Anderson Blvd., Topsail Beach, NC AREA OF ENVIRONMENTAL CONCERN — Estuarine Shoreline AEC Dear Mr. Eagles: I have reviewed the information submitted to this office in your inquiry concerning the necessary filing of an application for a minor development permit under the Coastal Area Management Act. Based on the information provided, I have determined that the activity you propose is exempt from needing a minor/major development permit if it remains consistent with the revised scope of work detailed in your email, which was received by DCM on 12/31/20, and meets the conditions specified below. If your plans should change and your project will no longer meet these conditions, please contact me before proceeding. MAINTENANCE & REPAIR (1) The maintenance and repair work authorized under this exemption specifically includes the repair/maintenance of an existing structure located along the Estuarine Shoreline and within the Coastal Wetland Areas of Environmental Concern (AEC). NO additions, roof overhangs, expansions, enclosures, HVAC/duct work, septic replacement/repair, plumbing, electrical work, re -framing, drywall, siding, windows, etc. are authorized under this exemption. (2) Repair and maintenance to the structure shall be limited to $11,589, per your revised materials and cost list. (3) The development must not alter naturally or artificially created surface drainage channels. (4) The development must be consistent with all applicable use standards and local land use plans in effect at the time the exemption is granted. (5) The proposed development shall remain consistent with the attached work plan drawings. (6) This permit does not authorize expansion of the existing structure. (7) The development must not involve removal, damage, or destruction of threatened or endangered animal or plant species (8) THIS EXEMPTION AUTHORIZES ONLY THE WORK DESCRIBED IN YOUR 12/31/2020 REQUEST FOR REPAIR MAINTENANCE. The revised 12-31-20 materials list you submitted does not appear to accurately reflect "market value" pricing for some of the previously completed work, as well as the "work remaining to secure home". For example, you note under the "materials to date" section, "Misc. materials such as nails were provided from my shop. We operate a maintenance company". These items should be accounted for your proposal. We had to buy the bulk of everything including nails and used a nail gun. However, some misc. materials, nails, saw blades, caulk etc. were pulled from our work truck. My receipts reflect approx. $100 in nails and I would guess that we used another $100 of "shop" materials. This would be an additional +$200 to the labor and materials list. As previously mentioned, and in accordance with 15A NCAC 07J .0210, (1) NON -WATER DEPENDENT STRUCTURES. Proposed work is considered replacement if the cost to do the work exceeds 50 percent of the market value of an existing structure immediately prior to the time of damage or the time of request.... (b) The cost to do the work is the cost to return the structure to its pre -damaged condition using labor and materials obtained at market prices regaFdless of the actual cost incurred by the owner to restore the structure. It shall include the costs of construction necessary to comply with local and state building codes and any improvements that the owner chooses to construct. The cost shall be determined by the Division utilizing any or all of the following: (i) an estimate provided by a North Carolina licensed contractor qualified by license to provide an estimate or bid with respect to the proposed work; As stated previously, I am a general contractor and have provided a cost estimate. More importantly, the work completed does not require the license of a general contractor. As a homeowner, I can purchase materials and hire labor at market value to complete all work described. (ii) an insurance company's report itemizing the cost, excluding contents and accessory structures; or (iii) an estimate provided by the local building inspections office. Because you began repairs to the structure prior to obtaining authorization from the NC Division of Coastal Management, it is unknown what cost have been incurred to date, relative to "market pricing" I have described in detail the work done prior and provided their associated costs. I moved 'forward with removing internal personal items from the previous homeowners, removing wood rot, removing damaged/moldy sheetrock and repairing the roof because it was the only way to preserve the structure as it was actively leaking and no one would give me a clear answer despite my attempts to explain and prove that I could support my position. I moved forward with the direction of a structural engineer and that of a licensed electrician. I could not just sit back and watch another storm drop more and more rain into the structure. I've apologized for my actions, yet they were very much needed. However, with regard to the work remaining to secure the home, please expand on the items described in your revised 12-31-2020 materials list. Work Remaining to Secure home: Install interior sub -floor. Purchased, on -site and accounted for in the materials listed above. Market value 4x8 3/4 inch plywood is approximately $44/sheet. Attached are two receipts from Lowes. I purchased the material on one occasion for $28.33 and another time for $24.82. 