Ocean Isle Beach , as requested in the permittee's application dated, including attached wodwIan drawings (2) 1-2 of2 both dated 3/1/18 This permit, issued on June 3, 2020 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may )e subject to tines, imprisonment or civil action; or may cause rile permit to be nuu ana vota. Bulkhead 1) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 2) No backfill material shall be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. 3) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. 4) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Pernittee Carlee Cummings Permit No. 67-20 Page 2 of 3 ADDITIONAL CONDITIONS 5) All fill material to be placed below normal high-water level shall be confined behind the permitted bulkhead. 6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 7) The bulkhead shall be constructed prior to any backfilling activities 8) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 9) All backfill material shall be clean and free of any pollutants except in trace quantities. 10) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Sedimentation and Erosion Control 11) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 12) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 14) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the pennittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Resources has assigned the proposed project DWR Project No. 2020- 0392. NOTE: The U.S. Army Corps of Engineers authorized this project by Nationwide Permit 3 (Action ID No. SAW-1992-02342), which was issued on 4/28/20. It would seem that removal of the existing dilapidated bulkhead and construction of the new bulkhead on the landward side of the area of coastal wetlands would present a greater environmental problem with potential erosion and washout during the construction process as well as pose a possible threat to the foundation of the existing house structure. The property can be reached from Wilmington by traveling south on NC HWY 17 towards South Carolina. Continue 11 miles past the Supply 4-way intersection and make a left turn onto Ocean Isle Beach Road SW. Drive south on Ocean Isle Beach Road SW for 3.5 miles and continue straight through the round -about towards Causeway Drive. Continue over the bridge and take a left onto East 2"d Street. Take the first left onto Laurinburg Street and continue down to 58 Laurinburg Street. It will be on the right side of the road. The proposed project site sits on "natural" canal # 17. Existing structures on the .13-acre property include a multi -story house, a personal boat ramp, a docking facility, and a deteriorating bulkhead. Based on DCM records, no previous permit history can be found for the construction of the existing bulkhead or the docking facility. The total length of the existing bulkhead measures 50 linear feet and is constructed with treated wood. The high ground directly behind the bulkhead consists of large concrete slabs and load -bearing pilings. High ground is elevated approximately 4' above normal high water (NHW) and vegetation primarily consists of domestic grasses and ornamental landscaping. Smooth Cordgrass (Sparina alternaJlora) grows along the entire length of the existing bulkhead and extends approximately 20' waterward. The waters of the Ocean Isle Beach canals are classified SA by the Division of Water Quality and ARE NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. Based on visual observations made by DCM staff during the November 2019 site visit, there appears to be NO Submerged Aquatic Vegetation (SAV) on site. The current wooden bulkhead has begun to fail as worms and rotting wood have compromised the wall's integrity. Sand sediment is seeping through the bulkhead into the canal, causing the concrete slabs at the back of the property to sink and crack. Due to the location of the concrete slabs and the proximity of the house pilings to the current bulkhead, the applicant has proposed to step out the new bulkhead directly in front of the existing one. The proposed bulkhead would step out an average distance of 2' waterward of the existing bulkhead with a maximum distance of 3' waterward. The proposed bulkhead would be approximately 50 linear feet and impact approximately 100 IV of coastal wetlands and 100 ft of open water area. The applicant previously designed and built the existing bulkhead to allow for easy replacement with minimal high -ground disturbance. By running the tie rods through PVC pipes and threading them into the deadmen, the applicant is able to replace the tie rods anytime they fail by simply digging straight down at the deadmen location and releasing the rods, pulling them straight through the front of the bulkhead. Any high -ground disturbance would be limited to hand -dug holes approximately 10-15' landward of the bulkhead. Backftll required to cover the current bulkhead would be contained on the street -side of the residence and brought on site using a wheel barrow and shovel. The proposed bulkhead would tie into adjacent bulkheads to the north and south of the property. The new bulkhead would be backfilled using clean upland material delivered by dump truck and brought on site using a wheel barrow. The current bulkhead is failing and sand sediment is seeping through the old bulk head from the house side. This has caused the concrete slabs at the back of the garage to sink by at least three inches resulting In the concrete cracking and the loss of topsoil. Due to the proximity of the residential structure, deck and stairs to the current bulkhead the project proposal is requesting permission for the installation of a new bulkhead parallel and adjacent to the existing bulkhead. The proposal is to step the new bulkhead out 2' waterward and fill approximately 100 sq ft of coastal wetlands. The installation will be performed from the canal side of the bulkhead and will not impact the existing bulkhead and will require work area of approximately 24- 36" in front of the existing bulkhead. No excavation is required and after completion of the new bulkhead, backfill will be performed between the old and the new bulkhead. This proposal will result In a big cost savings for this project due to not having to move/work around the deck and stairs (See Attached photos). Construction Process: The construction will start by removing the existing deadman construction steel rods with the intention of installing longer rods that will extend through the new bulkhead once it is installed. Approximately 4'of the existing boat ramp and walkway boards at the current bulkhead will be removed for access and reinstalled when the new bulkhead is installed. A corrugated vinyl bulkhead will be installed parallel and within 24" of the existing bulkhead. The Installation will be performed along the canal side of the bulkhead with the use of a small floating barge/boat equipped with the necessary equipment for installing the vinyl sheet pilings. Backfill will be performed with sandy loam material free of any pollutants between the old and new bulkheads from the house side of the canal. A ground cover material sufficient to restrain water runoff will be installed landward of the new bulkhead cap immediately following the completion of backfilling activities. No backfill materials will be allowed to get into the water or vegetated wetland area. Every attempt will be made to complete this project without any environmental impact on sensitive vegetation or biological life. Although processing of the application is nearing completion, additional time is needed for this office to complete the review and make a decision on your request. Therefore, it is necessary that the standard review time be extended. An additional 75 days is provided by G.S. 113A-122(c) which would make August 8, 2020 the new deadline for reaching a decision on your request.
