This permit, issued on May 18, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Bulkhead 1) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 2) No backfill material shall be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. 3) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. 4) No vegetated wetlands shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Webb Permit No. 67-21 Page 2 of 3 ADDITIONAL CONDITIONS 5) All fill material to be placed below normal high-water level shall be confined behind the permitted bulkhead. 6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 7) The bulkhead shall be constructed prior to any backfilling activities. 8) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 9) All backfill material shall be clean and free of any pollutants except in trace quantities. 10) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Sedimentation and Erosion Control 11) In order to protect water quality, .runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 12) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. 13) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 14) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 15) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 16) All debris associated with the removal or construction of the permitted bulkhead and shall be contained within the authorized project area and removed to an appropriate upland location. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required, including but not limited to any authorizations required from the US Army Corps of Engineers. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. The applicant proposes to replace 61 linear feet of bulkhead immediately waterward of the existing bulkhead, resulting in the filling of approximately 83 square feet of Coastal Wetlands. The project is located at 115 Marlin Drive adjacent to a manmade canal, in Holden Beach, Brunswick County. Areas of Environmental Concern (AEC's) impacted by the proposal are EW, PTA and CS. Waters at the project site are classified as SA; HQW and are not open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the Town of Holden Beach Land Use Plan and offer the following comments. The general area of the project is classified Residential, while the AECs impacted are classified as Conservation. In general, the Town of Holden Beach allows development in Residential and Conservation classified AECs, which is consistent with the State's minimum use standards. The Town of Holden Beach Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these standards appear to be applicable to this proposal. This project appears to be consistent with the Town of Holden Beach Land Use Plan. The property can be reached by traveling NC HWY 17 south towards Holden Beach. At the Supply intersection, turn left onto NC 211 S. Travel .3 miles down NC 211 S and turn right onto Stone Chimney Rd SW. Drive down Stone Chimney Rd for 5.5 miles and continue onto Old Ferry Connection SW for 1.1 miles. Turn right onto Sabbath Home Rd SW and then take the next left onto NC 130 E towards Holden Beach. Travel over the Holden Beach bridge and take a right onto Ocean Blvd W. Continue for 3.8 miles and turn right onto Marlin Drive. The property will be on the left at 115 Marlin Drive. The proposed project site sits on a manmade canal that connects with the AIW W. Existing structures on the .12- acre property include a single-family residence, a docking facility, and a deteriorating concrete bulkhead. Based on DCM records, no previous permit history can be found for the construction of the existing bulkhead. The total length of the existing concrete bulkhead measures 50 linear feet long the canal with two 5.5% long wing walls, for a total of 61 linear feet of bulkhead. Structural deck pilings are located 10.5ft. landward of the existing bulkhead (Sheet I of 2). High ground is located approximately 7ft. above normal high water (NHW) and primarily consists of domestic grasses and ornamental shrubs. The existing bulkhead is located at normal high water (NHW). Waterward of the existing bulkhead is a strip of Coastal Wetlands, consisting of Salt Marsh Cordgrass (Spartina alternaflora) that is approximately 14ft.wide which transitions to open water. Salt Meadow Cordgrass grows along the entire length of the bulkhead except under the 6ft. wide access pier (Sheet 1 of 2). The waters of the Holden Beach canals are classified SA by the Division of Water Quality and ARE NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. Based on visual observations made by DCM staff during the January 2021 site visit, there appears to be NO Submerged Aquatic Vegetation (SAV) on site. PROPOSED PROJECT The applicant proposes to replace 61 linear feet of bulkhead approximately 1.5ft. waterward of the existing bulkhead, resulting in the filling of approximately 83 ft of Coastal Wetlands. According to the applicant, the existing vertical concrete bulkhead exhibits stress cracking and bowing, allowing high -ground sediment to seep through the compromised wall and into the adjacent waterbody. The applicant states that attempting to replace the deteriorating bulkhead in the same footprint could have greater environmental impacts than stepping out the new bulkhead. The proposed bulkhead would step out a maximum distance of 1.5ft. waterward of the existing bulkhead, resulting in the filling of approximately 83 ft of Coastal Wetlands (Sheet 1 of 2) below NHW. Vinyl sheets would be driven immediately adjacent to the existing concrete wall using a land -based excavator. The vinyl would be secured using the Manta Ray anchor system, driving tie -rods through the bulkhead at 5ft. intervals. According to the applicant, 15-20 yds. of clean fill would be used for grading and filling landward of the bulkhead resulting in approximately 1000 ftZ of high ground disturbance. The proposed bulkhead would terminate with 5-6ft. wing walls, making the bulkhead structurally independent of the bulkheads to the north and south of the property. Property pins on site show that the existing bulkhead wing walls are located inside of the property bounds and allow enough room for the proposed vinyl wall without crossing the property line. 10. ANTICIPATED IMPACTS The proposed bulkhead would step out a maximum of 1.5ft. waterward of the existing bulkhead, resulting in the Webb Private Bulkhead Feburary 3, 2021 filling of approximately 83 ft2 of Coastal Wetlands and 92 ft2 of Public Trust Area below NHW. Clean sandy loam would be used as backfill material and result in approximately 1000 ft2 of high ground disturbance. Increased turbidity levels should be expected during sheet pile installation. This is a privately owned lot with a single-family residence including a multilevel deck that extends into the backyard. The backyard consists of a grass lawn and several small beds with palm trees and other landscaped vegetation. There is a docking facility on site including a fixed platform and ramp to a floating dock (no work is proposed to the docking facility). A concrete bulkhead is located between the docking facility and yard of the applicant. Wetland vegetation is located on the waterward side of the existing bulkhead (Spartina alterniflora). Proposed Work: The applicant would like to install a vinyl bulkhead (49.5 linear feet across and 11 linear feet for the wing walls) directly adjacent to the existing concrete wall. The concrete wall would not be removed because of potential damage to privately owned lot and marsh area waterward of existing wall. The proposed work would be completed from land using an E5012k excavator which would be stored on site. An estimate of 15-20 yards of clean fill from J P Russ and Sons in Ocean Isle Beach would be used behind the new bulkhead. The new vinyl bulkhead sheets are roughly 8" thick; when secured directly to the concrete wall it is expected the new wall would encroach no more than 1.5' waterward of the existing concrete wall. The new wall would be secured by drilling into the concrete wall with an SDS drill every five feet for anchor rods to pass through. The anchor system is Manta Ray MRSR drive anchors with %" tie rods. Purpose & Need: The existing concrete bulkhead is failing (see photo attachment). There is evidence of erosion in the backyard and severe stress cracks in multiple areas of the existing wall. Removal of the existing concrete wall could be more harmful to the marsh as well as the private lot of the applicant. The demolition of the concrete wall would invite more opportunities for marsh to be degraded by equipment and debris. With the concrete wall being many years old the installation methodology is unknown and removal could be degrading to both the waterway in front of the wall and the integrity of the lot adjacent (structural deck pilings located 10.5' from existing bulkhead).
