including attached workplan drawings (4), drawing 1,2,4 of 4 dated 1/30/20, and drawing 3 of 4 dated 1/10/20.
This permit, issued on June 3, 2020 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terns may be subiect to fines. imprisonment. or civil action: or may cause the permit to be null and void.
Dockine Facility
1) This permit authorizes only the docks, piers, gazebos, and other structures and uses located in or over
the water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the
U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum,
permanent reflectors shall be attached to the structure in order to make it more visible during hours of
darkness or inclement weather.

This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair
qualified persons within twenty (20) days of the issuing date. of the Coastal Resources Commission.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2023
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) The authorized structures and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the established Wrightsville Beach pier -head line.
4) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
5) This permit authorizes a maximum of 4 formalized boat slips.
6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's area of riparian access.
7) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and
shall be permeable to air and water. Screen or wire on the'sides along with benches are permitted.
Lattice is specifically excluded from being used under this authorization.
8) The roof of the gazebo shall not be designed for second story use.
Bulkhead
9) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan
drawings.
10) No backfill material shall be placed within 30 feet of the normal high water line, except that which will
be used to backfill the area behind the permitted bulkhead.
11) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not
authorized.
12) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the
approved bulkhead alignment.
13) All fill material to be placed below normal high-water level shall be confined behind the permitted
bulkhead.
14) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure.
15) The bulkhead shall be constructed prior to any backfilling activities.
16) The bulkhead shall besolid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or
other suitable materials approved by Division personnel.
17) All backfill material shall be clean and free of any pollutants except in trace quantities.

18) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a
representative of the Division of Coastal Management within a maximum of 30 days prior to the start of
construction.
USACE Conditions
19) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish 8t Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

General
20) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
21) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
22) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of Programmatic
General Permit No. 198000291 (SAW Action Id. No. 2020-00528)
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2020-0391.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at [phone] prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

The applicant proposes to install a new timber bulkhead approximately 2' waterward of
the existing bulkhead and replace the 4-slip private residential docking facility in the
same footprint with an additional 16' x 8' sundeck.in Wrightsville Beach.
Areas of Environmental Concern (AEC's) impacted by the proposal are PTS, ES, PTA
and EW. Waters at the project site are classified as SB# and are not open to the
harvesting of shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Wrightsville Beach Land Use Plan
Update and offer the following comments.
The general area of the project is classified as Residential R-1.
In general, the Wrightsville Beach Land Use Plan contains policies, which allows
development in Residential R-1 classified AECs, which is consistent with the State's
minimum use standards. The Wrightsville Beach Land Use Plan contains some policies,
which exceed the State's minimum use standards. However, none of these policies
appear to be applicable to this project.

agency comments on this permit application by May 28, 2020.
The proposed project would be located in Shell Island Sound (Lollipop Bay) adjacent to Middle Sound and the AIWW at
112 Parmele Boulevard, Wrightsville Beach, New Hanover County, North Carolina ( N 34.221781 W-77.788653).
The applicant proposes to install a new timber bulkhead approximately two (2) feet waterward of an existing bulkhead,
which would be 100 feet in length. This will result in the fill of 200 square feet of open estuarine waters.
The applicant also proposes to re -construct a damaged docking facility. The new dock will include a 32 feet by 6 feet
access pier, a 20 feet by 20 feet gazebo, a 16 feet by 8 feet sun deck, a 25 feet by 6 feet floating dock and two (2) 24 feet
by 4.5 feet floating finger docks. This docking facility would cover 1,134 square feet of estuarine open waters.
Please see the attached application request, plans dated January 30, 2020 and a location map for more detailed
information concerning the proposed project.
EFH:
This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson -Stevens Fishery
Conservation and Management Act. The Corps' initial determination is that the proposed project may affect, but is not
likely to adversely affect EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management
Councils or the National Marine Fisheries Service.
The waters within Shell Island Sound are designated SB by the Division of Water Resources. These waters ARE NOT
designated as PNA by the NC Division of Marine Fisheries and are congitionally approved closed.
ESA:
The Corps has reviewed the project area, exafhined all information provided by the applicant and consulted the latest
North Carolina Natural Heritage Database. Based on available information, the Corps has determined that the project
may affect but is not likely to adversely affect the West Indian manatee. The use of the Manatee Guidelines would be
required as a condition of this proposed action.

