Upland Development — Single Family Residence with Wetland Fill 1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the homesite, driveway, other associated infrastructure and approximately 191 ftZ of federal Section 404 Wetland Fill, all as expressly and specifically set forth in the attached permit application and workplan drawings. (Sec attached sheet for Additional Conditions) This permit action may be appealed by the pernittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Stormwater Management 4) The Division of Energy, Mineral and Land Resources (DEMLR) has determined this project will require a Stormwater Management permit. The permittee shall receive a Stormwater Management permit from DEMLR prior to the initiation of any construction. Any violation of the permit approved by DEMLR shall be considered a violation of this CAMA permit. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2020-00227). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 20-0189. NOTE: Future development of the permittee's property may require a modification of this permit. River Beach Road Jarvisburg, NC 27947 Dear Ms. Honeycutt: NORTH CAROLINA Environmental Quality April 27, 2020 Subject: Stormwater Approval SW7200110 CAMA Major — Honeycutt Residence Credit for Permeable Pavement Design Currituck County The Division of Energy, Mineral and Land Resources received a copy of your CAMA Major Application for the subject project located at 279 Kilmarlic Club Drive in Powells Point, NC. The proposed project involves the construction of a single family residence and access drive on Lot 131 in the Kilmarlic Club Residential Subdivision which is covered by an existing low density stormwater permit (SW7020914). Because the proposed impervious area exceeded the amount of built -upon area allowed by the existing permit, several options were suggested to meet the requirements of the stormwater rules. After several discussions with your consultants, we received a submittal package on April 17, 2020, along with site plans and supporting information, for a permeable pavement driveway. The proposed permeable pavement system has been designed to meet the Minimum Design Criteria (MDC) found in the Permeable Pavement Chapter C-5 of the State Stormwater Design Manual. This approval, along with the enclosed site plan and supporting information, is for the construction of a single family residence with a permeable pavement driveway. The driveway will be constructed with permeable interlocking pavers with a #57 washed stone base over a clean sand backfill. The system is designed to store approximately a 4.0-inch rain event with a drawn down time of 1.25 days for the required 1.5-inch design storm event. A breakdown of the proposed built -upon area shows 5535-sf for the House and covered decks; 297-sf for the concrete apron; and 2686-sf for the pervious pavement driveway. This approval for the use of permeable pavement to meet the Built -Upon Area (BUA) Credit for the proposed project is contingent on the following conditions: 1. The overall development and built -upon areas are constructed as shown on the approved plans. 2. The permeable pavement system is installed and maintained at the area, elevations and grades shown on the plans. 3. The permeable pavement does not receive any direct, concentrated flow from roofs or other surfaces. 4. The permeable pavement system is operated and maintained according to the attached signed Operation and Maintenance Agreement. A stormwater permit may be required for any modifications or, if the project is not constructed as shown on the approved plans. Failure to obtain a stormwater permit under the above scenarios is a violation of NCGS 143-215.1 and may result in potential enforcement action, including the requirement to apply for and receive a Stormwater Management Permit. Storm Water Narrative Lot 131, Kilmarlic Club To achieve a permissible residential development on the subject lot, situated at 279 Kilmarlic Club Drive, Powells Point in Currituck County, the proposed parcel improvements are subject to a CAMA Major permit application and consequently, review and approval from NCDEQ for impervious site coverages. This storm water narrative is requested by NCDEQ for the use of permeable pavement for the dwellings proposed driveway to satisfy the requirements to meet the BUA (built upon area) credit. The subject lot is in the Kilmarlic Club development which is associated with a state storm water permit SW7060216, specific to the subject lot, it is defined within the existing storm water permit that lot 131 has potential for 30% site coverage or 7,484 square feet. The proposed site improvements impervious site coverages are proposed at 5,832 square feet or 23.2% of the site. Site calculations are provided on the site plan and support the site coverages, storage volumes and drawdown time of the storm water volume stored in the aggregate base of the permeable paver system. Upon inspection, it is determined that the current site exists on sandy loam soils and is void of any significant vertical change across the site. The site has been prepared for development and appears to have some minor fill placed where development is to occur. The site is approved for on -site septic disposal from Albemarle Regional Health Services with loading rates accepted at 0.65 gallons per square foot per day. The design of the permeable driveway is calculated for 1.5 inches of rainwater volume over the driveway surface without other impervious surfaces contributing to the necessary design storage volume in the aggregate below the paver. The aggregate base has 40% void volume, which is used to calculate the aggregate storage capacity. Calculations require that the depth of aggregate is equal to 7.5 inches. The design plan proposes 7.5 inches of aggregate base below the driveway paver. It should be noted that aggregate must be washed and free of fine particles. The designer shall witness the washed aggregate prior to install. The driveway finish surface must be installed per the site plan design grades as the permeable paver design criteria mandates that the aggregate subgrade be installed at 2% or less in slope. Site soils accomplished an infiltration rate of 1 inch per hour on average but for design, a safety factor of 0.5 is used in calculating the permeable paver drawdown time. It is determined that the permeable paver drawdown time frame is expected to occur in 1.25 days for the quality management rain event of 1.5 inches. A drawdown time frame of 3 days or 72 hours is the maximum time duration for permeable paver design. In conclusion, the design and intended function of the proposed driveway permeable paver system appears to meet NCDEQ's requirements and with the project owners conceding to the operation and maintenance requirements and execution of the O&M agreement of the permeable paver system, the criterial of the BUA credit appears to be permissible. As indicated on Page 11-2, the purpose of the Limited Service designation is to provide for primarily residential development at low densities. As indicated on Page 11-1, the purpose of the Conservation designation is to provide for the long-term management and protection of significant, limited, or irreplaceable areas. Proper management is needed to conserve the natural, cultural, recreational, scenic or biologically productive values of these areas. The designation is applied to areas that should not be developed at all (preserved), or if developed, done so in a very limited manner characterized by careful planning and cautious attention to the conservation of environmental features. As indicated on Page 11-2, the standards of the Conservation class shall be applied in accordance with the site specific information made available during special studies and/or the land development process. Definitions of key words are provided on page 9-2. