Permit Class NEW STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission �QrliYit coP for X Major Development in an Area of Environmental Concern pursuant to NCGS I I3A-118 X Excavation and/or filling pursuant to NCGS 113-229 Issued to Kevin and Ellen Gannon, 2602 Kipling Ave. Spring Lake, NJ 07762 Permit Number 68-20 Authorizing development in New Hanover County at adi. to Middle Sound and AIW W. at 112 Parmele Blvd., Wrightsville Beach , as requested in the permittee's application dated 1/30/20 including attached workplan drawings (4), drawing 1,2,4 of 4 dated 1/30/20, and drawing 3 of 4 dated 1/10/20. This permit, issued on June 3, 2020 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terns may be subiect to fines. imprisonment. or civil action: or may cause the permit to be null and void. Dockine Facility 1) This permit authorizes only the docks, piers, gazebos, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair qualified persons within twenty (20) days of the issuing date. of the Coastal Resources Commission. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Kevin and Ellen Gannon Permit No. 68-20 Page 2 of 3 ADDITIONAL CONDITIONS 3) The authorized structures and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the established Wrightsville Beach pier -head line. 4) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 5) This permit authorizes a maximum of 4 formalized boat slips. 6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access. 7) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the'sides along with benches are permitted. Lattice is specifically excluded from being used under this authorization. 8) The roof of the gazebo shall not be designed for second story use. Bulkhead 9) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 10) No backfill material shall be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. 11) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. 12) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 13) All fill material to be placed below normal high-water level shall be confined behind the permitted bulkhead. 14) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 15) The bulkhead shall be constructed prior to any backfilling activities. 16) The bulkhead shall besolid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 17) All backfill material shall be clean and free of any pollutants except in trace quantities. Kevin and Ellen Gannon ADDITIONAL CONDITIONS Permit No. 68-20 Page 3 of 3 18) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. USACE Conditions 19) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish 8t Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at http://www.fws.gov/nc-es/mammal/manatee guidelines.12M. General 20) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 21) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 22) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of Programmatic General Permit No. 198000291 (SAW Action Id. No. 2020-00528) NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2020-0391. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 7. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not I considered significant. 8. The project site is located at 112 Parmele Boulevard in Shell Island Sound also known locally as Lollipop Bay, adjacent to Middle Sound and the Atlantic Intracoastal Waterway (AIWW). The site is located within the Town of Wrightsville Beach, in New Hanover County. To locate the property, travel east on Eastwood Road (N.C. HWY 74) from Military Cut -Off Road for approximately 1 mile towards Wrightsville Beach. Once over the drawbridge turn left onto West Salisbury Street and travel over the second bridge over Banks Channel. At the traffic light turn left onto North Lumina Avenue for a little more than a quarter mile until you reach Parmele Boulevard. Turn left onto Parmele Boulevard and the destination will be on your right. The applicant currently maintains a single family residence and private residential 4-slip docking facility on the project site. The property is adjacent to residential properties with existing single family structures and private residential docking facilities. High ground vegetation consists of ornamental landscaping. The lot is approximately 10,600 square feet in size and has an average elevation of approximately 5.0' above normal high water (NHW). The project site has approximately 100 linear feet of shoreline frontage stabilized by an existing bulkhead, which meets NHW. There are no Coastal Wetlands within the vicinity of the project area. The applicant currently maintains an existing 4-slip private residential docking facility within Shell Island Sound/Lollipop Bay (see Sheet 1 of 4). An access pier, measuring 32' in length by 6' in width extends in an easterly direction from the existing bulkhead. The pier terminates into a T-Head covered platform, measuring 20' in length by 20' in width. An access ramp leads from the covered platform onto a floating dock, measuring 25' in length by 6' in width, oriented perpendicular to the pier and parallel with the shoreline. Attached to this floating dock are two floating docks, measuring 24' in length by 4Y2' in width, extending perpendicularly in an easterly direction from the 25' x 6' floating dock, creating a "U-shaped" configuration that provides 4 formalized boatslips. The existing 4-slip private residential docking facility meets the Town of Wrightsville Beach's Established Pierhead Line and does not encroach into either 15' Riparian Setbacks. Th. Town of Wrightsville Beach Land Use Plan classifes'the high ground area of the project site Residential and the adjacent waters as Conservation. There are no known archaeological sites located in the project vicinity. The waters in the project area are classified SB;# by the Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. 10. PROPOSED PROJECT The applicant proposes to install a new timber bulkhead approximately 2' waterward of the existing bulkhead and replace the 4-slip private residential docking facility in the same footprint with an additional 16' x 8' sundeck. There is an existing bulkhead, measuring approximately 100' in length, which meets NHW and stabilizes the shoreline (see Sheet 1 of 4). The applicant proposes to construct a new timber bulkhead approximately 100' in length and approximately 2' waterward of the existing bulkhead's alignment (see Sheet 2 of 4). There are no Coastal Wetlands waterward of the existing bulkhead nor in the vicinity of the project area. The applicant also proposes to rebuild the deteriorating 4-slip private residential docking facility damaged from Hurricane Florence and add an additional approximate 16' in length by 8' in width uncovered fixed platform, also called a sundeck. The applicant proposes to rebuild the existing 4-slip private residential docking facility within Shell Island Sound/Lollipop Bay in the same footprint (see Sheet 2 of 4). A proposed access pier, measuring approximately 32' in length by approximately 6' in width would extend in an easterly direction from the existing bulkhead. The water depths In the area of the proposed docking facility range from approximately -4.0' to -7.0' at normal low water (NLW) as reported by the applicant (see Sheet 4 of 4). The proposed 4-slip private residential docking facility meets the Town of Wrightsville Beach's Established Pierhead Line and does not encroach into either 15' Riparian Setbacks. 11. ANTICIPATED IMPACTS The proposed bulkhead would fill approximately 200 ftz of sandy bottom within the Estuarine Waters and Public Trust Areas AECs and would disturb approximately 1,800 ft2 of high ground within the Estuarine Shoreline and Public Trust Shoreline AECs. There are no Coastal Wetlands located within the vicinity of the project area. The proposed 4-slip private residential docking facility would incorporate approximately 1,134 ftz of the Estuarine Waters and Public Trust Areas AECs. The proposed 128 ftz sundeck addition of shading impacts to these AECs would meet the 8 square feet per linear foot of shoreline rule. The proposed 4- slip private residential docking facility would not exceed the Town of Wrightsville Beach's Established Pierhead Line. The proposed 4-slip private residential docking facility would not encroach into either 15' Riparian Setback. The proposed 4-slip private residential docking facility would extend approximately 90' into the Shell Island Sound/Lollipop Bay waterbody, which measures approximately 600' wide. The gazebo was approximately 20' x 20', the pier approximately 6' x 30' (stops at the gazebo's drip line), perpendicular landward floating dock approximately 6' x 25', and the two parallel floating docks approximately 4.5' x 24.5'. Also please remove the "Submerged Lands" from the plans (all sheets), as we are thinking there is a submerged lands claim located there causing confusion. 2) Does the applicant want to rebuild the docking facility to the existing footprint or do they want to make it somewhat smaller for costs? Please revise the plans for the top -down footprint of the proposed docking facility (sheet 2 of 4) to the dimensions that will exist post -construction. 3) Revise the cross-section of the plans (sheet 4 of 4) to show the 2' overhang on the roof to the gazebo if that's what's being proposed today and the applicant is keeping the same footprint. If no overhang is proposed to the roof and it will be built to 16' x 16' then no changes are necessary. 4) What does the applicant want to do with the two non -conforming pilings that are located beyond the pierhead line?
