This permit, issued on November 2, 2020 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Docking Facility
1) This permit authorizes only the demolition of the existing docking facility and the construction of the
pier, boathouse, partially covered platform, finger piers and cleaning station, and other structures and
uses located in orover the water that are expressly and specifically set forth in the permit application.
No other structure, whether floating or stationary, shall become a permanent part of this docking
facility without permit modification. No non -water dependent uses of structures shall be conducted
on, in or over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2023
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal.

ADDITIONAL CONDITIONS
3) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as
measured from the bottom of the decking.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes a maximum of one (1) formalized boat slip.
6) The boathouse shall not be completely enclosed or have side coverage more than one half the height of
the side, from the roof waterward. The footprint of the boathouse shall not exceed the dimensions on the
authorized workplans.
7) The authorized boathouse shall be single story, and shall not be designed to allow for second story use.
8) The authorized partially covered platform shall not be enclosed. Any material used on the sides shall not
obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches
are permitted. Lattice is specifically excluded from being used under this authorization.
9) The roof of the covered platform shall not be designed for second story use.
10) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
11) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
General
12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
13) All debris associated with the removal or construction of the permitted docking facility shall be
contained within the authorized project area and removed to an appropriate upland location
14) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2019-02026).

NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2020-0992.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at [phone] prior to the commencement of any
such activity for this determination. The permittee is further advised that many land disturbing
activities are not authorized within 50 feet of the normal water level unless specifically exempted
by Environmental Management Commission's (EMC) Tar Pamlico buffer regulations in
place at the time of such development.
NOTE: An application processing fee of $250 was received by DCM for this project.

The applicant proposes to install a fixed access pier with covered gazebo and platforms, boathouse, and fish cleaning station.
The purpose of the project is to provide water access and a boat house to the residential property.

of equipment and where it is to be stored.
Typical dock construction methods and equipment will be used. Equipment will be stored on site, if needed.

The applicant proposes removal of the existing fixed pier and construction of an 88' long x 6' wide private pier that would
terminate in a partially covered 24' x 18' platform. The partially covered platform would have a roofiine dimension of 20' x 14'.
A fixed side pier measuring 19' 4" long x 5' 4° wide and 32' long x 5' 4" wide would partially encompass a 32' long x 14' wide
boathouse with 34' x 16' roofline. The boathouse would accommodate the applicants 24' center console vessel with room for
the applicant to store a larger vessel in the future. Additionally, an 18" x 48" fish cleaning station would be attached to the side
pier. See appendix A for details. No upland development is proposed.

In review of the project with staff we have concerns that the justification for the larger boathouse is
insufficient. Typically an applicant supplies a make and model with dimensions of a vessel that would require the
proposed boathouse as justification. If the applicant has any more tangible justification as to the need for a larger

The subject CAMA Major Permit Application is located in Jack's Creek, a tributary to
the Pungo River, and proposes to construct a new 64' x 6' pier terminating in 24'x 24' L-head
platform with a roofed area measuring 20' x 14', a boat house with a roofline measuring 34' x
16' which will have a fixed pier partially under the roofline surrounding the boathouse
measuring 5' 4" wide and 51'. The project will shade a total of 1,722ft2 of estuarine creek
bottom along a property with a shoreline measuring approximately 350' in length.
Staff has reviewed the proposed project regarding rules found in Subchapter 7H
concerning development in Estuarine Water and Public Trust Areas. The project appears
consistent with rules set for in 15A NCAC 07H.0208(b)(6), specifically (B) and (D).
Additionally, the applicant has provided proof of the need for a boathouse larger than 400f0; the
26ft boat was stored onsite near the residence during site visits and the applicant has stated desire
to upgrade to a 30ft boat. It is staffs recommendation the application be permitted as requesting
with standard permit condtions.

Reference the application of Jeff S. Aldridge for a Department of the Army permit to
remove an existing pier and platform and construct a new pier with platform and boat house, on
property located at 5271 Sidney Road, adjacent to Jack Creek, near Sidney's Crossroads, in
Beaufort County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. Except as specified in the plans attached to this permit, no excavation, fill or mechanized
land -clearing activities shall take place at any time in the construction or maintenance of this
project, in such a manner as to impair normal flows and circulation patterns within waters or
wetlands or to reduce the reach of waters or wetlands.
3. The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for reason other than safety.
4. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this

project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
5. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.

