Breakwaters 1) The four (4) breakwaters shall be constructed in accordance with the alignments depicted on the attached workplan drawings. 2) The height of the permitted breakwater shall not exceed 4 foot 2 inches above the normal water level. 3) The breakwater shall be constructed with an equal gap between each sheathing board totaling at least two inches of open area for every two linear feet of breakwater. The breakwater sections may be staggered and overlap as long a five-foot separation between sections is maintained. (See attached sheet for Additional Conditions) This permit action may be appealed by the pennittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Darling Permit No. 121-20 Page 2 of 2 ADDITIONAL CONDITIONS 4) The permitted breakwaters shall be constructed of treated wood, plastic lumber, metal or vinyl sheet piles or other suitable materials approved by Department personnel. 5) No backfill of the breakwater or any other filling of wetlands, estuarine waters, public trust areas or high ground is authorized by this permit. 6) Should the Lot to the north be sold prior to the initiation of construction of the breakwaters, the permittee shall obtain a written agreement from the new owner(s) waiving the minimum setback, and authorization to construct the portion of the breakwaters within the property owner's riparian setback, and submit it to the Division of Coastal Management prior to initiating construction of the breakwaters. 7) Perpendicular sections, return walls or sections which would enclose estuarine waters or public trust areas shall not be allowed under this permit. 8) The permittee shall maintain the breakwaters in good condition and in conformance with the terms and conditions of this permit or the remaining breakwater structures shall be removed within 90 days of notification from the Division of Coastal Management. General 9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 10) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required, including but not limited to any authorizations required from the NC Division of Water Resources and the US Army Corps of Engineers. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. NOTE: An application processing fee of $250 was received by DCM for this project. Darling Major Permit Recommendations The applicant proposes to install four vinyl breakwater sill sections to protect two 90 degree bulkhead comers from damage and erosion associated with strong southeasterly winds. The site of the proposed development is located at 936 Waterlily Road (SR#1142), Coinjock, Currituck County, adjacent to the Currituck Sound. The development proposal involves the Public Trust Area (PTA) and Estuarine Waters (EW) Areas of Environmental Concern (AFC's). I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project and my findings are as follows: 15A NCAC 07K 0206 Estuarine Waters (d) Use Standards. Suitable land/water uses shall be those consistent with the management objectives in this Rule. Highest priority of use shall be allocated to the conservation of estuarine waters and their vital components. Second priority of estuarine waters use shall be given to those types of development activities that require water access and use which cannot function elsewhere such as simple access channels; structures to prevent erosion; navigation channels; boat docks, marinas, piers, wharfs, and mooring pilings. In every instance, the particular location, use, and design characteristics shall be in accord with the general use standards for coastal wetlands, estuarine waters, and public trust areas described in Rule 07H.0208. Consistent: The proposed development is consistent with the intent of this rule. Acceptable uses shall be those consistent with the management objectives in Paragraph (c) of this Rule. In the absence of overriding public benefit, any use which jeopardizes the capability of the waters to be used by the public for navigation or other public trust rights which the public may be found to have in these areas shall not be allowed. The development of navigational channels or drainage ditches, the use of bulkheads to prevent erosion, and the building of piers, wharfs, or marinas are examples of uses that may be acceptable within public trust areas, provided that such uses shall not be detrimental to the public trust rights and the biological and physical functions of the estuary. Projects which would directly or indirectly block or impair existing navigation channels, increase shoreline erosion, deposit spoils below normal high water, cause adverse water circulation patterns, violate water quality standards, or cause degradation of shellfish waters are considered incompatible with the management policies of public trust areas. In every instance, the particular location, use, and design characteristics shall be in accord with the general use standards for coastal wetlands, estuarine waters, and public trust areas. Consistent: The proposed development is consistent with the intent of this rule. 15A NCAC 07H.0208 Use Standards Paragraph (a) addresses General Use Standards, and sub -paragraph (1) precludes uses that are not water dependent within the EW and PTA and lists uses that may be considered water dependent. , Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(A) states that the location, design, and need for development, as well as the construction activities involved shall be consistent with the management objective of the Estuarine and Ocean System AEC and shall be sited and designed to avoid, significant adverse impacts upon the productivity and biologic integrity of coastal wetlands, shellfish beds, submerged aquatic vegetation as defined by the Marine Fisheries Commission, and spawning and nursery areas. