Any violation tf these terms may be subject to tines, imprisonment or civil action; or may cause uic ycuruL w In -Water Work Moratorium 1) In order to reduce the potential for negative effects on the spawning migration of anadromous fish, no excavation or filling shall be permitted between February 1 and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with appropriate resource agencies. Boat Ramp Expansion 2) Unless specifically altered herein, this permit authorizes one concrete boat ramp, as indicated on the attached workplan drawings. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Harvest Point HOA Permit No. 56-20 Page 2 of 3 ADDITIONAL CONDITIONS 3) The boat ramp shall be poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. 4) Placement of fill materials below normal water level shall be limited to the ramp structure. 5) Excavation and ground disturbing activities, associated with the placement of the boat ramp, above and below the normal water line shall be limited to that absolutely necessary to establish adequate ramp slope and provide a ramp no greater in size than specified in the attached permit application and workplan drawings. 6) The groins shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 7) The alignment of the authorized groins shall be verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -staked by DCM within a maximum of 30 days prior to the new expected start of construction. 8) _ The groins, as depicted on the attached workplans, shall not extend more than 20 feet waterward of the normal water level at the time of construction. 9) The permitted groins shall be constructed of treated wood, plastic lumber, metal or vinyl sheet piles or other suitable materials approved by Department personnel. 10) Should the Lot to the east be sold prior to the initiation of construction of the boat ramp expansion and groin, the permittee shall obtain a written agreement from the new owner(s) waiving the 15-foot riparian corridor setback and submit it to the Division of Coastal Management prior to initiating construction of. the docking facility. Docking Facility Expansion 11) This permit authorizes only the step down and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility expansion without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 12) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. Harvest Point HOA Permit No. 56-20. Page 3 of 3 ADDITIONAL CONDITIONS 13) The permittee shall install and maintain at his expense any signal lights or signals,prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 14) This permit does not authorize any new formalized boat slips. 15) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. USACE Conditions 16) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at http://www.fws.gov/ne-es/manirnal/manatee euidelines.ndf. General 17) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third parry without the written approval of the Division of Coastal Management. 18) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 19) The permittee and/or his or her contractor shall meat with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2020-00461). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2004-1545 v2. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. After consultation with Elizabeth City (Cynthia and Ron) the 59LF of shoreline identified on the MP-1 form and bio-report was incorrect. The actual LF as determined by Google Earth is 89LF, which allows for 712ft2 of platform. The proposal request to add 90ft2, bringing the total platform area to 630ft2. The MP-1 form and bio-report were changed to reflect the correct shoreline length. (b) Specific Use Standards (b)(6) Addresses Piers and Docking Facilities. (b)(6)(B) requires that the total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the total. Projects requiring dimensions greater than those stated in this Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Size restrictions shall not apply to marinas. Consistent: The proposed lower platform addition adds an additional 90 square feet of shading for a total of 630 square feet which is less than the 712 square feet allowed for the 89 foot shoreline. The addition is to allow for easier access into boats by the public where a lower platform does not already exist. (b)(6)(F) requires that piers and docking facilities shall be single story. They may be roofed but shall not be designed to allow second story use. Consistent: The proposed addition to the pier will not be covered. (b)(6)(G) requires that pier and docking facility lengths shall be limited by: (i) not extending beyond the established pier or docking facility length along the same shoreline for similar use; (This restriction does not apply to piers 100 feet or less in length unless necessary to avoid unreasonable interference with navigation or other uses of the waters by the public); Consistent: The proposed platform will not increase the piers length. (ii) not extending into the channel portion of the water body; and Consistent: The proposed platform addition will not extend into the channel portion of the waterbody. (iii) not extending more than one-fourth the width of a natural water body, or human -made canal or basin. Measurements to determine widths of the water body, canals or basins shall be made from the waterward edge of any coastal wetland vegetation that borders the water body. The