This permit, issued on February 14, 2020 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation if these terms may be subject to fines, imprisonment or civil action; or may cause the permit to ne null ana vola. Shoreline Stabilization - Bulkhead 1) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 2) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 3) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within a maximum of 30 days prior to the new expected start of construction. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Kelly Campbell Permit No. 23-20 Page 2 of 3 ADDITIONAL CONDITIONS 4) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 5) The bulkhead shall be constructed prior to any backfilling activities. 6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 7) The fill material shall be clean and free of any pollutants except in trace quantities. 8) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 9) No backfill material is to be placed within 30 feet of the normal water level, except that which will be used to backfill the area behind the permitted bulkhead. 10) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead. Sedimentation and Erosion Control 11) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfrlling activities. Docking Facility 12) This permit authorizes only the piers, 4 tie pilings, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 13) In accordance with commitments made by the permittee, the remnant pier located within the riparian setback of the property to the east shall be removed. 14) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the pennittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 15) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 16) This permit authorizes a maximum of 1 formalized boat slip. Kevin and Kelly Campbell Permit No. 23-20 Page 3 of 3 ADDITIONAL CONDITIONS J 17) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Upland Development 18) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the uncovered deck and repair and maintenance of the existing non -conforming structure in accordance with 15A NCAC 07J .0210, all as expressly and specifically set forth in the attached permit application and workplan drawings. 19) No development or land disturbing activity that is considered non -water dependent shall occur within 30 feet of the normal water level unless altered herein. Any other work or development proposed in an Area of Environmental Concern (AEC), including but not limited to the Estuarine Shoreline AEC and located within the applicant's property, shall require a review and authorization from the Division of Coastal Management prior to work commencing. General 20) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 21) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 22) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2019-02366) issued 2/3/20. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 19-1693. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. The site of the proposed development is located at 100-A Rivershore Drive (off of SR#I406) within the Little River Shores subdivision, Hertford, Perquimans County, adjacent to the Little River. The development proposal involves the Estuarine Waters (EW), Public Trust Area (PTA), Public Trust Shoreline (PTS) & Estuarine Shoreline (ES) Areas of Environmental Concern (AEC's). I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project and my findings are as follows: 1 SA NCAC 07H, 0208 (Ise Standards Paragraph (a) addresses General Use Standards, and sub -paragraph (1) precludes uses that are not water dependent within the EW and PTA and lists uses that may be considered water dependent. Consistent: The proposed development is consistent with the intent of this rule. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(B) states that development shall comply with state and federal water and air quality standards. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(C) states that development shall not cause irreversible damage to documented archaeological or historic resources as identified by the N.C. Department of Cultural Resources. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(D) states that development shall not increase siltation. Consistent:. The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(E) states that development shall not create stagnant water bodies. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(F) states that development shall be timed to avoid significant adverse impacts on life cycles of estuarine and ocean resources. Consistent: The proposed development is consistent with the intent of this role. Paragraph (a)(2)(G) states that development shall not jeopardize the use of the waters for navigation or for other public trust rights in public trust areas including estuarine waters. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (b) addresses Specific Use Standards. Of these, subparagraphs (6) Piers and Docking Facilities and (7) Bulkheads pertain to this project, and those subparagraphs not listed are not applicable to this project. Paragraph (6) Piers and Docking Facilities Subparagraph (6)(A) states that piers shall not exceed six feet in width. Piers greater than six feet in width shall be permitted only if the greater width is necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Consistent: The proposed development is consistent with the intent of this rule. RECEIVL Subparagraph (6)(B) states that the total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be 8 square feet per linear foot of shoreline with a EC 12 2 . maximum of 2,000 square feet. Projects requiring dimensions greater than those stated in this Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Size restrictions do not apply to marinas. