This permit, issued on June 1, 2020 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Shoreline Stabilization — Revetment and Breakwater
1) The alignment of the toe of rip rap shall not exceed the alignment as depicted in the attached permit
application and workplan drawings.
2) No vegetated wetlands shall be excavated or filled, even temporarily.
3) No open water shall be excavated or filled, even temporarily, outside of the approved revetment and
breakwater alignment.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2023
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
4) The alignment of the authorized revetment and breakwater shall be staked by the permittee and verified
by a representative of the Division of Coastal Management within a maximum of 30 days prior to the
start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by
adverse weather conditions, shall require the alignment to be re -staked by permittee and verified by
DCM within a maximum of 30 days prior to the new expected start of construction.
5) The revetment and breakwater material shall consist of clean rock or masonry materials such as, but not
limited to, granite, marl, or broken concrete. It shall be of a size sufficient to prevent its movement from
the approved alignment by wave or current action.
6) The revetment and breakwater material shall be clean and free of any pollutants except in trace
quantities.
7) If the crossing of wetlands with mechanized construction equipment is necessary, temporary
construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed
immediately upon completion of construction.
8) The height of the permitted breakwater shall not exceed one foot above the normal water level.
9) The breakwater shall have at least one, five-foot opening at every 100 feet.
10) No backfill of the revetment and breakwater or any other filling of wetlands, estuarine waters, public
trust areas or high ground is authorized by this permit unless altered herein.
General
11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
12) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
13) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2020-00670).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 20-0631.

ADDITIONAL CONDITIONS
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that many land disturbing
activities are not authorized within 50 feet of the normal water level unless specifically exempted
by Environmental Management Commission's (EMC) Tar Pamlico buffer regulations in
place at the time of such development.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

The eastern property shoreline has 500 linear feet of rock rip -rap. On the western property shoreline there is 125 feet of
bulkhead with rock rip -rap. There is also a 100' pier with a 8'x20' platform at the bulkhead. There is an existing relic
breakwater located 30'-80' waterward of eastern proeprty shoreline. An exisitng driveway provides acces to the main house
and two guest cottlages. Some of the existing ditch bank is stabilized with a wooden bulkhead.

Purpose of proposed project is to provide additional shoreline stabilization along the shoreline of the Pamlico Sound. The
property will continued to be used as a single family residence.

The rock rip -rap will be trucked in and stored on the vacant lot in the western side of the property adjacent to the Pamlico
Sound and British Cemetery Road. The rock will be carried by small backhoe and distibuted with an excavtor along
shoreline.

Shoreline stabilization along the shoreline is the only activity proposed at this time.

Permit to undertake development activities to construct shoreline stabilization, in Hyde County.
Although processing of the application is nearing completion, additional time is needed for this
office to complete the review and make a decision on your request. Therefore, it is necessary that
the standard review time be extended. An additional 75 days is provided by G.S. I I3A-122(c)
which would make August 10, 2020 the new deadline for reaching a decision on your request.'
However, we expect to take action prior to that time and will do so as soon as possible. In the

This CAMA Major Permit application proposes to construct 1,280ft of rock shoreline stabilization on the
north shore of the property located at 669 British Cemetery Road on Ocracoke Island in Hyde County, North
Carolina. The proposed development includes 780 linear feet of rip -rap placed at NWL along a sandy estuarine
beach with portions being placed below NWL just waterward of existing coastal wetland and 500 linear feet of
offshore breakwater constructed with rip -rap. All sections located below normal water level will have breaks a
minimum of 5ft per 100 linear feet.
Staff has reviewed the proposed project regarding rules found in Subchapter 7H concerning development in
Estuarine Water and Public Trust Areas. It is staff s recommendation that the proposed project appears consistent
with the rules set forth in 15A NCAC 07H.1105 and 15A NCAC 07H.2405 and the application should be permitted
as requested with standard permit conditions.

