This permit, issued on August 6, 2020 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation If these terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null anti voto. Docking Facility 1) This permit authorizes only the docks, boatlifts, piers, floating platform, covered platform, boathouse, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Wayne Del Tufo ADDITIONAL CONDITIONS Permit No. 84-20 Page 2 of 3 3) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout, the entire existence of the permitted structure. 4) In order to satisfy concerns of the resource agencies, physical stops shall be placed on the floating dock at a minimum height of 18" above the bottom substrate to prevent the floating dock from disturbing the bottom substrate. The physical stops shall remain in place for the life of the permitted docking facility. 5) The authorized structures and associated activity shall' not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) The boathouse portion shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. The footprint of the boathouse shall not exceed the dimensions on the authorized workplans. 8) The authorized boathouse portion shall be single story, and shall not be designed to allow for second story use. 9) The authorized covered platform portion shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches are permitted. Lattice is specifically excluded from being used under this authorization. 10) The roof of the covered platform portion shall not be designed for second story use. 11) This permit authorizes a maximum of 2 formalized boat slips. 12) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access. 13) Any portion of the permitted access pier and docking facilities built above Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured from the bottom of the decking. USACE Conditions 14) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at http://www.fws.gov/nc-es/mammal/manatee! guidelines.pdf. Wayne Del Tufo ADDITIONAL CONDITIONS General Permit No. 84-20 Page 3 of 3 15) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 16) All debris associated with this development shall be contained within the authorized project area and removed to an appropriate upland refuse disposal site. 17) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2020-00931). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2020-0696. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water. NOTE: An application processing fee of $250 was received by DCM for this project. Please understand that the waters around your project area have been identified by the Division of Marine Fisheries as Primary Nursery Area (PNA). Should the need for dredging within the proposed project area arise in the future, please be aware that new dredging within a PNA is not allowed under 15A NCAC 02B .0221 and is a degradation of water quality standards and therefore considered a water quality violation. The Town of Sunset Beach Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these standards appear to be applicable to this proposal. The proposed project would be located on the mainland side of and adjacent to the AIW W at 9421 Peakwood Dr. SW, Sunset Beach, Brunswick County, North Carolina. The proposal is to build a private 2-slip docking facility. This would include a 456 feet by 6 feet access pier, an 8 feet by 6 feet fixed access platform to the southeast of the pier leading waterward to a 16 by 3 feet access ramp which leads to a 12 feet by 8 feet floating dock. A 12 feet by 10 feet fixed platform would be located at the waterward end of the access pier. Extending to the northwest perpendicular to the pier and the platform would be a 33 feet by 13 feet boathouse with a boatlift. This docking facility would cover 1,872 square feet of coastal wetlands and 1,365 square feet of open water of the AIW W. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: Special Conditions 1. All work authorized by this permit must be performed in strict compliance with the submitted plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. 2. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. Approval of the structure is based on determinations that there would be no obstruction to navigation. The structure may be damaged by wave wash from passing vessels. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the N.C. Division of Water Resources at (919) 733-5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. 5. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 6. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. PROJECT DESCRIPTION MAY 2 2 2020 DCM-MHD CITY The proposed project is located on the mainland side of the AIW W in Sunset Beach, Brunswick County. The property can be reached by traveling NC HWY 17 south towards Sunset Beach. Travel straight through the intersection of HWY 17 and NC 130 in Shallotte, and continue down HWY 17 until you reach Seaside Rd SW/ NC 904. Take a left onto Seaside Rd S W/ NC 904 and continue south until it intersects with NC 179/ Old Georgetown Rd SW. Take a right onto NC 179/ Old Georgetown Rd SW and continue for approximately 3.5 miles. Turn left onto Beach Dr./ NC 179 Business. Continue south for approximately 1.5 miles and then take a right onto Ocean Harbor Golf Club Rd. Take your first left onto Peakwood Dr. and continue until you reach 9241 Peakwood Dr. on the left-hand side. The property consists of a single family residence under construction located on a .71-acre high bluff parcel approximately 16' above normal high water (NHW) and is vegetated with typical coastal -plain tree species found on well -drained, rich soils including Mockernut Hickory (Carya tomentosa) and Tulip Poplar (Liriodendron tulipifera). The property has approximately 124 linear feet of shoreline frontage along the southern edge of the property and is stabilized with landscape grasses. Sporadic patches of Saw Palmetto (Serena repens) and Wax Myrtle (Wica cerifera) separate the landscape grasses from the high marsh. High marsh spans approximately 20' waterward from the toe of the bluff and consists mainly of bulrush (Scirpus spp.). The Coastal Wetlands located water ward of MHW consist primarily of Smooth Cord Grass (Spartina alterniflora), spanning approximately 260' over intermittent mud flats as it extends out to the A1W W. The width of the waterbody measures approximately 618' from marsh to marsh in the vicinity of the proposed docking facility. The waters of the AIW W are classified SA by the Division of Water Quality and ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to install a private pier, finger pier, covered boathouse with boatlift and fixed platform underneath, and a floating dock for a total of 2 slips. The applicant proposes to build a 6' x 456' access pier (as measured from MHW) that would originate from an upland point and extend toward the southeast. The proposed access pier would lead to a 6' x 8' (48 sq. ft.) finger pier located at approximately 412' on the west side of the pier. The finger pier would lead down a gangway to an 8' x 12' (96 sq. ft.) floating dock (Slip 2). The access pier would continue beyond the finger pier another 44' where it would terminate with a 13' x 33' (429 sq. ft.) covered boathouse that includes a boadift (Slip 1) and a 10' x 12' fixed platform (approximately 144' beyond the waterward edge of the marsh). The property has approximately 124 linear feet of shoreline and the facility's design appears to remain within the applicant's area of riparian access and would not encroach into either 15 ft. adjacent riparian access. The applicant's design extends beyond the pier head line of adjacent docking facilities but does not exceed the'/. width of the waterbody. As measured by the contractor, the docking facility would extend across approximately 23% of the waterbody. The proposed design terminates approximately 55' landward of the USACOE 80' federal channel setback. The applicant proposes to extend beyond the pier head line to reach navigable water depths throughout the tidal range and to avoid bottom impacts to the Primary Nursery Area (PNA). Water depths (as measured by the contractor) at the pier head line are approximately -1.0' NLW. The contractor recorded water depths that ranged from -2.0' NLW at the landward edge of the proposed docking facility to -2.5' NLW at the waterward edge of the proposed docking facility. DCM staff recorded water depths ranging from -1.5' NLW at the landward edge of the proposed docking facility to -2.0' NLW at the waterward Del Tufo Private Docking Facility May 18, 2020 Page 3 edge of the proposed docking facility (measurements taken at 9:45am on 5-13-20). 10. ANTICIPATED UKPACTS The proposed docking facility would incorporate approximately 1,365 sq. ft. of Estuarine and Public Trust Area and would shade approximately 1,872 sq. ft. of Coastal Wetlands. The proposed configuration of the docking facility would provide docking space for two (2) vessels in water depths ranging from approximately -2.0 ft. to -2.5 8. @ NLW as measured by the contractor. The proposed development would be located outside of the adjacent 15' riparian corridor setbacks on both sides and would be constructed outside of the federal channel setback. Minor increases in turbidity should be expected during construction. Submitted by: Brendan Brock Date: May 18, 2020 Office: Wilmington RECEIVED MAY 2 2 2020 DCM-MHD CITY Scope of Project The purpose of the project is to facilitate allowances for riparian property owner's right to use adjacent water as articulated in the property deed of the owners of the property at 9241 Peakwood Dr. Sunset Beach, NC. The deeds stipulate the ability to build slips in accordance with state and federal laws. Currently, the neighboring structures are at an outward point of approx. 1 ft- depth of water at NLW. The "pier head line" which extends from the outermost distance of neighboring pier to neighboring pier is typically used for placement of outward distance of new piers in close proximity to them. Using this headline would place the new structure at the same depth of water as the neighboring piers which causes the inability of using the structure for docking at low tides. This, potentially, could cause problems not only with docking but with distress situations such as being stranded with no place to dock for hours until the tide rises enough to dock a boat. Other neighbors have already built their piers to the outward distance that is being proposed with this permit. The owner would like to place the pier approx. 