one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier head line. The one-fourth length limitation shall not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. (b)(6)(I) requires that piers and docking facilities shall not interfere with the access to any riparian property and shall have a minimum setback of 15 feet between any part of the pier or docking facility and the adjacent property owner's areas of riparian access. The line of division of areas of riparian access shall be established by drawing a line along the channel or deep water in front of the properties, then drawing a line perpendicular to the line of the channel so that it intersects with the shore at the point the upland property line meets the water's edge. Consistent: The proposed platform will remain outside of the 15 foot setback. (b)(9) Addresses Groins. (b) (9) (A) requires that groins shall not extend more than 25 feet waterward of the normal high water or normal water level unless a longer structure is justified by site specific conditions and by an individual who meets any North Carolina occupational licensing requirements for the type of structure being proposed and approved during the application process; Consistent: The proposed groins will be 20 feet which is less than the 25 foot limitation. (b) (9) (B) requires that groins shall be set back a minimum of 15 feet from the adjoining riparian lines. The setback for rock groins shall be measured from the toe of the structure. This setback may be waived by written agreement of the adjacent riparian owner(s) or when two adjoining riparian owners are co -applicants. Should the adjacent property be sold before construction of the groin commences, the applicant shall obtain a written agreement with the new owner waiving the minimum setback and submit it to the permitting agency prior to initiating any development of the groin; Consistent: The proposed groins will be more than 15 foot from the left riparian property line but not the right but the property owner has obtained a waiver. (b)(9)(C) requires that groins shall pose no threat to navigation Consistent: The proposed groins will not pose a threat to navigation. (a)(2)(A) requires that the location, design, and need for development, as well as the construction activities involved shall be consistent with the management objective of the Estuarine and Ocean System AEC (Rule .0203 of this subchapter) and shall be sited and designed to avoid significant adverse impacts upon the productivity and biologic integrity of coastal wetlands, shellfish beds, submerged aquatic vegetation as defined by the Marine Fisheries Commission, and spawning and nursery areas. Consistent: The development is designed to not interfere with Shellfish beds or submerged aquatic vegetation. (a)(2)(B) requires that the development shall comply with state and federal water and air quality Consistent: This development will not violate water and air quality. (a)(2)(C) requires that the development shall not cause irreversible damage to documented archaeological or historic resources as identified by the N.C. Department of Cultural resources. Consistent: There are no known archaeological or historic resources on the property. (a)(2)(D) requires that the development shall not increase siltation. Consistent: It does not appear that this development will measurably increase siltation. A (a)(2)(E) requires that the development shall not create stagnant water bodies. Q40#"', Consistent: It does not appear that the development will create stagnant water , bodies. (a)(2)(F) requires that the development shall be timed to avoid significant adverse impacts on life cycles of estuarine and ocean resources. Consistent: The development will have minimum adverse effects on life cycles or estuarine resources. (a)(2)(G) requires that the development shall not jeopardize the use of the waters for navigation or for other public trust rights in public trust areas including estuarine waters. (b) Specific Use Standards (b)(6) Addresses Piers and Docking Facilities. (b) (6) (B) requires that the total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the total. Projects requiring dimensions greater than those stated in this Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Size restrictions shall not apply to marinas. Possible Inconsistency: The proposed lower platform addition adds an additional 90 square feet of shading for a total of 630 square feet which is greater than the 472 square feet allowed for the 59 foot shoreline. However, the addition is to allow for easier access into boats by the public where a lower platform does not already exist. (b)(6)(F) requires that piers and docking facilities shall be single story. They may be roofed but shall not be designed to allow second story use. Consistent: The proposed addition to the pier will not be covered. (b)(6)(G) requires that pier and docking facility lengths shall be limited by: (i) not extending beyond the established pier or docking facility length along the same shoreline for similar use; (This restriction does not apply to piers 100 feet or less in length unless necessary to avoid unreasonable interference with navigation or other uses of the waters by the public); Consistent: The proposed platform will not increase the piers length. Aop (ii) not extending into the channel portion of the water body; and Consistent: The proposed platform addition will not extend into the channel portion of the