Rd., in Hampstead as requested in the permittee's application dated 10/17/19 (MP-1) and 10/31/19 (MP-
4) including attached workplan drawings (2), Sheet 1 of 1 and Sheet 2 of 2 both dated 12/3/19.
This permit, issued on June 15, 2020 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
tt these terms may be subject to tines, imprisonment or civil action; or may cause me permit to be null ana vota.
Docking Facility Reconfiguration and Expansion
This permit authorizes only the structure relocation, floating dock and additional boat lift, and uses
located in or over the water that are expressly and specifically set forth in the permit application. No
other structure, whether floating or stationary, shall become a permanent part of this docking facility
without permit modification. No non -water dependent uses of structures shall be conducted on, in or
over Public Trust waters without permit modification.
2) No portion of the authorized docking facility, including tie piles, shall extend more than one quarter of
the width of the water body. Measurements to determine width of the water body shall be made from
the normal high water line or the waterward edge of any coastal wetland vegetation which borders the
water body, whichever is more restrictive.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2023
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes 2 additional formalized boat slips for a maximum of 4 formalized boat slips at
this docking facility.
6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
7) Should 505 Hughes Road be sold prior to the initiation of construction of the docking facility, the
permittee shall contact the Division of Coastal Management to determine appropriate steps to obtain
authorization for the permitted facility to be constructed within the riparian corridor of 505 Hughes
Road.
USACE Conditions
8) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
10) All debris associated with the removal or construction of the permitted facility shall be contained within
the authorized project area and removed to an appropriate upland location.
11) The permittee shall maintain the authorized work in good condition and in conformance with the terns
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.

ADDITIONAL CONDITIONS
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2019-02405).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2019-1721.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high-water level.
NOTE: An application processing fee of $250 was received by DCM for this project.

This letter is in response to the above referenced CAMA permit application, which was accepted
as complete by the Division's Wilmington office on December 5, 2019. On January 7, 2020,
processing of your application was placed on hold pending resolution of issues with The US
Army Corp of Engineers (USACE). The USACE did not accept the application due to concerns
with future upland development and wetlands on site. This office received an email from the
USACE staff that their request for additional information had been satisfied on April 28, 2020.
Therefore, processing of your permit application has officially resumed. The revised projected
75-day deadline for making a decision is June 10, 2020.

Please see attached snip from the bioreport. The highlighted statement is what caused my initial response. It appears in
conflict with what both Ben Kastner and Coleman Parks are saying (see attached email from Mr. Parks).
The purchase of the lot 90A and deeded access, will not justify future impacts to any wetlands onsite. Mr. Kastner says
he has no intention to develop the site.
My email was meant to get clarification on what would be proposed with the property in the future, and advise that just
because there is ownership or deeded access, it does not guarantee that a federal permit to develop the site would be
granted. If the lot is sold in the future, or sewer becomes available, the previous statement still holds true.
Additionally, it looks like the site was delineated based on the information in Mr. Parks' email.
With the statement from Mr. Kastner and information submitted by Mr. Parks, I am happy to get this project out on
notice in the near future. This will be a 291 due to size of the new 8'X64' floating dock (512 square feet), and overall size
of the final structure (over 800 square feet).

I am not sure where anyone got the idea that ANY other use or development was going to occur on this property other
than the one pier with two docks. I have NEVER asked or indicated ANY other use than a dock. This tract was one lot
which I divided only to hopefully obtain another dock permit. It is an old salt pond and the dam is the only high ground
along the waterfront, but certainly not practical for building a house as the neighbors did. I have no plans to fill in or
request mitigation and in fact, I am willing to put all the wetlands area into a conservation easement. Please come look
at the existing dock and how I started from a sliver of high ground. Lets put a conservation easement on it and move
forward.

This letter is in response to the above referenced CAMA permit application, which was accepted

summarized below:
1) Based on correspondence submitted by The US Army Corp of Engineers (USACE) dated
December 26, 2019, the USACE has requested additional information concerning a
wetland delineation and an upland site development plan.
2) In accordance with 15A NCAC 07H.0208(a)(2)(B), it is the policy of this Division that,
prior to taking final action on a project of this nature, a Water Quality Certification for
the proposed development must first be approved by the Division of Water Resources
(DWR). The DWR has also voiced concerns regarding the LISACE request for additional
information. It appears as though this additional information from the applicant will be
required before a final decision on issuance of a Water Quality Certification can be made.