30 ft. water ward of the neighboring pier headline described above. This would be in line with several neighboring piers which have already been built to that distance and allow safer boating so as not to wait hours to dock safely. The USACE has been contacted and reported that the neighboring pier outward position is approx. 85 ft. from the 80 ft. setback from the toe of the AIWW dredge channel. Therefore the proposed distance of this pier is still approx. 5S ft. from the setback. There would be a total of one pier located a distance outward to allow for sufficient depth of water at designated slip sites as shown on submitted drawings. The stationary access pier would be built from above NHW on the property and extend approx. 456 ft. into the AI W W with one boat lift. prescribed (as shown on drawing) and one floating dock would be built located adjacent to the water ward end of the pier to be used as the single floating structure. The pier with its boat lift and floating dock will provide docking for the property owners of 9241 Peakwood Dr. The size of the tract is approx.71 acres and 124lineal ft. of frontage on the AIWW. All permits, delineations, and surveys deemed necessary for this project will be acquired. There are no current facilities built there at this time. Project Chronology: All building materials will be brought to the project site and unloaded on the Deltufo property above the coastal wetlands line. These materials will be moved by hand to the respective positions on the structure as needed during the building process. The materials will be handled with care taking precautions to minimize any movement in the wetlands area. Initial construction will begin with installation of the pier pilings. Pilings will be 6 in. by 6 in. marine grade pressure treated 2.5. These pilings will be "jetted" down into the grade using a 2 in. or 3 in. water pump. The water pump will be placed on a flotation device which is secured using an anchor system. The flotation device is in approx. 2 — 3 ft. deep water at normal low tide. The pilings will be installed @ approx. 8 ft. on center running perpendicular to the shoreline. The depth of the pilings will be approx. 6 ft. or to hard shell layer. The pilings will be installed to total length of the respective pier as shown on drawings. Once pilings are installed, the framework will be installed. 2 in. by 8 in. band boards will be run along the outside of the pilings longwise with the pier. These band boards are 16 ft. long and will incorporate 3 pilings per board. The pier will be constructed to that the elevation of the deck boards is @ 4 ft. above normal high water. The beginning of the pier is set at the top of the bank elevation. Once band boards are installed the girder beams will be installed. 2 in. by 8 in. girder beams will be placed underneath band boards and attached to the pilings on both sides per piling. The girders will be through bolted into the pilings using 5/8 hot -dipped galvanized carriage bolts. Once the girder beams are installed, the joists will be installed. 2 in. by 8 in. joists will be installed @ 2 ft. on center and toe nailed into the girder beams using hot -dipped galvanized 16d nails. The joists are 2 in. by 8 in. treated lumber using 16 ft. boards which incorporate 3 girders per board. The joists will meet halfway between girders and rest on top of the girders. Once the joists are installed, the decking will be installed. Decking material is 2 in. by 6 in. # 1 treated lumber. These will be installed using stainless steel screws (# 10). Deck boards will be installed as to allow for proper spacing between boards for drainage etc. Decking will extend from outside of band board to outside of band board. Once decking is complete on the pier, the water pump will be placed on the pier to complete any necessary jetting of pilings. RECEIVED MAY 2 2 2020 Once decking is complete, the floating dock will be constructed. The floating dock will be constructed off —site and floated to site. Dimensions: 12ft. L. by 8 ft. W. with an additional gangway landing section DCM-MHD CITY dim. 8 ft. W. tapering to 6 ft. W. by 6 f. L. The floating dock will be constructed using black polyethylene encapsulated Styrofoam billets. Billet dimensions— 2 ft.W by 4 ft. L by 18 in. depth. Band boards are 2 w MAY 0 7 2020 in. by 8 in. set @ 2 ft. on center. Corners of frame are reinforced using 3 in. by S in. hot dipped galvanized steel angle brackets and Y. in. galvanized carriage bolts through wood and brackets. Decking is 2 in. by 6 in. treated lumber secured using #10 stainless steel screws. Once dock is complete and brought to site via water, the dock will be secured with three pilings. Pilings will be set outside the framework of the dock using exterior piling guides. Two pilings will be set on the east side of the floating dock toward the stationary boat house and one on the north side next to the gangway. Pilings will be installed using the water pump and will be jetted to approx. 