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6)(C) states that piers and docking facilities over coastal wetlands shall be no wider than six feet and shall be elevated at least three feet above any coastal wetland substrate as measured from the bottom of the decking. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6)(F) states that piers and docking facilities shall be single story. They may be roofed but shall not be designed to allow second story use. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6)(G) states that pier and docking facility length shall be limited by: (i) not extending beyond the established pier or docking facility length along the same shoreline for similar use; (This restriction does not apply to piers 100 feet or less in length unless necessary to avoid unreasonable interference with navigation or other uses of the waters by the public); Consistent: The proposed development is consistent with the intent of this rule. (ii) not extending into the channel portion of the water body; Consistent: The proposed development is consistent with the intent of this rule. (iii) not extending more than one-fourth the width of a natural water body, or human -made canal or basin. Measurements to determine widths of the water body, canals or basins shall be made from the waterward edge of any coastal wetland vegetation that borders the water body. The one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier -head line. The one-fourth length limitation does not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. However, the proposed pier or docking facility shall not be longer than the pier head line established by the adjacent piers or docking facilities, nor longer than one-third the width of the water body. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6)(I) states that piers and docking facilities shall not interfere with the access to any riparian property and shall have a minimum setback of 15 feet between any part of the piqECE IVE or docking facility and the adjacent property owner's areas of riparian access. Consistent: The proposed development is consistent with the intent of this rule. DEC 12 ZC .. Consistent: See Subparagraph ()(D) below. Subparagraph (7)(B) states, `Bulkheads shall be constructed landward of coastal wetlands in order to avoid significant adverse impacts to the resources." Consistent: The proposed development is consistent with the intent of this rule. There are no coastal wetlands present. Subparagraph (7)(C) states, "Bulkhead backfill material shall be obtained from an upland source approved by the Division of Coastal Management pursuant to this Section, or if the bulkhead is a part of a permitted project involving excavation from a non -upland source, the material so obtained may be contained behind the bulkhead." Consistent: The applicants have indicated that clean fill will be used. Subparagraph (7)(D) states, `Bulkheads shall be permitted below normal high water or normal water level only when the following standards are met: (i) the property to be bulkheaded has an identifiable erosion problem whether it results from natural causes or adjacent bulkheads, or it has unusual geographic or geologic features, e.g. steep grade bank, which will cause the applicant unreasonable hardship under the other provisions of this Rule; Consistent: The proposed development is consistent with the intent of this rule. Severe erosion is occurring on the property and has significantly increased over the last year as the bulkhead failed, which is exposing old fill and debris. The 3'4' erosion escarpment is now 8' from the existing building. (ii) the bulkhead alignment extends no further below normal high water or normal water level than necessary to allow recovery of the area eroded in the year prior to the date of application, to align with adjacent bulkheads, or to mitigate the unreasonable hardship resulting from the unusual geographic or geologic features; Consistent: The proposed alignment is consistent with the intent of this rule. The proposed alignment is landward of the failed alignment and will provide a buffer to the existing building as well as compensating for the severely eroded irregular shoreline. (iii) the bulkhead alignment will not adversely impact public trust rights or the property of adjacent riparian owners; Consistent: The proposed development is consistent with the intent of this rule. (v) the property to be bulkheaded is in a nonoceanfront area. Consistent: The proposed development is consistent with the intent of this rule. 1 SA NCAC 07$ 0209 Coastal Shorelines (d) Use Standards. Acceptable uses shall be those consistent with the management objectives in Paragraph (c) of this Rule. These uses shall be limited to those types of development activities that will not be detrimental to the public trust rights and the biological and physical functions of the estuarine and ocean system. Every effort shall be made by the permit applicant to avoid, mitigate or reduce adverse impacts of development to estuarine and coastal systems through the planning and design of the development project. In every instance, the particular location, use, and design characteristics shall comply with the general use and specific use standards for coastal shorelines, and where applicable, the general use and specific use standards for coastal wetlands, estuarine