This permit, issued on March 27, 2020 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Excavation 1) In accordance with commitments made by the permittee and in order to protect juvenile shrimp and finfish populations, no excavation or filling shall be permitted between April 1 and November 15 of any year without the prior approval of the Division of Coastal Management, in consultation with appropriate resource agencies. 2) No excavation shall take place outside of the area indicated on the workplan drawings. 3) Excavation shall not exceed -12 feet below the mean lower low water level. In no case shall the depth of excavation exceed the depth of connecting waters. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee Carteret County Permit No. 35-20 Page 2 of 4 ADDITIONAL CONDITIONS 4) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 5) No excavated or fill material shall be placed at any time in any vegetated wetlands or surrounding waters. 6) All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the National Response Center at (800) 424-8802 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. 7) The permittee is advised that submerged aquatic vegetation (SAV) habitat exists in close proximity to the authorized project. All available precautions shall be utilized to ensure that damage to SAV habitat does not result from the construction and/or operation of the authorized facilities. Should dredging of these areas be proposed in the future, the permittee is further advised that the Rules of the Coastal Resources Commission prohibit new dredging within SAV beds. Spoil Disposal 8) No spoil material shall be placed within 30 feet of the mean high water line. 9) All excavated materials shall be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 10) The permittee and/or his contractor shall take all necessary precautions to ensure that the spoil material is properly contained during transport to the disposal site, and that all the proper coordination has taken place with the local or state governments to ensure that any damage to public streets caused by transport of the spoil material has been addressed. 11) Spoil shall not be stockpiled at the offloading site and shall be timely transferred to the final disposal site to the greatest extent practicable. 12) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Division of Energy, Mineral and Land Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405. Carteret County ADDITIONAL CONDITIONS Maintenance Clause Permit No. 35-20 Page 3 of 4 13) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any maintenance excavation work authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for spoil disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the spoil disposal site shall be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. D. The date of map revision and the permittee's signature shown anew on the original plan. USACE Conditions 14) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at http://www.fws.gov/nc-es/mammal/manatee guidelines.pdf. 15) The permittee shall follow NMFS's Sea Turtle and Smalltooth Sawfish Construction Conditions to further reduce interaction risk and require all construction workers to watch for sturgeon and sea turtles. Operation of any mechanical construction equipment will cease immediately if a protected species is seen within a 50-foot radius of the equipment. Activities will not resume until the protected species has departed the project area of its own volition. General 16) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 17) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2017-02286) issued 3/27/20. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2019-1718. The development conforms to the guidelines set forth under 15A NCAC 07H .0208. The waters of Taylors Creek area are closed to shellfish harvest and is not designated as a Primary Nursery Area. Assuming that state and federal agencies concur with the proposal, the District recommends the project be authorized as proposed, contingent upon the following conditions: • All development shall be constructed as shown on plats accepted as complete by DCM on 9/3/19. • All excavation shall remain outside of any SAV areas. • The channel shall not exceed a width of 75' and a final depth of -12' MLLW • All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind effective dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. Overview The applicant is proposing to excavate and re -align the existing entrance channel along the east end of Taylors Creek. Taylors Creek in located in Beaufort, NC and is a total of 3 miles in length and has a 75' wide USACOE channel with a 51' channel setback along the project area. Historically the USA COE has maintained the channel entrance to a depth of -7' MLLW and approximately 75' wide, the current alignment has not been dredged since 2017. Presently there are existing single- family residences with bulkheads and piers to the north and an undeveloped parcel to the south known as Carrot Island. Carteret County would like to maintain a channel width of 75' but increase the depth to -12' MLLW to match the interior of Taylors Creek. The connecting water depths are -12' MLLW to -14' MLLW. They would also like to realign the channel entrance from its current northwest direction to a more southwest direction. This area has not been dredged since 2013 and has naturalized over time with shoaling. Per the applicant this new alignment would match the channels historic location identified from 2003- 20011 and should provide an improved flushing potential from Beaufort