and Natural Resources and the Coastal Resources Commission for development
in an area of environment concern pursuant to Section 113A-118 of the
General Statutes, "Coastal Area Management"
Issued to Scott McGinley, authorizing development in the Estuarine Shoreline - ORW (AEC) at 28 Osprey Drive, in
North Topsail Beach, NC, as requested in the permittee's application, dated January 6, 2012. This permit, issued on
February 13, 2012, is subject to compliance with the application and site drawing (where consistent with the permit), all
applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.
This permit authorizes: General fill activities at 28 Osprey Drive, North Topsail Beach, NC.
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s) dated received on January 10, 2012 and January 18, 2012.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at (910)796-7221 for a final inspection at
completion of work.

This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days of the issuing date. From the date of an appeal, any
work conducted under this permit must cease until the appeal is resolved. This
permit must be on the project site and accessible to the permit officer when ftC `� A Jason Dail

(5) The amount of impervious surface shall not exceed 25% of the lot area within 575 feet of Normal High Water
(Estuarine Shoreline - ORW Area of Environmental Concern).
(6) Unless specifically allowed in 15A NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing, all
development/construction shall be located a distance of 30 feet landward of Normal High Water. No portion of the
roof overhang shall encroach into the 30 ft. buffer.
(7) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of filter cloth must
be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area
has been properly stabilized with a vegetative cover.
(8) Any proposed for grading within the 30' buffer from the Normal High Water must be contoured to prevent additional
stormwater runoff to the adjacent marsh. This area shall be immediately vegetatively stabilized, and must remain in
a vegetated state.
(9) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction
completion.
(10) This permit does not authorize the filling or excavation of any wetlands.

Pursuant to NCGS 113A-119(b), the North Carolina Division of Coastal Management, an
agency authorized to issue CAMA permits in areas of environmental concern, hereby gives NOTICE
that on January 18, 2012, Scott McGinley, applied for a CAMA permit to fill & grass the existing
upland area of property located at 28 Osprey Dr., adjacent to Alligator Bay, in North Topsail Beach,

The site exhibits water bodies with mean high water and wetland criteria as defined in the 1987 wetland delineation
manual. The water bodies on the site include Alligator Bay, a Section 10 Navi able Waterway. and ad'acent wetlands.
This determination is based on a site visit and verification by David E Bailey on 6/2/2011
D. Remarks
The wetland line was delineated and verified by David E Bailey (USACE) and are approximated on the attached man
entitled "Approximate Wetland Field Sketch"
E. Attention USDA Program Participants
This del ineation/determination has been conducted to identify the limits of Corps' Clean Water Act jurisdiction for the
particular site identified in this request. The del ineation/determination may not be valid for the wetland conservation
provisions of the Food Security Act of 1985. If you or your tenant are USDA Program participants, or anticipate participation
in USDA programs, you should request a certified wetland determination from the local office of the Natural Resources
Conservation Service, prior to starting work.

Lou,
I received the CAMA minor permit application, submitted by you on behalf of Scott McGinley, on January 10, 2012. In
order for the Division of Coastal Management to process your request for development, there are some additional items
that need to be addressed/added. They are as follows:
1) The check you wrote was made payable to the Town of North Topsail Beach. Since North Topsail no longer runs
the CAMA permit program, the check needs to be made out to NCDENR.
2) On the site plan drawing, we need to see the following:
- Name of the property owner.
- Property dimensions and names of adjacent property owners.
- Dimensions and location of all existing and proposed structures. Please define the areas where the proposed
fill is being placed (i.e. show the limits of the fill).
- Please label and show the adjacent water body and the normal high water line.
- Please accurately show the location of both the federal ("404" type) and coastal wetlands. This needs to be
confirmed by the US Army Corp of Engineers. The representative with the Corp for North Topsail is David
Bailey @ 910-251-4469. Since this is a fill project located immediately adjacent to federal wetlands, we need
to confirm/ensure that no fill is being placed in the marsh.
- Please show the location of the 575' Area of Environmental Concern (AEC) as measured from the normal
high water line. This is the line/area that triggers the permitting requirement.
Once you have provided the Division of Coastal Management the information requested above, we will resume

This notice is intended to make you, the applicant, aware of the
special risks and conditions associated with development in this
area, which is subject to natural hazards such as storms, erosion
and currents. The rules of the Coastal Resources Commission
require that you receive an AEC Hazard Notice and acknowledge

The Commission's rules on building standards, oceanfront
setbacks and dune alterations are designed to minimize, but not
eliminate, property loss from hazards. By granting permits, the

changes in shoreline configuration. The structure(s) must be
relocated or dismantled within two (2) years of becoming
imminently threatened, and in any case upon its collapse or
subsidence.
The best available information, as accepted by the Coastal
Resources Commission, indicates that the annual long-term
average ocean erosion rate for the area where your property is
located is feet per year.
The rate was established by careful analysis of aerial photographs
of the coastline taken over the past 50 years.
Studies also indicate that the shoreline could move as much as
feet landward in a major storm.
The flood waters in a major storm are predicted to be about
feet deep in this area.
Preferred oceanfront protection measures are beach nourishment
and relocation of threatened structures. Hard erosion control
structures such as bulkheads, seawalls, revetments, groins, jetties
and breakwaters are prohibited. Temporary sand bags may be
authorized under certain conditions.
The applicant must acknowledge this information and requirements
by signing this notice in the space below. Without the proper
signature, the application will not be complete.
SPECIAL NOTE: This hazard notice is required for development
in areas subject to sudden and massive storms and erosion. Permits
issued for development in this area expire on December 31 of the
third year following the year in which the permit was issued.
Shortly before work begins on the project site, the Local Permit
Officer must be contacted to determine the vegetation line and
setback distance at your site. If the property has seen little change
since the time of permit issuance, and the proposed development
can still meet the setback requirement, the LPO will inform you
that you may begin work. Substantial progress on the project
must be made within 60 days of this setback determination, or
the setback must be remeasured. Also, the occurrence of a major
shoreline change as the result of a storm within the 60-day period
will necessitate remeasurement of the setback. It is important
that you check with the LPO before the permit expires for official
approval to continue the work after the permit has expired.
Generally, if foundation pilings have been placed and substantial
progress is continuing, permit renewal can be authorized. It is
unlawful to continue work after permit expiration.
