This permit, issued on November 30, 2020 , is subject to compliance with the application .(where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Boathouse
1) This permit authorizes only the boathouse addition and uses located in or over the water that are
expressly and specifically set forth in the permit application. No other structure, whether floating or
stationary, shall become a permanent part of this docking facility without permit modification. No
non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without
permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2023
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
4) This permit does not authorize any new formalized boat slips. The docking facility is authorized for no
more than two (2) formalized boat slips located under the authorized boathouse.
5) , The boathouse shall not be completely enclosed or have side coverage more than one half the height of
the side, from the roof waterward. The footprint of the boathouse shall not exceed the dimensions on the
authorized workplans.
6) The authorized boathouse shall be single story, and shall not be designed to allow for second story use.
7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
8) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
General
9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
10) All debris associated with the removal or construction of the permitted boathouse addition shall be
contained within the authorized project area and removed to an appropriate upland location.
11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2020-01593).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2020-1157.

NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at [phone] prior to the commencement of any
such activity for this determination. The permittee is further advised that many land disturbing
activities are not authorized within 50 feet of the normal water level unless specifically exempted
by Environmental Management Commission's (EMC) Tar Pamlico River buffer regulations
in place at the time of such development.
NOTE: An application processing fee of $250 was received by DCM for this project.

Inner Banks Engineering, PC has submitted a CAMA Major Permit application on behalf of Mr. Vincenzo
Cilluf o for the construction of a 640 ftz boathouse over an existing uncovered boatlift located off SR 1112 at 3311
Mouth of the Creek Rd. on the Pamlico River near the Community of Blounts Creek in Beaufort County, North
Carolina.
Staff has reviewed the proposed project with regard to rules found in Subchapter 7H concerning development
in Estuarine Water and Public Trust Area. It is staffs recommendation that the proposed project appears consistent
with 15A NCAC 07H .0208 as described below.
This office feels the development is consistent with 15A NCAC 07H .0208(b)(6)(B) which states in part that
"The total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be 8
square feet per linear foot of shoreline with a maximum of 2,000 square feet." The applicant has 128 linear feet of
shoreline on the Pamlico river which provides a maximum shaded impact of 1,024 ftz. The applicant is proposing a
total of 960 ftz of shaded impact. The applicant states that the large boathouse (>400 ftz) is needed to accommodate
a boat as well as PWC. The construction of the boathouse is of similar design along this shoreline and will not cause
interruption of existing navigation.
Staff recommend the following conditions be included if the project is permitted.
i. No attempt will be made by the permitter: to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
2. This permit authorizes only the structures and uses located in or over the water that are expressly and
specifically set forth in the permit application. No other structure, whether floating or stationary, may
become a permanent part of this docking facility without permit modification. No non -water dependent uses
of structures may be conducted on, in or over public trust waters without permit modification.
3. The boathouse shall not be completely enclosed or have side coverage more than one half the height of the
side, from the roof waterward.
4. The authorized boathouse shall be single story, and shall not be designed to allow for second story use.

A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has
reviewed the CAMA Permit application for proposed actions that impact fish and fish
habitats. The proposed action is located at 3311 Mouth of the Creek Road, Blounts Creek,
within Beaufort County, North Carolina. The applicant is proposing to construct a
boathouse roof over the existing uncovered boatlift and existing floating PWC dock. The
boathouse roof will measure 40 feet long by 16 feet wide, covering approximately 640
square feet of estuarine water and public trust area.
The proposed project is located along Blounts Bay, of the Pamlico River, in waters
designated as Permanent Secondary Nursery Habitat. Nursery areas are areas that for
reasons such as food, cover, bottom type, salinity, temperature, and other factors, young
finfish and crustaceans spend a major portion of their initial growing season. Secondary
nursery areas are those areas in the estuarine system where later juvenile development
takes place. Populations are composed of developing sub -adults of similar size that have
migrated from an upstream primary nursery area to the secondary nursery area located in
the middle portion of the estuarine system. DMF recommends a moratorium on in -water
work from 1 April through 30 September. This moratorium reduces the potential negative
effects on critical life history activities.

