VAN DER VAART Secretary Coastal Management ENVIRONMENTAL QUALITY BRAXTON DAVIS Director September 9, 2016 Kim and Lee McGahey 2011 Ocean Blvd. 10'3oci-HLO Topsail Beach, NC 28443 RE: EXEMPTED PROJECT (MINOR) EXEMPTION STRUCTURAL ACCESSWAY (15A NCAC 7K .0207) — Exemption# TBEX16-14 2011 Ocean Blvd, Topsail Beach, NC AREA OF ENVIRONMENTAL CONCERN — Ocean Hazard AEC Dear Ms. And Mrs. McGahey: I have reviewed the information submitted to this office in your inquiry concerning the necessary filing of an application for a minor development permit under the Coastal Area Management Act. Based on the information provided, I have determined that the activity you propose is exempt from needing a minor development permit as long as it remains consistent with your site drawing dated received by DCM on 8/19/16, and meets the conditions specified below. If your plans should change and your project will no longer meet these conditions, please contact me before proceeding. ACCESSORY STRUCTURE l . The development specifically authorizes the work detailed in the site plan dated received by the Division of Coastal Management 9/8/16, to include construction of a 6' x 12' enclosed ground level storage area and 8' x 8' observation platform along the beach access walkway. Any additional development not illustrated on the referenced site plan will require re-evaluation by the Division of Coastal Management. 2. The development must not involve removal, damage, or destruction of threatened or endangered animal or plant species. 3. The development must not alter naturally or artificially created surface drainage channels. 4. The development must not alter the land form or vegetation of a frontal dune. 5. The development must be consistent with all applicable use standards and local land use plans in effect at the time the exemption is granted. 6. The proposed development shall remain consistent with the attached work plan drawings. 7. This permit does not authorize expansion of the existing structure. 8. No portion of the seating area shall extend seaward of the First Line of Stable Natural Vegetation (FLSNV). MAINTENANCE AND REPAIR l . The maintenance and repair work authorized under this exemption specifically includes the replacement of exterior decking along the ocean and street side of the existing residence. No additions, including roof overhangs, enclosures, etc. are authorized under this exemption. 2. The development must not involve removal, damage, or destruction of threatened or endangered animal or plant species. 3. The development must not alter naturally or artificially created surface drainage channels. The development must be consistent with all applicable use standards and local land use plans in effect at the time the exemption is granted. 5. The proposed development shall remain consistent with the attached work plan drawings. 6. This permit does not authorize expansion of the existing structure. This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or Local authorization. I have some new Customers who Have recently purchased the home at 2011 Ocean blvd. topsail beach. They have hired me to replace all of their exsisting decks and walkway to the beach using the exsisting footprint. However they would like to add a 8ft x 8ft platform at the end of the exsisting walkover.it will not go beyond the Crest of the exsisting Dune. They would also like to add a set of steps from the exsisting walk way going under the exsisting deck. And they would like to add 6ft x 12.3 ft to the exsisting ground level storage that is allready in place.This new storage area will be built with Break away walls if you allow it to be built. I have forwarded the recent Survey from Charles riggs.On it I have penned in the location of requested 8x8 platform that will not extend past the Crest of the dune. and, requested extra stairs to go off walkway to go under deck,and the location of the request to add on to the exsisting storage area with breakaway walls.