waterbody. (iii) not extending more than one-fourth the width of a natural water body, or human -made canal or basin. Measurements to determine widths of the water body, canals or basins shall be made from the waterward edge of any coastal wetland vegetation that borders the water body. The one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier head line. The one-fourth length limitation shall not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. Consistent: The proposed platform will not increase the pier length. (b)(6)(1) requires that piers and docking facilities shall not interfere with the access to any riparian property and shall have a minimum setback of 15 feet between any part of the pier or docking facility and the adjacent property owner's areas of riparian access. The line of division of areas of riparian access shall be established by drawing a line along the channel or deep water in front of the properties, then drawing a line perpendicular to the line of the channel so that it intersects with the shore at the point the upland property line meets the water's edge. Consistent: The proposed platform will remain outside of the 15 foot setback. (b)(9) Addresses Groins. (b)(9)(A) requires that groins shall not extend more than 25 feet waterward of the normal high water or normal water level unless a longer structure is justified by site specific conditions and by an individual who meets any North Carolina occupational licensing requirements for the type of structure being proposed and approved during the application process; Consistent: The proposed groins will be 20 feet which is less than the 25 foot limitation. (b)(9)(B) requires that groins shall be set back a minimum of 15 feet from the adjoining riparian lines. The setback for rock groins shall be measured from the toe of the structure. This setback may be waived by written agreement of the adjacent riparian owner(s) or when two adjoining riparian owners are co -applicants. Should the adjacent property be sold before construction of the groin commences, the applicant shall obtain a written agreement with the new owner waiving the minimum setback and submit it to the permitting agency prior to initiating any development of the groin; Consistent: The proposed groins will be more than 15 foot from the left riparian property line but not the right but the property owner has obtained a waiver. (b) (9) (C) requires that groins shall pose no threat to navigation Consistent: The proposed groins will not pose a threat to navigation. (b)(9)(D) requires that the height of groins shall not exceed one foot above normal high water or normal water level; Consistent: The proposed groins will not exceed one foot above normal water level. (b)(9)(F) requires that "L" and "T" sections shall not be allowed at the end of groins Consistent: The proposed groins will not contain any "L" or "T" ends. 07H .0209 Coastal Shorelines (d) Use Standards. Acceptable uses shall be those consistent with the management objectives in Paragraph (c) of this Rule. These uses shall be limited to those types of development activities that will not be detrimental to the public bust rights and the biological and physical functions of the estuarine and ocean system. Every effort shall be made by the permit applicant to avoid, mitigate or reduce adverse impacts of development to estuarine and coastal systems through the planning and design of the development project. In every instance, the particular location, use, and design characteristics shall comply with the general use and specific use standards for coastal shorelines, and where applicable, the general use and specific use standards for coastal wetlands, estuarine waters, and public trust areas described in Rule .0208 of this Section. Consistent: The development proposal meets the intent of this rule. (d)(1) requires that all development projects, proposals, and designs shall preserve and not weaken or eliminate natural barriers to erosion including peat marshland, resistant clay shorelines, and cypress gum protective fringe areas adjacent to vulnerable shorelines. Consistent: The proposed development does not weaken or eliminate any natural barriers to erosion. (d)(4) requires that the development shall not have a significant adverse impact on estuarine and ocean resources. Significant adverse impacts include development that would directly or indirectly impair water quality standards, increase shoreline erosion, alter coastal wetlands or Submerged Aquatic Vegetation (SAV), deposit spoils waterward of normal water level or normal high water, or cause degradation of shellfish beds. Consistent: The proposed development meets the intent of this rule. �® t (d)(5) requires that the development shall not interfere with existing public rights of access to, or use of, navigable waters or public resources. DATE: March 24, 2020 Consistency Determination: The request is consistent with/not in conflict with the Pasquotank County/Elizabeth City 2004 Advanced Core Land Use Plan (LUP) certified by the CRC on February 9, 2012. Overview: The .76 acre subject property has 59 linear feet of shoreline along Newbegun Creek which connects to the Pasquotank River. Water depths range from 2.5 feet a distance of approximately 40 feet from the shoreline to 3.2 feet a distance of approximately 80 feet from the shoreline. The property has an elevation of approximately 2 feet above Normal Water Level (NWL) along the