This permit, issued on July 2, 2020 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terns may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. In -Water Work Moratorium 1) In order to reduce the potential for negative effects on the spawning migration of anadromous fish, no excavation or filling shall be permitted between February 1 and June 30 of any year without the prior approval of the Division of Coastal Management, in consultation with appropriate resource agencies. Kayak Launch 2) This permit authorizes only the docks, pier, kayak launches, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this kayak launch without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires father Division approval. All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee City of Washington Permit No. 78-20 Page 2 of 3 3) In order to satisfy concerns of the resource agencies, physical stops shall be placed on the floating kayak launches at a minimum height of 18" above the bottom substrate to prevent the floating kayak launches from disturbing the bottom substrate. The physical stops shall remain in place for the life of the permitted facility. 4) The kayak launch facility shall post signage indicating that facility is only intended for non -motorized vessel usage. 5) This permit does not authorize any formalized boat slips. 6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 8) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the approved permit drawings. Upland Development 9) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including concrete pad and the boardwalk connector, all as expressly and specifically set forth in the attached permit application and workplan drawings. Shoreline Stabilization - Bulkhead 10) The bulkhead shall not extend waterward more than 2 feet from the normal water level at any point along its alignment at the time of construction. 11) No open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 12) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within a maximum of 30 days prior to the new expected start of construction. 13) The bulkhead shall, be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 14) The bulkhead shall be constructed prior to any backfilling activities. City of Washington Permit No. 78-20 Page 3 of 3 ADDITIONAL CONDITIONS 15) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 16) The fill material shall be clean and free of any pollutants except in trace quantities. 17) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead. Sedimentation and Erosion Control 18) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 19) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 20) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 21) All debris associated with the removal or construction of the permitted facility shall be contained within the authorized project area and removed to an appropriate upland location. 22) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2020-00834). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 1989-0127 v3. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many land disturbing activities are not authorized within 50 feet of the normal water level unless specifically exempted by Environmental Management Commission's (EMC) Tar Pamlico River buffer regulations in place at the time of such development. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. Overview: The project site consists of a ±6.27-acres bisected by NC HWY 32 located at Havens Garden Park, adjacent to the Pamlico River and Runyon Creek in the City of Washington, Beaufort County, North Carolina. The site has ±1,308' along the Pamlico River, and ±436' along the Runyon Creek. Existing site improvements include a bulkhead, riprap, bridge, boat ramp, pier, park with shelter, restrooms and parking. The park is vegetated with a maintained lawn, a few hardwood trees, shrubs, and a small vegetated wetland area (north end of the site between the bridge and boat ramps). The applicant is proposing to construct a 70' long by 6' wide pier/walkway over the wooded wetland area on the boat ramp side of the property. A proposed 24' long by 5' wide gangway off this pier will terminate into a proposed 10' x 26' floating platform, which will have 2 floating kayak/canoe launches attached. One kayak launch will be 24.5' long by 2' wide and the other will be 12 'long. Water depths in this area are approximately -2.0' below NWL. This general area is heavily impacted by boater traffic due to its close proximity to the city boat ramp. The applicant also proposes to construct a concrete sidewalk and pad within Zone 2 of the Tar -Pamlico Buffer to connect to the 70' x 6' pier. The 70' long pier/walkway will serve as the Creek portion of a future conector boardwalk. This future boardwalk will be to connect the River and Creek City properties as previously permitted in the original LAMA Major Permit No. 90-09. The applicant also proposes to construct 65' long x 6' wide boardwalk on the River side to tie into the existing concrete boardwalk section under the NC HWY 32 bridge. The applicant proposes to replace 1,100linearfeet of bulkhead 2.0' waterward of the existing. Approximately 395 linear feet of bulkhead was replaced vis CAMA General Permit No. 72913-8 issued on 10 October 2018. The site is a not a Primary Nursery Area, and is closed to shellfishing. There is no Submerged