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work for reason other than safety. 7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the work authorized by this permit and again upon completion of the work authorized by this permit. 8. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 9. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 10. Grantor assigns to Beneficiary, in the event of default all rents and profits from the land and any improvements thereon, and authorizes Beneficiary to enter upon and take possession of such lend and improvements, to rent same, at any reesonable rate of rent determined by Beneficiary, and after deducting from any such rents the cost of reletting and collection, to apply the remainder to the debt secured hereby. 4. PARTIAL RELEASE. Grantor shall not be entitled to the partial release of any of the above described property unless a specific provision providing therefor is included in this Deed of Trust. In the event a partial release provision is included in this Deed of Trust, Grantor must strictly comply with the terms thereof. The Grantor covenants that he will keep the Promises herein conveyed in as good order, repair and condition as they are now, reesonable wear and tear excepted, and will comply with all governmental requirements respecting the Premises or their use, and that he will not commit or permit my waste. 6. CONDEMNATION. In the event that any or all of the Premises shall be condemned and taken under the power of eminent domain, Grantor shall give immediate written notice to Beneficiary and Beneficiary shall have the right to receive and collect all damages awarded by reason of such taking, and the right to such damages hereby is assigned to Beneficiary who shall have the discretion to apply the amount so received, or my part thereof, to the indebtedness due hereunder and if payable in installments, applied in the inverse order of maturity of such installments, or to my alteration, repair or restoration of the Premises by Grantor. 7, WARRANTIES. Grantor covenants with Trustee and Beneficiary that he is seized of the Premises in fee simple, has the right to convey the same in fee simple, that title is marketable and free and clear of all encumbrances, and that he will warrant and defend the title against the lawful claims of all persons whomsoever, except for the exceptions hereinafter stated. PROJECT SUMMARY: The applicant proposes to clear, fill, and grade the site to construct a single family dwelling, pool, driveway, and parking area partially within the CAMA Estuarine Shoreline AEC that involves USACE 404-wetland fill landward of the AEC. Project Setting The project is located at 279 Kilmarlic Club Drive, Lot 131, off of SR #1112, Powells Point, Currituck County, N.C. 27966, adjacent to the Albemarle Sound. The property is t 25,121 ft2 (0.58 acres) ih size and has an elevation approximately 5' above NWL. The property has been partially graded with no man made features in the high ground area. Vegetation includes 404-wetlands, yard grasses, and a few remaining trees. The wetlands located on the property have been delineated by the USACE, t1,746 ft2 in size, and is primarily vegetated by Phragmites. The properties shoreline is t 160' and has been hardened though vinyl bulkheading. According to the USDA's Natural Resources Conservation Service's Web Soil Survey, the soil on the property is made up of conetoe loamy sand (CnA). Based on available information, no archaeological sites are on or near this property. The Albemarle Sound is classified as Coastal Waters by agreement with the Marine Fisheries Commission and Wildlife Resources Commission. The Division of Environmental Management's water quality classification for the Albemarle Sound is SB and it is closed to shellfish taking. The adjacent riparian property to the northwest is contains single family dwelling with a bulkheaded shoreline. The adjacent riparian property to the southeast is the Fortune Bay Golf Club. This majority of this parcel is undeveloped. The property contains a large wetland area and has an unhardened shoreline. Development Proposal The applicant proposes to construct a two story single family dwelling with an attached accessory building, a concrete pool, wooden decking and a concrete driveway landward of the CAMA 30' Buffer. This project is projected to include t2,829 ft2 of impervious coverage located within the CAMA 75' AEC (23%). To complete this project, the applicant proposes to fill t 191 ft2 of the existing t1,746 ft2 of delineated USACE 404-wetlands within a depression located landward of the 75' ES AEC. We propose the construction of a single family dwelling with an attached, residential accessory building meeting the restrictions set forth by the Currituck County Zoning Department. The home shall meet all the covenants of the Homeo%vners Association and reflect the aesthetics of this unique community. The allowable buildable footprint for the home is defined by several unalterable conditions: (1) The wetlands. sound front AEC and CAMA setbacks which define not only the house location but also that of the on -site waste truter treatment s}s7em. This system has to meet specific setbacks away from those areas (2) The driveway required to access the house, has to skirt that system, is sized to meet the parking requirements of the Currituck County Zoning Department (3) The Site Plan was designed by House Engineering of Kitty Ilawk. North Carolina, to also manage storm water on the site. This plan was derived considering subsurface soil conditions to allow for the proper absorption of said water within shallow swales (4) These requirements created a "pocket' (See attached Site Plan) into which the house was placed. We have attempted to avoid any infringement of the wetlands on the Northeast corner of the property.