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(B) states that development shall comply with state and federal water and air quality standards. .Consistent: The -proposed development is consistent with the intent of this rule. DATE: September 3, 2020 Y e F� �cA Y tl IFm SEP 4 2020i Darling to install four (4) breakwater sills totaling Sound; at 936 Waterlily Road, in the Waterlily Consistency Determination: The request is consistent with/not in conflict with the Currituck 'County 2006 Core Land Use Plan (LUP) certified by the CRC on May 18, 2007 as amended through July 2, 2019. Overview: The .21 acre site has approximately 97 linear feet of shoreline along the Currituck Sound. Water depths near the shoreline measure -2 feet below Normal Water Level (NWL). Site elevations range from 2 feet along the shoreline to 4 feet above NWL within highground areas. The site is vegetated with yard grasses and ornamental bushes. The property is located within the AE Floodzone. Existing site improvements consist of a single-family house, two (2) sheds and a fenced garden. Existing shoreline improvements consist of a wooden bulkhead along the entire length of shoreline, a 4 foot wide by 24 foot long pier with an 8 foot by 8 foot terminus platform, a 24 long wooden breakwater located along the south side of the pier and a remnant 10 foot wide groin. Installation of four (4) breakwater sills totaling 42 linear feet is proposed. Three (3) 9 foot long breakwater sections and a 15 foot long breakwater section will be installed 2 feet to 24 feet waterward of NWL. The breakwater sections will have a 2 inch gap between 2 foot wide vinyl sheets to allow water flow and will extend 4 feet above NWL and 2 feet above adjacent bulkheads. The breakwaters will protect two (2) 90 degree bulkhead corners from damage and erosion associated with strong southeasterly winds. The waters of the Currituck Sound in this area are classified as Joint and SC waters and are closed to shellfish taking. The open water fetch to the east and southeast of the site ranges from 5 to 19 miles. Submerged Aquatic Vegetation (SAV) was not observed growing within or adjacent North Carolina Department of Environmental Quality I Division of Coastal Management Elizabeth City Office 1 401 South Griffin Street. Basis for Determination: The project is located on the Currituck Sound. Areas of Environmental Concern (AECs) are designated as "Conservation Areas" as indicated on Page 11-1. As indicate on Page 11-1, "(t)he purpose of the Conservation class is to provide for the long-term management and protection of significant, limited, or irreplaceable areas. Proper management is needed to conserve the natural, cultural, recreational, scenic or biologically productive values of these areas. The Conservation class should be applied to areas that should not be developed at all (preserved), or if developed, done so in a very limited manner characterized by careful planning and cautious attention to the conservation of environmental features." RECEIVED Project Settinq The site of the proposed development is located at 936 Waterlily Road (SR#1142), C&qo1IQ, 2020 Currituck County, adjacent to the Currituck Sound. DCM-MI-ID CITY Roxy R. Darling Field Investigation Report Page 2 The property is ±9,079 ft2 (0.21 acres) in size and elevations range from ±2' along a bulkheaded shoreline to ±4' above NWL within the highground area. Man-made features in the highground area include a single-family dwelling and two sheds. Vegetation within this area includes yard grasses, ornamental bushes, and gardens. Based on available information, no archaeological sites are on or near this property. The properties shoreline is ±97' in length, runs generally north & south, and has been hardened with a wooden bulkhead. The adjacent property shorelines to the north and south of the site are both bulkheaded and extend in an eastward direction from the applicant's shoreline creating a basin -like area. The adjacent shoreline to the north extends ±98' eastward while the adjacent shoreline to the south extends ±20'. Additional structures located along the site's shoreline include a 24'x4' pier with an 8'x8' platform located ±19' south of the northern property line, a 24' wooden breakwater located along the southern side of the pier and a remnant ±10' groin. The Currituck Sound is classified as Joint Waters by agreement with the Marine Fisheries Commission and Wildlife Resources Commission. The Division of Environmental Management's water quality classification for the Currituck Sound is SC and it is closed to shellfish taking. Water depths within the project area measure ±2' below NWL with a sandy bottom substrate and SAV was not observed growing within or adjacent to the project area. The open water fetch to the east and southeast of the site ranges from ±5 miles to ±19 miles. Development Proposal The applicant proposes to install four vinyl breakwater sill sections to protect two 90 degree bulkhead corners from damage and erosion associated with strong southeasterly winds. The existing groin will be removed and a 9' section of breakwater (#1) will be installed 2' out from the existing bulkhead sheeting and approximately 7' out from the first 90' degree bulkhead corner. Breakwater #2 will be 9' in length and will extend under the existing platform at an angle from the existing breakwater located along the pier. Breakwater sections #3 (15' in length) & #4 (9' in length) will be located north of the platform. These three sections are designed to protect the second 90' degree bulkhead corner and range from 2' to 24' waterward of NWL. The breakwater sections have been designed to have a 2" gap between 2' wide vinyl sheets to allow water flow. They have also been designed to extend 4' above the NWL and ±2' above the top of the adjacent bulkheads to break up waves and reduce overspray. Anticipated Impacts The construction of the breakwater sills along the proposed alignments will result in the disturbance of ±84 ft2 of shallow bottom located in the PTA and EW AEC's. Project narrative: I am applying for a permit to have1hree breakwaters constructed per attached drawings to protect the northeast corner and another smaller corner of my property. The most northeasterly one adjoins my neighbor Russ Hanson's property. The smaller one is further south along my bulkhead just inland from my pier. Both corners bear the full brunt of the strong southeasterly winds and consequent seas, which, when the water is high and rising (after prolonged winds), results in powerful and destructive breaking waves, often high enough to break green water on the top of a 7.5' high shed located a few feet from the most northeasterly corner. Mr. Hal Go dman of Construction Engineering Services, Manteo, NC has py! engineered the a breakwaters and provided the accompanying site, elevation and construction plans. They will be constructed by Layden Marine Construction. The creation of these breakwaters is to aid in preventing further destruction to these 900 corners. Without this protection the rising water levels of Currituck Sound coupled with a greater frequency of strong southeasterly storms, even now in winter, will result in continual damage to these corners. The battering is already damaging the bulkhead structure, creating areas that need frequent rebuilding and continual additions of fill to rectify the washout of the land behind the bulkhead.