Aquatic Vegetation (SAV). A report of archaeological/cultural resources was not provided. Anticipated impacts resulting from this project are expected to include: The construction of the pier will shade ±420 ftZ of wooded wetlands. The proposed gangway, floating platform and kayak launches will shade approximately 453 ftZ of creek bottom. The 65' x 6' boardwalk will shade approximately 390 ftZ of river bottom. The construction of the 1,100 feet of bulkhead will result in the filling of 2,200 ftZ of shallow river bottom. The backfill, installation of dead men and tie back system will result in approximately 18,000 ftZ of upland disturbance. The project will result in localized short-term turbidity from the installation of the pier and platform pilings. Basis for Determination: The project site is in the ETJ of the City of Washington and is subject to the town's 2007 Land Use Plan. The Future Land Use Map (FLUM) designates the site as Conservation. This land use category has the following development guidelines: Allowable Density: Except for cluster development, the minimum lot size for development within the Conservation category is 20,000 square feet. Densities will not exceed 1.5 units per acre. Cluster development will be encouraged in conservation areas. Impervious Surface: The impervious surface coverage objective per parcel is 10% regardless of use. This will require revision to the City's zoning ordinance. Maximum Building Height: The maximum building height for this category is 35 feet. Permitted Uses: This category was established in response to environmentally sensitive and natural hazard areas identified through the land suitability analysis and environmental composite discussion earlier in this plan. Due to these factors, land use within this category should consist of low density residential housing and recreational/open space with accessory support uses. All development should be contingent on whether all environmental impacts have been assessed, and potential effects of natural hazards taken into account. Development within this category will primarily rely on on -site wastewater treatment facilities. Uses Not Permitted: Non-residential uses are not routinely permitted in this district. However, proposals for non-residential development will be assessed on a case -by -case basis by making a determination regarding a given adverse development impact on environmental conditions. The applicant also proposes to construct a 65' long by 6' wide boardwalk on the river side to tie into the existing concrete boardwalk section under the NC 32 bridge. Lastly, the applicant proposes to replace 1,100 linear feet of bulkhead 2' waterward of the existing bulkhead. The portion of the Pamlico River where work is proposed is designated as Permanent Secondary Nursery Habitat Area. Additionally, this portion of Runyon Creek is designated as Anadromous Fish Spawning Area (AFSA) by the NC Wildlife Resource Commission. (C) The hardship is due to the physical nature of the applicant's property, such as its size, shape, or topography, which is different from that of neighboring property. (E) The applicant did not purchase the property after the effective date of this Rule, and then request an appeal. (F) The hardship is unique to the applicant's property, rather than the result of conditions that are widespread. If other properties are equally subject to the hardship created in the restriction, then granting a variance would be a special privilege denied to others, and would not promote equal justice; (ii) The variance is in harmony with the general purpose and intent of the State's riparian buffer protection requirements and preserves its spirit; and (iii) In granting the variance, the public safety and welfare have been assured, water quality has been protected, and substantial justice has been done. Basically, the project would have to satisfy the requirements as outlined above or the minor variance would be denied. The platform would have two kayak/canoe launches. Water depths in the launch area approach -2' NWL. A concrete sidewalk and pad are proposed within the NCDWR buffer. The 70' walkway will serve as a connector to the future river boardwalk connector that was permitted under Permit No. 90-09. The river boardwalk was not constructed, and the permit has since expired. The proposal includes 1,100' of bulkhead replacement 2' waterward the existing bulkhead alignment along the river. The Pamlico River and Runyon Creek at these locations are classified SC NSW by the Environmental Management Commission and are subject to the NC Division of Water Resources Tar -Pamlico Buffer Rules. Runyon Creek is designated an anadromous fish spawning area (AFSA) by the NCWRC. The NCWRC has reviewed this project proposal and is familiar with the project area and its resources. We also reviewed and commented during the 2009 and 2011 permitting processes (Dunn 25 July 2011). RECEIVED MAY 0 6 2020 DCM-MHD CITY City of Washington Beaufort County Project setting The City of Washington has submitted a CAMA Major Permit application for the construction of a pedestrian boardwalk, floating kayak platform and bulkhead replacement at the Havens Garden Park. The project site is located at Havens Garden (City Park and boat ramps) on Runyon Creek off the Pamlico River at the NC 32 Bridge crossing in the City of Washington in Beaufort County, North