Permit Crass NEW Permit Number 113-20 STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Permit for X Major Development in an Area of Environmental Concern pursuant to NCGS I I3A-118 Excavation and/or filling pursuant to NCGS 113-229 Issued to Vincenzo Cilluffu, 3311 Mouth of the Creek Rd., Blounts Creek, NC 27814 Authorizing development in Beaufort County at adj. to the Pamlico River, at 3311 Mouth of the Creek Rd. in Blounts Creek, as requested in the permittee's application dtd 6/28/20 (MP-1) & "Rec DCM WaRO 9/l/20" (MP-4), incl att workplan drawings (3), Sheets 1,3 of 3 dtd "Revised 9/l/20" & Sheet 2 of 3 dtd 5/29/20. This permit, issued on November 30, 2020 , is subject to compliance with the application .(where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Boathouse 1) This permit authorizes only the boathouse addition and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature Vincenzo Cilluffo ADDITIONAL CONDITIONS Permit No. 113-20 Page 2 of 3 3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 4) This permit does not authorize any new formalized boat slips. The docking facility is authorized for no more than two (2) formalized boat slips located under the authorized boathouse. 5) , The boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. The footprint of the boathouse shall not exceed the dimensions on the authorized workplans. 6) The authorized boathouse shall be single story, and shall not be designed to allow for second story use. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 8) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. General 9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 10) All debris associated with the removal or construction of the permitted boathouse addition shall be contained within the authorized project area and removed to an appropriate upland location. 11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2020-01593). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2020-1157. Although processing of the application is nearing completion, additional time is needed for this office to complete the review and make a decision on your request. Therefore, it is necessary that the standard review time be extended. An additional 75 days is provided by G.S. 113A-122(c) which would make January 29, 2021 the new deadline for reaching a decision on your request. Staff has reviewed the proposed project with regard to rules found in Subchapter 7H concerning development in Estuarine Water and Public Trust Area. It is staffs recommendation that the proposed project appears consistent with 15A NCAC 07H .0208 as described below. This office feels the development is consistent with 15A NCAC 07H .0208(b)(6)(B) which states in part that "The total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be 8 square feet per linear foot of shoreline with a maximum of 2,000 square feet." The applicant has 128 linear feet of shoreline on the Pamlico river which provides a maximum shaded impact of 1,024 ftz. The applicant is proposing a total of 960 ftz of shaded impact. The applicant states that the large boathouse (>400 ftz) is needed to accommodate a boat as well as PWC. The construction of the boathouse is of similar design along this shoreline and will not cause interruption of existing navigation. Staff recommend the following conditions be included if the project is permitted. i. No attempt will be made by the permitter: to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 2. This permit authorizes only the structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 3. The boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. 4. The authorized boathouse shall be single story, and shall not be designed to allow for second story use. The proposed action is located at 3311 Mouth of the Creek Road, Blounts Creek, within Beaufort County, North Carolina. The applicant is proposing to construct a boathouse roof over the existing uncovered boatlift and existing floating PWC dock. The boathouse roof will measure 40 feet long by 16 feet wide, covering approximately 640 square feet of estuarine water and public trust area. The proposed project is located along Blounts Bay, of the Pamlico River, in waters designated as Permanent Secondary Nursery Habitat. Nursery areas are areas that for reasons such as food, cover, bottom type, salinity, temperature, and other factors, young finfish and crustaceans spend a major portion of their initial growing season. Secondary nursery areas are those areas in the estuarine system where later juvenile development takes place. Populations are composed of developing sub -adults of similar size that have migrated from an upstream primary nursery area to the secondary nursery area located in the middle portion of the estuarine system. DMF recommends a moratorium on in -water work from 1 April through 30 September. This moratorium reduces the potential negative effects on critical life history activities. The lot is approximately 25.0' in elevation above the normal water level. The water depth at end of the existing pier with uncovered boatlift is approximately 3.5 below normal water level (NWL). The lot is mostly vegetated with lawn grasses and ornamental shrubs. The applicant proposes to construct a boathouse roof over the existing uncovered boatlift and existing floating PWC dock. The boathouse roof will measure 40' long x 16' wide. The boathouse roof will cover approximately 640 ft2 of estuarine water and public trust area as measured from the dripline. AECs involved include: Public Trust Area and Estuarine Water. The Pamlico River is classified as SB NSW by the Environmental Management Commission and classified as Coastal fishing waters by the NC DMF at the project site. No SAV's were observed during the on -site visit. This property is subject to the Tar -Pamlico Buffer rules enforced by the NC Division of Water Resources. The Pamlico River is not open to shell fishing in this area. Basis for Determination: The project is subject to the Beaufort County Joint Land Use Plan 2006 Update. The counties Future Land Use Map (FLUM) classifies the site as Transition, Conservation I (water protected by Tar -Pam Buffer), and Conservation II (100-year flood plain). Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not l authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. The lot is approximately 1.32 acres (57,500 112) in size and has 128 linear feet of shoreline on the Pamlico River. Man-made features on the lot include a single-family residence, impervious driveway, jetties, bulkhead, retaining wall, pier, platform, floating PWC docks and an uncovered boatlift. The lot is approximately 25.0' in elevation above the normal water level. The water depth at the end of the existing pier with uncovered boatlift is approximately 3.5 below normal water level (NWL). The lot is mostly vegetated with lawn grasses and ornamental shrubs. The downstream (cast) property is developed with a single family dwelling, rip rap stabilized shoreline and pier with a boathouse. The upstream (west) property is a developed lot with a bulkheaded shoreline and a single family dwelling. The Pamlico River is classified as SB NSW by the Environmental Management Commission and classified as Coastal fishing waters by the NC DMF at the project site. No SAV's were observed during the on -site visit. This property is subject to the Tar -Pamlico Buffer rules enforced by the NC Division of Water Resources. The Pamlico River is not open to shell fishing in this area. Proicct description The applicant proposes to construct a boathouse roof over the existing uncovered boatlift and existing floating PWC dock. The boathouse roof will measure 40' long x 16' wide. The boathouse roof will cover approximately 640 ft2 of estuarine water and public trust area as measured from the dripline. Anticipated impacts The project will result in localized turbidity as a result of the installation of the boathouse pilings. The proposed boathouse and existing platform will result in total 960 ft2 of platform. The construction of the boathouse is of similar design as existing boathouses along this shoreline and will not cause interruption of existing navigation. Kelly Spivey — 3 September 2020 RECEIVED SEP 0 9 2020 P?CM-MHD CITY INNER BANKS ENGINEERING, PC CILLUFFO BOAT HOUSE NARRATIVE Mr Cilluffo has requested to install a boat house over an existing boat lift which has previously been permitted. The boat house will cover 640 sf. The owner plan to hire a contractor who is experienced in working in and around marine type structures and will be required to maintain the site to not cause pollution to the existing waterways. The attached plan shows the existing boat lift as well as the pier system and decks which surround the area. The existing boat lift piles shall be used to construct the boat house and roof. Previous plans showed an additional 6' overhang and larger boat house. This roof area has been removed from the project and the overall size reduced by 2' to remain with in the allowable square footage and stay in compliance with NCAC 07H.0208. The additional area is needed for the storage of a jet ski as well as the owner's boat.
