1) Unless specifically altered herein, this Minor Modification authorizes the boardwalk realignment and
8 foot wide boardwalk sections, all as expressly and specifically set forth in the attached letter and
workplan drawings. Any additional development activities may require a modification of this permit.
2) No attempt shall be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work.
3) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2023
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
General
4) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
5) This Minor Modification shall be attached to the original Permit No. 26-20, which was issued on
2/24/20, as well as all subsequent modifications, refinements, and renewals, and copies of all documents
must be readily available on site when Division personnel inspect the project for compliance.
6) All conditions and stipulations of the active permit remain in force unless specifically altered herein.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The Division of Water Resources assigned the proposed project DWR Project No. 2020-0015 Q.
NOTE: The U.S. Army Corps of Engineers assigned the project Action ID SAW-2020-00035.
NOTE: A minor modification application processing fee of $100 was received by DCM for this project.

This letter is to request a modification for the City of Washington, NC CAMA permit 26-20. The
contractor that won the bid for the project proposed two changes. The City is in favor of these
proposed changes, with permission from your office.
We request to modify the layout and width of the boardwalk structure. Please see the attached
drawing, which indicated the existing and new proposed design. The design simply straightens out some
of the turns and increases the width to 8 feet. The increased width will help individuals to socially
distance and allow more room for anyone that may have a mobility device.
Adjacent riparian property owners are being notified. We will provide certified mailing information as
soon as we have them returned.

On 24 February 2020 the City of Washington was issued CAMA Major Permit #26-20 to
construct 6 new transient day docks along the Stewart Parkway bulkhead, four finger piers
on the downstream end of the Parkway and to replace the existing 7' wide by 1,982 linear
feet boardwalk in the same footprint as the existing.
On 14 January 2021 the Washington District office received a request to modify CAMA
Major Permit No. 26-20 to re -align the existing/permitted boardwalk and increase the
width of the boardwalk from 7.0' to 8.0'.
This office recommends that CAMA Major Permit No. 26-20 be modified to re -align the
pedestrian boardwalk and increase the width to 8.0'. As a note the $100.00 for the renewal
and modification has been deposited into the Division's account.

SUBJECT: CAMA Dredge/Fill Permit Modification for City of Washington #26-20, Beaufort
County, North Carolina
Biologists with the North Carolina Wildlife Resources Commission (NC)AfRC) reviewed the permit
application with regard to impacts on fish and wildlife resources. The project site is located along Stewart
Parkway on the waterfront of the Pamlico River in Washington, NC. Our comments are provided in
accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as
amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife
Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.).
The applicant proposes to modify the existing permit by realigning the existing/permitted boardwalk and
increasing the width of the boardwalk from 7' to 8' in width. The boardwalk proposal is more aligned
with the position of the stormwater retention pond and ripmpped shoreline rather than its existing position
within the river. This modification is associated with several permits (4119-98 and #6-11) that have
scripted development along Stewart Parkway. The Pamlico River at this location is classified SC, NSW
by the Environmental Management Commission, is subject to the Tar -Pamlico Buffer Rules, and is
designated a Primary Nursery Area (PNA) by the NCWRC.
The NCWRC has reviewed the modification request and does not object to the realignment of the
boardwalk and its expansion from 7' to 8' in width. We request all permit conditions be carried forward
with this modification, including the February 15 — September 30 in -water work moratorium to protect
aquatic resources within the PNA. In -water work includes the dredging or the removal of material from
the river bottom that disturbs sediment, filling of public trust waters with sediment or large amounts of
material in the waterway or along shore, pile installation (driving, washing, or vibrating), and activities
with significant noise levels or elevated turbidities (such as pile, log, riprap, or structure removal).

Activities within the stormwater pond or on the shoreline that have no interface with river would not be
subject to this moratorium. Any piles driven into the river bottom, however, would be subject the
moratorium.

City Marina Expansion and Boardwalk Replacement
1) In order to reduce the potential for negative effects on the spawning migration of anadromous fish, no
in -water work shall be permitted between February 15 and September 30 of any year without the
prior approval of the .Division of Coastal Management, in consultation with appropriate resource
agencies.
2) This permit authorizes only the docks, signage and boardwalk replacement, and other structures and
uses located in or over the water that are expressly and specifically set forth in the permit application.
No other structure, whether floating or stationary, shall become a permanent part of this marina
without permit modification. No non -water dependent uses of structures shall be conducted on, in or.
over Public Trust waters without permit modification.