waters, and public trust areas described in Rule .0208 of this Section. Development shall be compatible with the following standards: (1) All development projects, proposals, and designs shall preserve and not weaken or eliminate natural barriers to erosion including.peat marshland, resistant clay shorelines, and cypress -gum protective fringe areas adjacent to vulnerable shorelines. Consistent: The proposed development is consistent with the intent of this rule. (2) All development projects, proposals, and designs shall limit the construction of impervious surfaces and areas not allowing natural drainage to only so much as is necessary to adequately service the major purpose or use for which the lot is to be developed. Impervious surfaces shall not exceed 30 percent of the AEC area of the lot, unless the applicant can effectively demonstrate, through innovative design, that the protection provided by the design would be equal to or exceed the protection by the 30 percent limitation. Redevelopment of areas exceeding the 30 percent impervious surface limitation may be permitted if impervious areas are not increased and the applicant designs the project to comply with the intent of the rule to the maximum extent feasible. Consistent: The proposed development is consistent with the intent of this rule. (3) All development projects, proposals, and designs shall comply with the following mandatory standards of the North Carolina Sedimentation Pollution Control Act of 1973: (A) All development projects, proposals, and designs shall provide for a buffer zone along the margin of the estuarine water which is sufficient to confine visible siltation within 25 percent oj" C E IVED the buffer zone nearest the land disturbing development. (13) No development project proposal or design shall permit an angle for graded slopes or fill which is greater than an angle which can be retained by vegetative cover or other erosion -control devices or structures. Consistent: The proposed development is consistent with the intent of this rule. (C) All development projects, proposals, and designs which involve uncovering more than one acre of land shall plant a ground cover sufficient to restrain erosion within 30 working days of completion of the grading; provided that this shall not apply to clearing land for the purpose of forming a reservoir later to be inundated. Consistent: The proposed development is consistent with the intent of this rule. (4) Development shall not have a significant adverse impact on estuarine and ocean resources. Significant adverse impacts include development that would directly or indirectly impair water quality standards, increase shoreline erosion, alter coastal wetlands or Submerged Aquatic Vegetation (SAV), deposit spoils waterward of normal water level or normal high water, or cause degradation of shellfish beds. Consistent: The proposed development is consistent with the intent of this rule. (5) Development shall not interfere with existing public rights of access to, or use of, navigable waters or public resources. Consistent: The proposed development is consistent with the intent of this rule. (7) Development shall not cause irreversible damage to valuable, historic architectural or archaeological resources as documented by the local historic commission or the North Carolina Department of Cultural Resources. Consistent: The proposed development is consistent with the intent of this rule. (8) Established common-law and statutory public rights of access to the public trust lands and waters in estuarine areas shall not be eliminated or restricted. Development shall not encroach upon public accessways nor shall it limit the intended use of the accessways. Consistent: The proposed development is consistent with the intent of this rule. (10) Within the Coastal Shorelines category (estuarine and public trust shoreline AECs), new development shall be located a distance of 30 feet landward of the normal water level or normal high-water level, with the exception of the following: (A) Water -dependent uses as described in Rule 07H .0208(a)(1) of this Section; RECEIVED Consistent: The proposed development is consistent with the intent of this rule. DATE: December 18, 2019 Consistency Determination: The request is consistent with/not in conflict with the Perquimans County / Town of Hertford / Town of Winfall Land Use Plan (LUP) certified by the CRC on February 10, 2016, as amended through March 5, 2018. Overview: The .42 acre subject property has approximately 200 linear feet of shoreline along the Little River. Water depths range from .5 foot to 1.5 feet below Normal Water Level (NWL) at the shoreline and greater or equal to 2 feet below NWL a distance of 88 feet from the shoreline. A 20 sq. ft. area of Section 404 wetlands is located at the shoreline. The property has an elevation of 3.5 feet above NWL and is mostly cleared and vegetated with yard grasses. A large cypress tree is located on the far east peninsula of the property approximately 3 feet waterward of NWL. A drainage ditch runs along the eastern property line. The site is located primarily within the AE floodzone. Existing site improvements consist of a former marina store building and associated septic system. Existing shoreline improvements consist of a breached bulkhead, a 21 foot wide concrete boat ramp with return walls, and remnant dock, pier and pilings. The shoreline has become highly eroded. Approximately 71 linear feet of bulkhead is located atNWL, with the remainder averaging 20 feet waterward of NWL. Erosion has caused a 3 foot to 