the dune's protective value is not weakened or reduced. Disturbed dune areas will be immediately stabilized. (8) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Disturbed areas shall be vegetatatively stabilized (planted and mulched) within 14 days of construction completion (9) This permit does not authorize any development on property or easements not owned or maintained by the Town of North Topsail Beach. (10) Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently threatened by changes in shoreline configuration. The structure(s) shall be relocated or dismantled within two years of the time when it becomes imminently threatened, and in any case upon its collapse or subsidence. However, if natural shoreline recovery or beach renourishment takes place within two years of the time the structure becomes imminently threatened, so that the structure is no longer imminently threatened, then it need not be relocated or dismantled at that time. This condition shall not affect the permit holder's right to seek authorization of temporary protective measures allowed under CRC rules. The reason we bought in the New River Beach Club was that it was private and only owners of the properties located in this area and respective guests would enjoy the privacy of such land. While we would oppose such public use as to general use because of the legality of such, we welcome a plan executed by your staff which prevents known or unknown problems which could result as to the use of such. For example, the roadway is not designed to accommodate greater traffic or parking in that area. Also, nuisances which may evolve as a result of the public use such as trash, noise, and problems associated with increased traffic. We believe the proposed walkway should be used by the New River Beach Club owners and guests only and not a general public access which violates the covenants of said private community. Spring Break we will be in town to spend Easter at the Beach and would welcome the opportunity to meet with you and your staff to incorporate a plan which meets the legal threshold as to the use while guaranteeing public nuisances do not infringe upon our family use of the home. We are moving there full time in the third quarter of this year and look forward to wo�[JcC town and our neighbors to make the town a true jewel in coastal North Carolina. Faulkner, MPA Interim Town Manager Terrie Woodle Deputy Town Clerk My original letter dated February 26, 2013 (which was enclosed with the letter sent on March 14th) did not indicate that the path and ramp in the New River Beach Club would become a public access. It will remain just as it has been a path to the beach in your development. As I recall, your subdivision has a wall at its entrance and is marked "private." The road in your development is a private road and is not owned or maintained by the State or the Town. The Town has no plans to post Public Beach Access signs near the path and ramp or to allow public parking in your development. As stated in the 2/26 letter the ramps, fencing and vegetation will be installed to prevent foot traffic at many areas of the dune to preserve the dune so that it can one day be recognized by CAMA as a stable frontal dune and the development moratorium can be lifted. Debbie Wilson is going to call our Assistant Director on Monday (he's out today) and confirm whether or not the State needs to be the applicant or if it should be NTB. If the State is determined to be the applicant, we will need something in writing from State Property Office (SPO) authorizing you as the agent. Similarly, someone needs to sign the permit application, whether it be you or SPO. Understandably, we will not know who that is until Monday, when Debbie can speak with Ted, but I just wanted to let you know that are working on getting it in process as fast as possible. In addition to these minor deficiencies, I also need to get some type of work plan drawing showing the dimensions of the hatteras ramps as well as the location of the dune/berm and the proposed sand fence, that is to run atop and along the crest of the dune. Lastly, we'll need confirmation regarding the linear footage of the proposed sand fence. Assuming we can hash out the aforementioned items early next week, and you can provide the remaining items, we will begin preparing the application package for public notice. Faulkner, MPA Interim Town Manager Terrie Woodle Deputy Town Clerk North Topsail Beach Town Staff had a meeting with some of your fellow property owners, the Town's local permitting officer and a compliance and enforcement representative from Division of Coastal Management - CAMA. The purpose of the meeting was to get answers to questions that have been asked about what property owners are able to do on their property after the New River Inlet Channel Realignment Project and what can be done on and around the new man-made dune behind your homes. According to CAMA, no new development can occur seaward of the current vegetation line. If there