The project will not affect any other species listed as threatened or endangered or their critical habitat formally
designated pursuant to the Endangered Species Act of 1973 (ESA) within the project area.
NHPA 106:
Pursuant to Section 106 of the National Historic Preservation Act (NHPA) of 1966, Appendix C of 33 CFR Part 325, and
the 2005 Revised Interim Guidance for Implementing Appendix C, the District Engineer consulted district files and
records and the latest published version of the National Register of Historic Places, the Corps has preliminarily
determined that the proposed project will have no effect on cultural resources and requests concurrence from the State
Historic Preservation Office.

We recommend that the following conditions be included in the State authorization:
Special Conditions
1. All work authorized by this permit must be performed in strict compliance with the
submitted plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. For
further information, the permittee should contact the U.S. Coast Guard Marine Safety Office at (910)

3. Approval of the structure is based on determinations that there would be no obstruction to
navigation. The structure may be damaged by wave wash from passing vessels. Issuance of this
permit should not be construed, as relieving the permittee of taking proper steps to insure the
structure and moored boats will not be damaged by wave wash.
4. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee
shall immediately report it to the N.C. Division of Water Resources at [phone], Ext. 526 or
[phone] and provisions of the North Carolina Oil Pollution and Hazardous Substances
Control Act will be followed.
5. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this project
with a copy of this permit. A copy of this permit, including all conditions, shall be available at the
project site during construction and maintenance of this project.
6. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and
the immediate stabilization of all disturbed areas. Additionally, the project must remain in full
compliance with all aspects of the Sedimentation Pollution Control Act of 1973
7. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that the
turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the
North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
I considered significant.
8. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration
before completion of the work will, without expense to the United States and in such time and
manner as the Secretary of the Army or his authorized representative may direct, restore the water
or wetland to its pre -project condition.
9. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the
applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly

The project site is located at 112 Parmele Boulevard in Shell Island Sound also known locally as Lollipop
Bay, adjacent to Middle Sound and the Atlantic Intracoastal Waterway (AIWW). The site is located within
the Town of Wrightsville Beach, in New Hanover County. To locate the property, travel east on Eastwood
Road (N.C. HWY 74) from Military Cut -Off Road for approximately 1 mile towards Wrightsville Beach.
Once over the drawbridge turn left onto West Salisbury Street and travel over the second bridge over
Banks Channel. At the traffic light turn left onto North Lumina Avenue for a little more than a quarter mile
until you reach Parmele Boulevard. Turn left onto Parmele Boulevard and the destination will be on your
right.
The applicant currently maintains a single family residence and private residential 4-slip docking facility
on the project site. The property is adjacent to residential properties with existing single family structures
and private residential docking facilities. High ground vegetation consists of ornamental landscaping. The
lot is approximately 10,600 square feet in size and has an average elevation of approximately 5.0' above
normal high water (NHW). The project site has approximately 100 linear feet of shoreline frontage
stabilized by an existing bulkhead, which meets NHW. There are no Coastal Wetlands within the vicinity
of the project area.
The applicant currently maintains an existing 4-slip private residential docking facility within Shell Island
Sound/Lollipop Bay (see Sheet 1 of 4). An access pier, measuring 32' in length by 6' in width extends in
an easterly direction from the existing bulkhead. The pier terminates into a T-Head covered platform,
measuring 20' in length by 20' in width. An access ramp leads from the covered platform onto a floating
dock, measuring 25' in length by 6' in width, oriented perpendicular to the pier and parallel with the
shoreline. Attached to this floating dock are two floating docks, measuring 24' in length by 4Y2' in width,
extending perpendicularly in an easterly direction from the 25' x 6' floating dock, creating a "U-shaped"
configuration that provides 4 formalized boatslips. The existing 4-slip private residential docking facility
meets the Town of Wrightsville Beach's Established Pierhead Line and does not encroach into either 15'
Riparian Setbacks.
Th. Town of Wrightsville Beach Land Use Plan classifes'the high ground area of the project site
Residential and the adjacent waters as Conservation. There are no known archaeological sites located
in the project vicinity. The waters in the project area are classified SB;# by the Division of Water
Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine
Fisheries and they are CLOSED to the harvest of shellfish.
10. PROPOSED PROJECT
The applicant proposes to install a new timber bulkhead approximately 2' waterward of the existing
bulkhead and replace the 4-slip private residential docking facility in the same footprint with an additional
16' x 8' sundeck. There is an existing bulkhead, measuring approximately 100' in length, which meets
NHW and stabilizes the shoreline (see Sheet 1 of 4). The applicant proposes to construct a new timber
bulkhead approximately 100' in length and approximately 2' waterward of the existing bulkhead's
alignment (see Sheet 2 of 4). There are no Coastal Wetlands waterward of the existing bulkhead nor in
the vicinity of the project area.
The applicant also proposes to rebuild the deteriorating 4-slip private residential docking facility damaged
from Hurricane Florence and add an additional approximate 16' in length by 8' in width uncovered fixed
platform, also called a sundeck. The applicant proposes to rebuild the existing 4-slip private residential
docking facility within Shell Island Sound/Lollipop Bay in the same footprint (see Sheet 2 of 4). A proposed
access pier, measuring approximately 32' in length by approximately 6' in width would extend in an
easterly direction from the existing bulkhead. The pier would terminate into a T-Head covered platform