4 foot high erosion escarpment to form at NWL and, as of early December, the escarpment is 8 feet from the northern corner of the former marine store building. The former marina was authorized through CAMA Major Permit #96-84. According to the applicant, the marina has been closed for over 20 years. Approximately 52 linear feet of bulkhead will be installed within the same alignment as the existing boat ramp return walls. West of the boat ramp, an 8 foot section of bulkhead will tie into a bulkhead comer on an adjacent property averaging 4 feet waterward of NWL. East of the boat ramp, a 155 linear foot bulkhead section will have an alignment landward of the breached bulkhead, averaging 8.6 feet waterward of NWL with a maximum distance of 15.5 feet waterward of NWL. A 5 foot bulkhead return wall will be installed into the land at the mouth of the ditch. The bulkhead configuration will provide a 20 foot buffer between the bulkhead and northern corner of the building and protect the cypress tree on the peninsula. The pier terminus platform will be arranged in an "L" configuration. Tie pilings will be installed on the east side of the platform to create a formalized wet slip. The open raised wooden deck will be constructed on the waterward side of the existing building and, as measured from the submitted site plan, will be located a minimum of 10 feet from the bulkhead. Building repair and maintenance will not result in building expansion or an increase in impervious coverage. The waters of the Little River in this area are classified as Class SC waters and Joint Waters and are closed to shellfish taking. No submerged aquatic vegetation (SAV) was observed within the project area. No archaeological sites were identified on or nearthe property. A review of historical sites was not provided. Anticipated Impacts resulting from this project are expected to include: the filling of 1,401 sq. ft. of Public Trust Area/Estuarine. Waters Areas of Environmental Concern (AEC) and 20 sq. ft. of Section 404 Wetlands within the Public Trust/Estuarine Shoreline AEC; the shading of 672 sq. ft. of Public Trust Area/Estuarine Waters AEC and 192 sq. ft. of Public Trust/Estuarine Shoreline AEC, and; the disturbance of 3,667 sq. ft. of Public Trust Shoreline/Estuarine Shoreline AEC. Basis for Determination: The property is designated as "Residential" on the Perquimans County Future Land Use Map (FLUM). "Designated conservation/open space areas" are also included within the project area. As indicated on Page IX-34 "(t)he precise location of protected/regulated areas that have a conservation or open space connotation such as coastal wetlands, estuarine waters, estuarine shoreline, pubic trust areas, and Section 404 wetlands must generally be determined by field investigation on a case by case basis. These areas, scattered throughout the County and generally found along creeks and rivers, are not individually identified on the future land use map." The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in'strict compliance with the attached plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. 2.. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal, relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910- 3282 at least two weeks prior to beginning work and upon completion of work. 3. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 4. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 5. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. PROJECT SUMMARY. The applicant proposes to construct a replacement bulkhead to protect the existing marina store, construct a new one slip docking facility, install an elevated wooden deck adjacent to the store and then do repairs to the building. Kevin 6 Kelly Campbell Field Investigation Report Page 2 Project Setting The site of the proposed development is located at 100-A Rivershore Drive (off of SR#1406) within the Little River Shores subdivision, Hertford, Perquimans County, adjacent to the Little River. It should be noted that a locked chain -link fence gate prohibits free entry onto the site. The subject property is the site of a former marina authorized through CAMA Major Permit #96- 84. It is ±18,230 ft2 in size, has an elevation of ±3.5' above normal water level (NWL), and is mostly cleared and vegetated with yard grasses. A drainage ditch runs along the eastern property line as well as a ±10' wide strip of woody brush, trees, cat briers and poison ivy that extends landward from its edge. Man-made features on the highground area include the marina store building and the associated septic system. Based on available information, no archaeological sites are on or near this property. The current shoreline is ±200' in length and has become highly eroded waterward of an existing breached bulkhead alignment. Approximately 71' of this bulkhead is located at NWL while the remaining remnant alignment averages ±20' waterward of NWL. This erosion has caused a sheer 3'-4' high erosion escarpment to form at NWL and, as of December 61, the escarpment is 8' from the northern corner of the marina store building, making it an imminently threatened structure. A ±20 ft2 patch of USACE jurisdictional wetlands (Juncus effusus) is located on the landward side of the bulkhead section still at NWL. In addition to the breached bulkhead, a functional 21' wide concrete boat ramp is located on the western side of the shoreline and a remnant marina pier is located offshore within the waters of the Little River. Also, of note, a large Cypress tree is located on the far eastern "peninsula" of the property