1 used $28 in my estimate. Yes, I did get a 5% discount. However, anyone with a Lowes card can get 5% off. I've attached proof of that as well. Furthermore, we may only use 15-18 of the 25 boards left. - Install sill plate and repair other studs in sunroom. Purchased, on -site and accounted for in the materials listed above. Describe repair and all material needed to complete this portion of the project, labor and materials at market value. The sill plate is only a 2x4 placed on the floor that wall studs will rest on. The old sill plate has been removed. A new 2x4 will be installed and nailed. A few of the studs resting on this plate will be sistered and nailed. This is not complicated and will only take a few studs that again have been included in our estimate of materials. This labor will be combined with the sub - floor, caulking around the perimeter and securing the back left exterior door. - Weatherproof flooring at all walls & plumbing with caulking/treated wood/etc. Should be described in detail and a materials list included citing market value prices. Caulking at walls and plumbing is not time consuming nor expensive. The caulk would be estimated at $50. This labor is included with sub -floor, sill plate and securing the back left door. Repair back left exterior door to close and lock. Should be described in detail and include all materials and labor cost at market value. Our intentions are to use the existing door. It needs to be adjusted and nailed in the proper place. The existing threshold is on -site and will be re -used. Nails will be used and perhaps some caulking. This labor is included with sub -floor, sill plate and securing the back left door. NOTE CONCERNING LABOR: I will be paying (3) workers $42 per hour to address the sill plate, caulk at floors/plumbing, adjusting exterior door and installing approx. 15 to 18 sheets of plywood. I have given them 16 hours to complete the work. This is extremely conservative as they should finish in +/- 10 hours. - Replace/upgrade (6) interior light fixtures. List items to be replaced at market value. No'new wiring is needed. We are not installing overhead lights in the sunroom. That wiring is not present and will not be added. Floor lamps will be sufficient. As indicated, we proposed a budget allowance of $500 for the light fixtures. Attached are the light fixtures that we have selected, totaling $390. 1 have contacted a licensed electrician, and they have given me an estimate of $250 to replace the old with our new fixtures. This would be $110 savings adjustment to the labor and materials list. Install existing toilet. Should include materials and labor at market value I have contacted a plumber for an estimate to re -install the existing toilet, install the utility sink in the kitchen and install a vanity in the bath. The estimate is $450. Install new bath vanity and connect to existing plumbing. Should include material at market value and labor cost. As mentioned above, the plumbing labor will include the existing toilet, utility sink and vanity. Previously, we presented an allowance for the bath vanity with sink at $200. Attached is the vanity with sink and it is priced at $209. This is a +$9 adjustment. Install utility sink in kitchen and connect to existing plumbing. Should include material at market value and labor cost. Again, the plumbing labor includes the existing toilet, vanity with sink and the utility sink. Our initial allowance for the utility sink was presented at $150. Attached is the utility sink with faucet and it priced at $171.16. This is a +$21.16 adjustment. Cost to Do Remaining Work: Allowance for Light Fixtures. $500 (detail light fixture and note whether electrical will need to be replaced). Provide market value of fixtures and include electrical labor cost (market value). As addressed above, no new wiring is required. Attached are the fixtures to be used. Price is $390 rather than our initial allowance/budget of $500. The electrician has quoted $250 to replace existing fixtures with our new fixtures. Allowance for Bath Vanity with sink. $200 Should include cost of vanity with sink and labor at market value. As addressed above, we budgeted $200 and have selected one for $209. Plumber will install all three plumbing fixtures (existing toilet, utility sink with faucet and vanity with faucet) for $450. Allowance for Utility sink. $150 Should include the cost of the sink as well as installation labor at market pricing. As addressed above, we budgeted $150, yet have selected one for $171.16. Plumber will install all three plumbing fixtures (existing toilet, utility sink with faucet and vanity with faucet) for $450. - Estimate for electrician to replace (6) light fixtures. $250 Will new wiring be required to bring these fixtures up to code? If so, please include cost associated with this work, materials and labor) As previously addressed, no new wiring is needed. The existing wiring and external panel have been inspected and considered in good condition. We are not installing overhead lights in the sunroom. That wiring is not present and will not be added. For the items you've described, does the work to the subfloor result in a finished floor system or simply a rough floor system with plywood? Similarly with the framing and walls. I assume you are planning to dry out the framing and roofing prior to treatment and refinishing. The living room and bedrooms had hardwood floors over a sub -floor. The hardwoods have been removed. The questionable sub -floor in those areas have been repaired. The 3/4 plywood will replace the areas that previously had hardwoods. The sunroom, bath and kitchen already have a plywood down and were previously covered with a vinyl flooring. The old vinyl has been removed. Only at the back left rear door and bath will there be a need for the % plywood. Most of these areas were found to be solid. Thankfully, with our efforts to install a new roof, all interior wood has dried. When regulations allow, our intentions are to cover all flooring with vinyl. (Per FEMA/CAMA, would flooring count against the 50%?) We are not planning to go back with any