This permit, issued on March 11, 2020 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility Expansion
1) This permit authorizes only the boatlift and uses located in or over the water that are expressly and
specifically set forth in the permit application. No other structure, whether floating or stationary, shall
become a permanent part of this docking facility expansion without permit modification. No non -
water dependent uses of structures shall be conducted on, in or over Public Trust waters without
permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2023
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's riparian access corridor.
4) This permit authorizes the addition of one (1) formalized boat slip for a total of three (3) formalized boat
slips.
5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
USACE Conditions
7) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

8) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
9) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit
197800056 (Action ID SAW-2020-00239).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2020-0201.

As proposed, the project would be CONSISTENT with the use standards set forth in NCAC

rule. The proposed structures would be located entirely over open water. This office has
NO OBJECTION to the proposed work provided it is consistent with all other state and
federal permitting requirements.
It is recommended that any permit issued should include standard conditions for private
docking facilities.

Dear Mr. Holland:
Through coordination with the North Carolina Division of Coastal Management we have
learned of your request to expand an existing docking facility located at 480 Roberts Road,
adjacent to the AIW W and Topsail Island, in Hampstead, Pender County, North Carolina.
On January 1, 2017, we renewed general permit No. 197800056, (copy enclosed), that
authorizes the maintenance, repair, construction and installation of piers, docks, boathouses and
boat shelters, mooring piles, dolphins, jetties and breakwater structures in navigable waters of the
United States in the State of North Carolina pursuant to Section 10 of the Rivers and Harbors Act
of 1899.
Your work is authorized provided it is accomplished in strict accordance with your
submitted plans, the enclosed general conditions, and the following special conditions:
1. All work authorized by this permit must be performed in strict compliance with the
submitted plans and the revised plans received by DCM on January 14, 2020, which are a part of
this permit.
If any change in your work is required because of unforeseen or altered conditions or for
any other reason, plans revised to show the change must be sent promptly to this office and the
North Carolina Division of Coastal Management prior to performing any such change or
alteration. Such action is necessary as revised plans must be reviewed and the authorization
modified. Your Department of the Army permit will expire on December 31, 2021.

I have reviewed this proposal for consistency with the Pender County Comprehensive
Land Use Plan and offer the following comments.
The general area of the project is classified as Developed and Conservation.
Waters at the project site are classified as SA and are open to the harvesting of shellfish
(adjacent). The area is a Primary Nursery area. Areas of Environmental Concern are EW
and PT.
Pender County allows development in Developed/Conservation classified AECs, which is
consistent with the State's minimum use standards. The Pender County Comprehensive
Land Use Plan contains some policies, which exceed the State's minimum use standards.
However, none of these policies appear to be applicable to this project.
This project appears to be consistent with the Pender County Comprehensive Land
Use Plan Update.

Hey Man, sorry it's taken a few days to get back to you. See below for clarification. Let me know if you need
anything else.
1. The lift is 12' 6" center to center on the width of the pilings and 12' 6" outside to outside on the length of the
piling so I guess you can call it 13 x 13.
2. The owner got the permit for this pier and also did the drawing. He had the gazebo at 17 x 17. This is a hog slat
pier and the pier size is dictated by the size of the slats. The deck area finished at 16 x 17 and with a one foot
overhang on the roof the drip line dimension ends up being 18 x 19.

Your Holland project is my first review so I'm working out the kinks still. I had a few questions on the project that I was
hoping you could clarify for the file.
1. Your project summary, project description, bio report, and Trip's MP4 form all list the lift as a 12' x 12', however,
Trip's project narrative dated 1/12/2020 lists the lift as a 13' x 13'. Can you clarify that the final lift will be 12' x
12'.
2. The listed existing platform area in your recommendations list the total as 609 square feet: a 17' x 17' platform
and a 8' x 40' floating dock. The general permit looks like it has 17' x 17', but both riparian notification forms list
the covered platform as 17' x 18' and the work plan drawings show the platform as 18' x 19'. Can you (1) clarify
that the existing platform is actually 17' x 17' and (2) that the applicant isn't proposing expanding the covered
platform. That way, Jonathan said if it is a reduction in the amount, the riparian notification forms won't have to

be redistributed. And if it isn't proposing to increase past 17' x 17', there won't be an issue with the allowable
platform area/ LF of shoreline.
Let me know if there is anything I'm reading incorrectly or if I missed anything, I'm still trying to get the eye for reviewing
these on the DCM side.

