Issued to Brunswick County Sheriffs Office, 70 Stamp Act Drive, Bolivia, NC 28422
Authorizing development in Brunswick County at the AIW W adiacent to Southport Marina, the Yacht
Basin, and W. Bay Street, in Southport , as requested in the permittee's application dated 1/22/20, including attached
workplan drawing (2), dated "RECEIVED DCM WILMINGTON, NC 3/23/20".
This permit, issued on May 27, 2020 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
No Wake Sins
1) The "No Wake Zone" markers shall be installed in accordance with the attached workplan drawings.
2) The "No Wake Zone" markers shall conform with any and all appropriate regulations governing such
structures, including but not limited to marking and lighting requirements of the US Coast Guard.
3) The permittee shall maintain the authorized "No Wake Zone" markers in good condition and in
conformance with the terms and conditions of this permit. The permittee is not relieved of this
requirement if he abandons the permitted activity without having it transferred to a third party.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2023

ADDITIONAL CONDITIONS
4) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
5) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
that may be caused from existing or future operations undertaken by the United States in the public
interest.
USACE / FEDERAL CONDITIONS
6) In order to further protect the endangered West Indian Manatee, Dichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

7) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
8) This permit does not authorize any excavation or fill of any vegetated wetlands.
9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The N.C. Division of Water Resources has assigned the proposed project DWR Project No.
2020-0492.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project Action Id. No. SAW-2020-
00661, Nationwide Permit 1.
NOTE: An application processing fee of $400 was received by DCM for this project.

Recommendations for State Permit — Brunswick County Sherrifrs Office c/o Mr. Charles Miller 4/3/20
The installation of the "No Wake Zone" signs would likely result in a temporary increase in turbidity. The proposed
locations for the signs do not appear to pose a threat to navigation. This office has no objections or other concerns
regarding the proposed development. It appears to be consistent with all other conditions of NCAC 07H .0208. It is
recommended that any permit issued should include conditions addressing navigational aids.

Special Condition: In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant
must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The
guidelines can be found at http://www.fws.gov/nc-es/mammal/manatee_guidelines.pdf.

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the attached
Nationwide Permit #1 General and Regional Conditions, your permit application and drawings dated January 6, 2020. Any
violation of the attached conditions or deviation from your submitted plans may subject the permittee to a stop work order, a
restoration order, a Class I administrative penalty, and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide and/or regional general permit
authorization is modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide and/or regional
general permit authorization is reissued and/or modified, this verification will remain valid until the expiration date identified below,
provided it complies with all requirements of the modified nationwide permit. If the nationwide and/or regional general permit
authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the terms and

commence in reliance upon the nationwide and/or regional general permit, will remain authorized provided the activity is completed
within twelve months of the date of the nationwide and/or regional general permit's expiration, modification or revocation, unless

The Division of Water Resources (DWR) has received a copy of your CAMA Major application
request dated received by this office on April 9, 2020. DWR issues approval in the form of a
Water Quality Certification (WQC) in conjunction with the CAMA Major Permit and General
Permit(s) 198000291 or 197800056 issued by the US Army Corps of Engineers (USAGE). This
Certification allows you to use the CAMA Major Permit when the Division of Coastal Management
issues it.
In accordance with the attached General Certification #4175 (GC 4175), the impacts described in
your application do not require written authorization to utilize GC 4175. However, you are required
to follow the conditions listed in the attached certification. You should get or otherwise comply
with any other federal, state and local requirements before you go ahead with your project
including (but not limited to) erosion and sediment control regulations.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by
filing a written petition for an administrative hearing to the Office of Administrative Hearings

AIWW adjacent to the City of Southport.
Areas of Environmental Concern (AEC's) impacted by the proposal are PTA and EW.
Waters at the project site are classified as SC and are open to the harvesting of shellfish.
The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Southport and Brunswick County
Land Use Plans and offer the following comments.
The general area of the project is classified as Open Space.
In general, Southport allows development in Open Space classified AECs which is
consistent with the State's minimum use standards. The Southport and Brunswick
County Land Use Plans contain some policies, which exceed the State's minimum use
standards. However, none of these standards appear to be applicable to this proposal.
This project appears to be consistent with the Southport and Oak Island Land Use Plans.