ceilings, we would like to keep it open. The only walls that are not covered are in the sunroom and bath. They can remain as is for now. I cannot find in your quotes any reference to the cost associated with electrical connection, water connection or sewer connection. Could you please explain and include any cost that have occurred to date with regard to these utilities? We have had no costs associated with re -connecting any utilities. From the point of purchase, our water/sewer account with the Town of Topsail was transferred to our names, and we have been billed each month. As for the electrical, it only required a call to the electrical provider as it was only last turned off as of 9-18-2020 by the previous owners just prior to our purchase. No service person was needed as it was simply turned on in our name from their main office. Once you have provided the information requested, we will evaluate your proposal and respond accordingly. December 10, 2020 Per your request, I have performed on -site observations of the existing structure located at the above referenced address. The building is currently vacant and was originally constructed as a single-family residence. The exact date of construction is unknown but is believed to have been constructed at least 70 years ago. The dwelling is a one-story wood frame structure with approximately 885 s.f. and is located in a 150-mph wind zone in Pender County, NC, The purpose of the observations was to evaluate the current condition of the building's structural system. At the time of observation, the building appeared vacant and was without a connected electrical service. The following is a list of general construction methods used: - Foundation consists of 8" diameter round pilings. - Floor framing consists of 2" x 8" floor joists all within allowable spans of the current NC Residential Building Code. - Wall framing consists of 2" x 4" wood studs spaced 16" on center, - Roof system is framed with 2" x 6" rafters spaced at 16" center. - Existing roof system is framed as a low slope roof with a shingle roof. Based on my observations, it is my professional opinion that the construction of the building is in a generally good condition given the age of the structure and is safe to occupy as a residential building. There are several repairs to the framing as described below that will need to be completed to restore the structural integrity of the building as it was originally constructed. 1. An exterior load bearing wall in the left rear corner of the home was removed and reconstructed at some point to include an existing porch into the former living space. I recommend adding 2" x 6" ceiling joists that span approximately 11'-8" to the existing ceiling joists in this area. 2. Due to a roof leak, several 2" x 4" wall studs and a 10' section of 2" x 4" sill plate will need to be replaced in the same area as item no. 1 in the rear left corner of the home, 3. I recommend replacing the entire roof finish materials after replacing several areas with water damaged roof sheathing. Please note these observations and evaluation was to address the items noted only and was n6t inspected for complete compliance with the North Carolina Residential Building Code or local laws and ordinances. Accessory Dwelling Units vs. Accessory Structure: Permitted uses of accessory dwelling units are defined yet permitted uses of accessory structures are not or at least I could not locate them. What are the specific permitted uses for an accessory structure? It seems logical to that our existing structure would be allowed as an accessory dwelling unit by way the rights of non -conforming structures. Our Intentions: Use this structure as a compliment to the dock that it is attached to. This would include the following uses: storage, personal gatherings, kitchen accessories for cooking and electrical as exists and full bathroom as exists. We would further intend on installing a ductless HVAC system. We could agree to the non-use of living quarters as we are building a new home on this lot. Alternative Use: If the current site plan and regulations of the town due not permit the above mentioned uses with our accessory building; then we would move to create a new lot for this structure and continue its use as a single-family dwelling as it has been used for almost 70 years. Of that, $7178 applies to the roof. I have paid market value for materials as they were purchased from Lowes and Best Distributing. As for the labor, it reflects the market as well. In fact, I could have gotten out cheaper on the roof with a roofing company. It's what they do every day. Anyway, I am a general contractor, yet that license is not required for this work. I am the property owner, can purchase materials and hire people to perform work. Also, included in our attached letter is additional work that we would like to do to further secure the home. That additional cost is $1836. With the completed and proposed work; our totals would equal $11,203. The current tax value of the structure is $23,916. 50% of that equals $11,958. As for the current value, I have contacted the Pender County Tax Assessor's office and asked for a re-evaluation through an on -site visit. Per the conversation I had with their office, the structure has not been physically looked at in years and the dock has never even been included in their value. It was my understanding from the Town that they had accepted our numbers to date and needed your office to acknowledge them as well (exemption) so that we could move forward with the Town with proper permitting. We have performed work on a non -conforming single-family dwelling (Grandfathered) due to damages caused by natural elements and kept our repairs to the alowable limits.