familiar with this area, as previous regulators from this office have conducted site visits to the adjacent parcel in recent
years. Standing water was observed on the lots in question in this application. Until we have additional information on

The Division of Water Resources (DWR) has received a copy of your CAMA Major application
request dated received by this office on December 16, 2019. DWR issues approval in the
form of a Water Quality Certification (WQC) in conjunction with the CAMA Major Permit and
General Permit(s) 198000291 or 197800056 issued by the US Army Corps of Engineers
(USACE). This Certification allows you to use the CAMA Major Permit when the Division of
Coastal Management issues it.
In accordance with the attached General Certification #4175 (GC 4175), the impacts
described in your application do not require written authorization to utilize GC 4175.
However, you are required to follow the conditions listed in the attached certification. You
should get or otherwise comply with any other federal, state and local requirements before
you go ahead with your project including (but not limited to) erosion and sediment control
regulations. This approval is for the purpose and design that you described in your
application. If you change your project, you must notify us and you may be required to send
us a new application.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B
by filing a written petition for an administrative hearing to the Office of Administrative
Hearings (hereby known as OAH). A petition form may be obtained from the OAH at
http://www.ncoah.com/ or by calling the OAH Clerk's Office at (919) 431-3000 for
information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the

It is the staffs recommendation that the proposal to construct a docking facility is
CONSISTENT with the Rules of 15 NCAC 71-1.0206 (d) Use Standards for Estuarine Waters,

This office has no objection to the proposed work, provided it is consistent with state and

This project is consistent and not in conflict with the Pender County Comprehensive
Land Use Plan Update.
The applicant proposes to expand an existing docking facility creating a total of four (4)
slips. The project is located at 503 and 505 Hughes Road in Hampstead, Pender County.
Areas of Environmental Concern (AEC's) impacted by the proposal are PT and EW.
Waters at the project site are classified as SA and are closed to the harvesting of shellfish.
The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Pender County Comprehensive
Land Use Plan and offer the following comments.
The general area of the project is classified Developed, while the AECs impacted by the
work are classified as Conservation and Resource Protection.
In general, Pender County allows development in Conservation and Resource Protection
classified AECs which is consistent with the State's minimum use standards. The Pender
County Land Use Plan contains some policies, which exceed the State's minimum use
standards. However, none of these more restrictive policies appear to be applicable to
this project.
This project is consistent with the Pender County Comprehensive Land Use Plan
Update.

Pursuant to the CAMA-Corps Programmatic Permit process, the North Carolina Division of Coastal Management
(NCDCM) has forwarded to our office a copy of the CAMA permit application, Field Investigation Report and BioReport
for the subject project. The attached notice requests federal agency comments on this project by June 1, 2020.
The proposed site is located within waters of Mill Creek, at lots 90A and 90B, 503 and 505 Hughes Lane, in Hampstead,
Pender County, North Carolina. Coordinates are 34.347828 N,-77.708416 W.
The applicant proposes to expand an existing docking facility to create a total of four slips. Specifically, the applicant
proposes to relocate the existing 8ftX 16ft floating dock and 12ftX 12ft boatlift by moving approximately 10 feet
waterward than the existing location, in order to access deeper water. The applicant proposes to construct an additional
8Ft wide X64 ft long floating dock and include another 13ftX13ft boatlift on the southern side of the existing pier and
platform.
The bioreport states that the project is associated with future upland development on lot 90A. Upon receipt of the
application, the Corps requested the site be delineated and the applicant provide a site plan, in order to determine
potential future impacts to wetlands on the property. The owner has provided a survey which shows the wetland
boundary, and a statement that development of the site is not being proposed now, or in the future due to the nature of
the wetlands located on the property.
Dredging is not proposed as a part of this project.
The facility is not located near the Corps federal channel or right of way.

Reference the application of Mr. Coleman Parks and Mr. Ben Kastner, associated with the
expansion of an existing docking facility in waters of Mill Creek, adjacent to lots 90 A and 90 B,
located at 503 and 505 Hughes Road, in Hampstead, Pender County, North Carolina.
Specifically, the applicant proposes to relocate the existing 8ft X 6ft floating dock and 12ft
X 12ft boatlift by moving approximately 10 feet waterward than the existing location, in order to
access deeper water. The applicant then proposes to construct an additional 8 ft wide X 64 ft long
floating dock and include another 13ft X 13ft boatlift on the southern side of the existing pier
and platform. The reconfigured facility would have a total of four slips.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report. We recommend that the following conditions be
included in the modification to the State authorization:
In order to further protect the endangered West Indian Manatee, Trichechus manatus,
the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and
strictly adhere to all requirements therein. The guidelines can be found at
http://www.fws.gov/nc-es/mammal/manateeguidelines.p
2. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities.
For further information, the permittee should contact the U.S. Coast Guard Marine Safety
Office at (910) 772-2191.
3. All work authorized by this permit must be performed in strict compliance with the
submitted plans, which are a part of this permit. Any modification to these plans must be
approved by the US Army Corps of Engineers (USACE) prior to implementation.

maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of.waters or wetlands.
. 5. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
6. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Resources at (919) 733-
5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and
Hazardous Substances Control Act will be followed.
7. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
8. If the permittee discovers any previously unknown historic or archeological remains
while accomplishing the authorized work, he will immediately notify the Wilmington District
Engineer who will initiate the required coordination procedures.
9.The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this'project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
10. The permittee shall employ all sedimentation and erosion control measures necessary
to prevent an increase in sedimentation or turbidity within waters and wetlands outside the
permit area. This shall include, but is not limited to, the immediate installation of silt fencing or
similar appropriate devices around all areas subject to soil disturbance or the movement of
earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project
must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of
1973 (North Carolina General Statutes Chapter 113A Article 4).
11. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by

the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
12. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will, without expense to the United States and in such
time and manner as the Secretary of the Army or his authorized representative may direct,
restore the water or wetland to its pre -project condition.
13. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

9. PROJECT DESCRIPTION
The project site is located at 503 and 505 Hughes Road (Lots 90A & B), adjacent to Mill Creek, in
Hampstead, Pender County. To get to the site from Wilmington take US Hwy 17 N to Hughes Road
(approximately 0.55 miles south of the intersection of Highway 17 and 210 in Hampstead). Turn
right onto Hughes Road and travel approximately 1.3 miles. The applicant's property is located on
the left hand side of Hughes Road, directly across the street from 518 Hughes Road.
Combined, the two lots are approximately 1.3 acres (0.65 acres each) and existing man-made
features include a private pier and docking facility. The high ground portion is elevated
approximately 3-5 feet above Normal High Water (NH W). Vegetation on the tract consists of scrub
brush, pines and Oaks. The good portion of the tracts are comprised of "404" type wetlands. Due the
fact that no high ground development is proposed, there was no requirement for a "404"
delineation. There is a highground berm located along the southern side of the property that
transitions to an area of Black Needlerush (luncus roemerianusl which extends approximately 30-
35 feet in width toward the Normal High Water (NHW) line. Along this transition, vegetation
changes from Black Needlerush to Smooth Cordgrass (Spartina Alternijlora).
The existing pier located along the southern property line of Lot 90B was authorized by CAMA
General Permit #69207 on 6/15/2017. The existing pier extends in a southerly direction, and
terminates approximately 25 feet beyond the edge of the marsh (extrapolated -between two points).
The existing docking facility includes a 12' x 16' "T-head" platform, an 8' x 16' Floating dock and a
12' x 12' boatlift. The width of the waterbody in this area of Mill Creek ranges from 1 15'to 145' feet,
as measured from the edge of marsh to edge of marsh. Current water depths around the existing
facility range from approximately -2.0 to -2.8, relative to Normal Low Water (NLW).
Pender County's Land Use Plan (LUP) classifies the local area as Resource Protection and
Conservation. The waters of Mill Creek, adjacent to the project site, are classified as SA by the North
Carolina Division of Water Quality. They ARE NOT designated as a Primary Nursery Area (PNA) by
the North Carolina Division of Marine Fisheries, and they are CLOSED to the harvest of shellfish.
PROPOSED PROJECT
According to the project narrative and application package, the applicant proposes to expand the
existing docking facility. Under the current proposal, the applicant seeks to install an 8' x 64' section
of Floating dock, and 13' x 13' boatlift along the southern side of the existing pier and platform.
Currently, the existing floating dock is located along the western side of the fixed platform and the
boat lift is located along the eastern side of the platform. The current layout creates usability Issues
as there is insufficient water along the northern side of the floating dock. Similarly, the area along
the northern half of the existing boatlift has shoaled/filled in since the initial construction, thereby
restricting use during periods of low tide.
To combat this issue, the applicant is proposing to relocate the existing floating dock and
boatlift simply by shifting the structures approximately 10' waterward from their current
locations.