Carolina. The site is a t6.27-acre tract owned by the City of Washington and the property is bisected by NC HWY 32. Havens Garden has t1,308' along the Pamlico River and t436' along Runyon Creek. The property has a bulkhead along the river front. The shoreline under the NC HWY 32 bridge is stabilized with riprap. The bulkhead continues on the upstream side of the bridge on the landward side of an existing vegetated wooded wetland area. Additional development on the Pamlico River side of the site includes a shelter, paved parking area, playground area, and a fishing pier. The River is approximately 0.75 miles in width at the location of the existing fishing pier. Water depth at the terminal end of the pier is approximately 5.0' below Normal Water Level (NWL). The Runyon Creek portion of the park includes the 2 boat ramps and 2 access piers, as well as a paved parking area. The park is vegetated with a maintained lawn, a few hardwoods trees, shrubs, and a small vegetated wetland area (at the north end of the site between the bridge and the boat ramps). CAMA Major Permit #90-09 was issued to the City of Washington on 6 July 2009 via the express Major permit review process authorizing the construction of a pedestrian walkway under NC HWY 32 bridge to connect the Park to the City boating access area. During the replacement of the NC HWY 32 bridge the NCDOT constructed the connector portion of the pedestrian walkway under the bridge. This has been the only development activity completed associated with the pedestrian walkway. CAMA Major Permit #90-09 was issued a major modification on 14 October 2011 for the replacement of the boat ramps, launch pier and renovation of parking area. The Permit was modified on 1 February 2011 to install a floating canoe/kayak platform on an existing pier located upstream of the existing boat ramp. This activity was never initiated. Additionally, the permit was modified to replace the existing fishing pier. The Major Permit expired on 31 December 2019. The northern (upstream) end of the property on Runyon Creek abuts a commercial metal working business with a bulkhead and pier. The western (upstream) end of the park on the Pamlico River terminates at the Carolina Coastal Railway. The Pamlico River and Runyon Creek are both classified SC -NSW by the Environmental Management Commission and are closed to shellfishing. The Pamlico River at this location is designated as Coastal Waters by the Division of Marine Fisheries. There was no submerged aquatic vegetation (SAV) observed in the project area. This area is subject to the N.C. Division of Water Resources Tar -Pamlico Buffer rules RECEIVED MAY 0 6 2020 City of Washington DCM-MHD CITY Beaufort County Page 2 Project description The applicant is proposing to construct a 70' long by 6' wide pier/walkway over the wooded wetland area on the boat ramp side of the property. A proposed 24' long by 5' wide gangway off this pier will terminate into a proposed 10' x 26' floating platform, which will have 2 floating kayak/canoe launches attached. One kayak launch will be 24.5' long by 2.0' wide and the other will be 12 'long. Water depths in this area are approximately -2.0' below NWL. This general area is heavily impacted by boater traffic due to its close proximity to the City boat ramp. The applicant also proposes to construct a concrete sidewalk and pad within Zone 2 of the Tar -Pamlico Buffer to connect to the 70' x 6' pier. The 70' long pier/walkway will serve as the Creek portion of a future connector boardwalk. This future boardwalk will be to connect the River and Creek City properties as previously permitted in the original CAMA Major Permit No. 90-09. The applicant also proposes to construct 65' long x 6' wide boardwalk on the River side to tie into the existing concrete boardwalk section under the NC HWY 32 bridge. The applicant proposes to replace 1,100 linear feet of bulkhead 2.0' waterward of the existing. Anticipated impacts The construction of the pier will shade ±420 ft2 of wooded wetlands. The proposed gangway, floating platform and kayak launches will shade approximately 453 ft2 of creek bottom. The 65' x 6' boardwalk will shade approximately 390 ft2 of river bottom. The construction of the 1,100 feet of bulkhead will result in the filling of 2,200 ft2 of shallow river bottom. Phase I of this project was done through a minor modification to permit 90-09. It is our hope to complete the remaining 1100' of bulkhead in phase 2 and phase 3 with the major modification. In addition, the City wishes to modify the permitted design for the previously requested kayak launch and pedestrian walkway. The new design will complement the boat launch facility, while keeping the kayaks safely away from motor boat traffic. Over the last few years the City has made many improvements; including a fully inclusive playground and new handicap accessible fishing pier. These improvements have only broadened the access to our waterway. The bulkhead replacement will help stabilize our waterfront area and enhance our shoreline protection. The project site is located at Havens Garden (City Park and boat ramps) on Runyon Creek off the Pamlico River at the NC 32 Bridge crossing in the City of Washington in Beaufort County, North Carolina. The site is a ±6.27-acre tract owned by the City of Washington and the property is bisected by NC HWY 32. Havens Garden has ±1,308' along