9. PROJECT DESCRD'TION
The project site is located within the AIWW adjacent to Southport Marina, the Yacht Basin and W. Bay Street in
Southport, Brunswick County. To find the project site, travel south (from Wilmington) on US Highway 17/US-76
and take exit toward Southport/Oak Island. Merge onto NC-133 S/River Rd. SE for 20.5 miles. Use left lane to
turn onto NC- 133/NC-87 S. Tom left onto NC-21 I N Howe Street. Turn right on W. West Street (toward
Southport Marina). The two pilings/signs located near the Yacht Basin are closest to the street end of Yacht Basin
Drive on W. Bay Street. The additional two pilings/signs will be located between waterway marker IA and 2A on
the western side of the entrance to Southport Marina via water and eastern side of the Yacht Basin.
The AIWW is approximately 550 linear feet across in the area of the proposed pilings for signs 1 and 2 and
approximately 3,500 linear feet across in the area of the proposed pilings for signs 3 and 4. The established "No
Wake Zone" extends 1,101 linear ft. from sign 1 to sign 3 and 1,242 linear ft. from sign 2 to sign 4 and runs past
the Southport Marina and Yacht Basin. The "No Wake Zone" encompasses the USACE Federal Channel and
Channel Setback areas. The applicant has included a letter from the US Department of the Army dated 7/19/19
approving the "No Wake Zone" (Attached). The area surrounding the AIWW is undeveloped to the south and
has ten properties of adjacent waterfront (riparian) landowners to the north. This section of the AIWW is bordered
by Coastal Wetlands, which is vegetated primarily with Smooth Marsh Cordgrass (Spartina alterniora).
The waters of the AIWW are classified SC by the Division of Water Resources and ARE NOT designated as a
Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of
shellfish.
10. PROPOSED PROJECT:
The applicant proposes to install four 8" pilings for "No Wake Zone" signs within the AIWW. The signs are
proposed to be 4 ft. long by 4 ft. wide and will be mounted via barge on 8" timber pilings (see Sheet 1 of 2). Two
signs are proposed adjacent to Southport Marina and two signs are proposed adjacent to W. Bay street. The first
proposed piling/sign would be located along the northern edge of the 80 ft. Federal Channel Setback at 331 55'
0.2388" N, 78° 1'49.116" W adjacent to Southport Marina. This sign would be located outside of the channel,
approximately 112 ft. from the adjacent developed shoreline to the north. The second proposed piling/sign would
be located along the southern edge of the 80 ft. Federal Channe, Setback at 33' 54' 56.9484" N, 78' 1'49.062" W.
This sign would be located along the southern edge outside of the channel, approximately 120 ft. from the
adjacent undeveloped shoreline to the south. The third proposed piling/sign would be located along the northern
edge of the 80 ft. Federal Channel Setback at 33' 54' 56.2752" N, 78' 1' 16.4172" W adjacent to W. Bay street.
This sign would be located along the northern edge outside of the channel, approximately 190 ft. from the
adjacent developed shoreline to the north. The fourth proposed piling/sign would be located along the southern
edge of the 80 ft. Federal Channel Setback at 33° 54' 52.4772" N, 78' 1' 16.4152" W. This sign would be located
along the southern edge outside of the channel, approximately 560 ft. from the adjacent developed shoreline to the
north, the area to the south is open water (see Sheet 2 of 2).
11. ANTICIPATED IMPACTS
The installation of the four 8" pilings for "No Wake Zone" signs will not result in permanent significant impacts
to Estuarine Waters and Public Trust Area. Minor increases in turbidity should be expected. The proposed
locations for the four pilings and signs do not appear to pose a threat to navigation and have been located outside
of the Federal Channel Setback. As proposed, all signs would be placed outside the 80' federal channel setback.

