Replacement of a Non -Conforming Structure 1) In accordance with 15A NCAC 07J .0211, the enclosed area of the dock house shall not change in use and shall not be constructed larger than 16ft. 1 Oin. x 1 Oft. 4in. with an 8ft. 4in. x 4ft. Tin. lean-to. 2) This permit authorizes only the replacement of the existing non -conforming structures within the previously existing footprint. No portion of the replaced non -conforming structure shall be located outside of the previously existing structure footprint. 3) The Division of Coastal Management shall be notified immediately in the event of any spillage of any hazardous, toxic, or harmful materials or substances (e.g. paint, stain, fuel, poyyFgtjy�Vi6* to the Estuarine Waters or the Public Trust Area. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Esham ADDITIONAL CONDITIONS General Permit No. 36-20 Page 2 of 2 4) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 5) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 6) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2020-00235). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 20-0204. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. The proposed development for the enclosed structure and lean-to shelter over estuarine waters in public trust area would be a replacement of a structure destroyed during Hurricane Dorian in September of 2019. Staff has reviewed the proposed project regarding rules found in Subchapter 7H concerning development in Estuarine Water and Public Trust Areas as well as Subchapter 7J. It is staff s recommendation that the proposed project appears inconsistent with 15A NCAC 07H .0208 and 15A NCAC 07J .0210 as described below. This office feels the development is inconsistent with 15A NCAC 07H .0208(a)(1) which in part states that "Uses that are not water dependent shall not be permitted in coastal wetlands, estuarine waters, and public trust areas" While the docking facility, pier and platform are water dependent the enclosed structure for storage is not a water dependent use and a storage building of similar size could be constructed on high ground of the property. Staff recommends the application for CAMA Major Permit be denied based on the language set forth in 15A NCAC 07J .210 which in part states "Replacement of structures damaged or destroyed by natural elements, fire or normal deterioration is development and requires CAMA permits. Replacement of structures shall be permitted if the replacement is consistent with current CRC rules" and 15A NCAC 07J .210 (1) "Non -Water Dependent Structures. Proposed work is considered replacement if the cost to do the work exceeds 50 percent of the market value of an existing structure immediately prior to the time of damage or the time of request". A repair exemption for only the platform was issued on November 18, 2019. The Pamlico Sound at the project side is classified SC by the Environmental Management Commission. The Sound and Silver Lake at the location are classified estuarine fishing water and closed to shell fishing. Dorian was the worst storm to hit Ocracoke Island in known history and flooded or destroyed many historic structures. Per attached Drawings B1.1, B1.2, B2.1, B2.2, B2.3 and B2.4, the proposed replacement of the Dockhouse is 10'4" wide by 16'10" long with a lean-to shelter 47' by 8'4", open on three (3) sides per the attached Plan View (131.1) and elevations by CBC. The roof outline is depicted in Drawing B1.2 which is 12'4" by 18'10" for the Dockhouse with 57' by 8' 5 1/2" for the lean- to shelter. All these dimensions came from "As -Built" drawings from 3-24-2014 when we considered raising the structure. We intend to provide new corner pilings per Drawing B1.1 that will extend to the eave of the structure and cover the roof and walls with cedar shakes to match the original construction to the extent possible. The Dockhouse will be re -constructed in the exact same spot it has been for the past 100 +/- years as it appears in numerous photos and artistic renderings of historic Ocracoke, many of which are attached. The building will be used to support fishing, hunting and boating activities which has been its primary use since the Lighthouse went to electrical power for its lamp. Some houses had two fences: an outer fence circling the entire property and an inner fence circling the house. The definition of space was particularly important in this crowded village, where lots were continually being subdivided, where yards often did not front on streets, and where streets themselves were simply nar- row dirt paths. The best preserved streetscape in the district is Howard Street, where the street is defined by continuous picket fences. Unlike cisterns, which are built of durable masonry, picket fences are made of perishable wood, and are continually rebuilt. The presence of a picket fence of traditional design is noted in the district inventory, but the fence is not counted as a separate resource because of the difficulty of dating and classifying by contributing or noncontributing status. Like cisterns, fences are a network counted as one con- tributing structure. DOCKS Weathered wooden docks jut into the water all around the shore of Silver Lake harbor. Some of these are private, some commercial, and there is a sizeable state ferry dock located beside the Coast Guard Station. Docks have been a necessary feature of Ocracoke life since at least the 1930s, when a map of Ocracoke village prepared by the Army Corps of Engineers showed Silver Lake bristling with them. As with picket fences, docks deteriorate quickly and are continuously repaired and rebuilt, and giving them construction dates is difficult. Silver Lake's docks form a network which add to the historic environment of the district and are counted as one contributing structure, OCRACOKE BUILDERS The earliest identified builder on Ocracoke is Noah Porter of Massachusetts, who constructed the Ocracoke Lighthouse out of solid brick and built the ad- jacent brick keeper's quarters. It is obvious that a builder who specilized in masonry lighthouse construction would have been necessary for such a mam- moth undertaking. However, Ocracoke has had a strong group of local car- penters who have constructed the houses and other buildings since at least ca. 1888, date of the earliest house associated with a local builder. The earliest known local builder was Thomas F. Gaskins, who is said to have built his own story and a jump house ca. 1888 (#132).
