This permit, issued on February 24, 2020 is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
if these terms may be subject to fines, imprisonment or civil action; or may cause me permit to De null ana vota.
City Marina Expansion and Boardwalk Replacement
1) In order to reduce the potential for negative effects on the spawning migration of anadromous fish, no
in -water work shall be permitted between February 15 and September 30 of any year without the
prior approval of the Division of Coastal Management, in consultation with appropriate resource
agencies.
2) This permit authorizes only the docks, signage and boardwalk replacement, and other structures and
uses located in or over the water that are expressly and specifically set forth in the permit application.
No other structure, whether floating or stationary, shall become a permanent part of this marina
without permit modification. No non -water dependent uses of structures shall be conducted on, in or,
over Public Trust waters without permit modification.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2023
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
marina. Any sewage discharge at the marina shall be considered a violation of this permit for which the
permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence
of the permitted structure.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes an additional 8 formalized transient boat slips for a maximum of 59 formalized
boat slips.
6) The marina shall display a sign showing the location of the on -site pumpout facility, including other
appropriate waste disposal information, all as described in the attached application.
7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
8) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
General
9) This permit shall not be assigned, transferred, sold, or. otherwise disposed of to a third parry without the
written approval of the Division of Coastal Management. .
10) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to .
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2020-00035).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 20-0015.

NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that many land disturbing
activities are not authorized within 50 feet of the normal high water level unless specifically
exempted by Environmental Management Commission's (EMC) Tar Pamlico buffer
regulations in place at the time of such development.

The City of Washington has submitted a CAMA Major Permit request for the
construction of six new transient docks along the bulkhead to connect all of the existing day
docks and construct 4 finger piers between existing wet slips along Stewart Parkway in
downtown Washington adjacent to the Pamlico River in Beaufort County.
Staff has reviewed the proposed project regarding rules found in Subchapter 7H
concerning development in a Public Trust Area. It is staffs recommendation that the
proposed project appears consistent with 15A NCAC 07H .0208 as described below.
This office feels the development is consistent with requirements found in 15A NCAC
07H .0208(b) (5) (H) which states that "Marinas shall be designed so that the capability of the
waters to be used for navigation or for other public trust rights in estuarine or public trust
waters are not jeopardized while allowing the applicant access to deep waters".
Staff recommends the permit be issued with standard conditions for docking facilities.

Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit
application with regard to impacts on fish and wildlife resources. The project site is located along Stewart
Parkway on the waterfront of the Pamlico River in Washington, NC. Our comments are provided in
accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as
amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife
Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.).
The applicant proposes to construct six new transient day docks along the bulkhead, create four additional
slips, and replace the existing 7' by 1,982' boardwalk in its existing footprint. This proposal is an addition
to work permitted and conducted under CAMA Major Permits #119-98 and #6-11 and their multiple
modifications. The NCWRC reviewed these projects during the NCDCM CAMA Major Permit process
as well as during the OLIA SEPA review, providing formal written comments (6 November 1997,
Wescott; 18 February 1998, Wescott; 20 July 1998, Wescott; 27 October 2009, Dunn; 3 February 2010,
Dunn; 17 August 2010, Dunn; 7 February 2011, Dunn; 15 February 2012, Dunn; 9 March 2015, Dunn)
and comments during meetings, entails, and phone conversations. The Pamlico River at this location is
classified SC, NSW by the Environmental Management Commission, is subject to the Tar -Pamlico Buffer
Rules, and is designated a Primary Nursery Area (PNA) by the NCWRC.
The NCWRC has reviewed the proposal and understands the project as proposed will be an addition to
the existing facilities and will provide public docking that will be managed as other public docking
facilities are along Steward Parkway. We would like to note that while the transient docks are to be used
by the public and provide more mooring options to the waterfront, the additional slips change the access
and view of the waterfront to non -vessel users. Consideration should be given to the causal use of the

waterfront by pedestrians, visitors, and those who enjoy the river from shore. Continued growth of the
docking facilities may alter their experience. The side -to mooring should not hinder use of the traditional
navigation channel.
This area of the Pamlico River is designated a Primary Nursery Area (PNA) by the NCWRC and provides
important habitat and spawning opportunities for several resident and anadromous species, including but
not limited to Striped bass (Moron sazatihs), Alewife (Alosa pseudoharengus), American shad (Alosa
sapidissima), and Hickory shad (Alosa mediocris). To protect these and other species, moratoria are
developed to minimize impacts during project development by prohibiting in -water work during
important biological periods. Descriptions of in -water work include dredging or other bottom disturbing
activities and installation of piles by drilling, vibratory driving, or jet washing. Therefore to minimize
impacts to the PNA habitats near the project area, the NCWRC requests a February 15 — September 30 in -
water work moratorium be included as a permit condition as it has in the past for previous permits.