Consistency Determination: The request is consistent with/not in conflict with the 2008 Hyde County
LAMA Core Land Use Plan certified by the CRC on March 27, 2008.
Project Overview: The project site is located at 669 British Cemetery Rd, Ocracoke, Hyde County, North
Carolina. The 40-acre parcel is developed with a single family residence, two guest cottages, septic system,
driveway, bulkhead, pier, and rip -rap. The property has 2,060 ft. of shoreline, of which 1,280 feet is
undeveloped. Along the western side of the property there is 125 feet of bulkhead and a 100-foot pier,
and along the eastern side of the property there is there are two sections of rip -rap and NWL level in two
sections 260 feet and 240 feet respectively. Also, there is an offshore rock sill on the eastern side of the
property approximately 70 to 100 feet waterward of NWL.
The applicants are proposing to construct 1,280 feet of rock shoreline stabilizations structures in two
sections along the north shore of the property bordering the Pamlico Sound. Approximately 780 linear
feet of the structure will be rip -rap placed at NWL along the sandy estuarine beach or just below NWL
water ward of coastal wetlands. The section located below NWL near the patchy Spartina alternaflora
marsh is proposed to have 5 foot breaks 100 linear foot. These sections are described in the project
drawings as section "A" and "B" respectively. Section "C" will be constructed as a breakwater 500 feet in
length 10 to 30 feet offshore spanning the areas of open water between the two existing areas of rip -rap
and extended to the west to tie into section "B". The area will also have 5 foot breaks for every 100 linear
foot and is proposed to have a maximum elevation of 1 foot above NWL. All sections of the proposed
structure have a maximum proposed base width of 10 feet.
The project is located in the following Areas of Environmental Concern (AEC): Estuarine Waters (EW),
Public Trust Shoreline (PTS) and Public Trust Area (PTA). The project is located adjacentto

and is designated SA;HQW by the Environmental Management Commission. The site is not a Primary
Nursery Area (PNA), and is open to shellfishing. The shoreline consists of coarse sandy estuarine beach,
remnant marsh mats, and patchy Spartina alternaflora marsh. It was noted on the site visit On February
18, 2020 that the areas of patchy alternaflora marsh appeared to be areas damaged during Hurricane
Dorian and were showing signs of regenerating at the time of the site visit. Just landward of the beach
and making up the majority of the parcel is coastal wetlands consisting of Juncus roemerianus, Spartina
patens, and Spartina cynosuroides with high ground hammocks with cedars and wax myrtle. During a site
visit on February 18, 2020 beds of SAV were visible approximately 50 feet offshore of the project area
along the western side of the property but none were observed in the area of the remnant rock sill
offshore of the existing rip -rap on the eastern side of the property. The area where no SAV was observed
had notably coarser bottom sediment. A review historic, and archaeological resources was not provided.
Anticipated impacts The project as proposed will result in the filling of 7,800 square feet of estuarine
beach and 5,000 square feet of shallow bottom habitat in the Pamlico Sound. There will be temporary
impacts of noise and turbidity during construction.
Basis for Determination:
The 2008 Hyde County CAMA Core Land Use Plan Future Land Use Map (FLUM) designates the project site
on land as "Agricultural/Law Density Residential', and all AECs as "Unbuildable Land", which limits
development to 15A NCAC 7H use standards. Uses in the Agricultural/Low Density Residential are as
follows:
Agricultural/Low Density Residential (pg. 236). This land use category is comprised of properties whose
use is related to both agricultural activities, as well as single-family residential housing. There are a
substantial number of properties within the county that accommodate both subsistence and small
farming operations and private residences. Generally these properties do not have access to county
infrastructure services. These properties are much larger in size, and generally exceed a minimum lot
size of five acres or greater.
Allowable density Five acres or greater
Maximum building height 40 feet
Preferred uses Low density residential housing, private agricultural
operations, private livestock operations
Uses not preferred High/moderate density housing developments,
commercial farming operations
Land Use Policies: The following LUP policies may be applicable to this request.
P.30 Residential, commercial, and industrial development which meets 15A NCAC 7H use standards will
be allowed in estuarine shoreline, estuarine water, and public trust areas. In all other areas, development
will be allowed that is consistent with applicable local, state, and federal regulations.
P.33 Hyde County supports the use of erosion control structures in estuarine shoreline areas.

