This permit, issued on October 16, 2020 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Upland Development
1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing
activities associated with the development of the above referenced property, including the four
homesites, driveways and parking, wastewater systems and boardwalks, and other associated
infrastructure, all as expressly and specifically set forth in the attached permit application and
workplan drawings.
Sedimentation and Erosion Control
2) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2023
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
4) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes.
General
5) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
6) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
7) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers assigned the project Action ID SAW-2020-01419.
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2012-0968.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
NOTE: An application processing fee of $250 was received by DCM for this project.

This letter is in reference to the application submitted for Mr. John Geewax, for a Coastal Area
Management Act Major Permit to undertake development activities to construct four single
family residences on Ocracoke Island, in Hyde County.
Although processing of the application is nearing completion, additional time is needed for this
office to complete the review and make a decision on your request. Therefore, it is necessary that
the standard review time be extended. An additional 75 days is provided by G.S. I I3A-122(c)
which would make December 17, 2020 the new deadline for reaching a decision on your
request. However, we expect to take action prior to that time and will do so as soon as possible.

This memo is in reference to the Major CAMA permit application submitted by Doug
Doorman with Atlantic Environmental Consultants on behalf of John Geewax for the
development of four consecutive single family residential lots located off SR 1357 (John Gaskins
Drive) on the east side of Ocracoke Village adjacent the Pamlico Sound near Horse Pen Point in
Hyde County, North Carolina. The property owner proposes to construct a single family
residence on each of the four lots. The home construction will impact Zone 2 of the Tar/Pamlico
River Basin Buffer on each lot with part of the house and deck tripping the Major CAMA Permit
process. Note: the application was received complete before the NCDWR made changes
removing the Tar/Pam buffer. This phase of the development of these four lots does not impact
any open water or wetland areas.
Staff has reviewed the project per the development standards as found in North Carolina
Administrative Code 7H.0209(d) and have determined the project to be consistent with the
applicable development standards. Staff recommends that the permit be issued with the standard
conditions for upland development addressing erosion and sedimentation control and impervious
surface limits.

Consistency Determination: The request is conditionally consistent with the 2008 Hyde County CAMA
Core Land Use Plan certified by the CRC on March 27, 2008, provided that the four proposed building
heights do not exceed 40 feet. The proposed buildings are located in the Agricultural/Low Density
Residential Classification on the Future Land Use Map, this classification specifies a maximum building
heights of 40 feet. The application does not state the height of the four buildings, therefore resulting in
the conditionally consistent determination.
Project Overview: The 3.01-acre project site is located off SR 1357 (O'Neal Drive) on the east side of
Ocracoke Village adjacent the Pamlico Sound near Horse Pen Point in Hyde County, North Carolina. The
site is a sandy berm/upland area bordered on the northeast side by the Pamlico Sound and the southwest
by a coastal wetland marsh vegetated primarily with Juncus roemeranus (Black Needlerush). Access to
the sandy upland is by a ±20' wide x ±200' long filled road across the marsh from SR 1357. The sandy
upland berm ranges in width from ±70'to ±200'and has an elevation of approximately 4'abovethe normal
water level (NWL). The upland berm is subdivided into 5 lots and the largest containing the most upland
located on the northern end (Lot 4, Section I of Issac and John O'Neal Heirs). This lot has served as a spoil
area in the past for dredging projects authorized by Major CAMA/Dredge and Fill Permits 132- 87 and 78-
01. This lot has considerably more elevation as a result of the spoil deposition activities as much as 9'
abovethe NWL. The spoil material (sand) has and continues to be redistributed as part of development
activities undertaken by the property owner, across the other remaining 4 lots. The last lot on the south
side of the upland berm is developed with a single family residence and associated biofiltration
wastewater treatment system. There is also a 6' x 150' long pier with a 20' x 20' L-head platform built into
the Pamlico Sound offshore of this lot.