SUBJECT: Major Permit Request City of Washington —Stewart Parkway
DATE: January 9, 2020
Consistency Determination: The request is consistent with/not in conflict with the 2007 City of
Washington CAMA Core Land Use Plan certified by the CRC on November 30, 2007.
Overview: The project site is located along Steward Parkway adjacent to the Pamlico River in the City of
Washington, Beaufort County, North Carolina. Existing site improvements include a bulkhead, docks with
finger piers, boardwalk, paved road, and parking lot. The parkway was constructed in 1969 and extends
for a distance of 2000'. The City owns an additional 1,200 feet of shoreline downstream that is used as
the Stewart Parkway storm water pond. A Federal navigation channel extends along the entire length of
the project area.
The city is proposing the construct 6 new transient day docks along the bulkhead to connect all of the
currently existing day docks. These docks will be 7' in width and range in length from 49' to 120'. The
resulting transient day dock will be approximately 860 linear feet in length. Four finger piers will be
constructed in front of the Estuarium on the downstream end of the Parkway to create four permanent
docks. One finger pier will be 25' long and 3 will be 30' long. All of these finger piers will be 6' in width.
Additionally, the City is proposing to replace the existing 7' wide by 1,982 linear feet boardwalk in the
same footprint as the existing. DCM's Public Beach and Coastal Waterfront Access Grant Program
provided $100,000 towards the development of this boardwalk in 2001. The city received a $280,560
grant in 2019-20 to remove and replace 1,006 ft. of the boardwalk. Based on the permit application it
appears that no net loss of public access will result from the replacement of the boardwalk.
AECs onsite include: Public Trust Areas. The project is located within in Tar -Pamlico River Basin and is
subject to the Tar -Pamlico Buffer Rule. The Pamlico River is classified as SC/NSW. The site is a Primary
North Carolina Department of Environmental Quality I Division of Coastal Management

Nursery Area, and is closed to shellfishing. A report of SAV, wetlands, and archaeological/cultural
resources was not provided.
Anticipated impacts The project as proposed will result in the shading of approximately±3,644 ft2 of River
bottom associated with the construction of the Dock expansion. The replacement of the existing
boardwalk will not result in any additional permanent impact. Currently the boardwalk shades

installation of both the docks and boardwalk replacement.
Basis for Determination:
The project is subject to the town's 2007 Land Use Plan. The Future Land Use Map (FLUM) designates the
site as Mixed Use (land) and Conservation (AECs). Additionally, the project is located within the Historic
District
Land Use Policies: The following LUP policies may be applicable to this request.
P.4 (pg. 185) The City of Washington will give priority to the protection of the following shoreline
assets....
• Stewart Parkway and recreation area.
• City of Washington Historic District.
• City of Washington Stewart Parkway Bulkhead Boat Dock.
P.29 (pg. 193) Except for policy P.74 and implementing actions 1.24 and 1.25, residential, commercial, and
industrial development which meets 15A NCAC 7H use standards will be allowed in estuarine shoreline,
estuarine water, and public trust areas. Policy P.74 and implementing actions 1.24 and 1.25 are more
restrictive than 15A NCAC 7H because the city desires greater control/protection.
• 1.24 "prohibits the construction of signs, except regulatory signs in public trust waters as defined
by 15A NCAC 7H".
• 1.25 states that the city "will adopt an ordinance to regulate off -road vehicle usage in
conservation areas".
• P.74 states the city "will support the establishment of mooring fields and the preparation of a
water use plan to govern mooring fields".
P.34 (pg. 194) As stated elsewhere in this plan, with the exception of policy P.74 and implementing actions
1.24 and 1.25, the City of Washington supports the enforcement of 15A NCAC 7H in areas of environmental
concern.
P.69 (pg. 205) The City of Washington supports the Tar -Pamlico River Basin Water Quality Management
Plan and the Tar -Pamlico stormwater rule (see pages 99-100 and 102-106).
P.83 The City of Washington will protect its waterfront/shoreline areas, historic district, and

The Permittee shall adhere specially to 15A NCAC 02B .0220 Tidal Salt Water Quality for
Class SC Waters (3)(g) pH: shall be normal for waters in the area, which generally shall
range between 6.8 and 8.5 except that swamp waters may have a pH as low as 4.3 if it is
the result of natural conditions; (1) Turbidity: the turbidity in the receiving water shall not
exceed 25 NTU; if turbidity exceeds this level due to natural background conditions, the
existing turbidity level shall not be increased. [15A NCAC 02B .0220]