(gazebo), measuring approximately 20' in length by approximately 20' in width. The proposed additional
uncovered fixed platform (sundeck), measuring approximately 16' in length by 8' in width, would extend
in a southerly direction from the gazebo. An access ramp leads from the covered platform onto a
proposed floating dock, measuring approximately 25' in length by approximately 6' in width, oriented
perpendicular to the pier and parallel with the shoreline. Attached to this floating dock are two proposed
floating docks, measuring approximately 24' in length by approximately 4'/' in width, extending
perpendicularly in an easterly direction from the 25' x 6' floating dock, creating a " Ll-shaped" configuration
that would provide 4 formalized boatslips. The water depths In the area of the proposed docking facility
range from approximately -4.0' to -7.0' at normal low water (NLW) as reported by the applicant (see Sheet
4 of 4). The proposed 4-slip private residential docking facility meets the Town of Wrightsville Beach's
Established Pierhead Line and does not encroach into either 15' Riparian Setbacks.
11. ANTICIPATED IMPACTS
The proposed bulkhead would fill approximately 200 ftz of sandy bottom within the Estuarine Waters and
Public Trust Areas AECs and would disturb approximately 1,800 ft2 of high ground within the Estuarine
Shoreline and Public Trust Shoreline AECs. There are no Coastal Wetlands located within the vicinity of
the project area.
The proposed 4-slip private residential docking facility would incorporate approximately 1,134 ftz of the
Estuarine Waters and Public Trust Areas AECs. The proposed 128 ftz sundeck addition of shading
impacts to these AECs would meet the 8 square feet per linear foot of shoreline rule. The proposed 4-
slip private residential docking facility would not exceed the Town of Wrightsville Beach's Established
Pierhead Line. The proposed 4-slip private residential docking facility would not encroach into either 15'
Riparian Setback. The proposed 4-slip private residential docking facility would extend approximately 90'
into the Shell Island Sound/Lollipop Bay waterbody, which measures approximately 600' wide. The
proposed expansion would conform to the % width rule. Minor increases in turbidity should be expected
during construction.