The shoreline adjacent the Pamlico Sound is stabilized with the combination of a vinyl bulkhead and riprap
revetment for a distance of ± 750'. Remnants of a 4' wide walkway/boardwalk runs the entire length
immediately adjacent the existing bulkhead. There is a ± 800' long dredged access channel, originally
authorized by CAMA/Dredge and Fill Permit No. 132-87, that connects to two dredged basins, authorized
by CAMA/Dredge and Fill Permit No. 78-01, located offshore the aforementioned lots. Each dredged basin
has a pier constructed to it with a total of six slips between the two piers that we severely damaged in
Hurricane Dorian. This dredging and pier construction was conducted as part of the development of the
Property.
Applicable AECs include Estuarine Shoreline and Public Trust Shoreline. The Pamlico Sound at this location
is designated as Coastal Waters by the Marine Fisheries Commission as well as SA by the Environmental
Management Commission. The wasters are not PNA. The offshore waters adjacent to this site are open
to shellfishing. Vegetation on the sandy upland berm consists of salt meadow hay (Spartina patens),
american beach grass (Ammophila breviligulato), pennywort (Hydrocotyle bonariensis) and sea oats
(Uniola paniculato). The upland/wetland transition on the southwest side of the upland berm is vegetated
with wax myrtle (Myrica cerifera) and red cedar (Juniperus virginiana).
The applicant is proposing to further develop each of the four remaining unoccupied lots with a single
family residence each with associated wastewater system, driveway and parking. Three of the four
proposed wastewater systems will be biofiltration and one will be a conventional system. Each
wastewater system has been authorized by the Hyde County Health Department. The conventional
system is proposed to be constructed on the largest lot on the north end of the upland berm. This lot will
also be used to support two of the biofiltration wastewater systems for adjoining lots lacking space to
support both a residence and wastewater system. These two lots will have a lift station to pump the
wastewater from the residence to the biofiltration system on the northern lot. According to the
application no wastewater will be discharged into wetlands. The driveway and parking areas are to be
constructed with gravel. Each residence will have a 3' wooden boardwalk constructed from the residence
ranging from 30' to 40'in length to the 3' x 360' boardwalk to be reconstructed adjacent the bulkhead.
Anticipated impacts The project as proposed will disturb 16,964 ftz of uplands. There are no proposed
wetland or open water impacts proposed in this application package. Impervious surface coverage for the
entire upland area will be 14,223 ftz or 10.8%. Impervious coverage within the Estuarine Shoreline is
10,419 ftZ or 20.9%. Home construction will result in 2,496 ftZ of additional impervious surface coverage
in Zone 2 of the Tar/Pamlico River Basin Buffer. There will be 460 ftz of Zone 2 shaded by open wooden'
decks elevated 8' above the existing ground level. Impacts in Zone I of the Tar/Pam Buffer, which will now
be the 30' CAMA Buffer, total 1,740ftz of wooden walkway from the homes to the bulkhead and boardwalk
along bulkhead. Mitigation credits for these impacts were purchased before the original permit for this
project was issued. The project will result in an increase of surface runoff from the developed areas. This
application and associated plats discuss the Tar/Pam Buffer impacts as the application was received
complete before this office was notified of the Division of Water Resources changes that made Ocracoke
Island no longer subject to the Tar/Pam Buffer.
Basis for Determination:
The 2008 Hyde County CAMA Core Land Use Plan Future Land Use Map (FLUM) designates the project site
on land as "Agricultural/Low Density Residential", and all AECs as "Unbuildable Land", which limits
development to 15A NCAC 7H use standards. Uses in the Agricultural/Low Density Residential are as

Agricultural/Low Density Residential (pg. 236). This land use category is comprised of properties whose
use is related to both agricultural activities, as well as single-family residential housing. There are a
substantial number of properties within the county that accommodate both subsistence and small
farming operations and private residences. Generally these properties do not have access to county
infrastructure services. These properties are much larger in size, and generally exceed a minimum lot
size of five acres or greater.

Land Use Policies: The following LUP policies may be applicable to this request.
1.14 All residential development must comply with 15A NCAC 7H use standards and applicable ORW
management plans in estuarine shoreline, estuarine water, and public trust areas. This action will be
regulated by state, federal, and local guidelines. Schedule: Continuing Activity.

will be allowed that is consistent with applicable local, state, and federal regulations.