4. This approval and its conditions are final and binding unless contested. [G.S. 143-215.5]
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by filing a
written petition for an administrative hearing to the Office of Administrative Hearings (hereby known as

Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A petition

Reference the application of the City of Washington for a Department of the Army permit
to replace existing boardwalks and construct additional docks and finger piers, on property
located at the City of Washington Marina, located along the Stewart Parkway, adjacent to the Tar
and Pamlico Rivers, in the City of Washington, Beaufort County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The penmittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
3. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Quality at (919) 733-5083,
Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
4. The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for reason other than safety.
5. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities.
For further information, the permittee should contact the U.S. Coast Guard Marine Safety Office
at (910) 772-2191.
6. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
7. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

Project setting
The applicant is the City of Washington which is located in Beaufort County. A portion of
the City lies adjacent to both the Tar and Pamlico Rivers. The downtown or business portion of the
City is separated from the Pamlico River by Stewart Parkway which is a+54' wide paved street that
runs parallel to the River in an East-West direction. The parkway was constructed in 1969 and
extends for a distance of 2000'. The City owns an additional 1,200 feet of shoreline downstream that
is used as the Stewart Parkway storm water pond. The City maintains a boardwalk along this portion
of shoreline. A Federal navigation channel extends along the entire length of the project area.
On 8 September 1998 the City of Washington was issued CAMA Major Permit No. 119-98
for the construction of 33 slips on 6 finger pier systems as well as a floating dock at the western end
for small boat access. At the same time, the City began a renovation plan of Stewart Parkway and
the existing concrete boardwalk at the permitted dock location was replaced with a new t12'6' wide
architectural paver boardwalk, and the existing bulkhead was refitted with a new concrete cap and
railing system. CAMA Major Permit No. 119-98 was later refined to add 3 additional slips and
delete the floating dock portion of the project. A pumpout was required by the permit and is in place
for use. CAMA Major Permit 119-98 was modified on 12 October 2000 to install 11 additional boat
slips and transient dockage for small boats and canoes. All work authorized by the permit has been
completed. This CAMA Major Permit expired on 31 December 2001.
The City of Washington submitted an Environmental Assessment dated revised September
2009 to enlarge the existing facility by an additional 68 slips. The City of Washington received a
Finding of No Significant Impact (FONSI) on 27 April 2010 for the construction of the additional
slips. The additional slips would have brought the total number of mooring to 116.On 13 January
2011 CAMA Major Permit #6-11 was issued to the City of Washington for the construction of 68
formalized boat slips (15 transient and 53 permanent boat slips) for a total of 116 formalized slips.
An amended Permit was issued on 11 April 2011 which removed a condition on the original Permit.
The City did not build any of the slips permitted by this Permit.
On 19 April 2011 the permit was modified to construct a 20' x 40'platfortn adjacent to the
existing bulkhead. On 12 February 2012 the Permit was modified to replace and reorient the floating
dingy dock on the upstream end of the Parkway. The Permit was refined on 2 October 2013 to
reorient impervious sidewalks in order to construct a boater facility and public restrooms. On 14
March 2014 the Permit was modified to remove Dock I and construct a pier and covered platform.
On 2 December 2014 the Permit was modified to add an additional 20' x 40' platform. The Permit
was renewed on 11 February 2016. The Permit was refined on 21 September 2016 in order to replace
an existing storage building. The Permit expired on 18 December 2017.
The Pamlico River at the project site has been classified as SC -NSW by the Environmental
Management Commission. The Pamlico River at this location is classified as inland fishing waters,
primary nursery area and is not open to shell fishing. Water depths in the location of the proposed
docks range from -6.0' to -11.0' below Normal Water Level. RECEIVED

Project description
The City of Washington is proposing the construct 6 new transient day docks along the
bulkhead to connect all of the currently existing day docks. These docks will be 7' in width and
range in length from 49' to 120'. The resulting transient day dock will be approximately 860 linear
feet in length. Four finger piers will be constructed in front of the Estuarium on the downstream end
of the Parkway to create four permanent docks. One finger pier will be 25' long and 3 will be 30'
long. All of these finger piers will be 6' in width.
Additionally, the City is proposing to replace the existing 7' wide by 1,982 linear feet
boardwalk in the same footprint as the existing.
Anticipated impacts
The project as proposed will result in the shading of approximately f3,644 11' of River
bottom associated with the construction of the Dock expansion. The replacement of the existing
boardwalk will not result in any additional permanent impact. Currently the boardwalk shades
approximately 13,097 f l of storm water pond which is located within the Coastal Shoreline AEC and
the Tar -Pamlico Riparian Buffer. There will be temporary localized turbidity associated with piling
installation of both the docks and boardwalk replacement.