Consistency Determination: The request is consistent with/not in conflict the Beaufort County Joint Land
Use Plan 2006 Update certified by the CRC on January 13, 2010, provided that the land development and
land use activities comply with the requirements of the Tar -Pamlico Buffer Rule, unless located in the
exempted or allowed areas (see policy 2.1.5), and that development meets the Beaufort County Flood
Damage Prevention Ordinance (see policy 2.2.3).
Overview The proposed project is located at 3311 Mouth of the Creek Rd. on the Pamlico River near the
Community of Blounts Creek in Beaufort County, North Carolina. The lot is approximately 1.32 acres
(57,500 ft2) in size and has 128 linear feet of shoreline on the Pamlico River. Man-made features on the
lot include a single-family residence, impervious driveway, jetties, bulkhead, retaining wall, pier, platform,
floating PWC docks and an uncovered boatlift. The lot is approximately 25.0' in elevation above the normal
water level. The water depth at end of the existing pier with uncovered boatlift is approximately 3.5
below normal water level (NWL). The lot is mostly vegetated with lawn grasses and ornamental shrubs.
The applicant proposes to construct a boathouse roof over the existing uncovered boatlift and existing
floating PWC dock. The boathouse roof will measure 40' long x 16' wide. The boathouse roof will cover
approximately 640 ft2 of estuarine water and public trust area as measured from the dripline.
AECs involved include: Public Trust Area and Estuarine Water. The Pamlico River is classified as SB NSW
by the Environmental Management Commission and classified as Coastal fishing waters by the NC DMF at
the project site. No SAV's were observed during the on -site visit. This property is subject to the Tar -Pamlico
Buffer rules enforced by the NC Division of Water Resources. The Pamlico River is not open to shell fishing

The project site is in Special Flood Hazard Area VE (EL7) according to the Beaufort County FIRM (Map p
3720660200K eff. 6/19/2020). A review of shellfish resources, Coastal/404 Wetlands and
archaeological/cultutal resources in the area was not provided.
Anticipated Impacts The project will result in localized turbiditySas a result of the installation of the
boathouse pilings. The proposed boathouse and existing platform will result in total 960 ft2 of platform.
The construction of the boathouse is of similar design as existing boathouses along this shoreline and will
not cause interruption of existing navigation.
Basis for Determination:
The project is subject to the Beaufort County Joint Land Use Plan 2006 Update. The counties Future Land
Use Map (FLUM) classifies the site as Transition, Conservation I (water protected by Tar -Pam Buffer), and
Conservation II (100-year flood plain).
The following LUP policies may be applicable to this request:
2.1 Conservation I
2.1.3 Only development and land/water use activities that are consistent with the use standards for
coastal wetlands, estuarine waters, and public trust areas (15A NCAC 07H .0208) are allowed in this
classification. Permitted extractive uses in the Aurora area will continue.
2.1.5 Unless in the exempted or allowed, land development and land use activities must comply with the
requirements of the Tar -Pamlico Buffer Rule (15A NCAC 02B .0259).
2.2 Conservation II
2.2.3 Development in any flood hazard zone delineated on a Beaufort County FIRM or in an area that is
subject to storm inundation as illustrated on Beaufort County storm surge maps must meet the location
and construction requirements of the Beaufort County Flood Damage Prevention Ordinance.

Creek Road, adjacent to the Pamlico River, near the Community of Blounts Creek, in Beaufort
County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
3. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not

authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
4. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Quality at [phone],
Ext. 526 or [phone] and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
5. The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the pubic of all navigable waters at or adjacent to
the authorized work for reason other than safety.
6. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
7. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

violation of stream or wetland standards [15A NCAC 02B .0200] Including but not limited to sediment impacts, and
any violation of state regulated riparian buffer rules [15A NCAC 02B .0200]. Information shall be provided orally
within 24 hours (or the next business day if a weekend or holiday) from the time the applicant became aware of
the circumstances. A written submission shall also be provided within 5 business days of the time the applicant

