The permittee shall receive a Stormwater Management Permit, and provide a copy of this permit to DCM, prior to the initiation of any development activities authorized by this permit. Any violation of the permit approved by the DEMLR shall be considered a violation of this CAMA permit. Project Summary: The proposed project is for the construction of a drop inlet with a 36-inch concr6ter culvert through the existing basin bulkhead to help reroute stromwater under the existing docks instead of above as it currently is. No work waterward of NHW is proposed. 9. Narrative Description: The Bogue Front, LLC project is located at 137 Breakwater Drive along Hwy 24 Field Investigation Report Bogue Front, LLC 137 Breakwater Drive Page 2 of 3 Newport, Carteret County. The site is found by following highway 24 east to the Gales Creek Bridge. Once you cross the Gales Creek Bridge, continue east along HWY 24 for approximately 11,143 feet (2.1 miles). Turn right onto Breakwater Drive and follow for approximately 1,939 feet. The HOA basin property will be immediately on the left portion of the cul-de-sac area. The HOA Basin property is .15 acres (6,534 sf) in its entirety, an average of 6' above nhw and has a shoreline length of 1,200'. Bogue Sound runs along the south side of the property. The upland vegetation consists of lawn grasses and there are no coastal wetlands along the basin area. The waters of Bogue Sound have approximately 2.5'to 3' lunar tidal amplitude. The Division of Water Resources classifies this area as HQW/SA Waters. This area of Bogue Sound is not designated as a Primary Nursery Area and is closed to the taking of shellfish. The Carteret County Land Use Plan classifies this area as Residential with Conservation within the AECs. According to Google Earth spacial data, the ICWW is located approximately 914' south of the mouth of the existing entrance canal for the s/d basin. 10) Proposed Development: The applicant was previously issued CAMA major permit 139-09 on 10/12/09 for upland development and then CAMA minor permit WO-04-16 for two bulkhead weirs and riprap liner along the embankment above the basin area. The applicant was issued stormwater permit SW8080709 and USACOE permit SAW-2008-00222 for the previous major permit which expired on 3/21/14. The current proposal is for the addition of a drop inlet with a 36" culvert that would discharge below the existing basin dock, through the bulkhead and into the existing subdivision basin. A 20' wide by 30' long area would be excavated within the high ground in order to accommodate the proposed drop inlet and culvert. The final depth would be an average of 5' below existing grade. The length of the proposed 36" culvert would be 16' and would remain a minimum of 3' above normal high water at its discharge point. The proposed drop inlet, grading and culvert placement would be controlled by a bulkhead and silt fencing. 11. Anticipated Impacts: The proposed grading, drop inlet and culvert placement would disturb a maximum of 2500 ftz of high ground. The development would increase direct discharge to the existing basin and waters of Bogue Sound instead of the existing sheet flow that is currently in place. The discharge would be treated with an in ground stormwater system before discharging into existing waters. Due to safety concerns for basin users, this would improve the subdivisions safe use of this area by allowing the discharge below the existing basin docks instead of over the area as it currently sits. Styro� SUBJECT: Comments and Recommendations - CAMA Major Permit —Bogue Front LLC, 137 Breakwater Drive, Newport, Carteret County The following is my assessment and consequent recommendations of the above referenced proposal: There is an existing subdivision with boat basin along this property that was previously permitted through major permit # 139-09. Since the issuance of the major permit, the subdivision's existing drainage swale was washed out in 2015 and a CAMA minor permit was issued for the installation of two bulkhead weirs and a riprap liner with sheetflow over the existing basin dock. Per the applicant even with the new stormwater measures, they are still having issues from the concentrated flow of stormwater along the existing basin docks. Due to this fact, they are proposing to install a drop inlet and 36" concrete culvert to collect the stormwater and discharge through the bulkhead into the basin and below the docks. The development conforms to the guidelines set forth under 15A NCAC 07H .0209. Just for my own curiosity, is stormwater alright with the direct discharge? I'm guessing the basin has a decent amount of water in it even during low tide, so the water being