In addition to relocating the existing structures, the applicant is requesting approval to install a new
8' x 64' section of floating dock and 13' x 13' boatlift. As proposed, the new floating dock would
connect to the existing floating dock along the western side, and would span in a westerly direction
running parallel to the shoreline. At the terminal end of the proposed float, the applicant would
install a new 13' x 13' boatlift. The proposed design (layout) would extend approximately 27'
beyond (waterward) the edge of a marsh island that is located just landward of the proposed
floating dock system. In this area, the width of waterbody is approximately 119', meaning the
proposed extension/expansion would conform to the % width requirement. Additionally, the
proposed dock would not extend beyond the existing channel portion of the waterbody at this
location.
The proposal is being sought to accommodate future upland development on Lot 90A. The
applicants) have indicated the preferred construction would be to have one point of origination for
the pier, but have an expanded docking facility sufficient enough to support the use of two (2)
properties. The proposed design/layout has the potential to accommodate up to seven (7) vessels;
However, the applicants have indicated only four (4) slips are proposed. The landward side of the
proposed floating dock has approximately 25" of water at low tide, so other restrictive measures
may be put in place to ensure this area is not utilized for dockage, or the review agencies may
proceed with authorization with the understanding these areas could potentially be used for
docking.
10. ANTICIPATED IMPACTS
The proposed project would include the incorporation of 681 sq. ft. of open water area as a result of
the proposed boat lift installation and floating dock expansion. This work would occur within Public
Trust and Estuarine Waters. As proposed, the project would conform to the % width requirement
and would not encroach beyond the near shore edge of the dredge channel. Additionally, the
proposed work would not encroach within the 15' setback of either adjacent riparian property.
Minor increases in turbidity should be expected; however, no long-term impacts are anticipated.

CAMA Major Development Permit Narrative
I am planning to purchase lot 90B at (505 Hughes Road) and deeded rights to the existing dock access on
lot 90A (503 Hughes Road) from Coleman Parks contingent on being granted a permit to build a dock in
front of this lot. Rather than applying for a minor permit and building a new dock access approximately
400' long from Hughes Road through the woods and across the marsh we are applying for a major
permit to share his existing access and have less impact on the woods and marsh as well as be able to
share maintenance expenses in the future on one access.
In this application we are proposing to move Mr, Parks existing floating dock to the front of the existing
t-head, move his lift out to be inline with the front of the floater and relocate the gangway ramp. Once
the existing parts are relocated, we would like to add 64' of 8' wide floating dock and a 13'x13' boat lift
in front of lot 90B (505 Hughes Road) as drawn on the attached plan.

Sorry for the delay on this turned out to be a busy week.
I was a little unclear on how to list the slips but this dock is only for Coleman and I so I noted each of our lifts
as a slip and the floating dock as two slips on the front side (one for me one for him), the backside will have
pilings and not good for slips. Let me know if there's anything you see I need to change and can easily do that
and resend over.
Also wasn't sure if you you need prints if so just let me know and i'll get them over to you.

additional docking facility and boatlifts for a total of 18 slips with covered gazebo at E. Yacht Dr., between NE
61" & NE 62nd St., adjacent to the AIWW, in Oak Island, Brunswick County; and on December 5, 2019,
Advance Design Build, LLC proposed to expand an existing private docking facility to create a total of four (4)
boatslips at 503 & 505 Hughes Rd., adjacent to Mill Creek, in Hampstead, Pender County. Copies of these
applications can be examined or copied at the office of Tara MacPherson (Brunswick County), or Jason Dail
(Pender County) N.C. Dept. of Environmental Quality, Division of Coastal Management, 127 Cardinal Drive

Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400 Commerce

The Division of Coastal Management hereby acknowledges receipt of your application requesting State approval for
development of the subject property located at 503 and 505 Hughes Road (Lots 90A and 90B), in Hampstead,
Pender County. It was received as complete on December 5, 2019 and appears to be adequate for processing at this
time. The projected deadline for making a decision is February 18, 2019. An additional 75-day review period is
provided by law when such time is necessary to complete the review. If you have not been notified of a final action
by the initial deadline stated above, you -should consider the review period extended. Under those circumstances, this
letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the
75th day.
If this agency does not render a permit decision within 70 days from December 5, 2019, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such
a meeting will be held within five working days from the receipt of your written request and shall include the
property owner, developer, and project designer/consultant.
NCGS It 3A-1 19(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where aprivate road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate
State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive
a copy of my field report and/or comments from reviewing agencies.
