Anderson Blvd., Topsail Beach, NC AREA OF ENVIRONMENTAL CONCERN — Ocean Hazard AEC Dear Mr. Aycock: I have reviewed the information submitted to this office in your inquiry concerning the necessary filing of an application for a minor development permit under the Coastal Area Management Act. Based on the information provided, I have determined that the activity you propose is exempt from needing a minor development permit as long as it remains consistent with your site drawing dated received by DCM on July 2, 2020, and meets the conditions specified below. If your plans should change and your project will no longer meet these conditions, please contact me before proceeding. ACCESSORY STRUCTURE/USE 1. The work authorized under this exemption specifically includes construction of a 10' x 10' seating area along the ocean side of the property. The final project dimension(s) shall not exceed a footprint greater than 100 square feet. 2. The development must not involve removal, damage, or destruction of threatened or endangered animal or plant species. 3. The development must not alter naturally or artificially created surface drainage channels. 4. The development must be consistent with all applicable use standards and local land use plans in effect at the time the exemption is granted. 5. The proposed development shall remain consistent with the attached work plan drawings. 6. This permit does not authorize expansion of the existing structure. 7. WITH EXCEPTION OF THE BEACH ACCESS WALKWAY, ALL DEVELOPMENT AUTHORIZED UNDER THIS EXEMPTION SHALL BE LOCATED LANDWARD OF THE FIRST LINE OF STABLE NATURAL VEGETATION (FLSNV). This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or Local authorization. This exemption expires 90 days from the date of the letter. D_EQ� Page 2 J. Aycock TBEX20-03 STRUCTURAL ACCESSWAY EXEMPTED 1. The accessway must not exceed six feet in width and shall provide only pedestrian access to the ocean beach. 2. The accessway must be constructed so as to make negligible alterations to the frontal dunes. This means that the accessway must be constructed on raised posts or pilings of five feet or less in depth, so that wherever possible only the posts or pilings touch the frontal dunes without any alteration to the dunes. In no case shall the frontal dune be altered so as to significantly diminish its capacity as a protective barrier against flooding and erosion. 3. Construction of the accessway be shall consistent with all other applicable local ordinances and N. C. Building Code standards. 4. No portion of the proposed walkway may extend beyond the seaward toe of the Frontal Dune, nor shall it extend onto the wet sand beach. Anderson Blvd., Topsail Beach, Pender County as requested in the permittee's application package, dated June 24, 2019, and received as complete by DCM on September 27, 2019. This permit, issued on October 14, 2019, is subject to compliance with the application and site drawing (where consistent with the permit) dated and received on September 27, 2019, all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes: Demolition of an existing residence (inc. septic tank) and construction of new dwelling with new septic system. (1) All proposed development and associated construction must be done in accordance with the permitted work plat drawing prepared by Weston Lyall, PE, PLS, PLLC, revised (R4) on September 20, 2019. The authorized work plat was received by the Division of Coastal Management on September 27, 2019. (2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations, applicable local ordinances and FEMA Flood Regulations. (3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. (4) A copy of this permit shall be posted or available on site. Contact this office at (910) 766-7221 for a final inspection at completion of work. (5) With exception of a beach access walkway and 100 sq. ft. or less of structurally independent decking, all other structures shall be set back a minimum of 60 feet from the first line of stable natural vegetation (FLSNV) and static vegetation line (SVL), as determined by the DCM, the Local Permit Officer (LPO), or another assigned agent of the DCM. itional Permit Conditions on This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further wdtten permit approval. Aycock, III Minor Permit # TB 19-17 Date: October 14, 2019 Page 2 (6) The permittee is required to contact the LPO at (910) 796-7221, shortly before he plans to begin construction to arrange a setback measurement that will be effective for sixty (60) days barring a major shoreline change. Construction must begin within sixty (60) days of the determination or the measurement is void and must be redone. (7) Any/all structures constructed within the Ocean Hazard area shall comply with the NC Building Code, including the Coastal and Flood Plain Construction Standards of the N. C. Building Code, and the Local Flood Damage Prevention Ordinance as required by the National Flood Insurance Program. If any provisions of the building code or a flood damage prevention ordinance are inconsistent with any of the following Area of Environmental Concern (AEC) standards, the more restrictive provision shall control. (8) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Disturbed areas shall be vegetated and stabilized (planted and mulched) within 14 days of construction completion. Any excess sand held in storage shall be re -distributed throughout the site; However, no material shall be deposited any further seaward than the landward toe of the frontal dune. (9) This permit does not authorize the removal and/or transportation of sand from the subject property. (10) With the exception of the permitted "boardwalk", or beach/structural access walkway, no other development shall be located seaward of the landward toe of the frontal dune, as determined by the NC Division of Coastal Management and depicted on the approved site plan drawing as "Toe of Dune-JAD 7-25-2019". (11) The total floor area of the permitted dwelling shall not exceed 1,760 square feet, per the application package. (12) All buildings must be elevated on pilings with a diameter of at least 8 inches in diameter if round, or 8 inches to a side if square; and the first -floor level of the sills and joists must meet the 100-year flood level elevation. (13) All pilings shall have a tip penetration greater than eight feet below the lowest ground elevation under the structure. (14) Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently threatened by changes in shoreline configuration. The structure(s) shall be relocated or dismantled within two years of the time when it becomes imminently threatened, and in any case upon its collapse or subsidence. However, if natural shoreline recovery or beach renourishment takes place within two years of the time the structure becomes imminently threatened, so that the structure is no longer imminently threatened, then it need not be relocated or dismantled at that time. This condition shall not affect the permit holder's right to seek authorization of temporary protective measures allowed under Coastal Resources Commission (CRC) Rules. (15) Pursuant to 15A NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise disposed of to a third -party. i^I N.