Inlet. The excavation would be approximately 1200 feet east of Carrot Island and per the applicant should not cause additional erosion problems. Perthe applicant's sediment sampling, the type of substrate within the dredge area is 97% sand and 3%fines. The excavation area would be 75' wide by 2,800' long and would remove a total of 36,000 cubic yards of material. The average existing water depth is-8.8'mllw and the final excavation depth would be -12 mllw. The spoils would be stored on an existing concrete pad and stabilized with erosion control measures. AECs involved include Public Trust Area and Estuarine Water. The project is within Taylors Creek, within this area the creek carries a water classification of SC;HQW, and there is a Federal Setback Channel. The creek is not designated as Primary Nursery Area, and is closed to the taking of shellfish. Riparian corridors were not determined. The neighbors within the excavation vicinity were notified and no objections were received. No Coastal Wetlands and SAV or shellfish beds were observed within the proposal project area. Anticipated impacts The excavation would remove a total of 210,000 sf of shallow bottom habitat and would cause temporary turbidity during removal. The spoils would be contained at an upland area, on an existing concrete slab and retained via erosion control measures. Future maintenance excavation would be anticipated and the proposed channel routes could increase yearly shoreline erosion by increase in boat traffic. Basis for Determination: The project site is located in Carteret County and Town of Beaufort. The project is subject to the 2006 Town of Beaufort Core Land Use Plan and the 2005 Carteret County Land Use Plan Update. The Beaufort LUPs Future Land Use Map (FLUM) designates the site as Conservation/Open Space (AECs). This "classification is intended to delineate areas where traditional land uses are not desirable or expected to develop. Land development may, however, include public buildings and facilities necessary to support existing uses with the areas..." (p. 95). The Carteret County LUPs Future Land Use Map (FLUM) designates the site as Conservation (AECs). According to the LUP "Uses allowed by Carteret County in AECs are those that are consistent with the State's minimum use standards, except when the policies contained in this plan are more restrictive that State Standards" (p. 94). The following LUP policies are applicable to this request: Town of Beaufort LUP Policies 4.2.6 Areas of Environmental Concern Policy 1: The Town of Beaufort supports state and federal law regarding land use and development in AECs (pg. 84). Policy 3: Beaufort supports the use standards for estuarine and public trust areas as specified in 15A NCAC.0207 (pg.84). 4.2.7 Areas of Local Concern Policy 6. Beaufort will continue to support and protect the town's Historic District and the Taylor's Creek waterfront area (pg. 85). Carteret County LUP Policy 2.4 Carteret County's policies for development in estuarine and public trust waters are as follow: 1. "Carteret County will only allow development activities in estuarine and public trust waters that are associated with water -dependent uses, consistent with state and federal standards, and meet all local policies contained in this plan." REGAN Secretary STEPHEN W.MURPHEY Director MEMORANDUM: TO: Gregg Bodnar, DCM Assistant Major Permit Coordinator FROM: Curt Weychert, NCDMF Fisheries Resource Specialist SUBJECT: Carteret County - Taylor's Creek Navigation Maintenance Dredging DATE: January 7, 2020 A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has reviewed the CAMA Major Permit application for proposed actions that impact fish and fish habitats. Carteret County is seeking to dredge portions of Taylor's Creek in Beaufort. The applicant states that the project will perform maintenance dredging for navigation in an area of 210,000 square feet to a depth of -T mean lower low water (MLLW) and remove 36,000 cubic yards of mostly sandy material from the channel and entrance at the east end of the creek. The applicant is proposing to change the alignment of the dredge template on the eastern side of the creek to follow a more naturalized channel that has formed between previous dredging events. The waters within the project area are classified as SC within the creek and as SA high quality waters (HQW) in certain areas and at the entrances to both sides of the creek. The areas are not open to the harvest of shellfish and a submerged aquatic vegetation (SAV) survey reported no SAV species were present within the project area. The project narrative states that in order to avoid migrating juvenile fish and manatee that the construction will not occur between the times of November 16th and March 31st. NCDMF finds these efforts to avoid and minimize project impacts as sufficient and would recommend these periods be conditioned on the permit. If the project at any point needs to occur during the mentioned moratorium periods the NCDMF recommends that the applicant follows traditional moratorium relief procedures through DCM in correspondence with NCDMF and other appropriate regulatory and resource agencies. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located within the mouth of Taylors Creek. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. I I3A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended, 16 U.S.C. 661 et seq.). Carteret County proposes to maintain a navigation channel within Taylors Creek by realigning the existing channel entrance. The current channel alignment has not be maintenance excavated by USACE since 2007 when the 75' wide channel was dredged to -7' NLW. The current proposal realigns the channel to a more southwest direction, that is more in line with historical channel locations from 2003- 2011. The 75' by 2,800' channel would have a final water depth of -12' NLW, an increase of 5' in depth - No SAV, coastal wetlands, or shellfish were observed in the project area. Dredged material would be removed via barged and trucked to 2525 Lennoxville Roade. Taylors Creek at this location is classified SA HQW. The NCWRC participated in the NCDEQ seeping meeting and has reviewed the permit application. Our comments and suggestions within the meeting have been reflected in the permit application. We support any permit conditions within the old permit that minimized impacts to environmental resources as well as any moratoria requested by NCDMF. Specifically, the project consists of deepening and realigning the east end of the entrance Channel of Taylors Creek in order to stabilize the channel and navigation access. Historically, the US Army Corps of Engineers has maintained the channel to -7 feet MLLW and 75 feet wide in accordance with the 1935 federal authorization, which allows maintenance operations to follow the most economical dredge alignment as identified by the district engineer. The county proposes to deepen the channel in this location from -7 feet MLLW to -12 feet MLLW to match the depth of the interior of Taylor's Creek. The realignment portion of the project would consist of realigning the entrance channel from its current northwest direction to a more southwest direction. According to the application, the proposed realignment would match the channel's historic location identified from 2003 to approximately 2011 and would provide an improved flushing potential from Beaufort Inlet. RE'MWED MAR 2 7 2020 NIP SECTION iAHD 2 The excavation area proposed is 75 feet wide for a length of 2,800 feet, and would remove a total of 36,000 cubic yards of material by clamshell dredge or excavator. 210,000 square feet of shallow bottom habitat would be removed from the project area. The spoils would then be transported via barge and offloaded at 2452 Lennoxville Road then transported by dump truck to be offloaded at 2525 Lennoxville Road. Spoil material would be stored on an existing concrete pad and stabilized with erosion control measures. (see attached plans for disposal locations). Additionally, the applicant proposes to limit construction activities to daylight hours between November 16 to March 31. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the modification to the State authorization: 1. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at hftp://www.fws.gov/nc-es/mammal/manatee quidelines.pdf. 2. In order to protect juvenile finfish resources and seasonal migrations of fish and protected species (i.e. sturgeon and sea turtles), no excavation or filling activities will be permitted between the dates of April 1 and November 15 of any year without the prior approval of the North Carolina Division of Coastal Management and the U.S. Army Corps of Engineers. Dredging will be restricted to daylight hours. 3. The applicant shall follow NMFS's Sea Turtle and Smalltooth Sawfish Construction Conditions in order to further reduce interaction risk, and require all construction workers watch for sturgeon and sea turtles. Operation of any mechanical construction equipment will cease immediately if a protected species is seen within a 50-ft radius of the equipment. Activities will not resume until the protected species has departed the project area of its own volition. 4. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. For further information, the permittee should contact the U.S. Coast Guard Marine Safety Office at (910) 772-2191. 5. All work authorized by this permit must be performed in strict compliance with the RECEIVEU MAR 2 7 2020 -3- MP SECTION MHD submitted plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USAGE) prior to implementation. 6. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land -clearing activities shall take place at, any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 7. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 8. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the N.C. Division of Water Resources at (919) 733- 5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. 9. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 10. If the permittee discovers any previously unknown historic or archeological remains while accomplishing the authorized work, he will immediately notify the Wilmington District Engineer who will initiate the required coordination procedures. 11. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 12. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, MAR 2 7 - 2020 MP SECTION MH® -4- the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 13. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 14. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion of the work will, without expense to the United States and in such time and manner as the Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre -project condition. 15. Violations of these conditions or violations of Section 404 of the Clean Water Act or Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation. PROJECT SUMMARY: The applicant proposes to excavate and re -align the existing entrance channel along the east end of Taylors Creek. 