that is currently located ±3' waterward of NWL. This tree previously existed on the landward side of the beached bulkhead. The waters of the Little River in this area are considered Joint Waters, classified as SC and are closed to shellfish taking. There is ±0.9 miles of open water to the northeast of the site The bottom substrate is made up of fine sands and water depths within the eroded area range from 0.5' to ±1.5' below NWL. Submerged Aquatic Vegetation (SAV) was not observed growing within the project area. The adjacent riparian property to the west is residential in nature with a single-family dwelling and has recently had its bulkhead replaced placing it 4' waterward of the applicant's bulkhead. The adjacent riparian property to the east is undeveloped with a natural shoreline and has areas of wetlands and highground. Development Proposal In order to prevent further erosion to the site and protect the building, the applicant proposes to construct ±220' of vinyl bulkhead. Of this length, ±52' will be constructed within the same alignment as the existing boat ramp return walls and the remaining length is broken into two sections. On the west side of the boat ramp, a short ±8' section ties into the adjacent bulkhead corner averaging 4' waterward of NWL. On the east side of the boat ramp, a ±155' section is proposed with an alignment that is landward of the failed bulkhead alignment averaging ±8.6' waterward of the current NWL with a maximum distance of ±15.5'. A 5' return will then be constructed back into land at the mouth of the ditch. This alignment will provide a 20' buffer between the bulkhead and the northern corner of the building. The applicant also believes the alignment around the large cypress tree will prevent it's death. , Kevin & Kelly Campbell Field Investigation Report Pageg Upon bulkhead completion, the applicant proposes to construct an 88'x6' pier with a 12'x12' platform in a "L" configuration. Four tie -pilings will be installed on the east side of the platform creating one formalized wet slip in a water depth of >_2' below NWL. The proposed pier & platform are similar to others in the area, meets the '/< width rule and does not encroach within the 15' setback. Within the highground area, the applicant proposes to. • construct a 12'x16' open raised wooden deck on the waterward side of the existing building. • conduct repair & maintenance to the existing building. Building expansion or additional impervious coverage is NOT proposed within the Public Trust Shoreline or Estuarine Shoreline AEC's. Anticipated Impacts • The construction of the bulkhead along the proposed alignment will result in the shallow bottom fill of ±1,401 ft2 of Estuarine Waters and Public Trust Area AEC's with clean fill from an upland source. • The construction of the bulkhead along the proposed alignment will result in the placement of ±51.9 cubic yards of fill material below NWL. • The construction of the bulkhead will result in the filling of ±20 ftz of USACE 404-wetlands within the Estuarine Shoreline AEC. • The proposed pier and platform will result in the shading of ±672 ft2 of Estuarine Waters and Public Trust Area AEC's. It is anticipated that there will be no SAV impacts from the proposed development. The area of the proposed bulkhead is shallow and quickly eroding. SAV's were not observed in the area of the boat slip and water depths are greater than 2'. The property is more specifically described as being 100A Rivershore Drive (SR #1406), and consists of —.417 acres (18,614sf), and —200' of shoreline fronting on the Little River. Existing development on and adjacent to the property Includes a remnant bulkhead, a remnant pier and pilings from an abandoned 19-slip marina, a 21' wide concrete boat ramp with a remnant courtesy dock, and a dilapidated marina concession building with bathrooms. Located on the landward side of the remnant bulkhead (on the east side of the boat ramp) is — 20sf of non -coastal wetlands comprised of soft rush. Little River Shores was platted in 1970 by Albemarle Developers (Joseph Tilden Whitehurst). In 1983 the developer applied for a CAMA Major Permit to construct a concession building, fill an existing basin, construct 2 floating docks on either side of the boat ramp, and construct a 150' pier with finger piers to accommodate 19 boat slips. On May 25,1984, CAMA Permit #96-84 was issued for the above described development. When the bulkhead was constructed an average of 3' of fill was placed on the property increasing the shoreline elevation from between 6" and 1' to an average of 3' above NWL. Backfill consisted of a sand clay mix, broken concrete and woody debris that is now visible in the water and along the escarpment. The CAMA Permit was subsequently renewed and transferred to Donald and Betty Swain. Over the years, the Swains stopped operations of the marina and eventually closed the property. The marina has been closed for over 20 years with only the ramp remaining functional. While the ramp continued to be used by some residents in Little River Shores, increasing erosion and damage to the bulkhead, damage to the building, a lack of repairs, personal liability, and taxes compelled the Swains heirs to sell the property. Current owners Kevin and Kelly Campbell would like to make the following improvements to the property for a private family recreational site; 1) Construct a vinyl replacement bulkhead that will include 163' of shoreline on the Little River, two 26' return walls within an existing 21' wide boat ramp (that will be constructed within the existing alignment), and a 5' return wall on the east side of the property, for a total of 220'. The Average distance waterward of NWL will be 8'-7", and the maximum would be 15'-6" from NWL. 2) Construct a new 88' x 6' pier with a 12' x 12' platform and four tie pilings for one formal boat slip on the east side of the existing boat ramp. 3) Construct a 12' x 16' open wooden deck on the river side of the existing building. 