This permit, issued on March 24, 2020 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Shoreline Stabilization - Bulkhead 1) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 2) No open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 3) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of. Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within a maximum of 30 days prior to the new expected start of construction. (See attached sheets for Additional Conditions) This permit action may be appealed by the perminee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Pennittee Paul Dowdey Permit No. 34-20 Page 2 of 4 ADDITIONAL CONDITIONS 4) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 5) The bulkhead shall be constructed prior to any backfilling activities. 6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 7) This pernit does not authorize any excavation waterward of the approved alignment, except for the removal oftrees necessary for the alignment of the authorized bulkhead. 8) The fill material shall be clean and free of any pollutants except in trace quantities. 9) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 10) No backfill material is to be placed within 30 feet of the normal water level, except that which will be used to backfill the area behind the permitted bulkhead. 11) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead. Sedimentation and Erosion Control 12) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. Boat Ramp 13) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact waters of the S`fate or waters that will enter waters of the State. 14) Placement of fill materials below normal water level shall be limited to the ramp structure. 15) Excavation`and ground disturbing activities, associated with the placement of the boat ramp, above and below the normal water line shall be limited to that absolutely necessary to establish adequate ramp slope and provide a ramp no greater in size than specified in the attached permit application and workplan drawings. / Paul Dowdey Permit No. 34-20 Page 3 of 4 ADDITIONAL CONDITIONS �- Docking Facilities 16) This permit authorizes only the removal of the remnant dock, and the construction of the docks, piers, tie pilings and boat lift, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of these docking facilities without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. / 17) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. ` Freestanding Mooring Buoy 18) This permit authorizes only the mooring buoy and uses located in or over the water that are expressly and specifically set forth in this permit. No other structure, whether floating or stationary, shall become a permanent part of this mooring without permit modification. No non -water dependent or commercial uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 19) Freestanding moorings shall be marked or colored in compliance with U.S. Coast Guard and NC Wildlife Resources Commission requirements and the required marking maintained for the life of the mooring. 20) Freestanding moorings must bear the owner'§.name, state vessel registration numbers and/or U.S. Customs Documentation numbers. Required identification must be legible for the life of the mooring. 21) The type of material used to anchor the mooring buoy must be non-polluting and of sufficient weight and design to safely anchor the buoy and vessel. 22) If freestanding mooring are to be replaced, the mooring shall comply with those guidelines of the Division in place at that time. General / 23) No attempt shall be made by the permittee tgprevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 24) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facilities or mooring buoy. Any sewage discharge at the docking facilities or mooring buoy shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall beppplied and enforced throughout the entire existence of the permitted structure. 25) This permit authorizes a maximum of 4 formalized boat slips, 3 formalized boat slips within the basin and one formalized boat slip located at the ipooring buoy. Paul Dowdey ADDITIONAL CONDITIONS Permit No. 34-20 Page 4 of 4 26) This p5xr6it shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 27) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 28) The permittee and/or his or her contractor shall meet with a representative of the Division prior to projec�tiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: /The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2020-00030) issued 3/24/20. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 19-1752. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. The applicant also proposes to construct 3 piers, 1 with a platform attached to the end. Lastly the applicant proposes to construct a total of 4 boat slips, 1 being a boat lift, 1 being a mooring buoy, and the other 2 slips designated by the placement of 4 tie piles. The site of the proposed development is located at 220 Marsh Causeway, Knotts Island Currituck County, adjacent to North Landing River connecting to Currituck Sound The development proposal involves the Public Trust Area (PTA), Estuarine Waters (EW), and Estuarine Shoreline (ES) Areas of Environmental Concern (AEC's). I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project and my findings are as follows: 1 SA NCAC 07H. 0208 Use Standards Paragraph (a) addresses General Use Standards, and sub -paragraph (1) precludes uses that are not water dependent within the EW and PTA and lists uses that may be considered water dependent. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(G) stales that development shall not jeopardize the use of the waters for navigation or for other public trust rights in public trust areas including estuarine waters. