I have reviewed the information submitted to this office in your inquiry concerning the necessary filing of an application for a minor
development permit under the Coastal Area Management Act. Based on the information provided, I have determined that the activity
you propose is exempt from needing a minor development permit as long as it remains consistent with your site drawing dated received
by DCM on 3/19/2013, and meets the conditions specified below. If your plans should change and your project will no longer meet
these conditions, please contact me before proceeding.
REPAIR AND MAINTENANCE
Structures may be repaired in a similar manner, size and location as the original structure. No expansions or additions are permissible.
The repairs are limited to 50% of the physical value of the existing structure and the following specific conditions.
(1) The project consists of removing the dilapidated decking and repairing/replacing with level wood decking.
(2) The development must not involve removal, damage, or destruction of threatened or endangered animal or plant species;
(3) The development must not alter naturally or artificially created surface drainage channels;
(4) The development must not alter the land form or vegetation of a frontal dune;
(5) The development must not be within 30 feet of normal water level or normal high water level; and
(6) The development must be consistent with all applicable use standards and local land use plans in effect at the time the
exemption is granted.
This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or Local
authorization. This exemption expires 90 days from the date of the letter.

Jason here is the info you requested about the deck repair job that we talked about 3/5. The
owners name is Joan Howerton. Her home address is 401 England ave. Fuquay Varina NC
27526. We are replacing the existing decking as is, there is 800 sq.ft. Of existing deck including
two 4'x50' cat walks down both sides of the house, and a 8'x50' street side deck. We are also
replacing two sets of steps. We are replacing the existing railing. We are not replacing the deck
framing. I will have the inspector look at the job to see if any upgrades to the existing structure
are needed. I will keep you informed. Thanks Keith Myers
