Five Ave, in Holden Beach as requested in the permittee's application dated 11/12/19 (MP-
1) and 3/24/20 (MP-4), including attached workplan drawing (1), dated 1/15/20.
This permit, issued on June 3, 2020 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
)r mese terms may oe subject to Tines, imprisonment or civil action; or may cause tue permit to be null and void.
Docking Facility
1) This permit authorizes only the docks, boatlifts, piers, covered platforms, and other structures and
uses located in or over the water that are expressly and specifically set forth in the permit application.
No other structure, whether floating or stationary, shall become a permanent part of this docking
facility without permit modification. No non -water dependent uses of structures shall be conducted
on, in or over Public Trust waters without permit modification.
2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the
U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum,
permanent reflectors shall be attached to the structure in order to make it more visible during hours of
darkness or inclement weather.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2023
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
4) The authorized structures and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the established Federal Channel Setback line.
5) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
6) This permit authorizes a maximum of 3 formalized boat slips.
7) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's area of riparian access.
8) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and
shall be permeable to air and water. Screen or wire on the sides along with benches are permitted.
Lattice is specifically excluded from being used under this authorization.
9) The roof of the gazebo shall not be designed for second story use.
10) Any portion of the permitted access pier and docking facilities built above Coastal Wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as
measured from the bottom of the decking.
USACE / FEDERAL CONDITIONS
11) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
13) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
14) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.

ADDITIONAL CONDITIONS
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2020-00657).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2020-0491.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water.
NOTE: An application processing fee of $250 was received by DCM for this project.

Recommendations for State Permit- Farrington Private Docking Facility
The square footage of the proposed docking facility is calculated as follows:
Shoreline length = 47.9 ft. x 8 sq. ft. = 383.2 sq. ft. allowable.
Proposed:
Access Pier = 6'x472' = 2832 sq. ft. (Not counted in square footage)
Fixed Platform=12'x16' (covered) =192 sq. ft.
Floating Dock=11'x16' =176 sq. ft.
Boatlift=13'x14' =182 sq. ft. (Not counted in square footage)
Total (proposed) = 368 sq. ft.
The proposed development would provide docking space for a total of three (3) vessels. The proposed docking
facility would extend 155' beyond the marsh to the edge of the USACOE 80' federal channel setback, exceeding
the '/4 width limit. The application appears to be CONSISTENT with the use standards set forth in NCAC 07H
.0208 (b)(6)(G)(iii), which states that the one-fourth limitation shall not apply when the proposed pier is located
between longer piers or docking facilities within 200 ft. of the applicant's property. However, the proposed pier
or docking facility shall not be longer than the pier -head line established by the adjacent piers nor longer than 1 /3
the width of the waterbody. The application also appears to be CONSISTENT with the remaining use standards
set forth in NCAC 07H .0208(b)(6), including those which dictate the maximum allowable platform area (the 8
square foot rule), the 15' riparian setback and federal channel setback.

Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit
application with regard to impacts on fish and wildlife resources. The project site is located at 342 Marker
Fifty -Five Ave. adjacent to the AIW W in Holden Beach, NC. Our comments are provided in accordance
with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended,
Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act
(48 Stat. 401, as amended; 16 U.S.C. 661 et seq.).
The applicant proposes to install a private pier, covered platform, boatliR and floating dock to establish
three slips. The 6' by 472' access pier would lead to a 12' by 16' covered gazebo and then continue 22'
waterward onto a ramp with a I F by 16' floating dock oriented perpendicular to shore. A 13' by 14'
boatlift is proposed west of the pier extension, landward the floating dock. Water depths in the vicinity of
the floating dock structure are -1.5' MLW. The design is beyond the 1/4 width of the waterbody, but
within the established pierhead. The AIW W in this location is classified SA by the Environmental
Management Commission and is closed to shellfish harvesting.
The structure terminates with a floating docking structure that may rest on the bottom during low water
events. Therefore, to minimize impacts to the shallow water habitat and reduce the likelihood of the
structure resting on the bottom, we request stops be incorporated into the floating dock design so the
structure rests at a minimum 18" above the substrate.

