Authorizing development in New Hanover County at adj. to the Cape Fear River, at 6708 River
Road, in Wilmington as requested in the permittee's application dated 2/15/21(MP-1) and 3/15/21
(MP-4), including attached workplan drawings (2), both dated 2/15/21.
This permit, issued on June 14, 2021 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
)r mese terms may De subject to lines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility Expansion
1) This permit authorizes only the additional boatlift and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the
U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum,
permanent reflectors shall be attached to the structure in order to make it more visible during hours of
darkness or inclement weather.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) The authorized structures and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
4) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
5) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
6) This permit authorizes an additional one (1) slip for a maximum of three (3) formalized boat slips.
7) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's area of riparian access.
USACE CONDITIONS
8) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
10) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
12) All debris associated with the removal or construction of the permitted docking facility shall be
contained within the authorized project area and removed to an appropriate upland location.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit
197800056 (Action ID SAW-2008-00439).

ADDITIONAL CONDITIONS
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 20210613.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water.
NOTE: An application processing fee of $250 was received by DCM for this project.

It is the staffs recommendation that the construction of the new boat lift, resulting in the incorporation of 169 SF
of public trust and estuarine waters, is CONSISTENT with the Rules of 15 NCAC 7H.0208 (b) (6) Specific Use
Standards for Piers and Docking Facilities.
The application states that the proposed boat lift would provide docking space for one (1) additional vessel at this
location for a total of three (3) slips in water depths of -2.0' to -2.5' @ NLW. The proposed structure would be
located over open water and not encroach into the riparian corridor setback of either adjacent riparian property
owner.
This office has no objection to the proposed work, provided it is consistent with all other state and federal
permitting requirements. It is recommended that any permit issued should include standard conditions for docking
facilities.

The Division of Water Resources (DWR) has received a copy of your CAMA Major permit application
request dated received by this office on March 22, 2021. The application proposes to install a boatlift at
an existing docking facilityto provide mooring forthree (3) vessels. The proposed project is located within
the waters of the Cape Fear River which are class SC waters by DWR. Please understand that the waters
around your project area have been identified by the Division of Marine Fisheries as Primary Nursery Area
(PNA). Should the need for dredging within the proposed project area arise in the future, please be aware
that new dredging within a PNA is not permitted under 15A NCAC 02B .0221 as it results in degradation
of water quality standards and therefore is considered a water quality violation. [15A NCAC 02B .0221]
The DWR issues approval in the form of a Water Quality Certification (WQC) in conjunction with the CAMA
Major Permit and Regional General Perm it(s)198000291 or 197800056 issued by the U.S. Army Corps of
Engineers. This Certification allows you to use the CAMA Major permit once issued by the Division of
Coastal Management.
In accordance with the attached General Certification #4175 (GC 4175), the impacts described in your
application do not require written authorization to utilize GC 4175. However, you are required to follow
the conditions listed in the attached certification. You should get or otherwise comply with any other
federal, state and local requirements before you go ahead with your project including (but not limited to)
erosion and sediment control regulations. Also, the approval to proceed with your proposed impacts to
waters a depicted in your application shall expire upon expiration of the 404 or LAMA Permit.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by filing a
written petition for an administrative hearing to the Office of Administrative Hearings (hereby known as
OAH). A petition form may be obtained from the OAH at htto://www.ncoah.com/ or by calling the OAH
Clerk's Office at (919) 431-3000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A petition

This project is consistent -with the New Hanover County Comprehensive Land Use Plan.
The applicant proposes install a new boatlift within their riparian corridor at a private
docking facility, increasing the number of slips from 2 to 3, at water depths of -2@NLW
within the Cape Fear River. The project is located at 6708 River Road in New Hanover
County.
Waters at the project site are classified as SC and are not open to the harvesting of
shellfish. The area is a Primary Nursery Area.
I have reviewed this proposal for consistency with the New Hanover County
Comprehensive Land Use Plan and offer the following comments.
The general area of the project is classified as Developed while the AECs impacted by
the work are classified as Conservation.
In general, New Hanover County allows development in Conservation classified AECs,
which is consistent with the State's minimum use standards. The New Hanover County
Comprehensive Land Use Plan contains some policies, which exceed the State's
minimum use standards. However, none of these standards appear to be applicable to this
proposal.
This project is consistent with the New Hanover County Comprehensive Land Use Plan.

