Any violation if these terms may be subject to tines, imprisonment or ccvu awion; Ur ..ray �auac wl p....... •� � ••�•• -••- • - Docking Facility 1) This permit authorizes only the demolition of the existing docking facility and the construction of the pier, boathouse, partially covered platform, finger piers and cleaning station, and other structures and uses located in orover the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Aldridge Permit No.104-20 Page 2 of 3 ADDITIONAL CONDITIONS 3) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured from the bottom of the decking. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of one (1) formalized boat slip. 6) The boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. The footprint of the boathouse shall not exceed the dimensions on the authorized workplans. 7) The authorized boathouse shall be single story, and shall not be designed to allow for second story use. 8) The authorized partially covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches are permitted. Lattice is specifically excluded from being used under this authorization. 9) The roof of the covered platform shall not be designed for second story use. 10) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 11) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. General 12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 13) All debris associated with the removal or construction of the permitted docking facility shall be contained within the authorized project area and removed to an appropriate upland location 14) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2019-02026). Jeffery S. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2020-0992. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many land disturbing activities are not authorized within 50 feet of the normal water level unless specifically exempted by Environmental Management Commission's (EMC) Tar Pamlico buffer regulations in place at the time of such development. NOTE: An application processing fee of $250 was received by DCM for this project. The partially covered platform would have a roofiine dimension of 20' x 14'. A fixed side pier measuring 19' 4" long x 5' 4° wide and 32' long x 5' 4" wide would partially encompass a 32' long x 14' wide boathouse with 34' x 16' roofline. The boathouse would accommodate the applicants 24' center console vessel with room for the applicant to store a larger vessel in the future. Overview The proposed project is located at 5271 Sidney Road in Belhaven, Beaufort County; along the shoreline of Jack's Creek, a tributary to Pungo Creek. The shoreline length is approximately 380 feet and the water depths at the boat house location are -3'to -3.8' @NWL. Existing development includes a single- family residence, a pumphouse for a private well, barn, and workshop/ storage building. Existing shoreline development includes 85' of wooden bulkhead along Jacks Creek and returned behind the coastal wetlands on either side. A 50' pier with a 12'x12' T-head platform is located centrally on the bulkhead and a concrete boat ramp is located adjacent to the pier with 20' groins on either side. The existing pier and platform are to be removed for the proposed development. The applicant is proposing to construct a new private docking facility with a pier, partially covered platform, and a boathouse. The new 64' x 6' pier will terminate in 24'x 24' L-head platform with a roofed area measuring 20' x 14'. Along the eastern side of the pier there will be a boat house with a roofline measuring 34' x 16' which will have a fixed pier partially under the roofline surrounding the boathouse measuring 5' 4" wide and 51' 4". An 18" x 48" fish cleaning station is proposed along the pier as well. The larger boathouse is to accommodate the applicants current 24' center console boat with plans to upgrade to a larger boat at a future date. The Pamlico River is classified as SC, NSW, is an inland Primary Nursery Area (per WRC), and is closed to shellfishing. The majority of the property is uplands with maintained lawn, trees, and shrubs leading up to the edge of Jack's Creek where the mowed lawn is flanked on the west by a coastal wetland comprised mainly of Cat -tail (Typha spp.) and Salt Reed Grass (Spartina cynosuroides) and flanked on the east by coastal wetlands comprised of a mix of Cord Grass (Spartina alternaflora), Black Needlerush (Juncus roemerianus), and Bulrush (Scirpus spp.). There was no SAV observed onsite. The project site is in Special Flood Hazard Area AE (EL5) according to the Beaufort County FIRM (Map # 3720668200K Panel 6682). A review of shellfish resources, 404 Wetlands and archaeological/cultural resources in the area was not provided. Anticipated Impacts The project as proposed will result in the shading of I, 722ft2 of shallow bottom habitat in Jack's Creek. Temporary impacts would include noise and turbidity resulting from the removal of the existing pier and construction of the new pier. Basis for Determination: The project is subject to the Beaufort County Joint Land Use Plan 2006 Update. The project location is at the north end of the property along the shoreline of Jack's Creek, a tributary to Pungo Creek. The majority of the property is uplands with maintained lawn, trees, and shrubs leading up to the edge of Jack's Creek where the mowed lawn is flanked on the west by a coastal wetland comprised mainly of Cat -tail (Typha spp.) and Salt Reed Grass (Spartina cynosuroides) and flanked on the east by coastal wetlands comprised of a mix of Cord Grass (Spartina alternaflora), Black Needlerush (Juncus roemerianus), and Bulrush (Scirpus spp.). The shoreline length is approximately 380 feet and the water depths at the boat house location are -3' to -3.8' @NWL. The initial site visit and consultation was on November 11, 2019 and a follow-up site visit was conducted on July 6, 2020; during the July visit broken floating SAV was seen collecting along the shore but no rooted SAV was noted in the immediate area. Existing shoreline development includes 85' of wooden bulkhead along Jacks Creek and returned behind the coastal wetlands on either side. A 50' pier with a 12'x12' T-head platform is located centrally on the bulkhead and a concrete boat ramp is located adjacent to the pier with 20' groins on either side. The existing pier and platform are to be removed for the proposed development. Jack's Creek in the project location is designated is classified as SC, NSW by the Environmental Resources Commission. Jack's Creek is designated as an inland primary nursery area by the Wildlife Resources Commission. Project Description The applicant is proposing to construct a new private docking facility with a pier, partially covered platform, and a boathouse. The new 64' x 6' pier will terminate in 24'x 24' L- head platform with a roofed area measuring 20' x 14'. Along the eastern side of the pier there will be a boat house with a roofline measuring 34' x 16' which will have a fixed pier partially under the roofline surrounding the boathouse measuring 5' 4" wide and 51' 4". An 18" x 48" fish cleaning station is proposed along the pier as well. The larger boathouse is to accommodate the applicants current 24' center console boat with plans to upgrade to a larger boat at a future date. Anticipated Impacts The project as proposed will result in the shading of 1,722ft2 of shallow bottom habitat in Jack's Creek. The boat house requested has a proposed roofline of 34' length, with an actual enclosure length of 32'. The client's current vessel has a centerline length of 24' 4". Take into account 3' for outboard motor storage and that leaves a 2.4' boathouse enclosure overhang on the bow and stern, appropriate for covering the existing vessel and allowing storage of a slightly larger vessel in the future without major reconstruction and permit modification.