Dear Mr. Howell:
Reference the application by Mark Cumalander to expand and modify an existing
residential dock and to dredge an area near the dock in Motts Channel at 216 Seacrest Drive,
Wrightsville Beach, New Hanover County, North Carolina IN 34.215 W-77.809861).
The applicant proposes to expand and modify an existing residential dock by adding a 40
feet by 6 feet floating dock parallel to the existing pier and two (2) 21 feet by 6 feet floating
finger docks located perpendicular to this dock, creating a U-shaped dock. This will create four
(4) boatslips. The applicant also proposes to dredge a 46 feet by 17 feet area at the northeast
comer of the proposed U-shaped dock to a depth of -4.0' at NLW, generating 45 cubic yards of
spoil material. This spoil material would be deposited on an upland spoil disposal island (DA
248), which is located outside the ACOE "Right -of -Way" and owned by Agnes Bean. The
applicant has obtained written authorization from the owner to place this spoil material.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
The activities will be covered by Programmatic General Permit 291 (PGP-291). We
recommend that the following conditions be included in the State authorization:
Special Conditions
1. All work authorized by this permit must be performed in strict compliance with the
submitted plans, which are a part of this permit. Any modification to these plans must be
approved by the US Army Corps of Engineers (USACE) prior to implementation.
2. Except as authorized by this permit or any USACE approved modification to this

permit, no dredge, fill, or mechanized land -clearing activities shall take place at any time
in the construction or maintenance of this project within waters outside the designated
permitted boundary. This permit does not authorize temporary placement or double
handling of excavated or fill material within waters outside the permitted area.
3. Work in wetlands are prohibited during the dredging, use of the disposal island or any
other aspect of work associated with this project.
4. No attempt will be made by the permittee to prevent the full and free use by the public
of all navigable waters at, or adjacent to, the authorized work for reason other than safety.
No activity may cause a hazard to navigation.
5. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other
toxic materials. In the event of a spill of petroleum products or any other hazardous
waste, the permittee shall immediately report it to the N.C. Division of Water Resources
at (919) 733-5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil
Pollution and Hazardous Substances Control Act will be followed.
6. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall
provide each of its contractors and/or agents associated with the construction or
maintenance of this project with a copy of this permit. A copy of this permit, including
all conditions, shall be available at the project site during construction and maintenance
of this project.
7. The permittee shall employ all sedimentation and erosion control measures necessary
to prevent an increase in sedimentation or turbidity within waters and wetlands outside
the permit area. This shall include, but is not limited to, the immediate installation of silt
fencing or similar appropriate devices around all areas subject to soil disturbance or the
movement of earthen fill, and the immediate stabilization of all disturbed areas.
Additionally, the project must remain in full compliance with all aspects of the
Sedimentation Pollution Control Act of 1973.
8. The activity must be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases
such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as
trout waters by the North Carolina Division of Environmental Management (NCDEM),
25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or
less in trout waters, are not considered significant.
9. In order to further protect the endangered West Indian Manatee, Trichechus manatus,

Consistencv: This project is consistent with the Town of Holden Beach Land Use
Plan update.
The applicant proposes to construct a private pier, covered platform, boatlift and floating
dock for a total of three slips. The project is located at 342 Marker Fifty -Five, adjacent to
the AIWW in Holden Beach.
Areas of Environmental Concern (AEC's) impacted by the proposal are EW, PT and CW.
Waters at the project site are classified as SA; HQW and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Town of Holden Beach Land Use
Plan and offer the following comments.
The general area of the project is classified Residential, while the AECs impacted are
classified as Conservation.
In general, the Town of Holden Beach allows development in Conservation classified
AECs, which is consistent with the State's minimum use standards. The Town of Holden
Beach Land Use Plan contains some policies, which exceed the State's minimum use
standards. However, none of these standards appear to be applicable to this proposal.
This project appears to be consistent with the Town of Holden Beach Land Use Plan.