ADDITIONAL CONDITIONS
3) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
marina. Any sewage discharge'at the marina shall be considered a violation of this permit for which the
permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence
of the permitted structure.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes an additional 8 formalized transient boat slips for a maximum of 59 formalized
boat slips.
6) The marina shall display a sign showing the location of the on -site pumpout facility, including other
appropriate waste disposal information, all as described in the attached application.
7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable,
waters at or adjacent to the authorized work.
8) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or. injury
which maybe caused from existing or future operations undertaken by the United States in the public
interest.

9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
10) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to .
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2020-00035).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 20-0015.

Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that many land disturbing
activities are not authorized within 50 feet of the normal high water level unless specifically
exempted by Environmental Management Commission's (EMC) Tar Pamlico buffer
regulations in place. at the time of such development.

Dear Ms. Roberson:
You have our approval for the impacts listed below for the purpose described in your application received by the Division
of Water Resources (Division) on March 16, 2021. Please note that you should get any other federal, state or local permits
before proceeding with your project, including those required by (but not limited to) Sediment and Erosion Control, Non -
Discharge, CAMA, and Water Supply Watershed regulations. This Authorization Certificate shall expire five (S) years
from the date of this letter.
This approval requires you to comply with the following additional conditions:
1. The following impacts are hereby approved provided that all of the other specific and general conditions of the Buffer
Rules are met No other impacts are approved, including incidental impacts [15A NCAC 02B. 06111

2. Diffuse Flow
An additional condition is that all stormwater shall be directed as diffuse Bow at non -erosive velocities through the
protected stream buffers and will not re -concentrate before discharging into the stream as identified Within 15A NCAC
02B .0734(5) or provide treatment via an approved stormwater BMP meeting the nutrient removal requirements
established within i5A NCAC 02B.0734(a)(1)(2). For this project, diffuse Flow can be accomplished through guttering
of all roof drainages and directing their discharge to a point outside the entirety of the riparian buffer.
3. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the
impacts depicted in the Buffer Authorization Application. All forestry operations activities shall be performed so that
no violations of state water quality standards, statutes, or rules occur [15A NCAC 02H .0502 and .0502].
4. The Permittee shall replant the vegetation within temporarily disturbed areas associated with this project in an "in
kind" manner immediately following construction. (Example: Disturbed areas with pre-existing grassed lawns must
be replanted with grass. Disturbed areas with pre-existing trees or woody vegetation must be replanted with trees
and woody vegetation. Disturbed areas with pre-existing forest vegetation must be replanted with forest vegetation
including at least two different native hardwood tree species at a density sufficient to provide 260 trees per acre at
maturity. This density can usually be achieved by planting approximately 360 (11 x 11 spacing) to 538 (9 x 9 spacing)
trees per acre.) Restoration of trees/shrubs/forest must be completed by the first subsequent planting season

(November 1 through March 30). Note, if the tree plantings do not survive, they will need to be replaced such that
the density is sufficient to provide 320 trees per acre at maturity. [15A NCAC 02H .0507 (c), 15A NCAC 02H .0506
(b)(3), and 15A NCAC 02B .0734 (6)]
5. This approval is for the purpose and design described in your application. The plans and specifications for this project
are incorporated by reference as part of the Authorization. If you change your project, you must notify the Division
and you may be required to submit a new application package With the appropriate fee. If the property is sold, the
new owner must be given a copy of this approval letter and Authorization and is responsible for complying with all
conditions. [ISA NCAC 02B .0507(d)(2)]
6. This approval and its conditions are final and binding unless contested. {G.S. 143-215.51
This Buffer Authorization can be contested as provided in Articles 3 and 4 of General Statute 150B by filing a written petition
for an administrative hearing to the Office of Administrative Hearings (hereby known as OAH). A petition form may be
obtained from the OAH at htW;//www ncoah com/ or by calling the OAH Clerk's Office at (919) 431-3000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A petition is considered
filed when the original and one (1) copy alongwith anyapplicable OAH filing fee is received in the OAH during normal office
hours (Monday through Friday between 8:00am and 5:00pm, excluding official state holidays).
The petition may be faxed to the OAH at (919) 431-3100, provided the original and one copy of the petition along with any
applicable OAH filing fee is received by the OAH within five (5) business days following the faxed transmission.