The DWR project # for this one is 2012-0968, and as Shane had mentioned in his field report, this application came in
right before the Tar -Pamlico Buffer Rules changed to no longer have Ocracoke as subject to those rules. Since the
project proposes no other waters/wetland impacts (only buffer impacts that no longer exist, since there Is no longer a
DWR riparian buffer (rule) on Ocracoke), no permits would be required by DWR. If you have any questions, please let

Project Setting
The 3.01-acre project site is located off SR 1357 (Oneal Drive) on the east side of
Ocracoke Village adjacent the Pamlico Sound near Horse Pen Point in Hyde County, North
Carolina. The site is a sandy berm/upland area bordered on the northeast side by the Pamlico
Sound and the southwest by a coastal wetland marsh vegetated primarily with Juncus
roemeranus (Black Needlerush). Access to the sandy upland is by a f20' wide x ±200' long
filled road across the marsh from SR 1357. The sandy upland berm ranges in width from *70' to
±200' and has an elevation of approximately 4' above the normal water level (NWL). The
upland berm is subdivided into 5 lots and the largest containing the most upland located on the
northern end (Lot 4, Section 1 of Issac and John O'Neal Heirs). This lot has served as a spoil
area in the past for dredging projects authorized by Major CAMA/Dredge and Fill Permits 132-
87 and 78-01. This lot has considerably more elevation as a result of the spoil deposition
activities as much as 9' above the NWL. The spoil material (sand) has and continues to be
redistributed as part of development activities undertaken by the property owner, across the other
remaining 4 lots. Vegetation on the sandy upland berm consists of salt meadow hay (Spawns
glens , american beach grass (Ammophila breviligulata), pennywort (Hydrocotyle bonariensis)
and sea oats(Um
ola aniculata . The upland/wetland transition on the southwest side of the
upland berm is vegetated with wax myrtle M rice cerifera and red cedar Juni rus vir 'niana .
The last lot on the south side of the upland berm is developed with a single family residence and
associated biofiltration wastewater treatment system. There is also a 6' x 150' long pier with a
20' x 20' L-head platform built into the Pamlico Sound offshore of this lot.
The shoreline adjacent the Pamlico Sound is stabilized with the combination of a vinyl
bulkhead and riprap revetment for a distance of±750'. Remnants of a 4' wide
walkway/boardwalk runs the entire length immediately adjacent the existing bulkhead. There is
a f800'long dredged access channel, originally authorized by CAMA/Dredge and Fill Permit
No. 132-87, that connects to two dredged basins, authorized by CAMA/Dredge and Fill Permit
No. 78-01, located offshore the aforementioned lots. Each dredged basin has a pier constructed
to it with a total of six slips between the two piers that we severely damaged in Hurricane
Dorian. This dredging and pier construction was conducted as part of the development of the
property.
The Pamlico Sound at this location is designated as Coastal Waters by the Marine
Fisheries Commission as well as SA by the Environmental Management Commission. The
offshore waters adjacent to this site are open to shellfishing.

Project Description
The applicant is proposing to further develop each of the four remaining unoccupied lots
with a single family residence each with associated wastewater system, driveway and parking.
Three of the four proposed wastewater systems will be biofiltration and one will be a conventional
system. Each wastewater system has been authorized by the Hyde County Health Department.
The conventional system is proposed to be constructed on the largest lot on the north end of the
upland berm. This lot will also be used to support two of the biofiltration wastewater systems for
adjoining lots lacking space to support both a residence and wastewater system. These two lots
will have a lift station to pump the wastewater from the residence to the biofiltration system on the
northern lot. The driveway and parking areas are to be constructed with gravel. Each residence
will have a 3' wooden boardwalk constructed from the residence ranging from 30' to 40'in length
to the 3' x 360' boardwalk to be reconstructed adjacent the bulkhead.
Anticipated Impacts
The project as proposed will disturb 16,964 ft' of uplands. There are no proposed
wetland or open water impacts proposed in this application package. Impervious surface
coverage for the entire upland area will be 14,223 ft' or 10.8%. Impervious coverage within the
Estuarine Shoreline is 10,419 ft' or 20.9%. Home construction will result in 2,496 ft= of
additional impervious surface coverage in Zone 2 of the Tar/Pamlico River Basin Buffer. There
will be 460 ft' of Zone 2 shaded by open wooden decks elevated 8' above the existing ground
level. Impacts in Zone 1 of the Tar/Pam Buffer, which will now be the 30' CAMA Buffer, total
1,740ft2 of wooden walkway from the homes to the bulkhead and boardwalk along bulkhead.
Mitigation credits for these impacts were purchased before the original permit for this project
was issued. The project will result in an increase of surface runoff from the developed areas.
This application and associated plats discuss the Tar/Pam Buffer impacts as the
application was received complete before this office was notified of the Division of water
Resources changes that made Ocracoke Island no longer subject to the Tar/Pam Buffer.