was development (deck, stairs, walkway, etc.) behind your property at one time and you have proof that it existed prior to the NRI Channel Realignment Project, you will qualify for a repair exemption and can replace what had been there up to your property line. Town Staff learned from the CAMA representatives that property owners will be allowed to place "fill sand" within the current footprint of their structures with a CAMA exemption instead of a permit. The "fill sand" will have to be approved by CAMA (it must be beach quality sand). If you need to place "fill sand" outside of the footprint of your structure you must obtain a permit. Please contact Mr. Jason Dail (910-796-7221 or jason.dail(a.ncdenr.gov) for assistance. The man-made dune and access to the beach is a major concern of the property owners I have spoken to. The dune as it currently exists does not meet CAMA's requirements for a "frontal dune." It would need to be an established dune with vegetation to meet this requirement and it can take between 18 months to 2 years for it to become established. After the dune is established, CAMA may issue permits for wooden crossovers. Another concern is the health of the dune. Without crossovers or marked paths to cross over the dune, the dune will be walked on everywhere by everyone and this will cause weak spots and openings in the dune. A substantial amount of Town funds were spent to create this dune and the Town wants to take measures to protect it. We also need your help to do this — to get the word out about how we all can protect and "grow" the dune. The Town will be installing "Keep off the Dunes" signs on the new dune as soon as possible. The Town also has smaller keep off the dune signs that can be purchased at Town Hall for $5 each. I am proposing that the Town plant sea oats and install sand fence on the dune (March 7, 2013 Board of Aldermen agenda item). CAMA indicated that the Town would be allowed to use sand fencing on the ocean side of the dune to mark off paths. The Town is also looking into installing "Hatteras ramps" which are allowed by CAMA and will be placed at the Town - owned accesses in the man-made dune area (Topsail Reef, Oyster Lane, Port Drive, and the Town owned property in the Beach Club) and one may be installed parallel to River Road (see attached pictures), This will give PgPEIVEI owners and renters access to the ocean at just these points and will prevent people from crossing over VAR 2 0 2013 LMINGTON APR 1 2 2M 2008 Loaaerhead Court Phone (9c1M-52RAMA ✓40 Page 2 of 2 several areas while the dune is getting established. The Town will be staking off the access areas soon. Please start using these as soon as possible to help protect the dune. Staff was asked how property owners can keep people from walking in their backyard. I have proposed that the Town install sand fencing along the crest of the dune and to run it parallel to the beach from the Topsail Reef to the most northern property. The fence will have breaks in the span at the paths/Hatteras ramps, but would otherwise be continuous. This will restrict pedestrian access to the land side of the dune. The planting of vegetation on your property is encouraged and may also be a helpful deterrent for trespassers. The Town will be having a Sea Oat Cost Share Program (50/50) this spring. The rules of the Coastal Resources Commission require that you receive an AEC Hazard Notice and acknowledge that notice in writing before a permit for development can be issued. The Commission's rules on building standards, oceanfront setbacks and dune alterations are designed to minimize, but not eliminate, property loss from hazards. By granting permits, the Coastal Resources Commission does not guarantee the safety of the development and assumes no liability for future damage to the development. Permits issued in the Ocean Hazard Area of Environmental Concern include the condition that structures be relocated or dismantled if they become imminently threatened by changes in shoreline configuration. The structure(s) must be relocated or dismantled within two (2) years of becoming imminently threatened, and in any case upon its collapse or subsidence. The best available information, as accepted by the Coastal Resources Commission, indicates that the annual long -tern average oceah, erosion rate for the area where your property is located is feet per year. The rate was established by careful analysis of aerial photographs of the coastline taken over the past 50 years. -,-also indicate that the shoreline could move as much as feet landward in a major storm. T e flpod waters in a major storm are predicted to be about feet deep in this area. Preferred oceanfront protection measures are beach nourishment and relocation of threatened structures. The applicant must acknowledge this information and requirements by signing this notice in the space below. Permits issued for development in this area expire on December 31 of the third year following the year in which the permit was issued.