9. PROJECT DESCRIPTION
The proposed project is at 342 Marker Fifty -Five Ave., located due west of the Holden Beach bridge and
adjacent to the AIWW on Holden Beach, Brunswick County.
The property can be reached by traveling NC HWY 17 south towards Holden Beach. At the Supply intersection,
turn left onto NC 211 S. Travel .3 miles down NC 211 S and turn right onto Stone Chimney Rd SW. Drive
down Stone Chimney Rd for 5.5 miles and continue onto Old Ferry Connection SW for 1.1 miles. Turn right
onto Sabbath Home Rd SW and then take the next left onto NC 130 E towards Holden Beach. Travel over the
Holden Beach bridge and take a right onto Ocean Blvd W. Continue 1.2 miles and turn right onto High Point St.
Take the next right onto Brunswick Ave. and then take an immediate left onto Marker Fifty -Five Ave. The
project site will be located on the left-hand side of the road.
The property consists of a single-family residence located on a .8-acre parcel approximately 10' above normal
high water (NHW) and is vegetated with ornamental grasses and landscaping. The property has approximately
47.9' of shoreline frontage along the northern edge of the property and is stabilized with native vegetation. No
404-type wetlands appear to be present on the project site. A 2-3' narrow strip of high -marsh species including
Salt Meadow Grass (Spartina patens) and Spike Grass (Distichlis spicata) vegetate the shoreline. A healthy
stand of Smooth Cord Grass (Spartina alternii fora) extends approximately 350' to the edge of the AIWW with
sporadic hummocks of high marsh species intermixed. The width of the waterbody measures approximately
538' from marsh to marsh in the vicinity of the proposed pier.
The waters of the AIWW are classified SA by the Division of Water Quality and ARE NOT designated as a
Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of
shellfish.
PROPOSED PROJECT
The applicant proposes to install a private pier, covered platform, boatlift, and a floating dock for a total of 3
slips.
The applicant proposes to build a 6' x 472' access pier (as measured from MHW) that would originate from an
upland point and extend northward. The proposed 472' long pier would lead to a 12'x16' (192 ft2) covered
gazebo and then would continue an additional 22' waterward to terminate via ramp onto a I Vx16' (176 ft )
floating dock oriented perpendicular to the shoreline. A boatlift, measuring 13'xl4' boatlift is proposed to the
west of the pier extension and landward of the floating dock.
Although the property has approximately 47.9 linear feet of shoreline as measured at the NHW line, the platted
property lines widen as they extend waterward (See original plat). As proposed, the facility's design appears to
remain within the applicant's area of riparian access; no waivers would be required for the proposed project.
Water depths in the vicinity of the proposed docking facility range from -1.5' at mean low water (MLW) to -
2.0' MLW near the waterward end of the floating dock. The applicant's design extends beyond the '/. width of
the waterbody to the established pier -head line and terminates at the edge of the USACE 80' federal channel
setback. As proposed, the docking facility would extend 155' from the edge of marsh to approximately 28% of
the waterbody width.

10. ANTICIPATED IMPACTS
The proposed (3) three -slip docking facility would result in the incorporation of approximately 368 square feet
of Estuarine Waters and Public Trust Area. As proposed, the docking facility would extend beyond the ''A width
of the waterbody, however, it would not exceed the established pier -head line or the USACE 80' federal
channel setback. The proposed development would be located outside of the adjacent 15' riparian corridor
setbacks to the east and west. Turbidity associated with the piling installation would be kept to a minimum.

Our company has been asked to install a docking facility for Mr. & Mrs. Jeff Farrington and family located at
342 Marker Fifty Five, Holden Beach NC along the AI W W . This docking facility is typical of the other
docking facilities in the area. It will consist of three docking slips, One boat lift and one floating dock. There
will be a covered stationary dock for seating/fishing.
Gary Gurganus Surveying has completed a survey with drawings indicating riparian corridor and pier head
alignment. Gurganus surveying will also locate the placement of the west side of the project before
cons:nxction starts. The total length of the project is 5071f. Th.: project will extend from the existing bank to
the pier head alignment of the a4jacent docking facilities. The parcel has 47.91f of shore line. The total
shaded area for the project is 368 square feet.
The structures at the AI W W end of the project will be a 16ftxl2ft covered dock with a 3ftx20ft aluminum
gangway connecting a I 1 ftxl6ft floating dock. Attached to the west side of the pier will be a 10,000# boat
lift.

The Division of Coastal Management hereby acknowledges receipt of your application for State approval for the
construction of a (3) three slip docking facility located at 342 Marker Fifty -Five Ave., Holden Beach, Brunswick
County, NC. It was received complete on March 25'", 2020 and appears to be adequate for processing at this time.
The projected deadline for making a decision is June 8'", 2020. An additional 75-day review period is provided by
law when such time is necessary to complete the review. If you have not been notified of a final action by the initial
deadline stated above, you should consider the review period extended. Under those circumstances, this letter will
serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from March 25'", 2020 you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such
a meeting will be held within five working days from the receipt of your written request and shall include the
property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at t}e location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate
State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive
a copy of my field report and/or comments from reviewing agencies.

adjacent to Southport Marina, the Yacht Basin & W. Bay St., in Southport, Brunswick County. A copy