LOCATION OF PROJECT:
The project consists of five lots. Lots 3, 4, 5, lot 4, Sec 1 & lot 2 Sec 1 located off Oneal
Drive (S.R. 1357) on Ocracoke, Hyde County, adjacent to the Pamlico Sound.
PURPOSE and PROPOSED CONSTRUCTION:
The total project area of all five lots is 204,647 square feet of highground and a mixture
of Section "404" and coastal wetlands. John Geewax was previously permitted to build
on the four separate lots under CAMA major permit #3-13 which expired on December
31, 2018, The proposed improvements to his property will remain as originally
permitted. The proposed project includes the construction of four single family
residences with associated wastewater systems, driveways, parking and walkways to
the existing piers. In addition, a 3' x 360' walkway will be re -constructed along the
existing bulkhead. The proposed walkway was destroyed over several years from
various hurricanes and was not re -constructed; therefore, we are proposing to rebuild it
in the same location.
There is an existing single family residence located on lot 2, Sec1 with a pier and
gazebo located on the Pamlico Sound. The remaining existing improvements on the
properties include an asphalt/gravel driveway, bulkhead, rip -rap shoreline, two piers with
7 boat slips and one boat house.

The NC Division of Coastal Management hereby acknowledges receipt of your application

deadline for making a decision is 2 October 2020. An additional 75-day review period is
provided by law when such time is necessary to complete the review. If you have not been
notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an
extended review. However, an additional letter will be provided on or about the 75th day.

NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development. You should post this notice
at a conspicuous point along your property where it can be observed from a public road.
Some examples would be: Nailing the notice card to a telephone pole or tree along the road
right-of-way fronting your property, or at a point along the road right-of-way where a private
road would lead one into your property. Failure to post this notice could result in an
incomplete application.

The Department of Environment and Natural Resources hereby gives public notice as
required by N.C.G.S. I I3A-119(b) that an application for a development permit in an Area of
Environmental Concern as designated under the Coastal Area Management Act (CAMA) was

1. Installation of the wastewater system shall be in strict accordance with the
approved site plan and all specifications included in this permit.
2. Place geotextile fabric over the rock bed prior to backfilling.
3. Place a 6" cap of soil (the last 1" to be topsoil) over the drainfield to extend 5' past
the bed sidewalls prior to tapering. Shape to shed surface water and establish a
grass cover. Maintain grass height not to exceed 3"-4".
4. Use water conserving fixtures i.e. 1.6 gallon flush toilets, 2 gpm shower heads, 1
gpm all lavatories. Try to spread out laundry loads during the week. Do not pour
grease or harsh cleaning chemicals into the house drains.

2. Stormwater Management
Stormwater generated off the residential dwelling must be collected and
treated. This may be accomplished through the use of gutters and rain
barrels or by collecting and directing to a residential rain
garden/biotention area. An Operation and Maintenance Agreement (O&M
Agreement) will be required when utilizing the above -mentioned Best
Management Practices (BMPs). A bioretention cell consists of a
depression in the ground that supports various types of water -tolerant
vegetation. The surface of the BMP is depressed in bioretention cell to
allow for ponding of runoff that filters through the soil. Ponding depth
shall be 12 inches or less. No dimension (width, length, or radius) can be
less than 10 feet. This is to provide sufficient space for plants. A final
plan for stormwater treatment must be provided and approved by the
Division, including an O&M Agreement.
3. Diffuse Flow
An additional condition is that all stormwater shall be directed as diffuse
flow at non -erosive velocities through the protected stream buffers and
will not re -concentrate before discharging into the stream as identified
within 15A NCAC 2B . 0259(5).
4. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality
Certification or applicable Buffer Rules, and any subsequent modifications,
the applicant is required to return the attached certificate of completion to
the 401 Oversight/Express Review Permitting Unit, North Carolina Division
of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
Any disputes over determination regarding this Authorization Certificate
(associated with the approved buffer impacts) shall be referred in writing to
the Director for a decision. The Director's decision is subject to review as
provided in Article 3 and 3 of G.S. 150B. This Authorization Certificate shall