9. PROJECT DESCRIPTION:
The project site is located at 480 Roberts Road, adjacent to the AIWW and Topsail Sound, in
Hampstead, Pender County. To find the property from the Wilmington Regional Office, take
Highway 17 North from Wilmington approximately 12 miles and turn right onto Sloop Point Road
(at the C-Store Gas Station/Subway). Travel approximately 2.1 miles to the intersection of Sloop
Point and Roberts Road. Turn right onto Roberts Road and continue to the end of the road (turns to
gravel/dirt). The subject property will be located at the terminal end of the road at house number
480 (new home construction).
Existing man-made features on the property include a single-family residential dwelling (under
construction) and a private docking facility. High ground vegetation consists of lawn grass and
ornamental shrubs. The high ground portion is elevated approximately 3'-5' above the normal high
water (NHW) level, and the shoreline (+/- 77 linear feet) is stabilized by rip-rap/concrete rubble.
There is a narrow fringe of Coastal Wetlands bordering the property along the eastern shoreline.
Residential properties border the property to the north, south and west and the AIW W and Topsail
Sound border the property to the east.
The existing pier and docking facility were authorized in June 2019 under CAMA General Permit No.
74315-D. The facility is located along the eastern portion of the property and extends
approximately 45' beyond the outer edge of marsh, into a maintained access channel. The facility
consists of a 6' x 20' access pier, 17' x 17' covered platform, 5' x 20' finger pier, 8' x 40' floating dock
and 12' x 16' boatlift (located on north side of the existing finger pier). The existing docking facility
extends approximately 43' beyond the outer edge of marsh, which places the entire structure
within % of the width of the water body and just outside of the existing channel.
The waters of Topsail Sound (adjacent to the project site) are classified as SA by the North Carolina
Division of Water Resources. They ARE designated as a Primary Nursery Area (PNA) by the
North Carolina Division of Marine Fisheries, and they are OPEN to the harvest of shellfish. Based on
visual observations made by DCM staff during the January 2020 site visit, there appears to be NO
Submerged Aquatic Vegetation (SAV) in the surrounding area. Water depths in the vicinity of the
existing facility range from -2' to -6', relative to normal low water (NLW).
PROPOSED PROJECT:
The applicant proposes to expand the existing docking facility by installing a new 12' x 12' boatlift,
creating a total of three (3) boat slips. According to the application package, a new boatlift would be
installed along the north western side of the existing 5' x 20' finger pier, between the finger pier and
the shoreline. The proposed boatlift would provide dockage for a single vessel. The additional lift
would create up to three (3) potential docking spaces, when combined with the existing structures
(existing boatlift and floating dock). The proposed boat lift would not encroach within the 15-foot
riparian corridor setback of either adjacent riparian property owner. Water depths surrounding the
existing floating dock and proposed boat lift average -2.5 to -3.0' during periods of low tide.

10. ANTICIPATED IMPACTS:
The proposed structure would incorporate approximately 144 sq. ft. of Estuarine Waters and Pubic
Trust Area. The boatlift would remain consistent with similar pier length requirements (established
pier -head line) and would be located outside of the federal channel setback. Minor increases in
turbidity should be expected during construction.

119(b) that the following applications were submitted for a development permits in Areas of Environmental
Concern as designated under the CAMA: On January 29, 2020, John Murphy proposed to construct a newfour
(4) slip private docking facility at 224 Waynick Blvd, adjacent to Banks Channel, in Wrightsville Beach, New
Hanover County, on February 4, 2020, Rufus Yates proposed to replace an existing 8'x16' floating dock wl
an 8'x30' floating dock at 94 Wilmington St., adjacent to a man-made canal, in Ocean Isle Beach, Brunswick
County, and on January 14, 2020, Jonathan Holland proposed to expand an existing private docking facility
from two (2) to three (3) slips at 480 Roberts Rd., adjacent to the AIWW/Topsail Sound, in Hampstead, Pender

The Division of Coastal Management hereby acknowledges receipt of your application,
acting as agent for the applicant - Jonathan Holland, requesting authorization under the
Rules of the N.C. Coastal Resources Commission for development activities at 480 Roberts
Road, adjacent to the AIWW and Topsail Sound, in Hampstead, Pender County. It was
received as complete on January 14, 2020 and with exception of the signed certified mail
receipts, it appears to be adequate for processing at this time. The projected deadline for
making a decision on your permit application is March 29, 2020. An additional 75-day
review period is provided by law when such time is necessary to complete the review. if
you have not been notified of a final action by the initial deadline stated above, you should
consider the review period extended. Under those circumstances, this letter will serve as
your notice of an extended review. However, an additional letter will be provided on or
about the 75th day.
If this agency does not render a permit decision within 70 days from January 14, 2020, you
may request a meeting with the Director of the Division of Coastal Management and permit
staff to discuss the status of your project. Such a meeting will be held within five working
days from the receipt of your written request and shall include the property owner,
developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development. You should post this notice
at a conspicuous point along your property where it can be observed from a public road.
Some examples would be: Nailing the notice card to a telephone pole or tree along the road
right-of-way fronting your property; or at a point along the road right-of-way where a
private road would lead one into your property. Failure to post this notice could result in
an incomplete application.