Consistency Determination: The request is consistent with/not in conflict the Beaufort County Joint Land
Use Plan 2006 Update certified by the CRC on January 13, 2010, provided that the land development and
land use activities comply with the requirements of the Tar -Pamlico Buffer Rule, unless located in the
exempted or allowed areas (see policy 2.1.5), and that development meets the Beaufort County Flood
Damage Prevention Ordinance (see policy 2.2.3).
Overview The proposed project is located at 5271 Sidney Road in Belhaven, Beaufort County; along the
shoreline of Jack's Creek, a tributary to Pungo Creek. The shoreline length is approximately 380 feet and
the water depths at the boat house location are -3'to -3.8' @NWL. Existing development includes a single-
family residence, a pumphouse for a private well, barn, and workshop/ storage building. Existing shoreline
development includes 85' of wooden bulkhead along Jacks Creek and returned behind the coastal
wetlands on either side. A 50' pier with a 12'x12' T-head platform is located centrally on the bulkhead and
a concrete boat ramp is located adjacent to the pier with 20' groins on either side. The existing pier and
platform are to be removed for the proposed development.
The applicant is proposing to construct a new private docking facility with a pier, partially covered
platform, and a boathouse. The new 64' x 6' pier will terminate in 24'x 24' L-head platform with a roofed
area measuring 20' x 14'. Along the eastern side of the pier there will be a boat house with a roofline
measuring 34' x 16' which will have a fixed pier partially under the roofline surrounding the boathouse
measuring 5' 4" wide and 51' 4". An 18" x 48" fish cleaning station is proposed along the pier as well. The
larger boathouse is to accommodate the applicants current 24' center console boat with plans to upgrade
to a larger boat at a future date.

AECs involved include: Public Trust Area and Public Trust Shoreline. The project is located within in Tar -
Pamlico River Basin and is subject to the Tar -Pamlico Buffer Rule. The Pamlico River is classified as SC,
NSW, is an inland Primary Nursery Area (per WRC), and is closed to shellfishing. The majority of the
property is uplands with maintained lawn, trees, and shrubs leading up to the edge of Jack's Creek where
the mowed lawn is flanked on the west by a coastal wetland comprised mainly of Cat -tail (Typha spp.) and
Salt Reed Grass (Spartina cynosuroides) and flanked on the east by coastal wetlands comprised of a mix
of Cord Grass (Spartina alternaflora), Black Needlerush (Juncus roemerianus), and Bulrush (Scirpus spp.).
There was no SAV observed onsite. The project site is in Special Flood Hazard Area AE (EL5) according to
the Beaufort County FIRM (Map # 3720668200K Panel 6682). A review of shellfish resources, 404
Wetlands and archaeological/cultural resources in the area was not provided.
Anticipated Impacts The project as proposed will result in the shading of I, 722ft2 of shallow bottom
habitat in Jack's Creek. Temporary impacts would include noise and turbidity resulting from the removal
of the existing pier and construction of the new pier.
Basis for Determination:
The project is subject to the Beaufort County Joint Land Use Plan 2006 Update. The counties Future Land
Use Map (FLUM) classifies the site as Agriculture -Forestry -Rural Housing, Conservation I (water protected
by Tar -Pam Buffer), and Conservation II (100-year flood plain).
The following LUP policies may be applicable to this request:
2.1 Conservation I
2.1.3 Only development and land/water use activities that are consistent with the use.standards for
coastal wetlands, estuarine waters, and public trust areas (15A NCAC 07H .0208) are allowed in this
classification. Permitted extractive uses in the Aurora area will continue.
2.1.5 Unless in the exempted or allowed, land development and land use activities must comply with the
requirements of the Tar -Pamlico Buffer Rule (15A NCAC 02B .0259).
2.2 Conservation II
2.2.2 Only development that is consistent with the use standards for the estuarine shoreline AEC and the
public trust shoreline AEC (15A NCAC 07H .0209(d) is allowed.
2.2.3 Development in any flood hazard zone delineated on a Beaufort County FIRM or in an area that is
subject to storm inundation as illustrated on Beaufort County storm surge maps must meet the location
and construction requirements of the Beaufort County Flood Damage Prevention Ordinance.

Dear Mr. and Mrs. Aldridge:
You have our approval for the impacts listed below for the purpose described in your application received by the Division of Water Resources
(Division) on July 29, 2020. These impacts are covered by the attached Water Quality General Certification Number 4175 and the conditions
listed below. This certification is associated with the use of Regional General Permit Number 291 once it is issued to you by the U.S. Army Corps
of Engineers. Please note that you should get any other federal, state or local permits before proceeding with your project, including those
required by (but not limited to) CAMA Major, Sediment and Erosion Control, Non -Discharge, and Water Supply Watershed regulations.