discharged from the pipe would not create a scour hole in the mud bottom, right? Thanks! Overview: The current proposal is for the addition of a drop inlet with a 36" culvert that would discharge below the existing basin dock, through the bulkhead and into the existing subdivision basin. A 20' wide by 30' long area would be excavated within the high ground in order to accommodate the proposed drop inlet and culvert. The final depth would be an average of 5' below existing grade. The length of the proposed 36" culvert would be 16' and would remain a minimum of 3' above normal high water at its discharge point. The proposed drop inlet, grading and culvert placement would be controlled by a bulkhead and silt fencing. The applicant was previously issued CAMA major permit 139-09 on 10/12/09 for upland development and then CAMA minor permit WO-04-16 for two bulkhead weirs and riprap liner along the embankment above the basin area. The applicant was issued stormwater permit SW8080709 and USACOE permit SAW-2008- 00222 for the previous major permit which expired on 3/21/14. The project is located at 137 Breakwater Lane along Hwy 24 Newport, Carteret County. The HOA Basin property is .15 acres (6,534 sf) in its entirety, and existing basin, bulkhead, stairs and bulkhead weirs with riprap liner, an average of 6' above nhw and has a shoreline length of 1,200'. Bogue Sound runs along the south side of the property. The upland vegetation consists of lawn grasses and there are no coastal wetlands along the basin area. The waters of Bogue Sound have approximately 2.5' to 3' lunar tidal amplitude. The surface water classifications are SA (Market Shellfishing, Salt Water) and HQW (High Quality Water). The site is not designated as a Primary Nursery Area, and is closed to the harvest of shellfish. According to Google Earth the ICWW is located approximately 914'south of the mouth of the existing entrance canal for the s/d basin. Anticipated impacts The proposed grading, drop inlet and culvert placement would disturb a maximum of 2500 ft2 of high ground. The development would increase direct discharge to the existing basin and waters of Bogue Sound instead of the existing sheet flow that is currently in place. The discharge would be treated with an in ground stormwater system before discharging into existing waters. Due to safety concerns for basin users, this would improve the subdivisions safe use of this area by allowing the discharge below the existing basin docks instead of over the area as it currently sits. Basis for Determination: The project site is subject to the 2005 Carteret County Land Use Plan Update. The Future Land Use Map (FLUM) designates the site as Limited Transition (land) and Conservation (Areas of Environmental Concern). Uses allowed in Areas of Environmental Concern are those consistent with the State's minimum use standards and state and federal regulations. I looked into this one a bit more. We received an application to modify the permit for this project and it has been assigned to my coworker Kelly. The modification includes the changes to the discharge from the site. I'm sure she will evaluate it for compliance with our stormwater rules but I cannot say at this time if we object to the new discharge method or not until she gets a chance to review the application. Our various sets of rules have dramatic differences in how the discharge to surface waters gets handled. However, most of the rules require at least a 30' buffer for the onsite runoff form a low density project such as this one. Offsite runoff may bypass the site and does not require the setback. I'm sorry 1 can't be more help on this one at this time. I will forward the original email to Kelly in case she wants to add anything else. PART OF THE SUBDIVISION FRONTED ON A MANMADE BOAT BASIN CONNECTED TO BOGL E SOUND. A DRAINAGE SWALE TERMINATED UP SLOPE OF THE MARINA AND SHEET FLOWED OVER A HEAVILY VEGETATED EMBANKMENT AND OVER A DOCK CONNECTING WETSLIPS IN THE MAN-MADE BASIN. OVER THE YEARS THE HEAVY GROWTH WAS CLEANED UP AND IN 2015 A MAJOR WASH OUT OCCURRED RESULTING IN THE SIGNIFICANT LOSS OF SOIL AND A SIGNIFICANT GULLY CREATED. GROUND WATER AND SURFACE WATER RAN CONTINOUSLY THROUGH THIS WASH OUT. IT WAS DECIDED TO INSTALL TWO BULKHEAD WEIRS AND A RIP RAP LINER FROM THE HEAD OF THE WASHOUT TO THE MARINA. THAT WORK WAS PERMITTED UNDER A CAMA MINOR PERMIT. THE RESULT OF THIS REPAIR HOWEVER STILL SHEETFLOWED OVER THE DOCK BUT NOW IN A MUCH MORE CONCENTRATED FORM. THIS APPLICATION IS FOR THE INSTALLATION OF A DROP INLET AND 36" CONCRETE CULVERTTO COLLECT THE DISCHARGE OF THE STORMWATER, ABSORB MOSTOF ITS ENERGY AND DISCHARGE INTO THE MANMADE BASIN THROUGH THE BULKHEAD.