shoreline. The lot is primarily vegetated with yard grasses, with Section 404 wetlands located at the shoreline. The AE Floodzone extends into the property approximately 220 linear feet landward of the shoreline. A community boating facility is located on the property. Existing site improvements consist of a driveway, parking area and turnaround. Existing shoreline improvements consist of riprap revetment, a 10 foot wide by 40 foot long hog slat boat ramp and a 195 foot long pier with six, (6) finger piers. The finger piers create ten (10) slips. Installation of a 12 foot wide by 41 foot long boat ramp, two (2) 20 foot long groins and a 3 foot wide by 20 foot long platform is proposed. The existing boat ramp will be removed using a cofferdam and replaced with the new ramp in the same location. Groins will be placed on either side of the ramp. The water classification at this site is Tidal Salt Water (SC), and water depths range from 2.5 feet at the terminus of the ramp to 3.2 feet near the first finger pier. This portion of the Pasquotank River (Newbegun Creek) has been designated as Anadromous Fish Spawning Area (AFSA). AFSAs have evidence of anadromous fish spawning through direct observation, capture of running ripe females, or indication of eggs or early larvae. Anadromous species within this area include alewife, blueback herring, and striped bass. An AFSA moratorium on in -water work, is recommended from 15 February through 30 September. This moratorium reduces the potential negative effects on critical fish life history activities, to include spawning migrations and nursery functions. Project Setting The property proposed for development is located at 0 Haley Point Road in Elizabeth City and consists of 0.76 acres adjacent to Newbegun Creek. The property contains a community boat ramp, driveway, parking area, and pier. The property to the north is a residential property and the property to the south is an undeveloped private lot. Vegetation on the site includes, but is not limited to, indigenous yard grass, Cyprus (Taxodium sp.), Saltmeadow cordgrass (Spartina patens), Needlerush (Juncus sp.), and Carex sp. Soil types include Yeopim Silt Loam (YeA). The property has an elevation of approximately 2 feet above Normal Water Level (NWQ =1 e shoreline. The shoreline is +/- 59 feet in length and has been hardened with a narrow riprap revetment. The property also contains an existing 10 foot by 40 foot hog slat boat ramp and 195 foot pier with six finger piers creating 10 slips. The water classification for this site is Tidal Salt Water (SC). The water depths range from 2.5 feet near the terminus of the ramp to 3.2 feet near the first finger pier. Development Proposal The applicant proposes to replace the existing 10 foot by 40 foot boat ramp with a new concretel2 foot by 41 foot boat ramp and construct two 20 foot groins one on either side of the new ramp. Submitted by: Cynthia Rountree RECEIVED Date: February 28, 2020 MAR 0 4 2020 DCM-MHD CITY Received JAN 15 2010 pA CC Narrative ACM -CC Harvest Pointe HOA Launch and Pier Upgrade The proposed permit details two upgrades to the launch and pier in the Harvest Pointe Homeowners Association (HOA) (Attachment 1), which is located at the southern confluence of Newbegun Creek and the Pasquotank River in Pasquotank County. The site within the HOA for the proposed upgrades is the Haley Point Commons (Attachment 2). The two upgrades are the boat launch/ramp and a step-up/step- down access deck, The existing pier and launch/ramp (`20 years of age) are shown in the GIS image (Attachment 3) and photograph (Attachment 4). Each of the two upgrades is discussed below. Attachment 5 is a scaled diagram of the exiting pier and launch area showing the upgrade location for the step-up/step down deck and the dimensions of the area. A "to scale" diagram of the area is also presented in Attachment 11, which is provided by the CAMA office. Launch area. The existing launch/ramp (pig grading) is deteriorating. Beyond the deterioration, the launch/ramp needs to be widened to allow for less risk/more safety in boat launching and retrieval. The proposed upgrade is the construction of a concrete launch in the same location. The new launch will be 12 feet in width (existing launch is 10 feet), and construction will be done via a cofferdam bordered by groins of each side. The project has been discussed with four potential contractors. The attached construction diagram (to scale) illustrates the proposed upgrade (Attachments 5). A cross sectional schematic of the existing and proposed launch is shown in Attachment 9. Step-up/Step-down Deck. The purpose of this upgrade is one of safety: allowing individuals to access the pier from a boat and vice versa with minimal risk. This problem is due to the height of the existing pier which exceeds that of the normal water level (NWQ by 3 feet. The proposed step-up/step-down deck will provide an intermediate deck surface. The proposed construction shows its location off the existing pier (Attachment 6). A lateral view of the construction shows the decking (3.0' x 30') supported by angled braces tied into the existing pilings. All construction boards will be pressure treated for marine applications. Ownership Documentation. The ownership documentation (Attachment 10) Is from the Pasquotank County GIS data base and shows the "Tax Card" for the Haley Point Common area within the Harvest Pointe HOA. Attachments 1.
