This permit, issued on March 11, 2020 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility Expansion 1) This permit authorizes only the boatlift and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility expansion without permit modification. No non - water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Jonathan Holland Permit No. 32-20 Page 2 of 3 ADDITIONAL CONDITIONS 3) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor. 4) This permit authorizes the addition of one (1) formalized boat slip for a total of three (3) formalized boat slips. 5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. USACE Conditions 7) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at httv://www.fws.gov/ne-es/mammal/manatee Quidelines.ndf. General 8) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 9) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit 197800056 (Action ID SAW-2020-00239). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2020-0201. I had a few questions on the project that I was hoping you could clarify for the file. 1. Your project summary, project description, bio report, and Trip's MP4 form all list the lift as a 12' x 12', however, Trip's project narrative dated 1/12/2020 lists the lift as a 13' x 13'. Can you clarify that the final lift will be 12' x 12'. 2. The listed existing platform area in your recommendations list the total as 609 square feet: a 17' x 17' platform and a 8' x 40' floating dock. The general permit looks like it has 17' x 17', but both riparian notification forms list the covered platform as 17' x 18' and the work plan drawings show the platform as 18' x 19'. Can you (1) clarify that the existing platform is actually 17' x 17' and (2) that the applicant isn't proposing expanding the covered platform. That way, Jonathan said if it is a reduction in the amount, the riparian notification forms won't have to be redistributed. And if it isn't proposing to increase past 17' x 17', there won't be an issue with the allowable platform area/ LF of shoreline. Let me know if there is anything I'm reading incorrectly or if I missed anything, I'm still trying to get the eye for reviewing these on the DCM side. PROJECT DESCRIPTION: The project site is located at 480 Roberts Road, adjacent to the AIWW and Topsail Sound, in Hampstead, Pender County. To find the property from the Wilmington Regional Office, take Highway 17 North from Wilmington approximately 12 miles and turn right onto Sloop Point Road (at the C-Store Gas Station/Subway). Travel approximately 2.1 miles to the intersection of Sloop Point and Roberts Road. Turn right onto Roberts Road and continue to the end of the road (turns to gravel/dirt). The subject property will be located at the terminal end of the road at house number 480 (new home construction). Existing man-made features on the property include a single-family residential dwelling (under construction) and a private docking facility. High ground vegetation consists of lawn grass and ornamental shrubs. The high ground portion is elevated approximately 3'-5' above the normal high water (NHW) level, and the shoreline (+/- 77 linear feet) is stabilized by rip-rap/concrete rubble. There is a narrow fringe of Coastal Wetlands bordering the property along the eastern shoreline. Residential properties border the property to the north, south and west and the AIW W and Topsail Sound border the property to the east. The existing pier and docking facility were authorized in June 2019 under CAMA General Permit No. 74315-D. The facility is located along the eastern portion of the property and extends approximately 45' beyond the outer edge of marsh, into a maintained access channel. The facility consists of a 6' x 20' access pier, 17' x 17' covered platform, 5' x 20' finger pier, 8' x 40' floating dock and 12' x 16' boatlift (located on north side of the existing finger pier). The existing docking facility extends approximately 43' beyond the outer edge of marsh, which places the entire structure within % of the width of the water body and just outside of the existing channel. The waters of Topsail Sound (adjacent to the project site) are classified as SA by the North Carolina Division of Water Resources. They ARE designated as a Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries, and they are OPEN to the harvest of shellfish. Based on visual observations made by DCM staff during the January 2020 site visit, there appears to be NO Submerged Aquatic Vegetation (SAV) in the surrounding area. Water depths in the vicinity of the existing facility range from -2' to -6', relative to normal low water (NLW). PROPOSED PROJECT: The applicant proposes to expand the existing docking facility by installing a new 12' x 12' boatlift, creating a total of three (3) boat slips. According to the application package, a new boatlift would be installed along the north western side of the existing 5' x 20' finger pier, between the finger pier and the shoreline. The proposed boatlift would provide dockage for a single vessel. The additional lift would create up to three (3) potential docking spaces, when combined with the existing structures (existing boatlift and floating dock). The proposed boat lift would not encroach within the 15-foot riparian corridor setback of either adjacent riparian property owner.