Project Narrative: Waterfront Dock and Boardwalk Improvements
This project will provide additional boating access for public use and reconstruct the existing
1,982' wetlands boardwalk. The City of Washington has developed public boat docking facilities
along the downtown waterfront at Stewart Parkway. The existing facilities contain for 51 slips,
48 as part of the Washington Waterfront Docks and 3 at the Estuarium.
The City plans to add 6 new alongside day dock pier sections. We will replace and reconfigure
the existing docks at the NC Estuarium to include 4 new fingers piers. There will be a total of 59
boat slips in the marina when this project is finished.
The existing boardwalk is almost 17 years old and has seen a tremendous amount of use. The
boardwalk gives the public a continuous walking space of of a mile along the waterfront.
During the 17 years of use there has been the occasional repair to the boardwalk in certain areas
along the decking but the continuous use has also made the wooden railings unstable creating a
safety hazard. The City looked at several ways in which to solve the safety issue with the
boardwalk and we plan to replace the existing walkway with a new concrete marine slat walkway
and replace the wooden pilings, decking and railings. The replacement of the existing boardwalk
will be done in 2 phases.

The NC Division of Coastal Management hereby acknowledges receipt of your application
for State approval for development of your property located off Stewart Parkway &
Waterfront. on the north side Pamlico River near Washington in Beaufort County, North
Carolina. It was received on 5 December 2019, and appears to be adequate for processing at
this time. The projected deadline for making a decision is 18 February 2020. An additional
75-day review period is provided by law when such time is necessary to complete the review.
If you have not been notified of a final action by the initial deadline stated above, you should
consider the review period extended. Under those circumstances, this letter will serve as
your notice of an extended review. However, an additional letter will be provided on or
about the 75th day. Kelly Spivey, Field Representative for the Division of Coastal
Management is responsible for processing your permit and he can be reached at 252-948-
3853 or via email at Kelly.Spivey(aincdenr.eov if you have any questions.
If this agency does not render a permit decision within 70 days from 5 December 2019,
you may request a meeting with the Director of the Division of Coastal Management and
permit staff to discuss the status of your project. Such a meeting will be held within five
working days from the receipt of your written request and shall include the property owner,
developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development. You should post this notice
at a conspicuous point along your property where it can be observed from a public road.
Some examples would be: Nailing the notice card to a telephone pole or tree along the road
right-of-way fronting your property, or at a point along the road right-of-way where a private
road would lead one into your property. Failure to post this notice could result in an
incomplete application.

CAMA MAJOR DEVELOPMENT PERMIT
The Department of Environment and Natural Resources hereby gives public notice as
required by N.C.G.S. 113A-119(b) that an application for a development permit in an Area of
Environmental Concern as designated under the Coastal Area Management Act (CAMA) was
received on 5 December 2019. According to the said application submitted by City of Washington
Marina applicant proposes to construct 6 new transient day docks along the bulkhead to connect
all of the currently existing day docks and create four additional slips.

This conveyance is made subject to the following easements
and covenants, restrictions and reservations which are hereby made and de-

Sections 1 -A and I -C(1 ) it is intended and agreed that the Agency and its
successors and assigns shall be deemed beneficiaries of the covenants provi-
dad in Section 1-A and 1-C(1 ) hereof, and the United States shall be deemed
a beneficiary of the covenant provided in Section 1-C(1) hereof, both for and it
their or its own right and also for the purposes of protecting the interests of
the community and other parties, public or private, in whose favor or for
whose benefit such covenant have been provided. Such covenant shall run in
favor of the Agency and the United States, for the entire period during which
such covenants shall be in force and effect, without regard to whether the
Agency or the United States has at any time been, remains, or is an owner of
any land or interest therein to or in favor of which such covenants relate.
The Agency shall have the right, in the event of any breach of any such cove-
nants, and the United States shall have the right in the event of any breach of
the covenant provided in Section l -C(1) hereof, to exercise all the rights and
remedies, and to maintain any actions or suits at law or in equity or othe r
proper proceedings to enforce the curing of such breach of covenant, to which
it or any other beneficiaries of such covenants may be entitled.
TO HAVE AND TO HOLD the said premises unto the purchas
together with all singular the rights, members and appurtenances thereof to
the same in any manner, belonging or appertaining to the only proper use,
behoof of the Purchaser forever, in FEE SIMPLE.
And the Local Public Agency will warrant and defend forever
the right and title thereof in the Purchaser against the claims of all persons
