violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian

ATTACHMENT TO ADJACENT RIPARIOR PROPERTY OWNER STATEMENT
I, Gary Plough and Janet Plough own the property adjacent to the property of Austin Waters.
Austin Waters' bulkhead extends 1.3 feet onto our property. We would have no objection to him
repairing his bulkhead, if he will sign an encroachment agreement acknowledging that should something
ever happen to his bulkhead where it had to be replaced, that he would place it all on his property. Until
that is done, we object to the replacement of the bulkhead.

THIS ENCROACHMENT AGREEMENT made and entered into this day of

referred to as "Plough", and William Austin Water and wife, Jean Waters, hereinafter referred to as
"Waters";
WITNESSETH:
WHEREAS, Plough and Waters own property adjacent to one another wherein Plough
owns Lots 39 and 40 in Block 19, as shown in map recorded in Map Book 6, Page 75, Carteret County
Registry.
WHEREAS, Waters owns Lot 41 which is located to the west of the property of Plough.
WHEREAS, the boundary line between Plough and Waters would be the wester property
line of Plough and eastern property line of Waters extended from Pine Drive to the highwater mark
of a canal.
WHEREAS, the bulkhead of Waters extends eastwardly onto the Plough property by
approximately 1.3 feet
WHEREAS, Waters wants to replace his bulkhead which the Ploughs will consent to if
Waters does hereby agree that in the event said bulkhead is ever destroyed or becomes in disrepair
where it has to be replaced, that the bulkhead would then be replaced all on the property of Waters.
THEREFORE, Waters does hereby agree that in the event said bulkhead needs to be
replaced and repaired in the future, then he will relocate said bulkhead on his property.