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (b) addresses Specific Use Standards. Of these, subparagraphs (6) Piers and Docking Facilities, (7) Bulkheads. and (10) Freestanding Moorings pertain to this project, and those subparagraphs not listed are not applicable to this project. Paragraph (6) Piers and Docking Facilities Subparagraph (6) (A) states, "Piers shall not exceed six feet in width. Piers greater than six feet in width shall be permitted only if the greater width is necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur;" Consistent: The proposed development is consistent with the intent of this rule. In calculating the shaded impact, uncovered open water slips shall not be counted in the total. Projects requiring dimensions greater than those stated in this Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Size restrictions shall not apply to marinas;" Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6) (C) states, "Piers and docking facilities over coastal wetlands shall be no wider than six feet and shall be elevated at least three feet above any coastal wetland substrate as measured from the bottom of the decking;" Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6) (D) states, "A boathouse shall not exceed 400 square feet except to accommodate a documented need for a larger boathouse and shall have sides extending no farther than one-half the height of the walls and covering only the top half of the walls. Measurements of square footage shall be taken of the greatest exterior dimensions. Boathouses shall not be. allowed on lots with less than 75 linear feet of shoreline. Size restrictions do not apply to marinas;" Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6) (E) states, ".The total area enclosed by an individual boat lift shall not exceed 400 square feet except to accommodate a documented need for a larger boat lift;" Consistent: The proposed development is consistent with the intent of this rule. Paragrauh (7) Bulkheads Subparagraph (7) (A) states, 'Bulkhead alignment, for the purpose of shoreline stabilization, shall approximate the location of normal high water or normal water level." Inconsistent: The proposed bulkhead alignment averages f2' waterward of NWL. Subparagraph (7) (B) states, `Bulkheads shall be constructed landward of coastal wetlands in order to avoid significant adverse impacts to the resources." Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (7) (D) states, "Bulkheads shall be permitted below normal high water or normal water level only when the following standards are met: (i) the property to be bulkheaded has an identifiable erosion problem, whether it results from natural causes or adjacent bulkheads, or it has unusual geographic or geologic features, e.g. steep grade bank, which will cause the applicant unreasonable hardship under the other provisions of this Rule; Consistent: The proposed development is consistent with the intent of this rule. (ii) the bulkhead alignment extends no further below normal high water or normal water level than necessary to allow recovery of the area eroded in the year prior to the date of application, to align with adjacent bulkheads, or to mitigate the unreasonable hardship resulting from the unusual geographic or geologic features; Consistent: The proposed bulkhead aligns with the adjacent property to the Northwest. (iii) the bulkhead alignment will not adversely impact public trust rights or the property of adjacent riparian owners; Consistent: The proposed bulkhead connects to and aligns with the adjacent properties bulkhead to the Northwest. (iv) the need for a bulkhead below normal high water or normal water level is documented by the Division of Coastal Management; Consistent: The proposed development is documented in a Field Investigation Report. (v) the property to be bulkheaded is in a nonoceanfront area. Consistent: The proposed development is consistent with the intent of this rule. Paragraph 00) Freestanding Moorings Subparagraph (10) (A) states, "A "freestanding mooring" is any means to attach a ship, boat, vessel, floating structure or other water craft to a stationary underwater device, mooring buoy, buoyed anchor, or piling (as long as the piling is not associated with an existing or proposed pier, dock, or boathouse);" Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (10) (D) states, "To protect water quality of shellfishing areas, mooring fields shall not be located within areas where shellfish harvesting for human consumption is a significant existing use or adjacent to such areas if shellfish harvest closure is anticipated to result from the location of the mooring field. In compliance with Section 101(a)(2) of the Federal Water Pollution Control Act, 33 U.S.C. 1251 (a)(2), and North Carolina Water Quality Standards adopted pursuant to that section, shellfish harvesting is a significant existing use if it can be established that shellfish have been regularly harvested for human consumption since November 28, 1975 or that shellfish are propagating and surviving in a biologically suitable habitat and are available and suitable for harvesting for the purpose of human consumption. The Division of Marine Fisheries shall be consulted regarding the significance of shellfish harvest as an existing use and the magnitude of the quantities of shellfish that have been harvested or are available for harvest in the area where harvest will be affected by the development;" Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (10) (E) states, "Moorings shall not be located without written consent from the leaseholders or owners of submerged lands that have been leased from the state or deeded by the state;" Consistent: The proposed development is consistent with the intent of this rule. Overview: The subject property is a 26.53 acre site with approximately 1,335 linear feet of shoreline along the North Landing River, which connects to the Currituck Sound. The property elevation averages 6 feet above Normal Water Level (NWL). The site is located primarily outside of a Floodzone, with shoreline areas located within an AE Floodzone. Existing site improvements consist of a former hunt club lodge, a barn and a tennis court. The lodge, known as the