the Pamlico River and ±436' along Runyon Creek. The property has a bulkhead along the river front. The shoreline under the NC HWY 32 bridge is stabilized with riprap. The bulkhead continues on the upstream side of the bridge on the landward side of an existing vegetated wooded wetland area. Additional development on the Pamlico River side of the site includes a shelter, paved parking area, playground area, and a fishing pier. The River is approximately 0.75 miles in width at the location of the existing fishing pier. Water depth at the terminal end of the pier is approximately 5.0' below Normal Water Level (NWL). The Runyon Creek portion of the park includes the 2 boat ramps and 2 access piers, as well as a paved parking area. The park is vegetated with a maintained lawn, a few hardwoods trees, shrubs, and a small vegetated wetland area (at the north end of the site between the bridge and the boat ramps). CAMA Major Permit #90-09 was issued to the City of Washington on 6 July 2009 via the express Major permit review process authorizing the construction of a pedestrian walkway under NC HWY 32 bridge to connect the Park to the City boating access area. During the replacement of the NC HWY 32 bridge the NCDOT constructed the connector portion of the pedestrian walkway under the bridge. This has been the only development activity completed associated with the pedestrian walkway. CAMA Major Permit #90-09 was issued a major modification on 14 October 2011 for the replacement of the boat ramps, launch pier and renovation of parking area. The Permit was modified on 1 February 2011 to install a floating canoe/kayak platform on an existing pier located upstream of the existing boat ramp. This activity was never initiated. Additionally, the permit was modified to replace the existing fishing pier. The Major Permit expired on 31 December 2019. The northern (upstream) end of the property on Runyon Creek abuts a commercial metal working business with a bulkhead and pier. The western (upstream) end of the park on the Pamlico River terminates at the Carolina Coastal Railway. The Pamlico River and Runyon Creek are both classified SC -NSW by the Environmental Management Commission and are closed to shellfishing. The Pamlico River at this location is designated as Coastal Waters by the Division of Marine Fisheries. There was no submerged aquatic vegetation (SAV) observed in the project area. This area is subject to the N.C. Division of Water Resources Tar -Pamlico Buffer rules RECEIVED MAY 12 2020 City of Washington DCM-MHD CITY Beaufort County Page 2 Project description The applicant is proposing to construct a 70' long by 6' wide pier/walkway over the wooded wetland area on the boat ramp side of the property. A proposed 24' long by 5' wide gangway off this pier will terminate into a proposed 10' x 26' floating platform, which will have 2 floating kayak/canoe launches attached. One kayak launch will be 24.5' long by 2.0' wide and the other will be 12 'long. Water depths in this area are approximately -2.0' below NWL. This general area is heavily impacted by boater traffic due to its close proximity to the City boat ramp. The applicant also proposes to construct a concrete sidewalk and pad within Zone 2 of the Tar -Pamlico Buffer to connect to the 70' x 6' pier. The 70' long pier/walkway will serve as the Creek portion of a future connector boardwalk. This future boardwalk will be to connect the River and Creek City properties as previously permitted in the original CAMA Major Permit No. 90-09. The applicant also proposes to construct 65' long x 6' wide boardwalk on the River side to tie into the existing concrete boardwalk section under the NC HWY 32 bridge. The applicant proposes to replace 1,100 linear feet of bulkhead 2.0' waterward of the existing. Approximately 395 linear feet of bulkhead was replaced vis CAMA General Permit No. 72913-B issued on 10 October 2018. Anticipated impacts The construction of the pier will shade ±420 ft2 of wooded wetlands. The proposed gangway, floating platform and kayak launches will shade approximately 453 ft2 of creek bottom. The 65' x 6' boardwalk will shade approximately 390 ft2 of river bottom. The construction of the 1,100 feet of bulkhead will result in the filling of 2,200 ft2 of shallow river bottom. The backfill, installation of dead men and tie back system will result in approximately 18'000ft2 of upland disturbance. project will result in localized short-term turbidity from the installation of the pier and platform pilings. A project narrative The Havens Gardens bulkhead is in need of replacement. We have recently completed 395' of bulkhead replacement. Phase I of this project was done through a minor modification to permit 90-09. It is our hope to complete the remaining 1100' of bulkhead in phase 2 and phase 3 with the major modification. In addition, the City wishes to modify the permitted design for the previously requested kayak launch and pedestrian walkway. The new design will complement the boat launch facility, while keeping the kayaks safely away from motor boat traffic. Over the last few years the City has made many improvements; including a fully inclusive playground and new handicap accessible fishing pier. These improvements have only broadened the access to our waterway. The bulkhead replacement will help stabilize our waterfront area and enhance our shoreline protection.