with the provisions of Session Law 2008-211 and 15A NCAC 2H .1000 (hereafter referred
to as the "stormwater rules') and the approved stormwater management plans and
specifications, and other supporting data as attached and on file with and approved by the
Division of Water Quality and considered a part of this permit.
The Permit shall be effective from the date of issuance until rescinded and shall be subject
to the following specific conditions and limitations:
I. DESIGN STANDARDS
Each of the 4 lots is limited to a maximum of 13,758 square feet of built -upon area,
as indicated in the application and as shown on the approved plans. The
stormwater management Ian shall utilize a roof water runoff system that will
include individual cisterns for each residence that will collect and store runoff to be
used for irrigation and gray water use on the properties. CAMA regulations may
reduce the allowable built -upon area for those lots within the AEC.
2. The overall tract built -upon area percentage for the project must be maintained at
12% per the requirements of Session Law 2008-211 and Section .1005 of the
stormwater rules.
3. The built -upon areas associated with this project shall be located at least 50 feet
landward of all perennial and intermittent surface waters.

4. The only runoff conveyance systems allowed will be vegetated conveyances such
as swales with minimum side slopes of 3:1 (H:V) as defined in the stormwater rules AUG1

II. SCHEDULE. OF COMPLIANCE
1. Swales and other vegetated conveyances shall be constructed in their entirety,
vegetated, and be operational for their intended use prior to the construction of any
built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of
the swales or other vegetated conveyances will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance necessary to
operate the permitted stormwater management systems at optimum efficiency to
include:
a. Inspections
b. Sediment removal.
i C. Mowing, and re -vegetating of the side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and
specifications.
f. Maintenance of level spreaders and infiltration areas in accordance with
approved plans and 0&M documents.
4. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed below:
a. Any revision to any of the items shown on the approved plans, including the
stormwater management system, design concept, built -upon area, details,
etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
e. Further subdivision, acquisition, or selling of the project area.
f. Filling in, altering or piping any vegetative conveyance shown on the
approved plan.
5. The permittee shall submit all information requested by the Director or his
representative within the time frame specified in the written information request.
6. No piping shall be allowed except that minimum amount necessary to direct runoff
beneath an impervious surface such as a road and that minimum amount needed
under driveways to provide access to lots.
7. Within 30 days of completion of the project, the permittee must certify in writing that
the project's stormwater controls, and impervious surfaces have been constructed
within substantial intent of the approved plans and specifications. Any deviation
from the approved plans must be noted on the Certification.
8. The permittee is responsible for verifying that the proposed built -upon area does not
exceed the allowable built -upon area. once the lot transfer is complete, the built -
upon area may not be revised without approval from the Division of Water Quality,
and responsibility for meeting the built -upon area limit Is transferred to the individual
property owner, provided that the permittee complies with the requirements of RECEI