9. Narrative Description The Carteret County channel excavation and relocation project is located along the east end of Taylors Creek in Beaufort, NC. Taylors creek is a total of 3 miles in length and has a 75' wide USACOE channel with a 51' channel setback along the project area (within Taylors Creek along the east end). The east entrance channel portion leading into Taylors Creek is the current alignment and was last dredged in 2017. Presently there are Field Investigation Report: Carteret County channel excavation, Taylors Creek Page 02 existing single- family residences with bulkheads and piers to the north and an undeveloped parcel to the south known as Carrot Island. The Town of Beaufort Land Use Plan classifies this area as Conservation. This section of Taylors Creek is not designated as Primary Nursery Area, is closed to the taking of shellfish and carries a water classification of SC. Riparian corridors were not determined. The neighbors within the excavation vicinity were notified and no objections were received. No SAV's or shellfish beds were observed within the proposal project area. 10. Proiect Description: The relocation and excavation of the east end entrance channel of Taylors Creek, per the applicant, would be for improved channel stability and navigation access. Historically the USACOE has maintained the channel entrance to a depth of -T MLLW and approximately 75' wide, however, the current alignment has not been dredged since 2017. Carteret County would like to maintain a channel width of 75' but increase the depth to-12'mllw to match the interior of Taylors Creek. The connecting water depths are-12'mllw to -14' mllw. They would also like to realign the channel entrance from its current northwest direction to a more southwest direction. This area has not been dredged since 2013 and has naturalized over time with shoaling. Per the applicant this new alignment would match the channels historic location identified from 2003- 20011 and should provide an improved flushing potential from Beaufort Inlet. The excavation would be approximately 1200 feet east of Carrot Island and per the applicant should not cause additional erosion problems. Per the applicant's sediment sampling, the type of substrate within the dredge area is 97% sand and 3% fines. The excavation area would be 75' wide by 2,800' long and would remove a total of 36,000 cubic yards of material. The average existing water depth is-8.8'mllw and the final excavation depth would be -12 mllw. The spoils would be transported via barge and offloaded at 2452 Lennoxville Road then transported by dump truck to be offloaded at 2525 Lennoxville Road. The spoils would be stored on an existing concrete pad and stabilized with erosion control measures. 11. Anticipated Impacts: The excavation would remove a total of 210,000 sf of shallow bottom habitat and would cause temporary turbidity during removal. No SAV, CW's or shellfish were observed within the excavation area. The spoils would be contained at an upland area, on an existing concrete slab and retained via erosion control measures. Future maintenance excavation would be anticipated and the proposed channel routes could increase yearly shoreline erosion by increase in boat traffic. All available precautions shall be utilized to ensure that damage to SAV habitat does not result from the construction and/or operation of the authorized facilities. Should dredging of these areas be proposed in the future, the permittee is further advised that the Rules of the Coastal Resources Commission prohibit new dredging within SAV beds. Spoil Disposal 8) No spoil material shall be placed within 30 feet of the mean high water line. 9) All excavated materials shall be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 10) The permittee and/or his contractor shall take all necessary precautions to ensure that the spoil material is properly contained during transport to the disposal site, and that all the proper coordination has taken place with the local or state governments to ensure that any damage to public streets caused by transport of the spoil material has been addressed. 11) Spoil shall not be stockpiled at the offloading site and shall be timely transferred to the final disposal site to the greatest extent practicable. 12) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. In addition, we are coming up on our 150 day date for Wainwrights. I am still waiting on USACE but will have to finalize a decision by the end of the week. I will notify you if USACE does not respond before then so you are aware that USACE authorization would still be required. Review agencies requested notification of dredging operations to keep in the loop for channel location and SAV, so that will be accomplished by coordination of the pre -con meeting. I will make sure you are notified when we complete things on our end. For Atlantic Harbor I have only received responses to the regrading White Point for wetland fill question from DMF and WRC. They are both opposed to regrading due to potential contaminants. I think the 100' reference NMFS is referring too, represents the currently maintained width for the interior portions of East Taylor's Creek as provided in Table 1 of the narrative and copied below. Regardless, the proposed width for this application is 75-ft. The narrative provides Table 1 to show the current proposal attempts to minimize dredging operations to a reasonable width and depth, but ultimately less than the interior of the creek under current authorizations. I think the current reduction in both width and depth currently at the creek entrance, provides a significant shoaling potential. The County's main intent is to try and reduce this'speed bump' so tidal velocities can maintain the entrance with reduced maintenance work.