3. No Waste, Spoil. Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur In wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in
the Buffer Authorization Application. All forestry operations activities shall be performed so that no violations of state water quality
standards, statutes, or rules occur [35A NCAC 02H .0502 and .0502].
The Permittee shall replant the vegetation within temporarily disturbed areas associated with this project in an "in kind" manner
immediately following construction. (Example: Disturbed areas with pre-existing grassed lawns must be replanted with grass. Disturbed
areas with pre-existing trees or woody vegetation must be replanted with trees and woody vegetation. Disturbed areas with pre-
existing forest vegetation must be replanted with forest vegetation including at least two different native hardwood tree species at a
density sufficient to provide 260 trees per acre at maturity, This density can usually be achieved by planting approximately 360 (21 x 11
spacing) to 538 (9 x 9 spacing) trees per acre.) Restoration of trees/shrubs/forest must be completed by the first subsequent planting
season (November 1 through March 30). Note, if the tree plantings do not survive, they will need to be replaced such that the density is

5. During construction of the proposed project, fueling, lubrication and general equipment maintenance should not take place
within 50 feet of a waterbody or wetlands to prevent contamination by fuel and oils. [15A NCAC 02H .0506 (b)(3) and (c)(3) and
15A NCAC 02B .0200 (3)(f))
6. The permittee shall report to the Washington Regional Office any noncompliance with this certification, any violation of stream or
wetland standards [35A NCAC 02B .0200] including but not limited to sediment impacts, and any violation of state regulated
riparian buffer rules [35A NCAC 02B.02001. Information shall be provided orally within 24 hours (or the next business day if a
weekend or holiday) from the time the applicant became aware of the circumstances. A written submission shall also be
provided within 5 business days of the time the applicant becomes aware of the circumstances. The written submission shall
contain a description of the noncompliance, and its causes; the period of noncompliance, including exact dates and times, if the
noncompliance has not been corrected, the anticipated time compliance is expected to continue; and steps taken or planned to
reduce, eliminate, and prevent reoccurrence of the noncompliance. The Division may waive the written submission requirement
on a case -by -case basis.
7. This approval and their conditions are final and binding unless contested. [G.S.143-215.5]
These Certifications can be contested as provided in Articles 3 and 4 of General Statute 150E by filing a written petition for an administrative
hearing to the Office of Administrative Hearings (hereby known as OAH). A petition form may be obtained from the OAH at

Project Setting,
The subject property is located at 5271 Sidney Road in Belhaven, NC approximately one-
half mile west of Sidney Crossroads. The project location is at the north end of the property
along the shoreline of Jack's Creek, a tributary to Pungo Creek. The majority of the property is
uplands with maintained lawn, trees, and shrubs leading up to the edge of Jack's Creek where the
mowed lawn is flanked on the west by a coastal wetland comprised mainly of Cat -tail (Typha
spp.) and Salt Reed Grass (Spartina cynosuroides) and flanked on the east by coastal wetlands
comprised of a mix of Cord Grass (Spartina alternaflora), Black Needlerush (Juncus
roemerianus), and Bulrush (Scirpus spp.). The shoreline length is approximately 380 feet and the
water depths at the boat house location are -3' to -3.8' @NWL. The initial site visit and
consultation was on November 11, 2019 and a follow-up site visit was conducted on July 6,
2020; during the July visit broken floating SAV was seen collecting along the shore but no
rooted SAV was noted in the immediate area.
Existing shoreline development includes 85' of wooden bulkhead along Jacks Creek and
returned behind the coastal wetlands on either side. A 50' pier with a 12'x12' T-head platform is
located centrally on the bulkhead and a concrete boat ramp is located adjacent to the pier with
20' groins on either side. The existing pier and platform are to be removed for the proposed
development.
Jack's Creek in the project location is designated is classified as SC, NSW by the
Environmental Resources Commission. Jack's Creek is designated as an inland primary nursery
area by the Wildlife Resources Commission.
Project Description
The applicant is proposing to construct a new private docking facility with a pier,
partially covered platform, and a boathouse. The new 64' x 6' pier will terminate in 24'x 24' L-
head platform with a roofed area measuring 20' x 14'. Along the eastern side of the pier there
will be a boat house with a roofline measuring 34' x 16' which will have a fixed pier partially
under the roofline surrounding the boathouse measuring 5' 4" wide and 51' 4". An 18" x 48" fish
cleaning station is proposed along the pier as well. The larger boathouse is to accommodate the
applicants current 24' center console boat with plans to upgrade to a larger boat at a future date.
Anticipated Impacts

3.1.1 Project Location and Existing Conditions
The project is adjacent to Jack's Creek at 5271 Sidney Road near Belhaven, Beaufort County. There is a single-
family residence, a pumphouse for a private well, barn, and workshop / storage building currently located on
the property. A bulkhead is located on the property issued under general permit #40608 April 2005. See
Appendix A for details. There is also a boat ramp and fixed pier (to be removed) located on the property
constructed under unknown permit numbers. Survey information was provided by Baldwin Design Consultants,
PA. Waters in the project area are classified as SC NSW and are not open to shellfishing. The area is not a
primary nursery area.
3.1.2 Proposed Action
The applicant proposes removal of the existing fixed pier and the construction of an 88' long x 6' wide private
pier that would terminate in a partially covered 24' x 18' platform. The partially covered platform would have
a roofline dimension of 20' x 14'. A fixed side pier measuring 19' 4" long x 5' 4" wide and 32' long x 5' 4" wide
would partially encompass a 32' long x 14' wide boathouse with 34' x 16' roofline. The boathouse would
accommodate the applicants 24' center console vessel with room for the applicant to store a larger vessel in the
future. Additionally, an 18" x 48" fish cleaning station would be attached to the side pier. See Appendix A for
details. No upland development is proposed.