9. Deed restrictions are incorporated into this permit by reference and must be
recorded with the Office of the Register of Deeds prior to the sale of any lot.
Recorded deed restrictions must include, as a minimum, the following statements
related to stormwater management:
a. The following covenants are intended to ensure ongoing compliance with
State Stormwater Management Permit Number SW7130404, as issued by
the Division of Water Quality under NCAC 2H.1000.
b. The State of North Carolina is made a beneficiary of these covenants to the
extent necessary to maintain compliance with the Stormwater Management
Permit.
C. These covenants are to run with the land and be binding on all persons and
parties claiming under them.
d. The covenants pertaining to stormwater may not be altered or rescinded
without the express written consent of the State of North Carolina, Division of
Water Quality.
e. Alteration of the drainage as shown on the approved plans may not take
place without the concurrence of the Division of water Quality.
f. The maximum built -upon area per lot is 854 square feet for Lot 3, 1,421
square feet for Lot 4, 2,522 square feet for Lot 5 and 8,960 square feet for
Lot 4, Section I. This allotted amount includes any built -upon area
constructed within the lot property boundaries, and that portion of the
right-of-way between the front lot line and the edge of the pavement. Built
upon area includes, but is not limited to, structures, asphalt, concrete, gravel,
brick, stone, slate, and coquina, but does not include raised, open wood
decking, or the water surface of swimming pools.
g. Filling in or piping of any vegetative conveyances (ditches, swales, etc.)
associated with the development except for average driveway crossings, is
strictly prohibited by any persons.
h. For those lots within CAMIA's Area of Environmental Concern, where DCM
calculates a different maximum lot built -upon area, the governing lot BUA
shall be the most restrictive of the two amounts.
i. Each lot will maintain a 50 foot wide vegetated buffer between all impervious
areas and surface waters.
j. All roof drains shall terminate at least 50 foot from the mean high water
mark.
k. If permeable pavement credit is desired, the property owner must submit a
request, with supporting documentation, to the permittee and receive
approval prior to construction of the permeable pavement.
10, The permittee shall submit a copy of the recorded deed restrictions within 30 days
of the date of recording.
11. If the permittee sets up an Architectural Review Committee or Board (ARC orARB)
to review plans for compliance with the restrictions, the plans reviewed must include
all proposed built -upon area (BUA). Any approvals given by the ARC or ARB do not
relieve the lot owner of the responsibility to maintain compliance with the permitted
BUA limit.
12. All stormwater conveyances will be located in either dedicated right-of-way (public
or private), recorded common areas or recorded drainage easements. The final
plats for the project will be recorded showing all such required easements, in
accordance with the approved plans.
13. The Director may notify the permittee when thepermitted site does not meet one or
more of the minimum requirements of the permit. Within the time frame specified in
the notice, the permittee shall submit a wine time The

14. If permeable pavement credit is desired, the permittee must submit a request to
modify the permit to incorporate such language as required by the Division of Water
Quality. The request to modify must include a soils report identifying the type of soil,
the Seasonal High Water Table elevation and the infiltration rate. Upon the
successful completion of a permit modification, the individual lot owners that request
to utilize permeable pavements must submit the necessary forms and
documentation to the permittee and receive approval prior to construction of the
permeable pavement.
III. GENERAL CONDITIONS
This permit is not transferable to any person or entity except after notice to and
approval by the Director. The Director may require modification or revocation and
re -issuance of the permit to change the name and incorporate such other
requirements as maybe necessary. In the event of a name or ownership change, a
completed Name/Ownership Change form, signed by both parties, must be
submitted to the Division of Water Quality accompanied by the supporting
documentation as listed on page 2 of the form. The approval of this request will be
considered on its merits, and may or may not be approved.
2. The permittee is responsible for compliance with all permit conditions until the
Director approves a transfer of ownership. Neither the sale of the project nor the
transfer of common areas to a third party, such as a homeowner's association,
constitutes an approved transfer of the stormwater permit.
3. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to an enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statutes 143-215.6A to 143-215.6C.
4. The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, or terminating the permit as
allowed by the laws, rules, and regulations contained in Session Law 2008-211,
Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000; and
North Carolina General Statute 143-215.1 et. al.
5. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including
those as may be required by the Division, such as the construction of additional or
replacement stormwater management systems.
6. The permittee grants permission to DENR Staff to enter the property during normal
business hours, for the purpose of Inspecting all components of the stormwater
management facility.
7. The permit issued shall continue in force and effect until revoked or terminated. The
permit may be modified, revoked and reissued or terminated for cause. The filing of
a request for a permit modification, revocation and re -issuance, or termination does
not stay any permit condition.
8. Unless specified elsewhere, permanent seeding requirements for the swales must
follow the guidelines established in the North Carolina Erosion and Sediment
Control Planning and Design Manual. RECEIVED

10. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state and federal), which have jurisdiction.
11. The permittee shall notify the Division in writing of any name, ownership or mailing
address changes at least 30 days prior to making such changes.
