VAN DER VAART Secretary RE: EXEMPTED PROJECT (MINOR) EXEMPTION MAINTENANCE AND REPAIR - (15A NCAC 7K .0209) — Exemption# TBEX16-01 1327 Ocean Boulevard, Topsail Beach, NC AREA OF ENVIRONMENTAL CONCERN — Ocean Hazard Area of Environmental Concern (AEC)) Dear Mr. and Mrs. Edwards: I have reviewed the information submitted to this office concerning the necessary filing of an application for a minor development permit under the Coastal Area Management Act. Based on the information provided, I have determined that the activity you propose is exempt from needing a minor development permit as long as it remains consistent with the information presented by your agent (Jeff James w/ Carolina Coast Contracting), received by the NC Division of Coastal Management on January 21 and 251h, 2016, and meets the conditions specified below. If your plans should change, your project may no longer meet these conditions. Under those circumstances, you should contact me before proceeding. MAINTENANCE AND REPAIR 1. The maintenance and repair work authorized under this exemption specifically includes the items detailed in your request dated received by DCM on January 25, 2016, to include: replacement of the ocean side decking, beach access walkway, stairs and accessory structure (sitting area). Any additional work, not specified above, is not authorized and shall be evaluated on a case by case basis. 2. Any portion of the 8' x 36' decking located within 60' of the First Line of Stable Natural Vegetation (FLSNV) shall be structurally independent of residence. 3. The development must not alter naturally or artificially created surface drainage channels. 4. The development must not alter the land form. 5. The development must be consistent with all applicable use standards and local land use plans in effect at the time the exemption is granted. 6. This permit does not authorize expansion of the existing structure. 7. New new decking, including platforms and/or walkways, is authorized under this exemption. STRUCTURAL ACCESSWAY 8. The accessway must not exceed six feet in width and shall provide only pedestrian access to the ocean beach. 9. The accessway must be constructed so as to make negligible alterations to the frontal dunes. This means that the accessway must be constructed on raised posts or pilings of five feet or less in depth, so that wherever possible only the posts or pilings touch the frontal dunes without any alteration to the dunes. In no case shall the frontal dune be altered so as to significantly diminish its capacity as a protective barrier against flooding and erosion. 10. VAN DER VAART Secretary Environmental Quality 11. No portion of the proposed walkway may extend beyond the mean high water boundary, nor shall it extend onto the wet sand beach. The walkway shall terminate as close as possible to the toe of the existing frontal dune. This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or Local authorization.