Additional information on the intended vessel would be helpful. The questions revolves around the 34x16 needed for a
vessel that is approximately 24.3x8.5. The additional length of the engine is helpful as that was not indicated in the
information provided. DCM looks at the entire size, including the drip edge, of the boathouse for impacts and for CRC
rules relating to bouthouses.

Gregg,
In our view the boathouse size justification is appropriate and reasonable. The boat house requested has a proposed
roofline of 34' length, with an actual enclosure length of 32'. The client's current vessel has a centerline length of 24'
4". Take into account 3' for outboard motor storage and that leaves a 2.4' boathouse enclosure overhang on the bow
and stern, appropriate for covering the existing vessel and allowing storage of a slightly larger vessel in the future
without major reconstruction and permit modification. We can send specs of larger vessels the client is considering for
purchase if that would be accepted as tangible justification. Please communicate this response to the concerned staff
and let us know if you require additional information.

In review of the project with staff we have concerns that the justification for the larger boathouse is
insufficient. Typically an applicant supplies a make and model with dimensions of a vessel that would require the
proposed boathouse as justification. If the applicant has any more tangible justification as to the need for a larger
boathouse please let me know.

Greetings Ryan and Jeff, we are working on the figures for your CAMA application and noticed a potential
comment that DCM would have regarding the boathouse dimensions. As the rule states:
'A boathouse shall not exceed 400 square feet except to accommodate a documented need for DECEIVED
a larger boathouse and shall have sides extending no farther than one-half the height of the
walls and covering only the top half of the walls. Measurements of square footage shall be

taken of the greatest exterior dimensions. Boathouses shall not be allowed on lots with less
than 75linear feet of shoreline. Size restrictions do not apply to marinas.'
As of now, the dimensions of your boathouse exceed the 400' allowance. Can we have a description of
your boat so we can meet the exception? - intended uses would help as well. Any additional supporting
documentation would help the review process move forward once submitted. thank you both

The NC Division of Coastal Management hereby acknowledges receipt of your application
for State approval for development of your property located 5271 Sidney Road, Belhaven NC
adjacent to Jack's Creek in Beaufort County North Carolina. It was received 8 July 2020 and
appears to be adequate for processing at this time. The projected deadline for making a
decision is 21 September 2020. An additional 75-day review period is provided by law when
such time is necessary to complete the review. If you have not been notified of a final action
by the initial deadline stated above, you should consider the review period extended. Under
those circumstances, this letter will serve as your notice of an extended review. However,
an additional letter will be provided on or about the 75th day. Shane Staples, Field
Representative for the Division of Coastal Management is responsible for processing your
permit and he can be reached at 252-948-3950 or via email at Shane.Staplesoncdenr.gov if
you have any questions.
If this agency does not render a permit decision within 70 days from 8 July 2020, you may
request a meeting with the Director of the Division of Coastal Management and permit staff
to discuss the status of your project. Such a meeting will be held within five working days
from the receipt of your written request and shall include the property owner, developer,
and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development. You should post this notice
at a conspicuous point along your property where it can be observed from a public road.
Some examples would be: Nailing the notice card to a telephone pole or tree along the road
right-of-way fronting your property, or at a point along the road right-of-way where a private
road would lead one into your property. Failure to post this notice could result in an
incomplete application.

OF APPLICATION FOR
CAMA MAJOR DEVELOPMENT PERMIT
The Department of Environment and Natural Resources hereby gives public notice as
required by N.C.G.S. 113A-119(b) that an application for a development permit in an Area of
Environmental Concern as designated under the Coastal Area Management Act (CAMA) was
received on 8 July 2020. According to the said application submitted by Jeffrey Aldridge applicant
proposed to remove the existing pier and platform and construct a new pier with L- Head platform
with covered area, finger pier around the boat house.
A copy of the entire application may be examined or copied at the office of Kelly Spivey,
District Manager, Washington Regional Office, 943 Washington Square Mall, Washington, NC,
during normal business hours. Public comments received by 21 August 2020 will be considered.
Later comments will be accepted and considered up to the time of permit decision. Project
modifications may occur based on further review and comments. Notice of the permit decision in
this matter will be provided upon written request.