The Division of Coastal Management hereby acknowledges receipt of your application for State
approval for the development of a new No Wake Zone within the Atlantic Intracoastal Waterway (AIW W)
located in Southport, Brlmswick County. It was received as complete on March 23, 2020 and appears to be
adequate for processing at this time. The projected deadline for making a decision is June 6, 2020. An
additional 75-day review period is provided by law when such time is necessary to complete the review. If
you have not been notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an extended review.
However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days March 23, 2020 you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your
project. Such a meeting will be held within five working days from the receipt of your written request and
shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card to a
telephone pole or tree along the road right-of-way fronting your property; or at a point along the road right-of-
way where a private road would lead one into your property. Failure to post this notice could result in an
incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by
the appropriate State or Federal agency. Please contact me if you have any questions and notify me in writing

a new private docking facility to accommodate three (3) boat slips at 342 Marker Fifty -Five Ave.,
adjacent to the AIWW, in Holden Beach, Brunswick County; and on March 13, 2020, The Brunswick
County Sherriff's Office proposed to install four (4) pilings for "No Wake Zone"signs along the AIWW,
adjacent to Southport Marina, the Yacht Basin & W. Bay St., in Southport, Brunswick County. A copy

Dear Chief Deputy Miller,
Reference your letter submitted in December 2017 requesting that a No Wake Lone
be established for recreational vessels in the Atlantic Intracoastal Waterway in the
vicinity of the City of Southport, North Carolina. This request was provided in
accordance with the implementation guidance developed for Section 1149 of the Water
Resources Development Act of 2016, No Wake Zones in Navigation Channels, dated
September 27, 2017,
In accordance with that law, the Assistant Secretary of the Army for Civil Works will
allow the implementation of a No Wake Zone for recreational vessels between
waterway markers 1A and 2A, as requested, in accordance with paragraph 7 of the
implementation guidance which states;
If the No Wake Zone is approved, the district (U.S. Army Corps of
Engineers — Wilmington) will coordinate with appropriate officials for
implementation of the approved measures. The state or local officials must
obtain all applicable federal, state and local permits, including any
necessary Department of Army permits, to authorize the installation and
retention of No Wake Zone signs in navigable waters of the United States.
After coordination of the location of the signage with the district (U.S. Army
Corps of Engineers — Wilmington), the signage will be installed and
maintained by the state or local official at their own expense, and shall
meet state agency and/or Coast Guard requirements. Additionally, the
signage shall clearly state that the No Wake Zone only applies to
recreational vessels. State or local officials will be responsible for
enforcing the No Wake Zone their own expense.
As the requesting state/local official, your next steps would be to contact the North
Carolina Wildlife Resources Commission (NC'WRC) and the NC Division of Coastal

Management to initiate obtaining applicable permits for the "No Wake Zone"
signage/posts/buoys. Further, the final location and verbiage of signage should be
coordinated with NCWRC, the United States Coast Guard, and the Wilmington District.
This No Wake Zone may be evaluated on an annual basis by the Corps to assess its
effectiveness in mitigating the wakes of recreational vessels.
The Wilmington District is available to help facilitate the initiation of your coordination
actions and proposes a teleconference call with you and representatives of the above
state and federal agencies at your convenience. Mr. Jim Medlock, Project Manager,

I am writing on behalf of Sheriff John W. Ingram, V. and the Brunswick County Board of Commissioners to
request that a "No Wake" speed zone be established for recreational vessels in the Atlantic Intracoastal
Waterway between waterway marker 1A and waterway marker 2A., in the area abutting the City of
Southport, North Carolina.
Attached please find the following:
a. A Resolution adopted by the Brunswick County Board of Commissioners on August 21, 2017
requesting a "No Wake" zone.
b. A channel map with the coordinates of the proposed No Wake Zone, including the marina
footprint.
c. Documentation that the proposed No Wake Zone involves the minimum area necessary to
address the navigation safety hazard.
d. Documented evidence of:
1) Specific navigation hazards in the covered navigation channel; and
2) The hazards are adjacent to a marina; and
3) The hazards are a direct result of excessive wakes from recreational vehicles
e. Documentation that all other reasonable measures have been evaluated and taken such that a
No Wake Zone is the only measure available to address the navigation safety hazard.