4) Repair the existing building. Repairs will include windows, exterior siding, roofing and the foundation along the southeast corner of the building. _. mooviD 1 DEC 12 2019 CITY The proposed bulkhead alignment being requested, while greater than an average of 2' from NWL, is considerably less than the original waterward alignment. The alignment is designed to avoid a hard corner that would create a debris collection problem, and intensify wave action and stress on a small localized section of bulkhead. In addition, the existing building is now only 12' from NWL. The proposed alignment will increase the building setback to a minimum of 20', reduce the existing area of impervious surface within the 30' buffer, reduce surface runoff, and provide added protection to the building. Pending a permit decision Mr. Campbell has placed temporary boards along the remnant bulkhead pilings to attenuate wave action along the 2'-6" to 4'-3" high escarpment and slow erosion. The following impacts will result from the proposed development: 1) 1,4015f of shallow bottom will be filled in association with the proposed bulkhead alignment, 2) —20sf of non -coastal wetland fill, 3) 3,667sf of high ground disturbance from bulkhead backfill, anchors, and associated grading, 4) 672sf of open water shading from the pier and platform. No submerged aquatic vegetation was found within the project area and the water depth at the proposed mooring slip is a minimum of 2' deep. The property is located along Joint Waters of the State, and as such are Estuarine Waters. The waters of the Little River are also classified as "C". Class C waters are "protected for uses such as secondary recreation, fishing, wildlife, fish consumption, aquatic life including propagation, survival and maintenance of biological integrity, and agriculture. The one-fourth length limitation shall not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. However, the proposed pier or docking facility shall not be longer than the pier head line established by the adjacent piers or docking facilities, nor longer than one-third the width of the water body. Consistent: No USACE channel and less than'/. the width of the sound. (H) Piers or docking facilities longer than 400 feet shall be permitted only if the proposed length gives access to deeper water at a rate of at least 1 foot each 100-foot increment of length longer than 400 feet, or, if the additional length is necessary to span some obstruction to navigation. The erosion has migrated to within 12' of an existing building (old marina concession store). (ii) the bulkhead alignment extends no further below normal high water or normal water level than necessary to allow recovery of the area eroded in the year prior to the date of application, to align with adjacent bulkheads, or to mitigate the unreasonable hardship resulting from the unusual geographic or geologic features; Consistent: It is our contention that the alignment proposed is consistent with the purpose and intent of this rule. The shoreline has eroded a deep scalloped pocket along a 4' bluff on the north side of the building (See enclosed Drawings and photos marked Attachments A and B with the Narrative). Erosion on the east side of the property and the area along the north side of the building has formed a 17' wide peninsula with an old growth cypress tree that now stands approximately 3' weterward of normal water level. This area continues to erode at an alarming rate, as it is subject to severe wave action from the north, west and east during storm events. The Campbell's would like to save the cypress that once existed on the landward side of the bulkhead. Construction of a bulkhead between the tree and normal water level will lead to the eventual death of the tree. In addition, to construct a bulkhead that follows the shoreline along the eroded pocket will result in a hard or sharp corner on the west side of the peninsula. Hard corners collect debris and direct intense wave action to a small area of the bulkhead, making it extremely vulnerable to damage during severe storm events. The creation of a hard or sharp corner will also result in the accumulation of debris that present a hazard to swimmers. It should be noted that the purpose of the property is to provide a recreational fishing and swimming site for the Campbell family and their friends. The "Management Objectives" for Estuarine Waters includes protecting the waters for recreation. The waters of the Little River are also Class C waters which are "protected for uses such as secondary recreation, fishing, wildlife, fish consumption, aquatic life including propagation, survival and maintenance of biological Integrity, and agriculture. Secondary recreation includes wading, boating, and other uses Involving human body contact with water where such activities take place in an Infrequent, unorganized, or incidental manner". (iii) the bulkhead alignment will not adversely impact public trust rights or the property of ReCC'IVed adjacent riparian owners; Consistent: The proposed alignment will pose no Interference to adjacent riparian rights nor will it adversely impact public trust fUJ 26 109 rights.