Flyway Hunt Lodge, is listed on the National Register of Historic Places. The lodge is located a minimum of 44 feet landward of NWL. Existing shoreline improvements are located along the southernmost 825 linear feet of shoreline. These include approximately 750 feet of remnant wooden bulkhead lined with concrete riprap and small bricks, a derelict 75 foot by 130 foot open water basin bounded by a perimeter of remnant sections of concrete groin, "U'- shaped pier/platforms and a 20 foot wide entrance, and a 5 foot wide by 32 foot long pier located within the basin. The remaining 510 linear feet of shoreline north of the basin is currently unimproved, though remnant pilings located 35 feet waterward of NWL suggest it was once protected with wooden bulkhead. Water depths range from -1 foot to -3 feet and average -2 feet below NWL near the shoreline. The shoreline has an erosion escarpment ranging from 1 feet to 8 feet. The bulkhead will tie into the existing bulkhead on adjacent property to the north and extend a maximum distance of 12 feet waterward of NWL at this location. The bulkhead will then taper back to NWL for a distance of 40 feet and average a distance of 2 feet waterward of NWL for the remaining 1,295 feet. The bulkhead will terminate with a 30 foot return wall at the southern property line. All backfill material will be from a clean upland source. The boat ramp will be placed in the open water basin and extend 30 feet waterward of NWL. The ramp will have a 1:10 slope ratio. The 32 foot long pier will replace the existing pier in the basin. Existing remnants will be removed as needed to accommodate new structures. The tie pilings will create two (2) boat slips. The mooring buoy will be located 120 feet waterward of the bulkhead and will be located in 3 feet of water The waters of the North Landing River in this area are classified as SC and Joint Waters and are closed to shellfish taking: No submerged aquatic vegetation was observed growing at the project site. Based on available_ information, there appear to be no archaeological sites on or near the property. Anticipated impacts resulting from this project are expected to include: the filling. of 3,120 sq. ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC); the shading of 1,163 sq. ft. of Public Trust Area/Estuarine Waters AEC, and; the disturbance of .62 acre of Estuarine Shoreline AEC. Basis for Determination: The site is designated as "Limited Service Areas' on the Currituck County Future Land Use Map (FLUM); with Areas of Environmental Concern (AECs) also designated as "Conservation Areas' as indicated on Page 11-1. As indicated on Page 11-2, the purpose of the Limited Service designation is to provide for primarily residential development at low densities. The policy emphasis for Knotts Island is indicated on Page 11-11. Developable areas are to remain as low to very low density residential, at predominately 1 unit per 3 acres. As indicated on Page 11-1, the purpose of the Conservation designation is to provide for the long-term management and protection of significant, limited,_ or irreplaceable areas. Proper management is needed to conserve the natural, cultural, recreational, scenic or biologically productive values of these areas. The designation is applied to. areas that should not be developed at all (preserved), or if developed, done so in a very limited manner characterized by careful planning and cautious attention to the conservation of environmental features. The proposal involves the construction of a bulkhead, pier and boat lift. No new structures or impervious areas are proposed for the high ground portion of the property at this time. Staff review of the plans and specifications has determined that the project, as proposed, consists of activities that will not pose surface water quality threats from stormwater runoff. PROJECT SUMMARY: The applicant proposes to construct the following: • 1335' of bulkhead with a maximum distance waterward of 12' with an average of 2' waterward • 60' x 15' Boat ramp • 84' x 5' Pier with a 16' x 16' platform attached to the end • 32' x 5' Pier • 16' x 5' Pier • 14' x 12' Boat lift • 4 Tie pilings (designating 2 separate slips) • 1 Mooring buoy with a 10' arc of swing Project Setting The site of the proposed development is located at 220 Marsh Causeway, Knotts Island Currituck County, adjacent to North Landing River connecting to the Currituck Sound. This property is the location of the historic Flyway Hunt Lodge and it is listed on the National Register of Historic Places. The property is approximately 26.53 acres in size and has approximately 1335' of shoreline with an erosion escarpment ranging from 1' to 8'. The southern shoreline is currently lined primarily with concrete rip rap with small bricks added throughout. This riprap is directly behind a remnant wooden bulkhead which extends from the southern property line in a northwest direction for ±750'. At this point the remnant bulkhead transitions to a non-functioning groin that extends ±500' to the west perpendicular to shore. This groin once provided protection for a large open water basin facility that is now derelict. 