Project setting
Inner Banks Engineering, PC has submitted a CAMA Major Permit application on behalf of Mr.
Vincenzo Cilluffo for the construction of a boathouse located at his property off SR 1112 at 3311 Mouth of
the Creek Rd. on the Pamlico River near the Community of Blounts Creek in Beaufort County, North
Carolina. The lot is approximately 1.32 acres (57,500 112) in size and has 128 linear feet of shoreline on the
Pamlico River. Man-made features on the lot include a single-family residence, impervious driveway,
jetties, bulkhead, retaining wall, pier, platform, floating PWC docks and an uncovered boatlift. The lot is
approximately 25.0' in elevation above the normal water level. The water depth at the end of the existing
pier with uncovered boatlift is approximately 3.5 below normal water level (NWL). The lot is mostly
vegetated with lawn grasses and ornamental shrubs.
The downstream (cast) property is developed with a single family dwelling, rip rap stabilized
shoreline and pier with a boathouse. The upstream (west) property is a developed lot with a bulkheaded
shoreline and a single family dwelling.
The Pamlico River is classified as SB NSW by the Environmental Management Commission and
classified as Coastal fishing waters by the NC DMF at the project site. No SAV's were observed during the
on -site visit. This property is subject to the Tar -Pamlico Buffer rules enforced by the NC Division of Water
Resources. The Pamlico River is not open to shell fishing in this area.
Proicct description
The applicant proposes to construct a boathouse roof over the existing uncovered boatlift and
existing floating PWC dock. The boathouse roof will measure 40' long x 16' wide. The boathouse roof will
cover approximately 640 ft2 of estuarine water and public trust area as measured from the dripline.
Anticipated impacts
The project will result in localized turbidity as a result of the installation of the boathouse pilings.
The proposed boathouse and existing platform will result in total 960 ft2 of platform. The construction of the
boathouse is of similar design as existing boathouses along this shoreline and will not cause interruption of
existing navigation.

CILLUFFO BOAT HOUSE NARRATIVE
Mr Cilluffo has requested to install a boat house over an existing boat lift which has
previously been permitted. The boat house will cover 640 sf. The owner plan to hire a
contractor who is experienced in working in and around marine type structures and will be
required to maintain the site to not cause pollution to the existing waterways.
The attached plan shows the existing boat lift as well as the pier system and decks which
surround the area. The existing boat lift piles shall be used to construct the boat house and
roof. Previous plans showed an additional 6' overhang and larger boat house. This roof
area has been removed from the project and the overall size reduced by 2' to remain with
in the allowable square footage and stay in compliance with NCAC 07H.0208.
The additional area is needed for the storage of a jet ski as well as the owner's boat.

deadline for making a decision is 15 November 2020. An additional 75-day review period is
provided by law when such time is necessary to complete the review. If you have not been
notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an
extended review. However, an additional letter will be provided on or about the 75th day.

If this agency does not render a permit decision within 70 days from 1 September 2020,

working days from the receipt of your written request and shall include the property owner,
developer, and project designer/consultant
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development You should post this notice
at a conspicuous point along your property where it can be observed from a public road.
Some examples would be: Nailing the notice card to a telephone pole or tree along the road
right-of-way fronting your property, or at a point along the road right-of-way where a private
road would lead one into your property. Failure to post this notice could result in an
incomplete application.

CAMA MAJOR DEVELOPMENT PERMIT
The Department of Environment and Natural Resources hereby gives public notice as
required by N.C.G.S. I I3A-119(b) that an application for a development permit in an Area of
Environmental Concern as designated under the Coastal Area Management Act (CAMA) was
received on 1 September 2020. According to the said application submitted by Vincenzo Cilluffo
proposes to construct a 40' long x 16' wide boathouse near the community of Blounts Creek in
Beaufort County North Carolina
A copy of the entire application may be examined or copied at the office of Kelly Spivey,
District Manager, Washington Regional Office, 943 Washington Square Mall, Washington, NC,
during normal business hours. Public comments received by 03 October 2020 will be considered.
Later comments will be accepted and considered up to the time of permit decision. Project
modifications may occur based on further review and comments. Notice of the permit decision in
this matter will be provided upon written request.