Reference the application of Katherine Hegamyer for a Department of the Army permit to
construct a 780 foot -long x 10 foot wide breakwater and place 500 linear feet of stone riprap
material along the shoreline, on property located at 669 British Cemetary Road, adjacent to the
Pamlico Sound, on Ocracoke Island, Hyde County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
3. Except as specified in the plans attached to this permit, no excavation, fill or mechanized
land -clearing activities shall take place at any time in the construction or maintenance of this
project, in such a manner as to impair normal flows and circulation patterns within waters or
wetlands or to reduce the reach of waters or wetlands.
4. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
trace -quantities.- Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
6. The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for reason other than safety.
7. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

3. Water Quality Certification
The proposed project must comply with all the conditions of the General Water Quality
Certification 4175. [15A NCAC 02H .0507(c)]
4. The Perm ittee shall replant the vegetation within temporarily disturbed areas associated with this
project in an "in kind" manner immediately following construction. (Example: Disturbed areas
with pre-existing grassed lawns must be replanted with grass. Disturbed areas with pre-existing
trees or woody vegetation must be replanted with trees and woody vegetation. Disturbed areas
with pre-existing forest vegetation must be replanted with forest vegetation including at leasttwo
different native hardwood tree species at a density sufficient to provide 260 trees per acre at
maturity. This density can usually be achieved by planting approximately 360 (11 x 11 spacing) to
538 (9 x 9 spacing) trees per acre.) Restoration of trees/shrubs/forest must be completed by the
first subsequent planting season (November 1 through March 30). Note, if the tree plantings do
not survive, they will need to be replaced such that the density is sufficient to provide 320 trees
per acre at maturity. [15A NCAC 02H .0507 (c), 15A NCAC 02H .0506 (b)(3), and 15A NCAC 02B
.0259(6)]
5. Turbidity Standard
The Permittee shall adhere specially to 15A NCAC 02B .0220 Tidal Salt Water Quality for Class SC
Waters (3)(g) pH: shall be normal for waters in the area, which generally shall range between 6.8
and 8.5 except that swamp waters may have a pH as low as 4.3 if it is the result of natural
conditions; (1) Turbidity: the turbidity in the receiving water shall not exceed 25 NTLI; if turbidity
exceeds this level due to natural background conditions, the existing turbidity level shall not be
increased. [15A NCAC 02B .0220)
6. This approval and their conditions are final and binding unless contested. [G.S.143-215.5]
7. All riparian buffer impacts by the placement of temporary fill or clearing activity shall be restored
to the preconstruction contours and revegetated. (15A NCAC 02B .0259)

Project setting
The subject property is located at 669 British Cemetery Road on Ocracoke, Hyde County,
North Carolina. The parcel totals 40 acres and consists of a single family residence with two guest
cottages on the eastern side of the property approximately 320 feet from the shoreline ofthe Pamlico
Sound. Near the homes and further from the Sound the property consists of uplands trees, shrubs,
and grasses. The total shoreline of the property along the Pamlico Sounds measures approximately
2,060 feet of which 1,280 feet is currently undeveloped. Along the western side of the property there
is 125 feet of bulkhead and a 100-foot pier and along the eastern side of the property there is there
are two sections of rip -rap and NWL level in two sections 260 feet and 240 feet respectively. Also
offshore rip -rap on the eastern side of the property is a rock sill approximately 70 to 100 feet
waterward of NWL. The remainder of the shoreline consists of coarse sandy estuarine beach,
remnant marsh mats, and patchy Spartina alternaflom marsh. It was noted on the site visit on
February 18, 2020 that the areas of patchy altemaflora marsh appeared to be areas damaged during
Hurricane Dorian and were showing signs of regenerating at the time of the site visit. Just landward
of the beach and making up the majority of the parcel is coastal wetlands consisting of Juncus
roemerianus, Spartina patens, and Spartina cynosuroides with high ground hammocks with cedars
and wax myrtle. During a site visit on February 18, 2020 beds of SAV's were visible approximately
50 feet offshore of the project area along the western side of the property but none were observed in
the area of the remnant rock sill offshore of the existing rip -rap on the eastern side of the property.
The area where no SAV was observed had notably coarser bottom sediment.
The Pamlico Sound at the project site is classified SA, HQW by the Environmental
Management Commission. The Sound is classified as coastal fishing waters and is open to the
harvest of shellfish. Water depths range from 0 to -1.2 feet in the proposed project location.
Project description
The applicants are proposing to construct 1,280 feet of rock shoreline stabilizations structures
along the north shore of the property bordering the Pamlico Sound in two main sections.
Approximately 780 linear feet of the structure will be rip -rap placed at NWL along the sandy
estuarine beach or just below NWL water ward of coastal wetlands. The section located below NWL
near the patchy Spartina altemaflora marsh is proposed to have 5 foot breaks 100 linear foot. These
sections are described in the project drawings as section "A" and "B" respectively. Section "C" will
be constructed as a breakwater 500 feet in length 10 to 30 feet offshore spanning the areas of open
water between the two existing areas of rip -rap and extended to the west to tie into section "B". The
area will also have 5 foot breaks for every 100 linear foot and is proposed to have a maximum
elevation of 1 foot above NWL. All sections of the proposed structure have a maximum proposed
base width of 10 feet.
Material will be trucked to the site where is will be moved along the upland area of beach
with a backhoe to the work site where it will be placed with an excavator. The beach area of the site
should allow all work to be completed without crossing wetlands.