120' of the groin has been backfilled with large blocks of concrete that extend approximately 3' above NWL. This concrete groin formed the southern side of the open water basin. The north side of the basin was formed by a remnant "L" shaped pier which has a maximum distance of approximately 120' waterward of NWL extending northwest before turning southwest for 30'. From the southern end of the "L" shaped pier/platform there is a 30' open area before another section of platform starts. This platform extends approximately 30' before connecting to the concrete groin. The placement of the pier, platforms, and groin formed a 130' x 75' open water basin. Inside this basin sits a 32' x 5' pier that is still in use today. The majority of the remaining ±510' of shoreline between the basin and the northern property line is unhardened and littered with roots and fallen trees with small arnounts of concrete riprap scattered along the length. Based on remnant piles, this section of shoreline was once protected by a wooden bulkhead. The remnant pilings are now ±35 waterward of the current NWL. As of now the parcel contains the former hunt club lodge, a barn, and a tennis court. According to the USDA's Natural Resources Conservation Services' Web Soil Survey, the majority soil on the property is made up of Bojac loamy sand, with a small amount of Tomotley fine sandy loam sand as well as Altavista fine sand present. These soils are covered with grasses that are mowed periodically. The adjacent riparian property to the north is an empty lot within the East Point Estates subdivision. This lot contains bulkhead shoreline and a "T head" pier which extends t100' perpendicular to shore. This pier is located outside the applicant's riparian corridor. The adjacent riparian property to the southeast is part of the Mackay Island National Wildlife Refuge which contains no hardened structures. Based on available information, there appears to be no archaeological sites on this property or nearby. The waters of North Landing River in this area are classified as SC and are closed to shellfish taking. The proposed project will take place in joint waters. Water depths within the project site range from -1' to -3' and average -2' below NWL The bottom substrate within the project area is made up of muddy sand. No submerged aquatic vegetation was observed growing at the proposed project site. Development Proposal In order to prevent further erosion, the applicant proposes to stabilize the shoreline by constructing 1335' of vinyl bulkhead. In order to connect to the bulkhead north of the property the proposed bulkhead must extend a maximum distance of 12' waterward of NWL at this location. The proposed bulkhead alignment will then taper back to NWL over a distance of 40' where it will continue roughly averaging 2ft waterward of NWL for the remaining 1295'. On the southeastern side of the bulkhead, the applicant proposes to build a 30' return wall along the property line. Excavation of trees and rootballs may be required along the western shoreline. All backfill material will be from a clean upland source. The proposed boat ramp will be constructed from concrete and will be 15' wide and 60' long. The boat ramp will be placed in the open water basin facing southwest and will extend 30' waterward of NWL. The proposed boat ramp will have a slope with a ratio of 1' 10' The water depth at the end of the proposed ramp is -2.5' measured from NWL. Three piers have been proposed with this project. The first pier is located in the footprint of the remnant pier which once formed the north side of the basin. This pier will be 84' x 5' and have a "T head" design with 16' x 16' platform attached to the end totaling a maximum distance of 100' from NWL. On the northern side of the platform the applicant proposes a 12' x 14' boatlift. The water depth at the proposed boat lift is -2 5' measured Field Investigation Report Page 4 from NWL. Also, proposed is a boat slip off the southern side of the pier. The boat slip will be designated by 2 tie piles. The water depth at the proposed slip location is -2.5' measured from NWL. The second pier will be replacing the current pier which is still in use inside the basin. This pier will be 32' x 5' and will also have a proposed slip off the southern side designated by 2 tie piles. The water depth at the proposed slip location is - 2.5' measured from NWL. The third pier will be located outside the basin ±400' from the southern property line. This pier will extend southeast perpendicular to the shoreline, and will be 16' x 5'. All three piers meet the''/<width rule and do not require a 15' setback. Lastly, the applicant is proposing a mooring buoy south of the basin located 120' waterward of the proposed bulkhead. The mooring buoy will have a 10' arc of swing, and will be in located in 3' of water_ Anticipated Impacts • The construction of the bulkhead along the proposed alignment will result in the filling of ±2,670 ft2 of the PTA and EW AEC with clean fill from an upland source along 1335' of the ES AEC. The construction of the bulkhead will disturb ±26,700 ft2 of high ground within the ES AEC. • The construction of the boat ramp will fill 450 ft' of shallow bottom of the EW and PTA AEC. • The boat ramp will have a 450 ft' high ground disturbance along a 15' wide portion along the ES AEC. • Combined the 3 piers, the platform, the boatlift, and the mooring buoy proposed will shade 1,163 ft' of open water of the PTA and EW AEC. We will excavate as needed and install vinyl bulkhead according to the attached drawings. Excavation of existing shoreline will be done to align the design and to remove any trees and/or rootballs to allow construction. The new bulkhead will be built upon or inland of the previous wall to ensure that no land is gained during this project. All excavated soil will be used for backfill. The wall will run from the existing neighboring bulkhead at the northernmost point to the survey pin located at the southernmost point. The NWL varies from 0" to approximately 18" along the entire 1335' of proposed wall. It is 0" where the land has eroded behind the previously built bulkhead and varies up to a depth of approximately 18" along the remnants of the previous bulkhead. Mean low water level is +/-6" below NWL. Mean high water level is +/-6" above NWL. We have experienced erosion over the last year which cannot be seen well on available aerial photographs. We have areas all along the property line which have experienced soil loss (up to 2'), including the loss of three large trees (approx. 3' diameter trunk) at the waterline near the dock area. Below is an area marked "A" on Attachment #1 (2016 aerial photograph) showing approximately 50 linear feet of soil erosion. Over the last year there has been approximately three foot of loss of land in this area due to the erosion.
