This permit, issued on August 12, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation n mcsc terms may De suoject to Imes, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility Expansion This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility expansion without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) Any portion of the permitted access pier and docking facilities built over wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured from the bottom of the decking. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Davis, Director Division of Coastal Management This permit and its conditions are hereby accepted. 7 of Permittee .Jodi Willis ADDITIONAL CONDITIONS Permit No. 101-21 Page 2 of 3 3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 4) This permit authorizes 2 additional formalized boat slips for a maximum of 4 formalized boat slips at this docking facility. 5) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. USACE Conditions 8) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at httys://www.fws.gov/raleigh/pdfs/ManateeGuidelines20l7.pdf. General 9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 10) All debris associated with the removal or construction of the permitted docking facility shall be contained within the authorized project area and removed to an appropriate upland location. 1 1) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit 197800056 (Action ID SAW-2021-01264). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-1012. PROJECT DESCRIPTION The project site is located at 7 Backfin Point on Figure Eight Island, adjacent to the Figure Eight Canal and Middle Sound, in New Hanover County. The island is accessed from the mainland at the end of Edgewater Club Road (SR 1402), by private bridge over the Atlantic Intracoastal Waterway (AIWW) and an earthen causeway, which traverses Middle Sound. Heading east on the causeway, turn right on Beach Road South and travel south approximately 0.4 miles. Turn right onto Backfin Point, travel approximately 417 feet to the destination on the left. The property is located on a man-made finger of upland on a canal adjacent to Banks Channel and Middle Sound on the southern end of Figure Eight Island, The 0.35 acre parcel has an existing single family residence and is approximately 5' above normal high water (NHW). Upland vegetation on the property currently consists of ornamental landscaping and lawn grasses. The approximately 106 linear feet of shoreline frontage is currently stabilized by a timber bulkhead with NHW approximately 10' to 15' waterward, A section of high marsh ranging from 10' to 15' in width, consisting mostly of sea oxeye (Borrichia frutescens) and spike grass (Disfichlis spicata) is located waterward of the timber bulkhead. The high marsh descends into a band of low marsh ranging from 20' to 25' wide, consisting mostly of salt marsh cord grass (Spartina alternaflora). The applicant currently maintains a two -slip private docking facility. A fixed pier extends west from an 8' by 5' platform over the bulkhead into the man-made canal. The fixed pier measures approximately 60' in length by 6' in width, terminating in an access ramp onto the 8' by 16' floating dock. A 13' by 13' boatlift is located on the south side of the floating dock. General Permit No. 16193-D issued on 7/18/1996 authorized the boatlift in an existing slip. It appears that the docking facility in the current configuration predates the boatlift permit, however, permit history could not be found for the original pier. General Permit No. 20413-D issued on 41411999 authorized the original timber bulkhead. The existing docking facility currently accommodates up to two (2) vessels. The Wilmington -New Hanover County 2006 Land Use Plan classifies adjacent waters and high ground portion at the property as Conservation. The waters of this canal, Banks Channel, and Middle Sound are classified SA-ORW by the Division of Water Quality. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to replace and expand the existing floating dock and add a second floating dock creating a total of 4 slips. The existing 8' by 16' floating dock would be replaced by a larger 8' an 30' float located approximately in the same location. Additionally, a new 6' by 26'floating dock would be added to the end of the 8' by 30' floating dock, positioned parallel to the shoreline, but not exceeding the pier headline (see Drawing 1 of 3). There appear to be no SAV present in the project area. Minor increases in turbidity should be expected during project construction.