Anticipated impacts
The project as proposed will result in the filling of 7800 square feet of estuarine beach and
5000 square feet of shallow bottom habitat in the Pamlico Sound. There will be temporary impacts of
noise and turbidity during construction.

Project Description:
The subject property is located at 669 British Cemetary Road on Ocracoke, Hyde
County, North Carolina. The 40 acre parcel consists of a single family residence with
two small guest cottages. There is currently 500 linear feet of rock rip -rap on the eastern
property shoreline in front of the main house. There is also a 100 foot pier, 125 linear
feet of bulkhead with rip -rap on the western property shoreline.
The proposed project will provide additional shoreline stabilization for the remaining
1,280 feet of shoreline not currently protected. Approximately 780 linear feet of the
proposed rip -rap will be installed at or near the normal water level (NWL) with a base of
10 feet. The remaining 500 linear foot of breakwater will be installed waterward of the
NWL a maximum of 30 feet in between the existing sections of rip -rap. A majority of the
rip -rap to be installed 10-30 feet waterward of the NWL is to protect the existing coastal
wetlands and areas of eroding coastal wetlands that will be lost if the shoreline is not
stabilized. The placement of rip -rap waterward of these areas will protect the existing
coastal wetlands and help to re-establish new wetland growth in the eroding areas.
Submerged Aquatic Vegetation (SAV) Analysis:
An SAV (subaquatic vegetation) evaluation was conducted on 8/28/19 by Doug Dorman
of Atlantic Environmental Consultants, LLC and there was no SAV growth in the location
of the proposed work area at that time. At a site visit with the NC Division of Coastal
Managements Shane Staples on February 18, 2020 it did not appear that SAV growth
has changed since the evaluation was done in 2019. Although the recent site visit was
done outside of the growing season it does not appear that SAV growth has changed
and remains offshore of the project area. The SAV evaluation done in 2019 had no SAV
growth closer than 50 feet of the NWL and the more recent site visit supports the current
conditions.
Wetland Delineation:
There are wetlands located throughout the subject property. The proposed shoreline
stabilization will not impact the existing wetlands for this project; therefore, the wetlands
have not been delineated and surveyed. The drawings show the approximate location of DECEIVED
the wetlands and were located by onsite evaluation and satellite images from Google
earth and the Hyde County GIS site.
Construction Techniques:

The rock rip -rap will be trucked in from an outside source and stored onsite at the uplarpCM"MHD
area located at the entrance to the property. A backhoe will move the rock along the
uplands landward of the shoreline to the work areas. An excavator will then place the
rock in the proposed locations along the shoreline.

Some examples would be: Nailing the notice card to a telephone pole or tree along the road

The Department of Environment and Natural Resources hereby gives public notice as
required by N.C.G.S. 113A-119(b) that an application for a development permit in an Area of
Environmental Concern as designated under the Coastal Area Management Act (CAMA) was
received on 13 March 2020. According to the said application submitted by Katherine Hegamyer
and Jaquelyne Hinkley propose to construct 780ft x 1Oft rip -rap shoreline stabilization and 500ft
x 1 Oft of breakwater along the northern shoreline of the property adjacent to the Pamlico Sound,
Hyde County, Ocracoke Island North Carolina.

Enclosed is a CAMA Major Permit application for the Hegamyer/Hinkley property to install
rock rip -rap along the properties shoreline adjacent to the Pamlico Sound. The project is located
at 669 British Cemetery Road, Hyde County, North Carolina.
The following information has been submitted as part of the permit application:
l . A copy of the site plan and details for the project.
2. Application forms DCM MP1 & MP2
3. A narrative description of the project.
4. Adjacent property owner notification letters and certified mail receipts.
5. An authorization letter for Atlantic Environmental Consultants to act as agent.
6. A copy of the deed for the subject property.
7. A check for $400 made payable to NCDENR.