9. PROJECT DESCRIPTION:
The project is located at 6708 River Road, adjacent to the Cape Fear River, in Wilmington, New
Hanover Co. To locate the project site from the Wilmington Regional Office (WiRO), travel north on
Cardinal Drive towards Market Street. Turn left onto Market Street. Travel approximately 0.3 miles
and turn left to College Drive, travel 9.5 miles south and then turn right onto Sanders Road. Travel
approximately 0.9 miles, and at the traffic circle, take the 2nd exit onto River Road. Travel
approximately 1.3 miles south, and the subject property will be on the right.
The property is approximately 5.19 acres in size and contains approximately 350 LF of shoreline
frontage along the Cape Fear Rover. The upland portion contains an existing single family residence,
detached garage, pool, and driveway. The property consists of ornamental grasses, and landscaping, and
the shoreline is currently stabilized with a bulkhead above normal high water, which was authorized in
2008 via General Permit 50354D and 2009 via General Permit 53906D. Waterward of the bulkhead,
there is coastal wetlands vegetation consisting primarily of Smooth Chordgrass (Spartina alterniJlora).
The current docking facility was consists of a fixed pier (175' x 6') extending from the high ground in a
waterward direction from the bulkhead and terminates on a open, t-head platform (20' x 20'). From the
waterward edge of the platform, a gangway leads to floating dock (8' x 16') that is oriented parallel with
the shoreline. Immediately south of the southern side of the open platform, there is an existing boat lift
(13' x 13'). The boatlift was authorized via CAMA General Permit GP-62616D, issued in 2013, and no
other permit history for the facility was located at the time of review. Currently the facility
accommodates 2 vessels for a total of two existing slips.
The New Hanover County Land Use Plan classifies the area near the project area as Conservation Area.
The waters in the project area are classified as SC by the N.C. Division of Water Resources. They are
designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and they are closed
to the harvest of shellfish.
PROPOSED PROJECT:
The applicant proposes to install a new boatlift within their riparian corridor at a private docking facility,
increasing the number of slips from 2 to 3, at water depths of -2@ NLW in the Cape Fear River.
According to the application materials, the proposed boatlift would be 13' feet in length by 13' in width,
and would be located immediately north of the northern side of the existing t-head platform, in a
mirrored orientation as the existing southern boadift. It would be located within the applicant's riparian
corridor and not require a setback waiver.
10. ANTICIPATED IMPACTS:
As proposed, the new boatlift would incorporate an additional 169 SF of public trust area and estuarine
waters in water depths of approximately -2' @ NLW..This proposed development would increase the
number of vessels accommodated by the facility, from two existing slips to three (3) total. Minor increases
in turbidity should be expected during project construction however, turbidity levels should return to
normal once the project is complete

deadline for making a decision is May 18, 2021. An additional 75-day review period is provided by law
when such time is necessary to complete the review. If you have not been notified of a final action by the
initial deadline stated above, you should consider the review period extended. Under those circumstances,
this letter will serve as your notice of an extended review. However, an additional letter will be provided
on or about the 75th day.
If this agency does not render a permit decision within 70 days from March 4, 2021, you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of
your project. Such a meeting will be held within five working days from the receipt of your written
request and shall include the property owner, developer, and project designer/consultant.
NCGS I I3A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right -of --way fronting your property; or at a point along the road
right-of-way where a private road would lead one into your property. Failure to post this notice could
result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