APPLICATION FOR CAMA MAJOR
DEVELOPMENT PERMIT
The Department of Environmental Quality hereby gives public notice as required by NCGS 113A-
119(b) that the following applications were submitted for a development permits in Areas of Environmental
Concern as designated under the CAMA: On March 10, 2020, Kevin & Ellen Gannon proposed to replace an
existing bulkhead and a private four (4) slip docking facility adding a sundeck at 112 Parmele Blvd., adjacent
to Shell Island Sound, in Wrightsville Beach, New Hanover Counly, and on March 13, 2020, Carlee
Cummings proposed to replace 50 linear ff. of bulkhead with associated wetland fill at 58 Laurinburg St.,
adjacent to a man-made canal, in Ocean Isle Beach, Brunswick County. Copies of these applications can be
examined or copied at the office of Patrick Amico (New Hanover County) or Brendan Brock (Brunswick
County) N.C. Dept. of Environmental Quality, Division of Coastal Management, 127 Cardinal Drive Ext.,
Wilmington, NC 29405, [phone] for New Hanover County or [phone] for Brunswick County
during normal business hours.
Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400 Commerce
Avenue, Morehead City, NC 28557-3421, prior to April 11, 2020 will be considered in making the permit
decision. Later comments will be accepted and considered up to the time of permit decision. Project
modification may occur based on review and comment by the public and state and federal agencies. Notice of
the permit decision in these matters will be provided upon written request.

Dear Mr. Flynn,
The Division of Coastal Management hereby acknowledges receipt of your application on February 21, 2020, acting
as agent for Kevin & Ellen Gannon, for State approval for major development located at 112 Parmele Boulevard,
Wrightsville Beach, New Hanover County, adjacent to Shell Island Sound (Lollipop Bay). The application was
accepted as complete on March 10, 2020 and appears to be adequate for processing at this time. The projected
deadline for making a decision is May 24, 2020. An additional 75-day review period is provided by law when such
time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated
above, you should consider the review period extended. Under those circumstances, this letter will serve as your
notice of an extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from March 10, 2020 you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such
a meeting will be held within five working days from the receipt of your written request and shall include the
property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will fird a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate
State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive
a copy of my field report and/or comments from reviewing agencies.

Good Morning Mr. Flynn (Agent),
The Division of Coastal Management's Wilmington Regional Office received the CAMA Major Development application
on February 21, 2020, requesting approval for major development activities at the subject address. In reviewing the
application after my site visit yesterday, I have discovered that additional information is needed to complete the review
process. Accordingly, I am requesting that you submit the following additional information to this office:
1) Revise the plans to show the top -down footprint of the existing docking facility (sheets 1 & 3 of 4), not the base
footprint of the deckboards. The gazebo was approximately 20' x 20', the pier approximately 6' x 30' (stops at
the gazebo's drip line), perpendicular landward floating dock approximately 6' x 25', and the two parallel
floating docks approximately 4.5' x 24.5'. Also please remove the "Submerged Lands" from the plans (all sheets),
as we are thinking there is a submerged lands claim located there causing confusion.
2) Does the applicant want to rebuild the docking facility to the existing footprint or do they want to make it
somewhat smaller for costs? Please revise the plans for the top -down footprint of the proposed docking facility
(sheet 2 of 4) to the dimensions that will exist post -construction.
3) Revise the cross-section of the plans (sheet 4 of 4) to show the 2' overhang on the roof to the gazebo if that's
what's being proposed today and the applicant is keeping the same footprint. If no overhang is proposed to the
roof and it will be built to 16' x 16' then no changes are necessary.
4) What does the applicant want to do with the two non -conforming pilings that are located beyond the pierhead
line? These could remain, but could not be replaced. Please add a description to the plans detailing the
proposed action with these existing non -conforming pilings. To X vx,14ov€D A Nor RCPL-Aced
5) Adjust the application MP forms and narrative to match the revised plans (if applicant is keeping the same
footprint).
6) Certified Mail Return Receipts (Green Cards) from the Adjacent Riparian Property Owner Notifications.
7) Check for $400 made out to NC DEQ since the applicant is proposing open water fill with their bulkhead (you can
give us another $150 since we already have $250 check p 8430).
In accordance with the NC Department of Environmental Quality regulations, we note that the application, as submitted
on February 21, 2020, is incomplete for processing. Let me know if you have any questions or if I can be of further