6 ft. depth or to hard shell layer. Once dock is in place, the gangway will be built and installed. The gangway will be attached to the pier and will rest on the floating dock with rollers at the end for movement Gangway dimensions: 3 ft. W by 16 ft. L. The gangway will be constructed using all aluminum framework, all aluminum roller system with rubber rollers, and composite decking. Once the gangway is installed, the handrail for the pier will be constructed. The handrail for the gangway and pier is the same and is described below: 4 in. by 4 in. posts set # 8 ft on center connected to the band boards on the pier using (1) 5/8 in. hot dipped galvanized carriage bolts. The top rail is a 2 in. by 6 in. board with another 2 in. by 4 in board adjacent attached together using # 10 stainless steel screws. A center rail board is a 2 in. by 4 in. board Both top and center rail boards are connected to the 4 in. posts using # 10 stainless steel screws Handrails will be installed on the main access pier and on the decked area of the boat house. Boat lift installation: The boat lift slip will only be built for the use of boat lifts and not for mooring, docking, etc. The boat lift pilings will be installed per footprint of respective manufacturer's specification. Typically, and for purposes of the permitting process, we are proposing the footprint for 'Ile 10,000lb. lift manufactured by Boatlift US. This footprint is for the dimensions of approx. 13 ft. W by 13 ft. L. The construction of the boat lift would go as follows: The lift would be brought in sections including beams, motors, bunks, and assembly packages. These would be walked onto the pier without anyone going into the wetland area. The pilings would be brought in by boat or barge and stood up in the appropriate positions. A water pump with jetting equipment would be used to jet the pilings into place @ approx. 8 ft. depth. The pilings are approx. 8 in. diameter and would extend to approx. 2 ft. above pier deck elevation. The only exception would be the pilings for a roofed slip. Once the pilings are installed, the beams would be placed on top of the pilings, and secured using S/8 in. hex bolts into the mounting bracket provided by the manufacturer. Once the beams are installed, the lower bunk beams are installed using manufacturer provided cable, and caRECEIVED clamps. Once the bunk beams are installed, the bunk itself is installed using manufacturer provided brackets and bolts. MAY 2 2 2020 Once the boat lift is installed, the electrical source is installed. Hardwire option: DCM-MHD CITY RECEIVED MAY 0 7 nN ACM Nc Option for hardwire will involve the installation of #4 wire to be run from meter box that will eventually be installed on the house. The wire will be outdoor wire and will be buried underground per Sunset Beach building code (2 ft. depth) using a ditch witch power trencher only to be used outside of the wetlands area. The trench will go to the beginning of the pier where the wire will be run to a panel box which will also serve as a disconnect per Sunset Beach code. From this location, a wire will be run in conduit under the pier (no. 8 wire) to the boatlift switch located on the handrail post adjacent to the boat lift slip. All electrical will be installed using licensed electrician and proper per code hardware. Roof over slip and deck construction: Roof over slip and deck construction' section to 13' W x 33' L. The covered boathouse consists of a covered boatlift and a covered gazebo all under one roof. The boat lift slip area being approx. 12 ft. W. by 10 ft. L and the boat lift (slip) is 23 ft. L. by 13 ft. W. The roofed slip would have 8 pilings spaced @ approx. 10 ft. on center. The roof material would be brought in on the pier and installed as follows: Approx. 8 in diameter pilings will be installed approx. 8 ft. depth or to hard shell layer using water pump and associated jetting equipment. Pilings elevation will be approx. 8 ft. above deck elevation. Once pilings are installed, the roof band boards will be installed on the outside of the pilings at the approx. 8 ft. elevation. The band boards will be thru bolted into the pilings using 5/8 galvanized carriage bolts. The band board will be doubled using 2 in by 8 in. treated boards. The rafters will be 2 in. by 6 in. treated boards and will be installed to a 5/12 pitch using a hip roof style. The hip rafters will be 2 in. by 8 in. treated boards. Collar beams — 2 in. by 6 in. will be installed from rafter to rafter per code. Total outside to outside measurements will be 14 ft. W. by 22 ft. L. including overhangs. The rafters will be installed @ 16 in. on center and have 1 in. by 6 in. strapping attached @ 2 ft. on center using screws for tin roofing installation. Its a PNA and the applicant is looking to exceed the pier head line but NOT the 1/4 width. I went out to verify his depths yesterday. I got -2.4' NLW at the waterward end of the proposed floating dock (Applicant got -2' 6" NLW) and -1.9' NLW at the landward end of the proposed boatlift/floating dock (Applicant got -2.0' NLW). Sunset Beach Bridge tidal gauge on 5/13 had low tide at 8:08am at.4' above average. I took measurements at 9:45am. Just wanted to get your expertise to adjust the numbers since you may be more familiar with the area and the tidal lag.
