The Division of Water Resources (DWR) has received a copy of your CAMA Major permit application request dated received by this office on May 5, 2021. The proposed project is located within the waters of the Davis Canal which are class SA;HQW waters by DWR. Please understand that the waters around your project area have been identified by the Division of Marine Fisheries as Primary Nursery Area (PNA). Should the need for dredging within the proposed project area arise in the future, please be aware that new dredging within a PNA is not permitted under 15A NCAC 02B .0221 as it results in degradation of water quality standards and therefore is considered a water quality violation. [15A NCAC 02B .0221j In accordance with the attached General Certification #4175 (GC 4175), the impacts described in your application do not require written authorization to utilize GC 4175. However, you are required to follow the conditions listed in the attached certification. PROJECT DESCRIPTION DECEIVED MAY 0 6 2021 DCM-MHD CITY The proposed project is located at 107 & 109 SW 9" Street, in the Davis Canal in Oak Island, Brunswick County. The property can be reached by traveling NC HWY 17 south towards Shallotte/Myrtle Beach then take NC-906 to SW 9'" Street in Oak Island. Tum left onto SW 9' Street and the property is at the street end on the right. The property was formerly two parcels and were combined into one larger lot. The project site is approximately .54 acres and is vegetated primarily with grasses, shrubs, and mature trees. The high ground portion is elevated approximately 7'-17' above the normal high water (NHW) level, and the shoreline (+/- 120 linear feet), which is stabilized by an existing bulkhead. There are coastal wetlands (Spartina alterniora) within the riparian corridor of the applicant's property between the canal and existing bulkhead (approximately 12'-16' in width). The applicant's property is situated on Davis Canal, bordered by residential properties to the west and north, and SW 9th Street (town property) borders to the east. The width of the canal measures approximately 100' feet at the proposed project site. Existing structures on the project site include a single family residence, an existing bulkhead, and two separate private two slip docking facilities (4 slips total). The bulkhead was authorized in 2006 via CAMA General Permit GP-45830. No permit history was located for the existing docking facilities at the time of review. The applicant plans to demolish, reconstruct, and reconfigure the westernmost docking facility. The applicant plans to retain the easternmost docking facility as -is, with no proposed changes. The existing eastern docking facility consists of an access pier (4' x 3') extending from the bulkhead, and transitions to a fixed platform (12' x IT). From the southern edge of the fixed platform, a gangway extends waterward to an existing floating dock (8' x 16') that is oriented parallel with the shoreline. To the west of the floating dock, there is an existing boat lift (12'xl2'). Currently, the eastern docking facility serves as two slips (See Location Map page 2 of 5). The waters of the canal system are classified SA by the Division of Water Quality and ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. Based on visual observations made by DCM staff during the March 2021 site visit, there appears to be NO Submerged Aquatic Vegetation (SAV) in the surrounding waters. The water depths range from -2.5' @ NLW on the landward side of the proposed features to -5' @ NLW on the waterward end of the proposed features. PROPOSED PROJECT The applicant proposes to demolish and reconfigure an existing docking facility, retain an existing docking facility, and add two additional access points, resulting in 4 additional slips for a total of 8 slips across the property along Davis Canal. The easternmost docking facility, described in the section above, will be retained as -is, with the existing features serving as slips 1 & 2 (see Location Map Page 2 of 5). Approximately 35' to the west, the applicant is proposing to construct a fixed finger pier (6'wide x 20'long) extending to the south from the bulkhead, which transitions to a short fixed finger pier extension (3' x 8') perpendicular to the shoreline. To the immediate west and east of the fixed finger pier, the applicant is proposing to construct two boat lifts (each 12' x 12% serving as slips #3 and #4. Approximately 25' to the west of the previous finger pier, the applicant is proposing an aluminum gangway, extending to the south from the bulkhead, landing on a proposed floating dock (6.5' x 16% oriented perpendicular to the shoreline, and serving as slips #5 & slips 46. Approximately 25' to the west of the aluminum gangway, the applicant is proposing to construct a fixed access pier (6' x 16') extending to the south and terminating in a proposed fixed covered gazebo (18' x 16.5' dripline). From the east side of the fixed covered gazebo, a proposed fixed bumpout platform (4' x 4') would provide access for a gangway extending perpendicular to the shoreline, landing on a proposed floating dock (8' x 20') extending parallel to the shoreline, with the only open side serving as the 7' slip. On the western side of the fixed gazebo, the applicant is proposing a boatlift (12'x 12% serving as the 81 slip. The proposed westernmost boatlift (slip 8) and a portion of the fixed covered gazebo would extend into the 15' riparian buffer of the neighbor to the west, but the appropriate waiver has been completed and is included with the permit application. The application states that existing water depth in the vicinity of the proposed boatlift would range from approximately -2.5' to 5.1' @ NLW. None of the proposed constructed features would encroach into eastern riparian corridor setback, although the existing easternmost facility is located within the setback. As proposed, the constructed features would be located within the established pier head line and within'/4 of the width of the waterbody. 10. ANTICIPATED IMPACTS The proposed docking facility would incorporate approximately 1246 sq. ft. of Estuarine Waters and Public Trust Area, and shade 234 SF of coastal wetlands. The docking facility would remain consistent with the pier head line, and be consistent with the'/4 width of the waterbody. The proposed docking facility would encroach into the 15-foot riparian corridor setback of the western property owner and a waiver has been obtained. Minor increases in turbidity should be expected during piling installation. The Eastern facility consists of two boat slips (slip 1 and slip 2) as listed on the site plan. Slips 3&4 consists of two proposed boat lifts accessed by a 6' wide finger pier. The project is located in PNA. Sea Dog has confirmed that water depth of greater than 2' at low tide will be achieved for proposed structures. The lot has approximately 120 linear feet of water frontage. The neighboring property to the west has agreed to waive the 15' setback.
